History •The Hyderabad Cadre recruitment rules of Hyderabad Service of Engineers of erstwhile Government of Hyderabad, notified all 28-05-1954 and •the special rules relating to the Madras Engineering Service of the Composite Madras Government Issued on 28-09-1953 are superseded with •the special rules of AP Engineering Services issued by the Governor of AP vide G.OM.S.No.285, PWD Dated: 22-02-1967.

• The AP Engineering Service Rules are amended subsequently in supersession of the above said AP Engineering Service rules and a notification orders are issued duly notifying the special rules for AP Irrigation Engineering Services exclusively vide G.OM.S.No.32, Irrigation & CAD (Services –IX) Department Dated: 12-04-2010.

Rule 16:• (a) Commencement of Probation for direct recruits:Date of joining in duty or from such other date as may be prescribed by the

appointing authority.

• (b) Minimum Service for Commencement of Probation:60 days from the date of joining duty after having been appointed to such service,

class or category on a regular basis.

• (c) Period of Probation:Direct Recruits: Two years on duty within a continuous period of 3 years.Appointment by Transfer/Promotion: One year on duty within a continuous

period of 2 years.

Rule 16 (c): Tests to be passed during probation: Must pass the tests during the Period of Probation (f). i) If the candidate does not pass the tests the appointing authority can discharge him from service unless his probation is extended. If even then the candidate fails, the appointing authority shall discharge from service.•ii) The candidates will be on probation until the publication of the results. h) Change of date of Commencement of Probation: Candidate is deemed to have commenced his probation w.e.f. the date to be fixed by Government which would be anterior to a date to his passing such tests or acquiring such special qualification, so that the interval between the two dates shall be equivalent to the period of probation whether on duty or otherwise and seniority will be determined w.r.t. that date.

Rule 17: Suspension, Termination and Extension of Probation:a.If the probationer fails to pass the prescribed tests or acquire the prescribed qualifications the appointing authority may extend his probation to enable his to pass the tests or acquire special qualifications prescribed, as the case may be not exceeding one year whether on duty or otherwise in such service, class or category, in which case his increment is postponed until he completes his probation. Such postponement of increment is not a penalty and shall not affect future increments after he completes probations.

b. At any time, before or after the expiry of the period of probation the appointing authority may extend the probation by not more than one year in case it is not extended as stated above (for not passing of tests etc.) or terminate the probation and discharge the probationer from service, after giving him one month’s notice or one month pay in lieu thereof of such notice, on account of unsatisfactory performance of duties or unsatisfactory conduct or for any other sufficient reason to be recorded in writing (Termination of probation is not considered as a penalty)

c. At any before the expiry of the prescribed period of probation, the appointing authority may suspend the probation of the probationer and discharge him for want of vacancy.

Rule 18 : Declaration of probation :a. At the end of the prescribed period of probation the appointing

authority shall consider the probationer’s suitability for satisfactory declaration of probation and suitability for satisfactory declaration of probation and issue an order to that affect if the service is satisfactory during the period of probation. The decision to declare the satisfactory completion of period of probation or to extend or discharge him should be taken within a period of 8 weeks of the expiry of prescribed period of probation. The appointing or higher communicate the lapses on the part of the probationer well in advance to the expiry of period of probation so that he may rectify such lapses. (Rule 18 (b) (i))

b. If the probationer falls to give satisfaction to appointing authority which should be based on work and conduct or if he has not made use of the opportunities given to him, the appointing authority can discharge the probationer after giving one month’s notice, as already mentioned above.

c. The competent authority shall assess the outlook, character, ability, and aptitude for the work of the probationer before the probation is declared. If no order of satisfactory declaration of probation is issued (when all satisfied) even after one year of completion of probation or extended period of probation, the probationer shall be deemed to have satisfactorily completed his probation with retrospective effect from the date of expiry of the prescribed or extended period of probation and a formal order to that effect may be issued for purpose of record.

