    Transforming communities through sport

    In just a few months, the Pan American and Parapan American Games will be hosted by the GTA, and Im proud that some of our members have helped to design, engineer, plan and build the legacy venues across the region.

    These venues have been transformative for numerous communities and when the Games are over, they will serve as neighbourhoods, recreation hubs and training facilities for years to come.

    To tell us more about the Games, we invited Saad Rafi, CEO of Games Organizing Committee, to be our keynote speaker at our annual Industry Luncheon a few weeks ago. With more than 250 members in the room, Rafi said, many BILD members have helped to build the venues that will make the Games shine.

    One of them will be the new velodrome in the Town of Milton, which is only one of two internationally-sanctioned velodromes in Canada. The local share of funding for the venue was largely from development charges, paid by the development community and new-home owners in Milton.

    The Games has also brought much-needed infrastructure to the region, such as the Union-Pearson Express rail link and improved GO service, Safi said.

    The Games also spurred development of Torontos new waterfront community, the LEED Gold-designed Canary District, which

    will first be the Games Athletes Village and then a lively neighbourhood including 810 condominiums and townhomes. Of those, 100 will be available for affordable ownership and 253 will be affordable rental homes.

    A number of venues across the GTA have been updated and retrofitted for the Games, such as the Etobicoke Olympium and the equestrian park in the Town of Caledon, while others are new, such as the aquatics centre and field house in Scarborough.

    Safi said BILD members should take pride in the fact that they have built and renovated the complete communities that will host the 10,000 athletes, coaches and officials from 41 countries competing in 51 sports in more than 30 venues across the GTA in July and August.

    I wholeheartedly agree. We build more than just homes and employment space; we build complete communities that will welcome tens of thousands this summer and will help to put the GTA on an international stage. We look forward to seeing everything come together this summer.

    Higher Development Charges loom in Ontario

    Get ready, new-home buyers. No, not just in your general preparedness for buying a home, but for an increasingly di cult not to mention controversial issue thats costing you more money.

    And you may not even know it.Development Charges. If youre not familiar with this

    term, you likely will be soon, as its a contentious issue facing home builders and therefore buyers across the country.

    Just what are Development Charges? In short, they are the fees applied by various levels of government when new homes are built, to pay for new infrastructure such as roads, transit and other necessities.

    at part you may know. But what you likely arent aware of is that these fees are rising exponentially, have been for years, and theyre occupying an increasingly high portion of new-home costs. And theyre passed right on to you, the homebuyer.

    HOW MUCH ARE WE TALKING ABOUT? In Toronto, for example, City Council recently voted to increase Development Charges by 75 per cent, to almost $30,000 for a semi or single-detached home. ese new fees are being phased in, and will be fully implemented by Feb. 1, 2016.

    Its even worse further out in the GTA, where municipal fees and charges collected by Markham, Oakville, Brampton, Bradford-West Gwillimbury and Ajax average out to about $116,200 on a new single-detached home, representing 22 per cent of the cost. For a new highrise, the fees average $64,000 or 20 per cent.

    But this is not just a GTA or Toronto problem.In Ottawa, Development Charges and other government-

    imposed fees account for about 23 per cent of the cost of a new home or about $100,000 of a single-family home. Twenty- ve years ago, the costs accounted for just three per cent.

    Now, with recent proposed changes from the Ministry of Municipal A airs and Housing, new-home buyers could once again be dinged with higher DCs.

    e provincial government is proposing reforms to the Planning Act and the Development Charges Act designed to

    give residents a greater say in how their communities grow and would provide more opportunities to fund community services like transit and recycling.

    Others, however, including Ontario Home Builders Association (OHBA) and the Building Industry and Land Development Association, fear these changes will just add more taxes a disproportionate amount to new-home buyers.

    Municipalities are going to pile on a new transit tax on new home buyers and businesses, says OHBA CEO Joe Vaccaro. ose new neighbours ultimately pay every new tax generated by government in the price of their new home.

    ough the problem may di er slightly from one city and even province to the next, the concern is universal: new-home buyers are picking up a disproportionate part of the tab for infrastructure development.

    As a prospective new-home buyer, you may not appreciate the importance of the Development Charges issue just yet. But if youre a few or even several months away from making a purchase, or family members slightly further, you may learn the hard way what many are already concerned about: if such fees are allowed to rise unchecked, new-home a ordability will eventually be severely threatened.

    And that will be a price that, ultimately, no one can a ord to pay.

    New home builders recognized for excellence in customer service

    Tarion Warranty Corp. has announced the finalists for the 2015 Tarion Awards of Excellence, the only awards in Ontario that recognize new home builders based solely on their customer service delivery.

