7th CPC has cheated us on the minimumwage and fitment formula by adopting : (i) lowerprices than the actual retail Market rates & (ii)Gender bias out dated Dr Aykroyd formula of 1948adopted by 15th ILO in 1957 without updating itto suit digital India 2016 which consider the wifeof the worker to be 0.8 as compared to thehusband equal to one unit. The normative familyas per Dr Aykroyd and ILO 57 norms is taken toconsist of a spouse and two children below theage of 14. With the husband assigned 1 unit, wife,0.8 unit and two children 0.6 units each. In today’sdemographic and social compulsions, the familyconsists of not only husband, wife and twochildren but invariably includes the parents of thehead of the family. In Indian conditions, as mostparents totally depend upon the earning familymembers, they should have been included in thenormative family

Dr Aykroyd prescribed 2700 calories for anIndian adult with moderate activities.Unfortunately, the 7th CPC applied it uniformlyacross the board to all Males including lacs ofparamilitary, police & other security personnel aswell as to Trackmen in Rlys and labour classwhose activities are arduous and laboriousrequiring 3600 calories per day. However, thecommission provided only 2160 Calorie of food/nutrients. A lady of the house too puts in the sameamount, in fact rather more, of physical andintellectual work as compared to the husband.She needs more nutrients and healthcare to keepherself fit to be a mother and an educationist forher school going children. She needs betterclothing than 1957. A lady whether she is a wifeof a labourer or of a Secretary to Govt. of India,has a basic right to keep herself reasonablypresentable for which she needs some minimumadd-ons. As such treating her to be less than aunit is gross injustice, gender bias - a result ofcolonial mentality and is against the constitution.

of food, clothing and shelter but a measure offrugal comfort including good education forchildren, protection against ill health,requirements of essential social needs and ameasure of insurance against more importantmisfortunes including old age. The 7th CPC choseto workout minimum pay of the Central CivilGovernment employees based on need baseminimum wage which means a minimum wagefor the bare sustenance of life and for somemeasure of education, medical requirements andshelter etc. Still, going by 7 th CPC owncalculations, if the retail prices of the Directorateof Economics & Statistics, Department ofAgriculture & Cooperation, Ministry of Agriculture,Government Of India New Delhi of the month ofJuly 2016 are adopted, the minimum wage worksout to Rs 24,000/ which is 3.42 times increase.

Further if wife is taken as one unit i.e equal tohusband the minimum wage comes to 25,600/-.Adding to it requirement of digital India movingtowards less-cash society i.e. a smart phone &internet connection etc the need base minimumwage comes to Rs 26,000/- i.e an increase of3.7 times and consequently the fitment factorcomes to 3.7 applicable to all including pensions.Under the 7th Pay Commission slab which wasimplemented ten years after the previous paycommission, the salaries of the governmentemployees saw a marginal rise of just 14%. Thebasic pay under the 7th CPC i.e the minimumwage was increased to Rs 18,000/- from Rs7,000/- (2.57 times) while the salary of the seniorgovernment officials has gone up to Rs 2.50 lakhfrom Rs 90,000/- (2.77 times).The ratio minimum-maximum salary increased to 1: 13.88

The minimum wage was increased by 2.57times but in actual terms this increase is of justRs 2250/in 7th CPC taking into account 125%DA which was already being paid .CG employeeswage factor 2.25 times was already in existence,that is basic of Rs 7,000/- plus DA of 125% of Rs8750 equal to Rs 15,750/-. In the light of the abovefacts, there is need to review the minimum salary& consequently the fitment benefit and theretirement benefits.

Most of the Pre-2016 especially the pre-2006pensioners will suffer heavy loss in revised pensionranging from Rs 500/- pm to 16,600/- per month, ifthe Option-1 recommended by the Seventh CPCis denied to them.

BPS has been fighting for full parity betweenpre- & post CPC retirees right from 1988.Thougha substantial increase in pension, across thegroups, during the span of over 25 years could beachieved, Yet full parity remained elusive and adistant dream. It was with Vth CPC conceding theprinciple of complete parity in pension of pastpensioners upto 1.1.86 and modified paritythereafter which Govt. curtailed to 50% of theminimum of the revised pay of the scale in the postheld by the pensioner at the time of retirement.The issue of complete parity in pension startedinching towards the goal.

