Whereas, the Superintendent of Police, South Goa District, Margao vide letter dated 18-07-2013 has reported that in view of prevailing situation in the country and intelligence inputs regarding terrorist threats to Western Coasts of India, it is necessary to impose restrictions on the commercial places/ /shops which are popularly known as Cyber Cafes to use the internet facilities in such places including E-mail by a large number of people who visit them. And whereas, it has come to notice that certain anti-social elements/terrorists are using these facilities to mislead the security investigating agencies, create panic in the public, endanger the security of VVIPs and vital installations and help in the terrorist activities, thereby, directly affecting the security of the State. And whereas, the non maintenance of the users register by the Cyber Cafes and other such establishments to register the details of the service users by means of photo identity card (like Driving license, Passport, Election Card, Student Identity Card, etc.) such as name, date, time and usage of period, it becomes very difficult to trace them in case they commit any offence and are absconding. And whereas, it is necessary to take speedy measures in this behalf to prevent danger to human life or safety, to thwart/prevent terrorist activities, which may affect the security of the State and create disturbance of public order and tranquility. Now therefore, on being satisfied with the report of the Superintendent of Police, South Goa District, Margao, I, N. D. Agrawal, District Magistrate, South Goa District, Margao in exercise of the powers vested in me under Section 144 of the Code of Criminal Procedure, 1973 do hereby order that the Cyber Cafes running in the District and other such Establishments shall strictly comply with the following points:- i) Prohibit the use of Cyber Cafe by unknown person and whose identity has not been established by the owner of the Cafe. ii) Maintain register for identity to the visitor/ /user. iii) Make an entry in the handwriting of the visitor/user mentioning name, address, telephone number and identity proof. The visitor/user shall also sign the register kept for this purpose. iv) The identity of the visitor/user shall be established through Government identity card only like Voter Card, Driving license, Smart Card, Passport etc. v) Activity server log should be preserved in main server and its record should be preserved for at least six months. Note:- There is one Supplementary issue to the Official Gazette, Series III No. 20 dated 16th August, 2013 namely, Supplement dated 16-8-2013 from pages 621 to 652 regarding Notifications from Department of Finance (Revenue and Expenditure Division), Directorate of Small Savings & Lotteries (Goa State Lotteries).

Read No. SP/S-Goa/Reader/2821/2013 dated18-07-2013 from the Supdt. of Police,South Goa, Margao.

Whereas, the Superintendent of Police, South GoaDistrict, Margao vide letter dated 18-07-2013 hasreported that in view of prevailing situation in thecountry and intelligence inputs regarding terroristthreats to Western Coasts of India, it is necessaryto impose restrictions on the commercial places//shops which are popularly known as Cyber Cafesto use the internet facilities in such places includingE-mail by a large number of people who visit them.

And whereas, it has come to notice that certainanti-social elements/terrorists are using thesefacilities to mislead the security investigatingagencies, create panic in the public, endanger thesecurity of VVIPs and vital installations and help inthe terrorist activities, thereby, directly affectingthe security of the State.

And whereas, it is necessary to take speedymeasures in this behalf to prevent danger to humanlife or safety, to thwart/prevent terrorist activities,which may affect the security of the State andcreate disturbance of public order and tranquility.

Now therefore, on being satisfied with the reportof the Superintendent of Police, South Goa District,Margao, I, N. D. Agrawal, District Magistrate, SouthGoa District, Margao in exercise of the powersvested in me under Section 144 of the Code ofCriminal Procedure, 1973 do hereby order that theCyber Cafes running in the District and other suchEstablishments shall strictly comply with thefollowing points:-

i) Prohibit the use of Cyber Cafe by unknownperson and whose identity has not beenestablished by the owner of the Cafe.

ii) Maintain register for identity to the visitor//user.

iii) Make an entry in the handwriting of thevisitor/user mentioning name, address,telephone number and identity proof. Thevisitor/user shall also sign the register keptfor this purpose.

iv) The identity of the visitor/user shall beestablished through Government identity cardonly like Voter Card, Driving license, SmartCard, Passport etc.

v) Activity server log should be preserved inmain server and its record should bepreserved for at least six months.

Note:- There is one Supplementary issue to the OfficialGazette, Series III No. 20 dated 16th August, 2013namely, Supplement dated 16-8-2013 frompages 621 to 652 regarding Notifications fromDepartment of Finance (Revenue and ExpenditureDivision), Directorate of Small Savings & Lotteries(Goa State Lotteries).

vi) If any activity of the visitor is of suspiciousnature, the owner of Cyber Cafe willimmediately inform the Police Station.

vii) Records be maintained about the specificcomputer used by the person.

viii) CCTV cameras should be installed in CyberCafe and at entry point so as to capture theface cut of every person entering Cyber Cafe.The CCTV footage should be kept for at least30 days and be made available to Police ondemand.

And Whereas, the circumstances do not permitserving of the notice individually in due time to theconcerned, the order is hereby passed ex-parte. Itshall be published for information of publicthrough Press and also by affixing copies on theNotice Boards of all Sub-Divisional Magistrates,Mamlatdars and Police Stations.

Any person contravening this order shall bepunishable under Section 188 of the Indian PenalCode.

The Supdt. of Police, South Goa Margao, the SDPOof Margao, Quepem, Mormugao and the PoliceInspector/SHO’s of the respective Police Stationsare hereby authorized to file FIR on behalf of theState if any persons found contravening the aboveorder which shall be punishable under Section 188of Indian Penal Code.

This order shall come into force with effect from06-08-2013 and shall remain in operation for a periodof 60 days (both days inclusive) unless withdrawnearlier.

