APPLICATION FOR MINOR VARIANCE

APPLICATION NO. HM/A-t 6:115

iN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the 'Zoning By-Law No. 6593, of the City of Hamilton, Sections 6.4 and 6.6.

AND iN THE MATTER OF the Premises known as Municipal number 100 Wilson St., in theCity of Hamilton and in a "D4 & D6" (Downtown Local Commercial and DowntownMultiple Residential) district;

AND IN THE MATTER OF AN APPLICATION by the agent Stantec Architecture Ltd. onbehalf of the owner City of Hamilton (Lukas Keermaa), for relief from the provisions of theZoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so asto permit the construction of a two (2) storey investigative/forensic facility for the HamiltonPoMice Services subject to Site Plan Control Application DA-15-018 notwithstanding that:

1. A maximum building setback of 16.0m shall be permitted adjacent to the Wilson Streetline for the first, second and third storey instead of the maximum 2.0m setback permitted forthe first storey and the maximum 0.5m setback permitted for the second and third storeys;

2. A maximum of building setback of 1.0m shall be permitted adjacent to the Mary StreetMine for the second and third storeys instead of the maximum 0.5m setback permitted for thesecond and third storeys;

3. A maximum building setback of 23.5m shall be permitted adjacent to the CatharineStreet line second and third storeys instead of the maximum 0.5m setback permitted for thesecond and third storeys;

4. A maximum flankage yard of 23.5m shall be permitted adjacent to the Catharine Streetline instead of the maximum 3.0m setback required for a flankage yard;

5. A minimum building height of 1.5m shall be permitted for the rear masonry wallattached to the building at the basement wall and a minimum height of 4.5m shall be permittedfor the rear portion of the building located within the D6 zone instead of the minimum 9.0mbuilding height required within the D6 zone;

6. A maximum building setback of 23.5m shall be permitted from the Catharine Street linefor that portion of a building providing an access driveway to a garage instead of the maximum6.0m setback permitted;

7. A minimum fagade height of 3.5m shall be permitted for theone storey canopy facingthe Catharine Street line and Rebecca Street line and a minimum fagade height of 4.5m shallbe permitted for the portion of the building extending from the southerly canopy overhang onthe westerly side of the building to the limits of the D4 zone for that portion facing CatharineStreet and that portion of the building facing Mary Street between the two storey portion andthe D4 zone line instead of the minimum 7.5m fagade height required;

8. A maximum building setback of 7.0m shall be permitted adjacent to the hypotenuse ofthe daylight triangle located at the intersection of Wilson Street and Mary Street for the first,second and third storeys instead of the maximum 2.0m setback permitted for the first storeyand the maximum 0.5m setback permitted for the second and third storeys;

9. A minimum rear yard of 1.5m shall be permitted instead of the minimum 3.0m rear yardrequired; and,

10. Mechanical equipment shall be permitted to be located in any side yard whereas theBy-law indicates that mechanical equipment shall only be located within the required side yardrestricting the location of the mechanical equipment to be a maximum distance of 2.0m fromthe street line.

Notes:

These variances are required in order to facilitate Site Plan Control Application DA-15-183.

The applicant confirmed that the visitor parking will be at 3.0m setback from the street line.Therefore, a variance to the location of the parking spaces and the required planting strip arenot required. The applicant shall ensure that the required 3.0m planting strip is provided andmaintained; otherwise, additional variances shall be required.

Rooftop mechanical equipment shall be located and/or screened from view of any abuttingstreet.

3. The front uncovered porch including the stairs shall be permitted to be located asclose as 2.7 from the nearest street line instead of the minimum 4.0m setback required;and,

4. A minimum setback ofl.0m shall be permitted for the accessory building (privategarage) from the westerly side lot line and a minimum setback of 0.3m shall be permittedfrom the rear lot line instead of the minimum 2.0m setback required.

Notes: A duplex dwelling requires a minimum of one (1) parking space per unit. Pleasenote that while the plan shows a total of four (4) tandem parking spaces, only two (2)spaces have been considered as being provided for the proposed duplex in order toaccommodate required manoeuvring space.