    New home builders are building beautiful homes and communities across Ontario, but their jobs dont stop there. A great home builder ensures their customers feel supported long after theyve settled into their new home, says Tarion president and CEO Howard Bogach. The 2015 Tarion Awards of Excellence finalists demonstrate that excellent customer service is an essential part of a home builders job and can make the difference between a good home builder and a great one.

    According to Chris Spiteri, chairman of Tarions Board of Directors, Tarion sets the standards for new home builders in Ontario when it comes to licensing and after sales service delivery for warranty obligations. The Tarion Awards of Excellence f inalists represent builders who go above and beyond these requirements. Their commitment to excellent customer service helps validate the high caliber of service that the Ontario home building industry has to offer.

    Finalists were determined based on the results of a comprehensive survey sent to more than 49,000 Ontario homeowners who took possession of a new home between Oct. 1, 2013 and Sept. 30, 2014. Almost 7,900 survey responses were received, representing 16 per cent of consumers who bought a new home in Ontario during that time. The results were tabulated by Crunch Research in partnership with Harris Decima.

    Survey questions focused on homeowners satisfaction with their builder, covering every stage in the homeowner-builder relationship from the signing of the Agreement of Purchase and Sale, through construction and the pre-delivery period, to after-sales service.

    To qualify for the Awards, builders must have at least five new home possessions during the survey time frame and a specified number of completed questionnaires must have been received.

    Award recipients will be announced at a luncheon in Toronto on Monday, April 20, 2015.

    Q My wife and I would like to get into the real estate market before it becomes unaffordable. We have saved $10,000 for a down payment. We have above-average salaries but have been working only for the past three years. Is this the right time for us to buy? Joanne and Jake, Ajax

    AAs we progress further from the financial crisis of a few years ago, economic slowdown, stock market and even real estate declines, things are looking brighter for many Canadians. Canada survived the recession; though there are still some challenges, spending is up, stock markets have arguably rebounded and the real estate market has shown longer-term price and sales increases.

    Many economists predicted real estate price declines, and few expected price increases and such a quick recovery. Homebuyers who were counting on further price declines may have been kicking themselves. How long will this continue, you ask? Its anyones guess.

    The federal Finance Ministry has, on occasion, given notice it is concerned about a potential overheating of the real estate market. Borrowers must meet the requirements for a five-year, fixed-rate mortgage, even if they plan to choose a shorter term and lower rate. The maximum amortization

    period for government-insured mortgages was recently reduced to 25 years from 30. In addition, Canadians can now withdraw in refinancing only 80 per cent of their homes value, down from 85 per cent, while down payment requirements remain at five per cent for primary homes and 20 per cent for investment properties. Some experts feel these changes may leave some first-time buyers sitting on the sidelines.

    However, these issues should not be the primary factors to influence your decision to buy. Some consider-ations to reconcile before making the plunge include:

    How much of a house can you afford to purchase? Get pre-approved by your bank before shopping

    How much of a house do you want to afford? The answer is not necessar-ily to purchase the maximum house you qualify to buy, but what you want to afford

    What will your payments be, if interest rates rise (and they definitely will) one, two or three per cent? Ensure you can easily afford the increase

    First-time buyers of new homes priced at less than $425,000 will be minimally affected by the HST. Generally, there are no real estate commissions for the purchaser of a home. Legal fees are not usually high for a purchase and are minute in the grand scheme of purchasing a home

    At the end of the day, a home is a long-term investment, so look beyond the next year or two.

    As the credit system continues to evolve in Canada, consumers are getting increasingly confused with a greater variety of credit products from a greater variety of financial institutions. In fact, the average Canadian gets more corre-spondence from financial institutions than they do from family and friends combined (what have we come to?). To further complicate matters, institutions are granting credit to consumers at a pace never seen before.

    The combination of increasingly sophisticated marketing techniques to consumers coupled with more and more available credit truly becomes too much temptation for many people to bear. Consumer debt is a major issue in North America. The concept of keeping up with the Jones has destroyed both peoples financial health and their personal lives. What I am here to tell you is that you dont need to fall into this trap!

    Here are some simple guidelines that will prevent you from becoming yet another consumer credit victim:

    01 Control spending by knowing exactly where every dollar goes. Tracking your spending habits in detail periodically will enlighten you in ways that you never considered. While doing this on a monthly basis is not realistic, try to do this in detail for at least one month a year.Helpful tip: If you and your spouse spend $3 per day on coffee, this totals $1,095 per year. Depending on your tax bracket, this amount could represent over $2,000 in pre-tax income. Is the free coffee at your office that bad?