Whereas, in pursuance with the judgment of theHon’ble Supreme Court in the matter KumariMadhuri Patil and another V/s AdditionalCommissioner, Tribal Development and another;reported in 1994(6) SCC the Government has issuedfollowing Notifications/Order for the issuance ofSocial Status certificates and their scrutiny.

(i) Vide Notification No. 13/19/89-SWD/709 dated24-04-2001 Government has designatedDeputy Collector and Sub-DivisionalMagistrate as a Competent Authority to issueCaste Certificates (Social Status Certificate)for the Scheduled Castes/ Scheduled Tribes//Other Backward Classes.

(ii) Vide Notification No. 13/19/89-SWD/711 dated24-04-2001 Government has constituted theScrutiny Committee for Verification of CasteCertificates issued by the CompetentAuthority to persons belonging to ScheduledCastes/Scheduled Tribes/Other BackwardClasses.

(iii) Vide Order No. E-I/VIG-Cell/6426 dated06-09-1999 Government has constituted aVigilance Cell consisting of DeputySuperintendent of Police (Crime Branch) andtwo more Police Officers to personally verifyand collect all the facts of the Social Statusclaimed by the Candidate or the parent orguardian, as the case may be.

2. And Whereas the Government has prescribedthe following procedure in terms of directions ofSupreme Court for issuance of Social StatusCertificate/Caste Certificate, their scrutiny andtheir approval, in supersession of the CircularNo. 13/19/89-SWD/722 dated 26-4-2001.

(i) The application for grant of Social StatusCertificate/Caste Certificate shall be made tothe Deputy Collector and Sub-DivisionalMagistrate as per Annexure I (A) & I (B).

(ii) The parent, guardian or the candidate, as thecase may be shall file an Affidavit before theDy. Collector duly sworn and attested by aCompetent Gazetted Officer with particularsof caste and sub-caste, tribe, tribal community,parts or groups of tribes or tribal communities,

the place from which he/she originally hailsfrom and other particulars as prescribed bythe Directorate concerned, as per Annexure II(A) & II (B).

(iii) The application for Verification of CasteCertificate by the Scrutiny Committee shallbe filed at least 6 months in advance beforeseeking admission into educational institutionor an appointment to a post as per AnnexureIII (A) & III (B).

(iv) The Directorate concerned shall forward thecopies of Status Certificate to the VigilanceCell for verification.

(a) The Vigilance Officer shall go to the localplace of residence and original place fromwhich the candidate hails and usuallyresides or in case of migration to the townor city, the place from which he originallyhailed from. The Vigilance Officer shallpersonally verify and collect all the factsof the Social Status claimed by theCandidate or the parent or guardian, asthe case may be. He shall also examinethe school records, birth registration if any.He shall also examine the parents,guardian or the candidate in relation totheir caste etc. or such other persons whohave knowledge of the social status of thecandidate and then submit a report to theDirectorate of Social Welfare or Directorateof Tribal Welfare as the case may be;together with all particulars as envisagedin the Proforma as per Annexure IV (A) &IV (B), in particular, or of the ScheduledTribes relating to their peculiaranthropological and ethnological traits,deity, rituals, customs, mode of marriage,death ceremonies, method of burial of deadbodies etc. by the Castes or Tribes.

3. And Whereas, the Director concerned, onreceipt of the report from the Vigilance Officer if hefound the claim for social status to be “not genuine”or “doubtful” or spurious or falsely or wronglyclaimed, the Director concerned shall issue Show--cause Notice supplying a copy of the report of theVigilance Officer to the Candidate by a RegisteredPost with acknowledgment due or through the Headof the Educational Institution/Organizationconcerned in which the candidate is studying oremployed. The notice shall indicate that therepresentation or reply, if any, would be made withintwo weeks from the date of the receipt of the Noticeand in no case on request not more than 30 days

from the date of receipt of the Notice. In case, thecandidate seeks for an opportunity of hearing andclaims an inquiry to be made in that behalf, theDirector on receipt of such representation/replyshall convene the meeting of Scrutiny Committeeand the Chairperson who shall give reasonableopportunity to the candidate/parent/guardian toadduce all evidence in support of their claim. Apublic notice or any other convenient mode shallbe published in the village or locality and if anyperson or association opposes such a claim, anopportunity to adduce evidence may be given tohim/her. After giving such opportunity either tothe person or through Counsel, the Committee shallmake such inquiry as deems expedient and considerthe claims vis-a-vis the objections raised by thecandidate or opponent and pass an appropriateorder with brief reasons in support thereof.

4. Whereas, in case the report is in favour of thecandidate and found to be genuine and true, nofurther action needs to be taken, the concernedDirectorate shall issue a Certificate of Verificationas prescribed in Annexure V, except where thereport or the particulars given are procured or foundto be false or fraudulently obtained and in laterevent the same procedure as is envisaged in para3 above to be followed.

5. And Whereas, the findings recorded by theScrutiny Committee holding that the certificateobtained was false, on its cancellation andconfiscating simultaneously, same shall becommunicated to the educational institution//organization concerned or the appointing authorityby registered post with acknowledgement due witha request to cancel the admission or theappointment. The Principal of the educationalinstitution responsible for making the admission orthe appointing authority shall cancel the admission//appointment and debar the candidate from furtherstudy or continue in office in a post.

6. The Order passed by Scrutiny Committee shallbe final and conclusive only subject to theproceedings under Article 226 of the Constitutionof India.

7. Now therefore, it is enjoined upon all theGovernment Departments, Educational Institutionsetc. to accept the provisional Status Certificatesissued by competent authority till the final decisionis given.