During repeated interactions with 7th CPC,Bharat Pensioners Samaj stressed the need of fullparity in pension and appealed to 7th CPC to takeinto consideration the judicial pronouncements onthe issue of parity in pension, which resulted in theCommission recommending vide their Para10.1.67 which reads “All the civilian personnel

including CAPF who retired prior to 01.01.2016

shall first be fixed in the Pay Matrix being

recommended by this Commission, on the

basis of the Pay Band and Grade Pay at which

they retired, at the minimum of the

corresponding level in the Matrix. This amount

shall be raised, to arrive at the notional pay of

the retiree, by adding the number of increments

he/she had earned in that level while in service,

at the rate of three percent. Fifty percent of the

total amount so arrived at shall be the revised

pension”, i.e., Option-1 for pension revision of pre-2016 pensioners. The recommendation ifimplemented without any dilution or deviation willtake us nearer to full parity. Non-implementationon the sham plea of non-availability of records in afew cases is totally unacceptable when it can easilybe recast as per the procedure already laid downin Para 15 of OM No.F.No.45/86/97-P&PW(A)-Part-III dated 10.2.1998 of Government of India,Ministry of Personnel, Public Grievances - DOP&PW, which reads : “Revision of pay on notionalbasis from time to time as indicated in the precedingparagraphs will require locating old records for pastperiods. As the Ministries, Department and Officesof the Central Government have been re-organizedseveral times during this period, it is likely that the

service records of a large number of employees

may not be readily available. There is alsopossibility of the records having been destroyedon expiry of their scheduled retention period. Insuch cases the pensioner/family pensioner couldbe asked to produce copies of relevant orders etc.available with him/her indicating the scale of payof the post held by the Government servant at thetime of retirement/death as also qualifying servicerendered (in case of pensioner only). However, insuch cases the onus of verifying the correctnessof the records made available by the pensioner/family pensioner shall be with the administrativeauthorities. In very rare cases of pre-1973 retirees,if the Head of Department is satisfied and recordsa certificate to the effect that in-spite of all the bestefforts of Department including that of contactingthe concerned pensioner/ family pensioner it hadnot been possible to revise the pay on notionalbasis on service records in a particular case dueto non-availability of relevant records, the pay ofpre-1973 pensioner/deceased Governmentservant could be fixed outright at the minimum ofthe revised scale of pay introduced w.e.f. 1.1.1973.”

THOUGH OPTION-1 DOES NOT IN FACTGIVE 100% PARITY BETWEEN PRE-AND POST2016 RETIREES AS IT DOES NOT PROVIDEEQUAL PENSION FOR THE RANK POST ANDEQUAL LENGTH OF SERVICE. IT TAKES INTO

ACCOUNT ONLY THE INCREMENTS DRAWN INTHE SCALE FROM WHICH A PERSON RETIRED.It simply takes us very near to 100% parity whichwould be accepted by all. If we lose it now, then

we will never ever get it at any time in future.

A life member of BPS who is president RSCWS,Chandigarh (An affiliate of BPS) N.P Mohan, formerChief Engineer N. Rly, has very rightly andsuccintly explained the adverse effects of our losingOption-1 as follows:

i) Pre-2006 pensioners, in particular, who arevictims of modified parity will suffer a much biggerloss as compared to the post-2006 retirees. Thisaspect has been examined in the case of Pre-&

1. From the above table it will be clear, that pre-2006 pensioners, as victims of Modified Parity willstand to lose more in pension compared to post-2006 Pensioners if Option-1 of counting increments is notaccepted by Govt.

2. The loss in pension for post-2006 pensioners is in the range of Rs.1700 (from 1468 to a max of2076 as per col. 6) only and is nearly constant. Whereas for pre-2006 pensioners the loss in pensionincreases by almost Rs.1000/- for every one increment (Refer cols. 6 & 8).

3. For example, the loss suffered in pension of pre-2006 pensioner in losing 5 increments works outto 6868 as against 1710 for post 2006 pensioner.

Post S-19 pensioners and is presented below asan example. From the Table given below, it wouldbe evident that the reduction in pension for pre-2006 pensioner is increasing exponentially witheach increment lost. Similar is the case in otherscales also.

ii) The 7th CPC has considered pre-2016pensioners as one homogeneous group (Para10.1.53 refers). It means that all pre-2016pensioners have to be treated alike. Bharat Pensioners Samaj (Federation ofPensioners Association) seek your kind supportin a matter having serious implications on CentralGovernment Pensioners – especially the Pre-2006Pensioners.

