like a Segway minus the pole and handle-bars, a platform that riders steer with subtleshifts in weight. A well-coordinated hipstercan learn to ride one in a couple of minutes.Hoverboards started catching on in theU.S. last May, after Jamie Foxx wheeledone onto The Tonight Show’s set. Initiallyexpensive and hard to buy, they lookedevery bit the Brookstone oddity. But thenJustin Bieber, rapper Wiz Khalifa, and othercelebrities released Vines and Instagrams oftheir hoverboard exploits, fueling a wave ofbuying that spread from the celeb-obsessedto the gadget-savvy to the average teen.Brands like PhunkeeDuck (Foxx’s choice)popped up on Amazon, while other direct-from-China websites sold $300 unbrandedversions. By the end of 2015, 40,000 boardswere coming into the U.S. each day. Whilenobody tracks total sales, manufacturershave shipped more than $2 billion worth ofhoverboards over the past year and a half,by Fortune’s estimates.

The fad would have never reachedsuch proportions without companies likeShenzhen Bojulong. China is home to morethan 250,000 small manufacturers likeFeng’s, according to the country’s NationalBureau of Statistics, accounting for about$1.3 trillion in annual output. The nimbleoperations can switch production lines on adime, supplying customers worldwide withselfie sticks, pedometers, LCD TVs, andwhatever else is trending. And if not all theproduction is of the highest quality, well,do you really need the best flat-screen TVon your block when a cheaper one will do?

When knockoff manufacturing goeswrong, however, everybody gets egg on hisface. Copycats turned hoverboards into oneof the fastest global boom-to-bust cycles inmodern business. The first reports of boards’combusting because of shoddy lithium-ionbatteries hit social media late last fall. SinceDec. 1, the U.S. Consumer Product SafetyCommission has opened investigations into39 hoverboard fires in 19 states; there havebeen fires in Europe and Australia too. AfterAmazon pulled most boards from its sitebefore the holidays, other retailers followedsuit—though only after many shoppers hadalready put one under the tree. Display Technology, was wrapping up a terrific2015. His factory was one of hundreds in Chinacranking out no-name versions of the two-wheeled devices Western culture has adoptedas “hoverboards.” Shenzhen Bojulong produced

, selling them to distributors whoo thrill seekers from Australia to America.

But then Amazon abruptly pulled mosthoverboards from its sites, worldwide,because of safety concerns. By then thebattery-driven gadgets had shown a distress-ing tendency to burst into flames, occasion-ally burning down owners’ homes in theprocess. And it wasn’t just Amazon applyingpressure: Around the same time, Razor,an American company best known for itstwo-wheeled scooter, bought licensing rightsfrom the hoverboard’s U.S. patent holderand began cracking down on copycats bysuing a big American reseller.

It all spelled trouble for Feng’s factory andits competitors. His company hadn’t licensedany patent—its boards were copycats. Evenif it could prove that its boards were safe(Feng says none of his models were impli-cated in fires or explosions), it could facelegal sanctions. Today Shenzhen Bojulonghas just 100 employees, having laid off 400since the double whammy of bad news.Around Shenzhen, since mid-December acottage industry of more than 1,000 facto-ries that were churning out the boards hasshrunk to a couple hundred. “We maybe lost50% of our revenues after the Amazon an-nouncement,” says Feng, speaking from hisshamrock-green factory floor.

Despite its dangerous rep, the hover-board is as ubiquitous in American cultureright now as the Big Wheel once was. Itdoesn’t actually hover, of course. It’s more

Demand quickly grew in China (wherehoverboards are known as pinghengche, or“balancing wheels”) and abroad, and Chiccouldn’t produce enough. It soon licensedits design to 30 other Chinese factories. Thefactories agreed to build boards according toChic’s safety and quality standards; in returnthey got detailed blueprints.

The expansion plan, however, poured fuelon an already raging copycat fire. Unlicensedmanufacturers had begun copying Chic’sboard immediately after it appeared inCanton. By the summer of 2015, more thana thousand factories—up to 10,000, by someestimates—were making boards for distribu-tors who sold them abroad online. Factorieslike Feng’s that had been making LEDscreens or iPhone cases switched to buildinghoverboards in a matter of days. And manyfactories, licensed and otherwise, cut cornerson safety standards, often by subbing incheaper, potentially flammable batteries.“We have licensed to 30 factories, but only afew follow our rules,” Ying laments.

By late last year Chic had filed some 100lawsuits against copycats in China. But thedamage was done: Chic’s efforts to propup the industry had emboldened the veryfactories that were ripping it off.

SHANE CHEN ARGUES that it wasn’tChic’s board to begin with.

Chen grew up in China and moved tothe U.S. at 30; he’s now a serial inven-tor who lives and works outside Portland,Ore. He’s the creator of a vegetable strainerthat has sold on QVC, a single-personwater-levitating hydrofoil, and a gyroscope-powered unicycle without a seat called theSolowheel. Chen also invented a hoverboard,one he patented in the U.S. in 2014 and startedselling under the brand name Hovertrax.

The Solowheel sold modestly in the U.S.,but it appeared everywhere in China afterdozens of companies copied Chen’s idea.Chen filed several lawsuits and learned a les-son about legal reality in the country. Afterhe sued a company that had governmentties, the judge in the case advised Chen overthe phone to settle. “Even if you win the case,they will set up new a business and comeback,” Chen says the judge told him. “Younever can enforce the law, even if you win.”(Chen eventually took a settlement.)

Chen relayed this story to Chic’s CEO Yingin person last September, when he visited

have just added to the reputational smogsurrounding the product.

And yet, remarkably, hoverboards remaininternational bestsellers. Elsewhere inChina, slightly higher on the manufacturingfood chain than Feng, another company isstill building them and even plans to shiftproduction onto American soil this year. It’sgot reason to be optimistic: It created thehoverboard hype, after all.