A maximum 4.0m height is permitted for an accessory building. No details were providedto confirm compliance.

A maximum height of 10.0m is permitted for a duplex. No details were provided to confirmcompliance.

A minimum 50.0% of the front yard shall be maintained as a landscaped area. No detailswere provided to confirm compliance.

AND IN THE MATTER OF AN APPLICATION by the agent Dusan Stupar on behalf ofthe owners Milenija & Milan Jankovic, for relief from the provisions of the Zoning By-LawNo. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permitthe conversion of the existing single family dwelling to four (4) dwelling units as well asto establish a commercial unitwithin a portion the ground floor, notwithstanding that;

. A four (4) unit multiple dwelling and any commercial use in Section 14 (1) of theZoning By-law shall be permitted in the "C" district whereas a multiple dwelling andcommercial uses are not permitted in the "C" district;

. The lot containing the building to be converted is located within 0.0m of a lot whichhas been previously converted under the requirements of Section 19 instead of theminimum radial separation of 180.0m required;

3. The average floor area of all dwelling units shall be at least 42.0m2 instead of theminimum average of 65.0m= required;

4. A minimum manoeuvring aisle width of 5.6m shall be permitted instead of theminimum 6.0m manoeuvring aisle width required;

5. No planting strip shall be provided along the easterly, westerly and southerly lot linesinstead of the minimum 1.5m wide planting strip required;

. The access driveway shall be permitted to be located as close as 0.0m from thecommon boundary with the residential district whereas the By-law requires theaccess driveway of a use other than a residential use adjacent to a residentialdistrict to be located not less than 3.0m from the common boundary;

. Vehicular access to the parking spaces shall be permitted via an access drivewaypartially zoned residential, whereas the By-law states that no land in a residentialdistrict shall be used for the purpose of vehicular access to or egress from any landin a commercial district; and,

8. The existing fire escape shall be permitted to be as close as 0ÿ0m to the westerly lotline instead of the minimum 0.8m setback required.

Notes: The lot which has been previously converted under Section 19 of the HamiltonBy-law is known as 770 Barton Street East.

No parking is required for the residential use. In addition, no parking is required for anycommercial use, except for a medical office which includes "doctor, dentist, osteopathand drugless practitioner in an "H" district.

Please note that the Zoning By-law requires that the parking area, manoeuvring spaceand access driveway to be paved with concrete or asphalt. Insufficient details wereprovided to confirm compliance; as such, further variances may be required.

It appears that portions of the alley way may be privately owned. As such, in other toobtain vehicular access, the applicant shall obtain and properly register on title a Right-of-way between the adjacent owners. Otherwise, additional variances shall be required.

NOTES:

1. Variances requested for reduced yards are not required as the existing yards aredeemed to be legally established non-conforming.

2. This is a corner lot with the lot line abutting Wilson Street being deemed the frontlot line. The lot line abutting Greenaway Avenue is deemed to be a side lot line.

3. A further variance will be required if asphalt and/or concrete which is graded,drained and paved is not provided for the proposed parking spaces, manoeuvring spacesand access driveway.

b) That portion of a lot on which the Outdoor Commercial Patio is permitted shall not beused for commercial entertainment or commercial recreation including live or recordedmusic or dance facilities.

An Encroachment Agreement with the Roads Department may be required for the outdoorpatio shown on the Road Allowance:

The establishment of the proposed outdoor patio is subject to Site Plan Control. Varianceshave been written exactly as requested by the applicant. This property is subject to SitePlan Control; to date, no formal site plan application has been submitted and a full zoningreview has not been conducted for the proposed development. Further variances may berequired at such time that a formal zoning review is conducted on the proposeddevelopment.

Section 5.6 b) of Hamilton Zoning By-law 05-200 states:

"For any permitted use or uses within any Downtown Zone located in all or part of a

building existing on the effective date of this By-law, no parking spaces are requiredprovided that the number of parking spaces which existed on the effective date of this By-law shall continue to be provided and maintained. Where an addition or expansion of anexisting building is proposed, the parking requirements of Section 5.6 a) above, shall onlyapply to the use or uses contained within the increased gross floor area."