• However, this deeming provision will not, apply if charges have been communicated to the probationer during the period of probation or the extended period of probation or for failure to pass the prescribed tests or acquire the qualification within the period of probation (Rule 18 (b) (ii))

• The power exercisable by the appointing authority, other than State Government can be exercised by any higher authority to whom such authority is administratively subordinate whether directly or indirectly (Rule 20).

List the conditions under which changes in the dates of commencement and declaration of probation. Rule (6) (a): The probation period for direct recruit will be two years on duty within continuous period of three years and for commencement of probation maximum (60) days or service from the date of joining duty on a regular basis is required. For appointment by transfer or promotion the period of probation is one year of service within continuous period of 2 years.

During the probation period the candidate has to pass tests prescribed and if he fails the appointing authority can discharge him from service or extend, the probation period. The interval between the two dates i.e., passing of tests and date of commencement of probation shall be equivalent to the period of probation, whether on duty or otherwise and seniority will be fixed with respect to that date.

Resignation:• Rule 30:- Resignation • Forfeit past service• It takes effect from date of relief• If on leave from the date of expiry of leave • The employee may with draw it before it takes effect.• Government sanction is required if the withdrawal is made

after it take effect.• It cannot be accepted if Department programmes are pending

against the employee• If a person appointed to another post by APPSC his lien will

be in the previous post till 3 years or his probation is declared in the 2nd post.

• Contd…• [F.R. 18-A: A Government servant shall be deemed to

have resigned from the service if he—• a). is absent without authorization for a period exceeding

‘one year’ ; or • b). remains absent from duty for a continuous period

exceeding five years with or without leave; or• c). continues on foreign service beyond the period

approved by the State Government:• provided that a reasonable opportunity to explain the

reason for such absence or continuation on foreign service shall be given to the Government servant before the provisions of this sub-rule are invoked.]

SERVICE REGISTER – OPENING OF SERVICE REGISTER

Service Register in Form 10 (of Annexure of Part III of F.R.) should be opened to every Govt. employee, by the Head of the Office, as soon as a person is admitted to Govt. Service.

• Service Registers shall be maintained for all Govt. employees showing all the events from the date of appointment to the date of retirement.

• The S.R. should contain the particulars of qualifications, date of birth, date of first appointment, regularization of services, declaration of probation, tests passed or exempted, increments, pay fixations, options exercised, punishments awarded, breaks in service, suspension, subsistence allowance paid, all leaves except Casual Leave, recovery of over payments, willful absence treated as dies-non, training, Jointing Time, nominations for gratuity, A.P.G.I.S, List of family member in the prescribed format.1

• Providing certified copy of Service Book• 14. A certified copy of service book may be supplied on payment of a

copying fee [say Rs. 2/-per page] to a Government servant who asks for it on quitting Government service, by retirement, discharge or resignation.

• Periods of Absence• 15. The orders of the competent authority regarding the counting or

otherwise of periods of extraordinary leave,or periods preceding breaksin service or qualifying service for pension should be obtained

invariably at the very time the occasion arises and not later. Such orders should be noted in the service book.

• Photograph• 16. The photograph of the Government servant should be pasted on the

right side of page 1 of the service book.• Medical Examination at the time of appointment:• 17.Proper entries regarding medical examination of the Government

servant at the time of appointment and attestation forms verifyingantecedents and character etc. should be made at the appropriate place

ofthe service book.

C.P.S (Contribution Pension Scheme)G.O.Ms.No.654 Fin (Pension – I) Dept., Dt: 22-09-2004.• Government have introduced contributor pension scheme

to the A.P.Employees who are recruited on or after 01-09-2004. Under the new Contributory Pension Scheme introduced to the central Government employees, G.P.F Scheme is not applicable to the newly recruited employees.

• These rules shall not apply to Government servants appointed on or before 01-09-04 to services and posts in connection with the affairs of the state either temporary or permanent.