    02 Watch your liquidity closely. Liquidity refers to your or your familys ability to pay its short-term debt obligations. Watching what available funds you have to pay upcoming debt obligations is fundamental to avoiding credit problems. Helpful tip: Think carefully before using purchase programs that require no payments for a set period. If you cant afford to pay for it now, should you buy it?

    03 Develop a realistic budget and live by it always. A good budget must have specific financial goals with a clearly defined time horizon. Be sure to take into account all of your payments, including loans, utilities and dry cleaning. If you pay for it monthly, it should be allocated in your budget. You cant be too

    While these rules seem fairly simple, they are a little like a diet easy to start but tough to follow through. Despite popular opinion, material items will not bring you happiness.

    While it may not seem like it today, forgoing that purchase to save for your childs education (or your retirement) may make you feel a lot better in the long run (despite what the commercials may lead you to believe).

    Lowrise outsells highrise FOR FIRST TIME SINCE 2012

    The first two months of the years new home sales have proven to be stable and on par with the 10-year average, according to the Building Industry and Land Development Association (BILD).

    Total sales tallied 4,800 new homes with more lowrise than highrise sales for the first time since 2012 a result of a few strong project launches across the GTA in February.

    The year is off to a stable start and its encouraging to see our sales figures meeting the 10-year average for new homes sold across the GTA, says BILD chairman Steve Deveaux.

    We continue to monitor sales as one indicator of how the market is doing. We have a healthy demand, but we cannot ignore that the supply of housing and choice in housing type is limited due to the under-serviced land, designated for development in the GTA.

    In the month of February, there were 2,798 total new homes sales with 1,465 lowrise up 17 per cent from last February and 1,333 highrise, up nine per cent from this time last year.

    According to the RealNet New Home Price Index, the average price for a new lowrise home hit a new record high at $733,578 and the average highrise price remained stable at $442,672. The price gap between low and highrise homes continues to grow. In February, it was $289,906.

    If theres one buzzword in todays new home building industry that has consumers confused, its Green. Intended to indicate materials, features and building techniques that are environmentally friendly, or leave less of an environmental footprint, the word is sometimes misused.

    However, if we accept environmental friendliness as the main goal of Green, then todays new homes in Ontario fit that standard by design. The Ontario Building Code is continually being updated, and as of Jan. 1, 2012, every company applying for a building permit in Ontario has to comply with EnerGuide 80 levels of energy efficiency. The result is less wear and tear on the environment and utilities cost savings for owners.

    Add to that third-party rating systems such as Energy Star and LEED, and in the case of some builders, Green programs that go above and beyond, and the picture looks even brighter. For example, at Heathwood Homes, we have created our own Green Home Energy Program that combines Energy Star features and many other environmentally friendly elements.

    If you are considering purchasing a new home and Green characteristics are important to you, find out what each of the builders you are considering means by the word. Calling something Green does not necessarily mean that it is good for you

    LIVING GREEN What it means in todays new homes

    and/or the environment. Think about and research claims according to potential harm and obsolescence.

    For example, when the ecology became a focus in Canada in the 1970s, builders installed urea-formaldehyde foam insulation (UFFI) in homes with the belief that it would be more energy efficient and help the environment. We were misinformed, and the product had not gone through enough testing. When it was installed improperly, it caused overexposure to the toxic formaldehyde. Its use was banned in Canada in 1980. Ask whether the products you see promoted as Green are well tested and proven effective.

    Going back to the 1970s again, remember the initial hype about solar energy? That form of energy harvesting was introduced too early in its development and was not effective in the early days. We are hearing about solar energy again today, but we have to question whether it is advanced enough to make an actual difference to homeowners. Time will tell with thermal energy and windmills as well. The jurys not in on any of these as far as effectiveness.

    It seems to me that the Green concept is advancing at a rapid rate. Another question to ask is whether the environmentally friendly features being advertised will be obsolete in a short time. The new homes of today are the resale homes of tomorrow, so you want to ensure your choice is as advanced as possible.

    The bottom line is to choose your green criteria wisely when you are new home shopping, and keep in mind that adding elements to save on energy and water usage often add to the cost of your home.

    At Heathwood Homes, we decided to find out for ourselves the real impact of certain green elements. We developed a Green demonstration model home in Richmond Hill to monitor how efficient various advanced conservation features, environmentally friendly systems and materials actually are. For us, it was about using common sense rather than jumping to other peoples conclusions.

    Certainly, if environmental friendliness is important to you, and it is with most new-home buyers today, ask the appropriate questions of the sales representatives and do some research on your own. With so much information available on the Internet, you will find a variety of sources to consider. The good news is that new home builders are making more environmentally conscious choices than ever before!