As such, parking spaces are required only for the dwelling units within the increasedgross floor area. Additional gross floor area will be created within the portion of thebuilding known as 8 - 10 John St N as the applicants are proposing to add a 5th floor inthe existing roof in order for three (3) dwelling units on the 4th floor to have loft spacewithin the 5th floor. Further, two (2) dormers will be added to the roof of the portion of thebuilding known as 85 King St E so that two (2) dwelling units on the 3rd floor will have loftspace within the 4th floor. Therefore, five (5) dwelling units of the total proposed fifteen(15) dwelling units will be located within the increased gross floor area which requires four(5) parking .spaces (1 parking space for each dwelling unit).

AND IN THE MATTER OF AN APPLICATION by the agent A.J. Clarke & Associates Ltd.on behalf of the owner 1371946 Ontario Inc., for relief from the provisions of the ZoningBy-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as toalter the ground floor to an eighty-five (85) seat restaurant and to alter the second floorto contain a total of four (4) dwelling units in the building known municipally as 190Locke Street South and to recognize four (4) commercial (retail) units on the groundfloor and maintain eight (8) legal non-conforming dwelling units on the upper floors ofthe building known municipally as 192 - 198 Locke Street South notwithstanding that:

For 190 Locke Street South (to contain an 85 seat restaurant on the ground floorand 4 dweliinq units on the second floor)

, A maximum of four (4) dwelling units shall be permitted in the same building with acommercial use instead of the regulation permitting one or two dwelling units in thesame building with a commercial use permitted in the district;

. An open fire escape or open stairway may be permitted to project into the required7.5m rear yard not more than 1.4 metres so that the fire escape/open stairway shallbe at least 6.1m from the rear lot line instead of the requirement that an open fireescape or open stairway may be permitted to project not more than 1.0m into arequired rear yard;

. No parking spaces shall be provided for the eight-five (85) seat restaurant andparking at a ratio of 0.75 of a parking space per Class A dwelling unit with no visitorparking spaces shall be provided for the multiple dwelling instead of the parkingregulation requiring one (1) parking space per six (6) seats for a restaurant and 1.25parking spaces per Class A dwelling unit for a multiple dwelling which shall include0.25 of a space per Class A dwelling unit for visitor parking;

4. A minimum parking space size of 2.6m wide x 5.5m long shall be provided instead ofthe minimum required parking space size of 2.7m wide x 6.0m long;

. No on-site manoeuvring space shall be provided instead of the requirement that themanoeuvring space shall be provided and maintained only on the lot on which theprinciple use, building or structure is located; and,

. The access driveway shall be located 0.0m from the residential district to the eastinstead of the requirement that where a multiple dwelling is adjacent to a residentialdistrict that does not permit such uses, every access driveway to the multiple dwellingshall be located not less than 3.0 metres from the common boundary between thedistrict in which .the multiple dwelling is located and the district that does not permitsuch uses.

For 192 - 198 Locke Street South (to contain 4 commercial (retail) units on theground floor toqether with 8 leqally established non-conforminq dwelling units onthe upper floors)

° Parking at a ratio of 0.75 of a parking space per Class A dwelling unit with no visitorparking spaces shall be provided for the multiple dwelling instead of the parkingregulation requiring 1.25 parking spaces per Class A dwelling unit for a multipledwelling which shall include 0.25 of a space per Class A dwelling unit for visitorparking;

8. No loading space shall be provided instead of the minimum required one (1) loadingspace being 3.7m wide x 9.0m long x 4.3m high for a multiple dwelling;

9. A minimum parking space size of 2.6m wide x 5.5m long shall be provided instead ofthe minimum required parking space size of 2.7m wide x 6.0m long;

10.A minimum aisle width manoeuvring space of 4.5m shall be provided instead of theminimum required aisle width manoeuvring space of 6.0m;

11.A minimum access driveway width of 3.0m shall be provided instead of the minimumrequired access driveway width of 5.5m where a parking area contains more thanfive (5) parking spaces;

12. No bumper or wheel barriers shall be provided for the parking area containing morethan five (5) parking spaces; and,

13.The access driveway shall be located 0.0m from the residential district to the eastinstead of the requirement that where a multiple dwelling is adjacent to a residentialdistrict that does not permit such uses, every access driveway to the multiple dwellingshall be located not less than 3.0 metres from the common boundary between thedistrict in which the multiple dwelling is located and the district that does not permitsuch uses.