1. The Government had formed a Committee onFeasibility on Implementation of Option 1recommended by the 7th Pay Commission forrevision of pension of Pre-2016 pensionersbased on the number of Increments earned bythe Pensioner in the scale from which He/ Sheretired.

2. Cabinet Secretary informed the leaders of JCM/ NJCA on 19-1-2017 that the issue ofPensioners has already been referred to theCabinet.

3. Since the Cabinet is likely to consider and decidethe said issue early, we very earnestly requestthat the following points may very kindly beconsidered sympathetically to avoid injustice& hardship to old Pensioners:

i) After decades of persistent persuasion paycommission after pay commission, 7th CPCvide their para10.1.67 recommended option 1for the revision of pension of pre-2016 retireestaking them nearer to full parity. Pre 2016Pensioners especially the Pre-2006Pensioners will suffer heavy monthly loss inPension if the Option 1 recommended by 7th

CPC for revision of Pension is denied or diluted

on the unsustainable reason of non-availabilityof records for only about 18% of old pensioners;

ii) Sir, it is very much feasible to implement Option1 recommended by 7th CPC for revision ofPension of pre 2016 Pensioners since ServiceRecords of over 82% of old Pensioners areavailable;

iii) The missing service records of 18% pensionerscan easily be recast as per the procedure laiddown in Para 15 of OM No.F.No.45/86/97-P&PW(A)-Part-III dated 10.2.1998 ofGovernment of India, Ministry of Personnel,Public Grievances-DOP&PW which reads:

“Revision of pay on notional basis from timeto time as indicated in the preceding paragraphswill require locating old records for past periods.As the Ministries, Department and Offices of theCentral Government have been re-organizedseveral times during this period, it is likely that theservice records of a large number of employeesmay not be readily available. There is alsopossibility of the records having been destroyedon expiry of their scheduled retention period. Insuch cases the pensioner/family pensioner couldbe asked to produce copies of relevant orders etc.available with him/her indicating the scale of payof the post held by the Government servant at thetime of retirement/death as also qualifying servicerendered (in case of pensioner only). However, insuch cases the onus of verifying the correctnessof the records made available by the pensioner/family pensioner shall be with the administrativeauthorities. In very rare cases of pre-1973 retirees,if the Head of Department is satisfied and recordsa certificate to the effect that inspite of all the bestefforts of Department including that of contactingthe concerned pensioner/family pensioner it hadnot been possible to revise the pay on notionalbasis on service records in a particular case dueto non-availability of relevant records, the pay ofpre-1973 pensioner/deceased Governmentservant could be fixed out right at the minimum ofthe revised scale of pay introduced w.e.f. 1.1.1973.”

It is, therefore, requested that the Pension ofPre-2016 Pensioners be allowed to be fixed as perthe recommendation of 7th CPC option1detailed intheir Para 10.1.67 & 68 and accepted by Govt.(subject to feasibility) without any dilution.

Coffee Boardpensioners are very much disappointed as theBoard has not been sympathetic towardspensioners to resolve their problems.

“Department of Expenditure has observed thatthe upgraded Grade Pay of Rs. 4600/- was givensubsequently outside the recommendation of the6th CPC. Since this up-gradation is post-6th CPCdecision, it is not applicable to those who are holdingthe pre-revised scale of Rs.65,00-10,500/- andretired before 01.01.2006”:

ii).From the above cited observations ofDepartment of Expenditure, it is apparent that theDOE had objected to the extension of the saidbenefit to such of the Pensioners who had retiredfrom the posts upgraded outside therecommendations of the 6th Pay Commission.Incidentally, DOE had earlier agreed to give thebenefit of subsequent upgrading to old Pensionersin case of S 30 wherein PB 4 + GP 12000 wasupgraded to 67000-79000 (HAG). But ironically,similar benefit of subsequent upgrading is nowbeing denied to those who retired from the scaleRs.6500-10500/-;

iii). In any case, from the above it is clearlyinferred that DOE had no objection to give the saidbenefit of upgradation to the Pensioners who hadretired from posts which were upgraded outsidethe recommendations of 6th CPC.

iv). It is, therefore, requested, that the benefitof upgradation/merger of Pay Scales as perrecommendation of 6th CPC as per Section II ofCCS (Revised Pay) Rules 2008 may please begiven for the Revision of Pension of at least thoseof Pre-2006 Pensioners who had retired from postsupgraded by 6th CPC. If any pensioner represent forrevision of his/her pension, the samewould be revised on verification ofrecords provided by him/her;(ii) CPAO will also provide list of pendingcases to the banks to check thegenuineness of these cases on basis ofKYC records available with them.