Recovery of C.P.S (Contribution Pension Scheme)G.O.Ms.No.655 Dt:22-09-2004.

• It is mandatory for all the new employees, who are recruited on or after 01-09-2004 to become member of the scheme. Each employee will pay a monthly contributions of 10 % of the basic Pay and D.A from salary to the Contribution Pension Scheme.

• A matching contribution will be made by the State Government for each employee, who contributes to the scheme.

• Audit General (A & E) A..P., Hyderabad will maintain the accounts for the Contribution Pension Scheme as in the case of Contribution Pension Scheme will be allotted by the A.G (A& E) . Hyderabad on receipt of application from the Head of the Department/ Head of Offices in the prescribed form.

• Nomination has to be filed at the time of admission and has to be revised upon marriage of the subscriber and thereafter once in a five years.

AP LEAVE RULES ➢ EARNED LEAVE (Rules: 8,10, 17 & 20)

Leave Earning Eligibility •Temporary Government Servants :- who’s earning capacity is 1/22nd of the period spent on duty should be credited with 16 days earned leave in two installments, 8 days on the first January and July every year and maximum credit for emergency service 30 days.

•Regular Government Servant(Probationer also):- The account of leave of each regular Government employee in superior services should be credited with 30 days earned leave in two installments, 15 days on the first January and July every year and maximum credit for 300 days.

• Availment of Leave• As per Leave Rules 22, the maximum amount of

(Earned leave) that may be granted at a time to temporary Government Servant shall be :

• 180 days if he is probationer in superior service.• 50 days if he is probationer in last grade service• 30 days in the other case i.e., Temporary

employees.• Government in G.O.Ms.No.153 Dt:04-05-2010.• Maximum earned leave that may be granted at a

time to a Government servant in superior service is enhanced from 120 days to 180 days on par with the employees of the Government of India from the date of issue of the G.O.

• HALF PAY LEAVE20 days will be credited for every year, after completion of 1 year

service• TEMPORARY EMPLOYEES – not eligible for half pay leave

or half pay leave commuted to full pay (APLR 23 Ruling 2 read with Rule 15(b), 18(b), 19(b) and 23(a)(i) & Govt. Memo.No.20584/302/FR-I/74-1/F&P dt.12.9.74

• REGULAR EMPLOYEES – superior or inferior (APLR Rule 13 & 18)

• FULL PAY: For those suffering from TB, Heart Disease, Kidney failure avails HPL when he is not having, EL at credit full pay shall be paid upto a maximum period of 6 months.

• FOR PROBATIONERS: HPL can be granted on Medical grounds (APLR 23 a(i) – Superior Service – Should have completed 2 years of regular service – 2) Inferior Service –Should have completed 1 year of regular service.

• E.O.L (Extra Ordinary Leave)

• Rule 16 of A.P. Leave Rules 1933 :- E.O.L may be granted to a permanent Government servant in superior services in Spl. Circumstance.i.When no other leave in admissible, under these rules orii.When other leave being admissible, the Government servant

concerned applies in writing for the grant of E.O.L • II In the case of non-permanent Government servant the

duration of Extraordinary leave in any one occasion shall not exceed the following limit- Three months- Six months, in case where the Government servant has

completed three years continuous services in the date of expiry of leave of the kind due to admissible under the rules (Including 3 months E.O.L) under as and above and his request for such leave is supported by a medical certificate, as required under the rules.

➢ STUDY LEAVE: FR 84: i) NGGOs not eligible generally but in exceptional cases can be granted ii) one should not have less than 5 years of service & retiring with in 3 years with an option of retiring after 20 years of service- Maximum 5 yearsGovernment servants working under emergency provisions should not be

granted E.O.L for prosecution of higher studies in relaxation of relevant leave rules in future. In all those cases, how ever, where such sanctions have been accorded in relaxation of the rules and bonds got executed, the terms of bonds should be strictly enforced.(GO MS No. 183 F&P(FW) Dept. dt. 21-07-1978)