THE OFFICES OF Hangzhou Chic Intel-ligent Technology, a.k.a. Chic Robotics, are40 minutes outside downtown Hangzhou,some 800 miles from Feng’s factory, in a yel-low, pastel-painted office park coated withconstruction dust. It’s a division of Inno-works, a partly state-owned company thatmatches academics with businesses to helpChina meet its goal of accumulating patents.Last year Chic recorded about $30 millionin sales—80% of it from hoverboards.

Until recently Chic was best known forturning out imitation Segways. But its toy ofchoice changed, thanks in part to a 34-year-old American named John Soibatian. Soiba-tian, a former scout for startups for Verizon,had been in talks with Chic about exportingother products to the U.S. But on a 2014trip to Hangzhou, he saw Chic’s hoverboardprototype for the first time. He recognizedsomething special, a toy fusing Silicon Valleygeekery with skateboarder cool. He toldChic CEO Ying Jiawei that he thought thenew invention could sell well—very well—in America. “My idea was to have this as thehottest-selling item of 2015,” Soibatian says.

Chic moved fast, submitting designpatents in China, Europe, and the U.S. andunveiling its hoverboard to thousands ofpotential customers at China’s biggest tradeexpo, the Canton Fair. Rapturous responsesfollowed, and Chic set aside factory space tobuild boards especially for Soibatian’s U.S.-based company, IO Hawk, which sold themfor up to $1,800 each. Chic also startedmaking boards that it sold for less under itsown brand, S1.

Hangzhou. By then, Chen had already suedChic’s partner, IO Hawk, in the U.S. forpatent infringement. Chen thinks that Chic’sdesigners watched a video Chen had madefor a Kickstarter campaign for the Hovertraxand copied his concept. “That’s my guess,” hesays. “They’ve been knocking off Segways formany years.”

Still, Chen went to China ready to makea deal. He says Chic offered to buy his pat-ent as a backup to its own and promised topay Chen 5% royalties. “We were laughing”about the copycat epidemic, Chen says, add-ing that Chic executives “felt very angry thateveryone copied their [design], not mine.”But Chen says Chic asked for too much (hedoesn’t elaborate), and talks broke down.

Soibatian of IO Hawk says Chen’s patentisn’t enforceable. He may be right: Thepatent is light on specifics about the interiorfunctions of the hoverboard, says BenjaminBai, an intellectual-property lawyer and apartner at Allen Overy in Shanghai who re-viewed the patent for Fortune. If the patentis too narrowly constructed, whether Chicborrowed Chen’s idea may be a moot point.(The suit is set to go to trial in April 2017.)

Chic, which isn’t named in Chen’s suit,says it has been developing a hoverboardsince at least 2012. In his Hangzhou office,Ying brandishes originals of Chic’s patents inChina, the U.S., Canada, Japan, Britain,Russia, and the European Union. “Hisproject is very similar to Segway’s,” Ying saysof Chen. “That’s why Segway has a lawsuitagainst Shane Chen.” (Indeed, the Chinesecompany Ninebot, which now owns theSegway brand, has released its own hover-board, and it sued Chen’s company last fall.Chen replies, “Our lawyers don’t think weinfringe any of the Segway patents.”)

Chic is one of the few hoverboard playersnot currently tangled in a U.S. lawsuit. Butit’s keeping an eye on Shane Chen’s new ally,Razor. In November, Razor bought exclusiverights to use Chen’s patent for its hover-boards; almost immediately Razor sued

Swagway, one of the bigger U.S. importers ofChinese boards. Razor has claimed victoriesin past patent battles, having won injunc-tions and restraining orders against Ameri-can companies importing Chinese copiesof its eponymous scooter. “Razor intends toenforce its patent rights and seek to stop theflood of knockoffs,” a company spokespersonsays. (Swagway says it doesn’t believe thatChen’s patent is valid.)

SINCE DECEMBER, U.S. Customs officersin Los Angeles and elsewhere have beenseizing incoming Chinese hoverboards,citing both safety and intellectual-propertyissues. For Chic’s Ying, that’s vindication forhis side in the copycat wars. None of Chic’sboards, or Chen’s, have been linked to fires.Amazon still isn’t selling Chic’s hover-boards—Ying says Amazon’s lawyers haven’ttold him why, and the company declined tocomment to Fortune. But Chic’s own boardsand IO Hawk’s are getting through customs,Ying says, because they have safety certifica-tions and patents. The boards sell at kiosksin American malls and via websites otherthan Amazon—outlets where sales have kepthumming even as bigger retailers scale back.

Next up for Chic this year: U.S. expan-sion, though its plans still sound embryonic.“What do you think of the brand name ‘Chic’in America?” Chic’s overseas director, SimonWang, asks a reporter. “Not very good, right?Maybe something else? ‘Powered by Chic’?”Chic is searching for factory facilities inHouston or Denver, where former GeneralMotors plants offer attractive leases. A legalshowdown with Chen and Razor may loom,but for now Chic appears unconcerned. “Foroffice locations, what’s better, the West Coastor East Coast?” Wang asks.

For Feng, the manufacturer in Shenzhen,Razor’s entrance into the fray was one head-ache too many. “It is hard to export to theU.S. now,” he says. The fact that Chic’s boardsare getting through U.S. Customs is ironic:If Feng’s company had licensed designs fromChic before controversy erupted—somethingthat would have cost just 10,000 renminbi($1,500) in royalties, and was encouraged bythe local Shenzhen government—it could beselling hoverboards today.

Instead, Feng has abandoned the fad tochase a more reliable opportunity. ShenzhenBojulong is now a licensed contract manufac-turer of an American company’s drones.