(ii)Pensioners Association fromAmbarnath has said that most ofthe retirees have not get theirrevised PPOs and that PCDA(P),Allahabad is not acknowledgingtheir reminders. Secretary(P&PW) asked representativesof CGDA to hold a meeting ofPensioners and Officers ofPCDA (P), Allahabad inAllahabad to assess the situationand report outcome to DoPPW.

Department of Telecom informedthat 42 more PPOs have beenrevised. In remaining cases norecords are available with theDepartment.

Information is being retrieved from e-scrolls of CPPCs of Banks and these 2368cases would be revised by 31.12.2016.

Further, there are about 15,000 cases forwhich information on whether they are ofPre-2006 or Post -2006 is not available.Secretary (P&PW) asked Department ofEx-servicemen Welfare to take up thematter with the CPPCs of the concernedBanks, so that the 15,000 cases may berevised by the first week of February,2017. He also asked to share the list of48,245 cases with Defence PensionersAssociations so that they can tally it withlist available with them.PCDA(P) Allahabad have informed thatthey have issued approximately 1966PPOs in respect of civilian employees ofOrdnance Factory Ambarnath. To sort outthe issue, PCDA(P) Allahabad called ameeting on 20.10.2016 in DPTIAllahabad, but the representatives ofAssociation did not turn up for the meeting.Again, PCDA(P) Allahabad approachedthe association for the meeting, but thesame could not be held due to non-approval of TA/DA for which PCDA(P)Allahabad is not competent authority tosanction. Further, CGPA, Ambarnath on03.11.2016 intimated that approx. 1500members of their association havereceived corr. PPOs.

Ministry of Railway

Steps have already been taken byMinistry of Railways to incorporate thedetails of last pay drawn and the pay scalein the PPO. Further, steps are also beingtaken to incorporate the details of numberof increments drawn in the pay scale atthe time of retirement for futurereferences.

Ministry of Health and Family Welfare

(i) The final EFC Memo is underfinalization based on the commentsreceived from concerned Ministries/Departments.

(ii) In the Second Review Meeting heldon 20.12.2016, Ministry of Health andFamily Welfare has informed that theHeath Insurance Scheme i.e CGEPHISwill not be offered to Ex-servicemen asthis Scheme is for supplementing theCGHS whereas they are covered byECHS (Ex-Servicemen ContributoryHealth Scheme).

In response to the request of DisabledWar Veterans(India) that the Defence

Ministry of Health &Family Welfare has also been remindedon EFC Memo vide reminders dated17.11.2016 and 04.01.2017.

Ministry Of DefenceThe issue relates to payment of specialFamily Pension to war disabled invalidedsoldiers on their death withoutconsidering the limit of seven years. Theinvalided war disabled soldiers aregetting disability pension comprisingservice element and disability element.If they die after a period of seven years,the family pension is calculated basedonly on the service element-disabilityelement is ignored for family pension.The request is for calculating familypension taking into account bothdisability element and service element,even if the death occurred after sevenyears of their invalidation. The proposalwas earlier examined by Ministry ofDefence. Ministry of Defence has statedthat the comments of serviceHeadquarters on the issue has beensought vide MOD ID Note dated10.10.2016 from all the three Serviceswhich is still awaited.

CPAO has issued an OM Bo CPAO/Tech/Banks performance/2015-16/45dated 2nd June, 2016 to Heads ofCPPCs and Government BusinessDivisions of all Authorised Banks. Banksare supposed to commence the familypension to the spouse immediately onreceipt of death certificate of thepensioner, after obtaining proof of his/her own age/date of birth and undertakingof recovery of excess payment. Banksare instructed to arrange payment offamily pension latest within a month ofsubmission of above documents andprovide details of transaction for theintervening period of the familypensioner.

The matter was also reviewed in themeeting held with banks on 22nd Aug,2016 where it was advised to the Banks

EXPLANATORY MEMORANDUM

1. The Railway Services (pension) Rules, 1993came into force on the 3rd December, 1993.

2. In order to maintain uniformity with theDepartment of Personnel and Training’sNotification on the issue published in the Gazetteof India, vide number S.O.713(E) dated the 17thSeptember,2015, this notification is givenretrospective effect from the 17th September,2015.