    Financing and hidden tricks

    I cannot believe how certain builders (Vendors) try to take advantage of new-home buyers on the issue of mortgages. There is an attempt to squeeze extra money from innocent purchasers through certain clauses inserted into the Agreement of Purchase and Sale, that change something good into a potential trap for the unwary buyer:

    1. The purchaser agrees to apply to a lending institution designated by the Vendor... to assume any existing first mortgage... The first mortgage shall bear interest to be fixed by the lending institution at a rate not to exceed per cent and have about years to run...

    This clause makes sense and allows certainty for both sides. Where the buyer is potentially damaged is when this clause is combined with clauses two or three that follow:

    2. If at any time prior to the completion of the sale, the Vendor determines that it is unable for any reason whatsoever to arrange first mortgage financing for the subject property with a lender of its choice, this Agreement may, at the Vendors option, be declared null and void and the deposit money returned to the Purchaser without deduction or interest.

    This is scary. First of all, you have a Vendor with no restrictions or obligation to be reasonable, and this Vendor will probably react only out of self-interest. Our poor buyer, if terminated, doesnt even get interest on his deposit and this clause could be used right up to closing.

    3. It is agreed and understood that the term of the first mortgage may be varied at the option of the Vendor, by decreasing it by not more than 20 per cent of the total term... In the event the vendor has not received a mortgage commitment... above described, Purchaser agrees to accept such mortgage upon such terms and at such interest rate as the Vendor is able to arrange, provided that the interest rate . . . shall not exceed the interest rate shown above by per cent...

    This clause gives the builder the unrestricted option to reduce the term, as an example from five to four years (lowering the cost of money), and increase interest over what

    you thought you were getting at the beginning. A fairly sneaky builder could get a commitment that builds in a percentage of your mortgage payments as a bonus to the builder. This clause could be used by an unscrupulous builder, to the extreme detriment of an innocent purchaser.

    4. Sometimes a mortgage schedule is buried in the back of the Agreement. I recently reviewed one with a clause allowing the builder to terminate if the buyer did not provide him an acceptance letter for financing from an institution within 10 days of acceptance of the offer.Hmmm, closing in two years but we need to give the letter now. Good luck, and if not, the builder has the right to terminate any time up to closing.

    So, what should you do?a) Amend clauses like 2, 3 and 4 if they appear in your offer, or dont firm up. Request the option to seek your own financing, and get it in writing.b) When you see clauses like 2, 3 and 4 above, be suspicious especially if they are buried in fine print, and question whether you can trust a builder who does this.

    The moral of the story is to make sure that the offer is conditional for a few days on both financing and review by a lawyer. It is critical you get the right advice and only a lawyer can provide legal advice. That is the law. When you select a lawyer, find one who cares about you and a long-term relationship.

    A tale of two marketsTOLD BY CREAS REVISED RESALE FORECAST

    Canadian real estate isa tale of two markets the Prairies, and the rest of the country, according to the latest resale forecast by the Canadian Real Estate Association (CREA). But the bottom line is lower national sales in 2015, due to decreased home sales in Alberta.

    National sales are now projected to reach 475,700 units in 2015, representing an annual decline of 1.1 per cent. This would place annual activity slightly above but still broadly in line with its 10-year average, CREA reports.

    Looking into 2015, CREA predicts an uptick in activity across most provinces, thanks to the weakened Canadian dollar, mortgage rate declines and the boost in the U.S. economy.

    But that wontpositively impactthe resale forecastfor the Prairie provinces, where sales are expected to drag thanks to further declines in oil prices prompting potential buyers to wait while sellers continue to list. The biggest impact will be in Alberta, where home sales in 2015 are expected to fall 19.3 per cent well below the elevated pace set in the last three years of sellers market conditions.

    In the face of Albertas high-supply-low-demand scenario, Ontario and British Columbia are singing a very different tune with tightening inventory and increasing demand, resulting in price gains that surpass inflation this year at 2.5 and 3.4 per cent, respectively. This is no surprise in Vancouver, which has long been the priciest market in the country, and in Toronto, where the average single-family home surpassed the $1-million mark in February, according to the Toronto Real Estate Board.

    Prices are expected to remain stable in other provinces, with the exception of Alberta, where average price is forecast to fall by 3.4 per cent, reflecting a pullback in sales for luxury properties compared to homes in more affordable price segments, according to CREA.

    But as they say, what goes up must come down and vice versa. Looking ahead at 2016, national home sales are expected to increase 1.7 per cent to 482,700 units in 2016, in line with the anticipated economic recovery in Alberta and Saskatchewan. Meanwhile, anticipated mortgage rate increases are expected to keep activity in check in markets where homes are already less affordable and prices have continued rising, according to CREA, which forecaststhe national average price to rise by a further 1.9
