NOTICE OF APPLICATION FOR WASTE MANAGEMENT LICENCE FOR THE PROPOSED EXPANSION OF THE CHLOORKOP

LANDFILL SITE

We hereby provide notice of the commencement of an application process for a Waste Management Licence for the

above mentioned project.

EnviroServ Waste Management (Pty) Ltd (EnviroServ) own the Chloorkop Landfill Site (CLS) and operate it in terms

of a waste management licence (Ref: 16/2/7/A230/D17/Z1). The CLS is located in the Chloorkop Industrial area in

Ekurhuleni on Portion 63 of Klipfontein 12-IR and is accessed from Marsala Road. General waste is received from the

City of Johannesburg and the Ekurhuleni Metropolitan Municipality areas.

The waste body at the CLS has finite airspace, defined by the permitted footprint, height and design parameters.

Given the current and future waste generation potential of the region, there is an ongoing need for waste disposal

services, even with growing levels of waste diversion. EnviroServ is thus proposing to expand the CLS in order to

provide additional airspace for ongoing disposal of general waste.

EnviroServ is required to obtain a Waste Management Licence prior to the commencement of the CLS expansion.

The Waste Management Licence is required from the Gauteng Department of Agriculture and Rural Development in

terms of the National Environmental Management Waste Act, 2008 (No. 59 of 2008) (NEMWA). The application is

required to be subject to a Basic Assessment (BA) process as stipulated in the Environmental Impact Assessment

(EIA) Regulations, 2014 (GNR 982, 8 December 2014). Application will also be made for a Water Use Licence from

the Department of Water and Sanitation in terms of the National Water Act, 1998.

SLR Consulting (South Africa) (Pty) Ltd (SLR) has been appointed as the environmental assessment practitioner

responsible for undertaking the environmental regulatory processes and conducting public participation in support

of these applications.

As part of the initial phase of public consultation, SLR is notifying and distributing information to as many interested

and/or affected parties as possible. Through various resources SLR has obtained contact details for potential

stakeholders. Our information leads us to believe that you may have an interest in, or be affected by, the project.

We would thus like to notify you of the applications and provide you with introductory information on the proposed

project.

A Background Information Document (BID) containing information on the proposed project; the baseline

environment of the site; an outline of the Basic Assessment process that will be followed; and the potential

environmental impacts has been produced. The BID is attached and is available on our website at

EXPANSION OF THE CHLOORKOP LANDFILL SITE, GAUTENG

We are the registered owners of Erf 5371 in Lordsview. Although the need of the expansion

of the Landfill site is noted and in good order, the following items are of concern to us:

1. Sense of place

The landfill site is located in close proximity to residential area and industrial precinct.

Together with the quarry, the expansion of the landfill site will exacerbate the presence

of these land uses which do not tie in together with the predominant surrounding

human settlement land uses. There are environmental concerns of having a bigger

landfill site within a human settlement area. This expansion may encourage associated

land uses to expand further into this area, which is not desirable to all property owners

in Lordsview and surrounding residential area.

2. Visibility

Currently the landfill site is not aesthetically pleasing as the dump is visible from about

1 km. This has a negative topographical effect to surrounding areas as the huge dumps

are seen from afar. In addition, the hovering Seagals end up dead on surrounding land

parcels. This obviously results in health and pollution issues.

3. Air Pollution

The gases emitted from the landfill site may have a negative impact on the air quality

within the area.

4. Groundwater Contamination

We have environmental concerns regarding water sources within close proximity to the

land fill site. The expansion will lead to a further contamination of the existing ground

water discharge area.

We reserve our rights to make any additional comments or representations at any hearings

or similar committee meetings held in respect of this application.

We would therefore like to form part of any meeting or planning meetings pertaining to

this application.

Thank you for engaging in the public participation process.

Unfortunately there is only one meeting planned. However, meetings are only one mechanism for interested and

affected parties to engage with SLR during the Basic Assessment process. Interested and affected parties are

welcome to submit comments to SLR at any time during the assessment process.

All interested and affected parties will also have opportunity to review and comment on the Basic Assessment

report in due course.

The project was not discussed at the previous Chloorkop monitoring committee meeting, but will be discussed at

the following one. All members of the monitoring committee have been notified of the project and the Basic

Assessment process.

Thank you for your efforts to participate in the environmental assessment process thus far.

The situation that unfolded at the public information meeting that we attempted to host on 20 June 2019 was

outside of our control. We were not aware that representatives of two 3rd

parties would use the environmental

engagement process to air their differences. These parties and their differences are unrelated to the Chloorkop

Landfill Expansion project or any environmental aspect thereof.

Although we attempted to mediate for the sake of the public information meeting, it was apparent that the

situation between the two 3rd

parties could not be resolved. As a result of the disagreements between these

parties and the threats that were made, the meeting did not take place.

We are considering options to facilitate the participation of interested and affected parties in the assessment

process and you will be advised of the way forward in due course. Would you be available to attend an engagement

meeting with SLR and EnviroServ on the afternoon of Tuesday 9 July? Please advise soonest.

Lords View Industrial Park is the longest fence sharing neighbour of the proposed landfill expansion site. As such, we claim being most closely and directly affected by the existence of the Chloorkop Landfill Site.

Resulting in great degrees of dejection, our tenants (also interested and affected parties of this application) made all efforts to ensure representation by their most senior available personnel in this meeting which was said to be a write-off. We are greatly aggrieved by the failed public meeting for two key reasons:

1. We believe the notice period given for this public meeting was too short, and as such we (the developers of Lords View) could not ensure our own representation in the meeting to express and safeguard our interest in respect of this application. Having registered as an interested and affected party, especially with the degree to which we are exposed to the landfill, we request the chance to collaborate with you in terms of setting the date of such meetings in future.