3. The amendments to the said rules withretrospective effect will not adversely affect theinterest of any person.

Sub :Review of performance of Nivaran Portal.

Nivaran portal which was launched on30.06.2016 by Hon’ble MR has been steadilystabilishing and around 400 grivances have beenlodged on it by serving and former Railwayemployees. As the portal has been newly designedand developed the functionalities have not yetstabilised and efforts are being made to attend to theissues as they come to notice.

A. Certain problems have been faced by Railwaysin forwarding the grivances to the concernedauthorities which have been examined by CRIS andthe developers. It is revealed that problems arose atthe stage of creation of Internal Users. In order torectify thr problem, the following steps are requiredto be taken:-

1. The Chief Personnel Officers of Railways/PUs/RDSO/CORE and the Head of the Office of otherunits reporting to the Board were created as“Admin”by Railway Board. However, certain Railwayshave added them as CPO which should not be done.

2. Similarly CPOs were required to createSr.DPOs/Dy.CPOs and other authorised personswho are Head of the Personnel Department ofDivisions and extra Divisional Office as Admin at tierIII level. The Admins at all levels should be assignedboth the roles of “Sys Admin” and “Internal User” - Allother users should be assigned role of “Internal User”alone.

3. Some Railways have created the authority atHeadquater Office under Extra Divisional Office/Divisional office which has caused problem inforwarding of the grievances within the HeadquaterOffice. This need to be Edited by going to the UserList and all authorities at Headquater Office shouldbe reconfigured under Headquarter Division of Zone.

All offices are requested to review the InternalUsers in the ‘Users List’ to ensure that aboveprinciples are strictly followed.

B. The processing of cases by Railways has beenexamined at Railway Board level which reveals thatthe instructions conveyed under letter of even numberdated 30.06.2016 are not being dully followed indisposal of cases. It is reiterated that the portal hasbeen created to bring maxmium possible relief to anaggrieved employee. The objective of administrationshould be to facilitate him/her in conveying thegrievance to the administration so that the latter cantake corrective action. It is expected that railwayoffices shall act as facilitator and not be too rigid aboutsupplementary information. In some of the cases itis seen that information like PF No., designation etc.are being asked even though they are alreadyprovided by the complainant. If some clue to indicatethe identity of employee is present, the same shouldbe pursued instead of reverting to the employee in amechanical manner asking for full details. In casevalid mobile number is available, the required detailsmay be obtained over phone. This would cut downon processing time.

Following guidelines are reiterated for Closure ofa grivance on Nivaran:

is not only unwarranted but also an affront to thewomanhood in the context of atrocity against womenrampant in the country. This is inconsistent withacceptance of certificates with self-attestation.

3.Therefore, the Union has requested toeliminate the provision of counter signature fromothers duly accepting self attested certificates.

4.This department has also receivedrepresentations against provision for submission ofthese certificates every six months, which had beenforwarded to the CPAO for further necessary action.as general references.

5.This department has already allowedsubmission of self-certificate for non-marriage anddeclaration of income vide OM dated 21st July,1999, re-iterated vide OM dated 8th December, 2011and 20th September, 2012 (copies available atwww.persmin.nic.in). Rule 54 of CCS (Pension)Rules, 1972 has been amended to allow submissionof marital and income certificates only once a year.

6. In view of the foregoing, Central PensionAccounting Office, Department of Ex-servicemenWelfare and Ministry of Railways are requested tomake suitable changes to their respective forms forthe above certificate.

The employees working in the Quasi-governmentOrganizations, Autonomous Organizations, StatutoryBodies etc. set up and funded/controlled by the CentralGovernment, are not Central Government employeesand, therefore, the benefits implemented by Central

Government in respect of Central Governmentemployees as part of their service conditions, are notdirectly applicable to the employees working in suchautonomous organizations. The application of suchbenefits as given to Central Government employeesin respect of employees of such autonomousorganizations as well as the manner and conditionsgoverning such application, including sharing of theadditional financial implications arising thereon,requires specific approval of the CentralGovernment.The autonomous organizations areexpected to manage their affairs in such a fashion thattheir dependence on Central Government for financialsupport to meet the extra financial implications isminimal, as such autonomous organizations areexpected to be financially Self-sufficient so as not tocause any extra burden on the Central Exchequer.