4. A minimum rear yard depth of 6.5m shall be provided instead of the minimumrequired rear yard depth of 6.7m;

5. A maximum gross floor area of 3,210m2 shall be provided instead of the maximumpermitted gross floor area of 2,650m2;

6. No visitor parking spaces shall be provided instead of the minimum required 0.16of a parking space per Class A dwelling unit; and,

7. The access driveway shall be a minimum of 0.6m from the northerly lot line insteadof the requirement that where a multiple dwelling is adjacent to a residential district thatdoes not permit such uses, every access driveway to the multiple dwelling shall belocated not less than 0.8 metres from the common boundary between the district in whichthe muJtiple dwelling is located and the district that does not permit such uses.

7. An aisle width manoeuvring space of 0.0 m shall be provided for the parking spacesinstead of the minimum required 6.0 m; and,

8. The manoeuvring space for the parking spaces provided shall not be provided on thelot and shall be provided on the Strachan Street East road allowance instead of therequirement that the required parking space and manoeuvring space shall be provided andmaintained only on the lot on which the principle use, building or structure is located.

Notes:

i) Variances have been written as requested by the applicant; please note that no detailshave been provided for the height of the proposed building, the total number of habitablerooms to determine required number of parking spaces, eaves and gutters and encroachmentof the proposed gas fireplace; therefore, the proposed new dwelling shall conform to all otherrequirements of the By-Law; otherwise, further variances may be required.

ii) Eaves and gutters shall not encroach onto the neighbour's property. If the footings oreaves overhang the side lot line, an encroachment agreement and maintenance easementare required and must be properly registered on title.

7. The manoeuvring space for the parking spaces provided for Part 1 & 2 shall not beprovided on the lot and shall be provided on the Upper Wellington Street road allowanceinstead of the requirement that the required parking space and manoeuvring space shallbe provided and maintained only on the lot on which the principle use, building orstructure is located.

Notes:

Variances have been written as requested by the applicant; please note that no detailshave been provided for the height of the proposed building, the total number of habitablerooms to determine required number of parking spaces required on site, eaves andgutters; therefore, the proposed new dwellings shall conform to the requirements of By-Law; otherwise, further variances may be required.

. A minimum westerly side yard of 1.2m shall be permitted for the accessory buildinginstead of the minimum 1.5m side yard required;

. A maximum ground floor area of 79.3.0m2 shall be permitted instead of themaximum 40.0m2 ground floor area permitted; and,

5. A maximum lot coverage of 79.3m2 shall be permitted instead of the maximum90.0m2 lot coverage permitted for accessory buildings.

Notes: The applicant shall confirm that the height dimension of the accessory building(private garage) has been determined as defined in the Zoning By-law in order toensure that the requested height variance is correct. Otherwise, additional variancesmay be required.

The Zoning By-law permits a maximum lot coverage of 35.0% insufficient details wereprovided to confirm compliance.

Eaves or gutter may be permitted to project a maximum of 30.0cm into a requiredminimum setback area. No details were provided to confirm compliance.Please note that the floor of the private garage shall be a minimum of 30.0cm above thecentre line of the street adjacent to the garage. It appears it may not conform; however,no details were provided to determine compliance.

All new fencing proposed shall be in compliance with the regulations contained withinthe Fence By-law 10-142.

The storage area shown above the first floor of the proposed accessory structure shallonly be used for storage associated with the existing residential use.

No setback dimension was provided from the accessory building to the HiawarthaBoulevard street line. Therefore, the applicant shall confirm that the setback in variance#2 is correct.
