Ultimately all Recognized and Non-Recognized unions have truly sensed that their struggle for ensuring the

rdimplementation of 3 P.R.C. will not be a easy cake to taste but it will be really a test of their capability to show their strength and will to achieve the goal.

Needless to say that they have realized the limitations of the CMD BSNL and as such have not trusted the assurance of the CMD BSNL that the proposal passed by BSNL's Management Committee, for giving wage revision to BSNL employees with 15% fitment, has been sent to the DoT also, pending its approval by the BSNL Board. It is also reported that when the CMD BSNL has recently met Ms. Aruna Sundararajan, Secretary, DoT, she has suggested that both she and the CMD BSNL should meet shri Manoj Sinha, Hon'ble Minister of State for Communications on the wage revision issue.

In the meeting of the Unions it is said that all have agreed for joint struggle and joint programmes. They have also notified their action plan as well. But it is irony to say that they have opted to hide what would be their demands and strategy of parleys. The BSNL Corporate has already notified

rdthe Committee for discussion of the 3 P.R.C. implementation.

So far the Forum of Unions have not spelt out the names of negotiating committee for obvious reasons as neither they can share the responsibility with non-recognized unions nor they can afford to lose their support.

ndThe result of 2 P.R.C. Wage Revision Committee is before them and they have seen that how the talks were prolonged for no reasons were made futile by other Unions deciding to tell the Management through the representations of their members that they accept the scale and stalemate was ended.

The Pensioners Associations are talking to approach the DoT with a say that they should consider them as Central Government Pensioners and extend benefit of

thPension Revision as per recommendation of 7 CPC.

Knowing full well that this will not only be disadvantageous but may create legal hurdle in the way as again well criticized element of differential treatment to the pensioner may crept in. Admittedly, for any Pension Revision, Revision in the Pay Scale is primary obligation

rdand base for which we have to wait for result of 3 P.R.C. implementation by BSNL.

We have to leave aside the fear that the Working Unions may compromise for lower scale and bargain for lucrative Allowances which BSNL can offer to them as it does not affect the Pension Burden on DoT.

Secondly the Pensioners Associations are talking of United and Joint approach which seems good. But are they really sincere in their say. Our reply is 'NO.' Had it been so,

they would have not opted to file different suits for Pension Revision Arrears keeping their way of approach a guarded secret!!!

We would like to make it clear to all the Pensioners Association that the differential approach for similar cause will be in no way beneficial to pensioners' fraternity and may perhaps harm them. For the present we have to keep our eye on developments and watch the situation without any prejudice against anyone.

It will be interesting to know that uptill 1982 when even the Pension of Govt Pensioners were not revised and remained same as was fixed on their date of retirement. The Pay commissions used to recommend only the pay

scales of serving employees and their retirement benefits. In 1982 the Historic Judgment of Supreme Court came in famous D S Nakara case. The Apex court ordered that pensioners cannot be discriminated on the basis of a date and it is a violation of Article 14 of the constitution. Only after this Historic Judgment the item “Pension Revision” was included in terms and reference of 4th pay commission which delivered its report in 1986. Since then the pension of the already retired Govt. Pensioners use to get revised without any haste, with every pay commission

While sending Cabinet memo for ndPension Revision for 2 P.R.C. it was

stated in the justification of the Cabinet memo that due to implementation of

Supreme Court's Judgment on D S Nakara Case. It was mentioned in the memo that discrepancy would be created between BSNL pensioners retired before and after 1-1-2007 had the pension not been revised with equal formula.

Our request to incorporate condition of Pension rdRevision was not accepted by the 3 P.R.C. on the plea that

different schemes for Pensioners are prevailing in PSUs and it cannot be simplified. Our Leaders while negotiating for Government for BSNL Employees in the October 2000 have erred to press for incorporation for condition of Pension Revision of BSNL Pensioners simultaneously whenever in future Pay Revision of BSNL Employees takes place. Our members should not worry on this count as we will take due care of this point.

The MOC have assured in the Parliament that the Pension Revision of the BSNL Pensioners will be given through Cabinet Memo, after the Working Employees are

rdextended the benefit of 3 P.R.C.

Let us assure our members that we will continue to press for demand for Pension Revision simultaneously when Wage Revision of the Employees takes place as it will give pension revision for the employees' retired w.e.f. 01.01.2017 and there cannot be two set of pensioners.