2. In the above background, the question ofextension of the revised pay scales in terms of theCCS (RP) Rules, 2016 as notified on 25.7.2016 inrespect of Central Government employees based onthe recommendations of the 7th Central PayCommission, to the employees of the Quasi-government Organizations, AutonomousOrganizations, Statutory Bodies, etc., set up andfunded/controlled by the Central Government, wherepattern of emolument structure, i.e. pay scales andallowances, in particular Dearness Allowance, HouseRent Allowance and Transport Allowance, are identicalto those in case of the Central Government employees,has been considered by the Government and it hasbeen decided that the revised pay scales as per thePay Matrix, as contained in Part-A of the Schedule ofthe CCS(RP) Rules, 2016 as well as the principle ofpay fixation as contained in the said rules, may beextended to the employees of such organizations,subject to the following stipulations:-

(i) The conditions of service of employees of theseorganizations, especially those relating to hours ofwork, payment of OTA etc. are exactly Similar to thosein case of the Central Government employees.

(ii) The revised pay structure shall be admissibleto those employees who opt for the same inaccordance with the extant Rules.

(iii) Deductions on account of Provident Fund,Contributory Provident Fund or National PensionSystem, as may be applicable, will have to be madeon the basis of the revised pay w.e.f. the date anemployee opts to elect the revised pay structure.

b. In case of final disposal the designation ofauthority with whose approval the decision was takenmust be given, along with citing the name of authorityto whom Appeal lies. For example if Sr. DME tookthe final decision in a case and appeal lies with ADRM/DRM, then it should be so indicated in the concludingpara of comments. Further the case can only beclosed on being ratified by the Admin of that office,who is normally expected to be the head of PersonnelDepartment. The purpose of ratification is to makesure that disposal is in line with issues raised ingrivance.

A grivance, which is closed without following thisprocedure, would not be treated as “disposed off”

c. The time period of 60 days is the maximumperiod for redressal and should not be taken aslicense to delay processing of grivances, which shouldbe addressed in shorter time period. This speciallyapplies to grivances like emergency repair ofaccomodation, issue of urgent NOC etc.

d. A grivance must indicate having beingexamined by the Admin’s representative within 48working hours of registration. The case should eitherget forwarded to the concerned authority or the courseof action to be followed should be recorded on theportal.

Hon’ble MR shall start reviewing the division wiseposition from August 16 onwards. please ensure thatsystem is in place before regular review of the systembegins.

3. The revised pay scales contained in Parts B &part C of the Schedule of the CCS(RP) Rules, 2016,shall not be automatically applicable to the employeesof Autonomous Organizations. The concernedAdministrative Ministry shall consider such caseskeeping in view whether these pay scales are justifiedfor the category of staff of Autonomous Organizationsbased on functional considerations, recruitmentqualifications, as well as the applicable pre-revisedpay scales. Based on such an examination by theconcerned Administrative Ministry, appropriateproposals, if justified, would be submitted to the Ministryof Finance, Department of Expenditure, through theirIntegrated Finance.

4. In case of those categories of employees whosepattern of emoluments structure, i.e., pay scales andallowances and conditions of service are not similarto those of the Central Government employees, aseparate ‘Group of Officers’ in respect of each of theAutonomous Bodies may be constituted in therespective Ministry/Department. The Financial Adviserof the respective Ministry/Department will representthe Ministry of Finance on this Group. The Group wouldexamine the proposals for revision of pay scales etc.taking into account the views, if any, expressed by theStaff representatives of the concerned organizations.It would be necessary to ensure that the final packageof benefits proposed to be extended to the employeesof these Autonomous Organizations etc. is not morebeneficial than that admissible to the correspondingcategories of the Central Government employees. Thefinal package recommended by the ‘Group of Officers’will require the concurrence of the Ministry of Finance.

5. In regard to the additional financial impact arisingout of the implementation of the revised pay Scales,as provided above, the following parameters shall bekept in view:-

(i) In respect of those Autonomous Organizations,which have not been depending upon the GovernmentGrants for their operations or for meeting the cost ofsalary, including those autonomous organisationswhich are in a position to meet the additional financialimpact from their own internal resources, the additionalfinancial impact shall be met by the concernedautonomous organizations without any financialsupport whatsoever from the Government. No financialsupport shall be given by the Central Government insuch cases.

(ii) In respect of the other Autonomous

Organizations. which are not in a position to meet theadditional financial impact, either fully or partly, onaccount of the implementation of the revised payscales, the concerned autonomous organization willtake up the proposals with the Advisers of therespective Administrative Financial Ministry/Department, bringing out the extent to which theadditional cost could be met internally, the shortfall tobe made up and the reasons for the shortfall. Whilegiving concurrence to the implementation of the revisedpay scales, the Financial Advisers shall ensure thatthe extent of Government support is kept at theminimum, and in no case the Government supportshall be more than 70% (seventy percent) of theadditional financial impact.

(iii) In respect of Autonomous organisations setup under a specific Act of Parliament, not generatingadequate internal resources to meet the additionalfinancial impact, the extent of Government support maybe more than 70% of the additional impact, providedin the opinion of the concerned Financial Adviser thenature of functions and the fund position of theorganisations so warrant.

(iv) The mode of payment of arrears, as laid downin Rule 14 of the CCS(RP) Rules, 2016 shall befollowed, subject to the overall financial impact andthe capacity of the concerned autonomousorganization to absorb the cost without putting anyavoidable burden on the Governments finances,provided the conditions mentioned above are met.

6. The Central Government has not taken anydecision so far in regard to various allowances basedon the 7th Central Pay Commission in respect ofCentral Government employees and, therefore, untilfurther orders the existing allowances in theautonomous organizations shall continue to beadmissible as per the existing terms and conditions,irrespective of the revised pay Scales having beenadopted.

During review meetings held to evaluate thestatus of implementation of Bhavishya withMinistries/Departments, it was observed that GPFfinal payment in many cases is not being paid tothe retiring Government servants immediately onretirement from service leading to payment ofinterest for the delayed period.

2. Rule 34 of General Provident Fund (CentralService) Rules clearly provides that when theamount standing at the credit of a subscriber inthe General Provident Fund becomes payable, itshall be the duty of the Accounts Officer to makepayment. The authority for the amount payable isto be issued at least a month before the date ofsuperannuation, but payable on the date ofsuperannuation. It may be noted that therequirement of submitting a written application by

In continuation of this Department's OM No. 42/13/2012-P&PW(G) dated 30th April, 2012sanctioning the Dearness Relief to those CentralGovernment pensioners who are in receipt ofprovisional pension or pension in the pre-revisedscales of 5th CPC, the President is pleased to grantthe Dearness Relief to these Central Governmentpensioners as under:

(i) Those who are in receipt of provisionalpension or pension in the pre revised scales of 5thCPC are entitled to Dearness Relief @ 151% w.e.f1.7.2012.

(ii) The surviving CPF beneficiaries who haveretired from service between the period 18.11.1960to 31.12.1985 and are in receipt of ex-gratia @Rs.600/- p.m. w.e.f. 1.11.1997 under thisDepartment's OM No. 45/52/97-P&PW(E) dated16.12.1997 are entitled to Dearness Relief @ 151%w.e.f. 1.7.2012.

the retiring Govt. servant for GPF final paymenthas been dispensed with vide this Department’sNotification No.20(12)/94-P&PW (E) dated15.11.1996 and notified under S.O NO.3228 dated23.11.1996.

3. As per Rule 11(4) of GPF Rules, in case theGPF balance is not paid on retirement, interest onthe GPF balance is required to be paid for theperiod beyond the date of retirement also. Whileinterest for the first six months beyond retirementcan be allowed by the PAO in the normal course,approval of Head of the accounts office is requiredfor payment of interest beyond six months and thatof Controller of Account/Financial Adviser beyonda period of one year.

4. To ensure timely final payment of GPF, andto avoid unnecessary financial burden on accountof interest beyond retirement, it has now beendecided that every case, in which payment ofinterest on General Provident Fund becomesnecessary in terms of Rules 11(4) of GPF Rules,1960, shall be put up for consideration to theSecretary of the Administrative Ministry/Department. In all such cases the Secretary of theAdministrative Ministry/Department will fixresponsibility at all levels to take appropriate actionagainst the Government servant or servants whoare found responsible for the delay in the paymentof General Provident Fund.

4. It is clarified that the reference to pay in thisorder relates to the pay drawn in the level of pay.

5. Pensioners have an option to get their CGHSpensioner card made by either making CGHScontribution on an annual basis (twelve months) orby making contribution for 10 (ten) years {120 (onehundred and twenty) months} for getting a pensionerCGHS card with life-time validity. It is clarified that:

(i) Contribution to be made by pensioners / familypensioners would be the amount that they weresubscribing at the time of their retirement or at thetime of death of the Government servant;

(ii) Pensioner beneficiaries, who have alreadyobtained CGHS card with life time validity by payinga lump sum amount equivalent to 10 years’contribution, will not be required to pay any additionalamount as a result of the revision in the rates ofcontribution for availing CGHS facility;

(iii) Entitlement of pensioners / family pensioners,

who have already deposited their contribution for lifetime CGHS facility, will not be changed.

(iv) Pensioners / family pensioners who arecontributing to the CGHS on an annual basis andwish to continue to avail CGHS benefits will have tocontribute at the revised rates up to the time ofcontribution needed to cover a period of a total of tenyears from the time pensioner CGHS card was issuedfor the first time to them. The revised rate ofcontribution for the remaining period would be withreference to the level of pay that he / she would havedrawn in the post held by him / her (at the time of his/ her retirement / death) had he / she continued to bein service now but for his / her retirement/ death; and

(v) Any pensioner / family pensioner who isentitled to avail CGHS facility has not so far got his /her pensioner CGHS card made, the rate ofcontribution in such cases will be with reference tothe level of pay that he / she would have drawn in thepost held by him / her (at the time of his / her retirement/ death) had he / she continued to be in service nowbut for his/ her retirement / death.

TAMBARAM (TN): All India Rly Pensioners’Sangam — celeberated pensioners day on 03-12-2016 attended by large number of pensioners. Afterrendition of prayer by the prez N Kalivaradan, AWilliam narrated his experiences of service tenureand advised all to donate liberally to the sangam.Prez in his welcome speech apprised all of theimportant decisions arrived at the 61st AGM ofBharat Pensioners Samaj held on 13-11-2016 atNew Delhi which he alongwith two other membersattended. Advised all to wait for the report of COSto whom the GOI has referred unimplementedrecommendations of 7th CPC.Advised maximumpensioners from AIRPA to attend the Pensioners’Day celeberations of AIFPA at Chennai. recalled the history of holding function on 17thDecember every year starting from 1982  when theApex Court delivered judgement in the matter of  DS Nakra & Ors Vs UOI.He applauded the servicesof founder prez of AIRPS V S Devasunderam andthe role of central minister T T Krishnamachari inintroducing family pension in 1964 and benefitsextended to pensioners since then. Meeting endedwith vote of thanks proposed by C S Balakrishnanpreceded by serving of Vada and Coffee.

VIJAYAWADA (AP): Central & StatePensioners’ Organisation — Tri monthly Generalmeeting was held on 17-12-2016 presided by itsprez K Hannumantha Rao. E V Rao, DPS PMG,Vijayawada was the chief guest. Genl secy K KSubbarao invited chief guest alongwith PNageshwara Rao-SRM(Retd) and V Sitaramarao-ex gen secy, CSPO, Vijayawada to occupy theirchairs. 4) If the required details are not available withPay & Accounts Office, the pension paying branchmay be contacted to send the photocopy of PPOand obtain 12 digit number through CPAO toexpedite the revision cases.

5) Without above details, case if sent to CPAO,would be returned which would cause delay andinnecessary paperwork.

Budget 2017-18

Budget 2017-18 may not have met the highexpectation but it did bring some relief for everyone.The goverment has reduced the personal incometax rate for those in the tax slab of Rs. 2.5 lac toRs. 5 lac to 5% from 10% earlier, which translatesinto a saving of Rs. 12,500 (without inculding cess)for everyone. For those earning up to Rs. 5 lac,the savings are a lot more. The reduction in thefirst tax slab along with a rebate of Rs. 2,500 forincome up to Rs.3.5 lac means that if your annualincome is Rs.3 lac, you don’t pay any taxes. Eventhose who earn up to Rs.4.5 lac a year don’t paytaxes if you factor in the section 80C deduction ofRs.1.5 lac and the rebate. But for the rich there issome pain in the form of a surcharge. This budgetlevied a surcharge of 10% for those with incomesof Rs.50 lac - Rs.1crore. Those above Rs. 1 crorealready pay a surcharge of 15%.xxxx

First option recommended by 7th CPC for revision of pension of pre-2016 pensioners. ACommittee has been set up as per the decision of the Cabinet to examine the feasibility of

option 1 of the recommendations of 7th CPC for revision of pension of pre-2016 pensioners.The Committee has submitted its report to Department of Expenditure. The recommendation

of the above Committee would further be examined by Department of Expenditure andsubmitted to the Cabinet for its consideration and approval.
