GEOGRAPHICALINDICATIONSREGULATIONS2001

(Incorporatedthechangesmadeupto15thJuly2013)

Preamble

INexerciseofthepowersconferredbysection32oftheGeographicalIndicationsAct2000[Act602],theMinistermakesthefollowingregulations:

Regulation1.Citationandcommencement.

(1)TheseregulationsmaybecitedastheGeographicalIndicationsRegulations2001.

(2)TheseRegulationscomeintooperationon15August2001.

Regulation2.Interpretation.

In these Regulations, unless the context otherwise requires‐ "Office" means the CentralGeographical Indications Office or any other geographical indications office establishedundersection9oftheAct;"registeredproprietor",inrelationtothegeographicalindications,meansthepersonforthetimebeingregisteredasaproprietorofthegeographicalindication.

Regulation3.Fees.

(1)ThefeestobepaidundertheseRegulationsshallbeasprescribedintheFirstSchedule.

(2)ThefeesshallbepaidtotheRegistrarbysuchmeansandinsuchmannerastheRegistrarmaydirect.

Regulation4.Forms.

TheformsreferredtointheseRegulationsarethosecontainedintheSecondSchedule.

Regulation5.Classificationofgoods.

Forthepurposesoftheregistrationofgeographicalindications,goodsareclassifiedinthemannerprescribedintheThirdSchedule.

Regulation6.Applicationforregistration.

(1)AnapplicationfortheregistrationofageographicalindicationshallbemadeonFormGI1accompaniedbyacopyofstatutorydeclarationbytheapplicantandtheprescribedfee.

(2)Theapplicationshallbesignedbytheapplicantoranagentappointedbytheapplicantpursuanttosection11oftheAct.

(3)Applicationsignedbyanagentshallbeaccompaniedbythestatutorydeclarationoftheapplicant.

Regulation7.Size,etc.,ofdocuments.

SubjecttoanyotherdirectionsthatmaybegivenbytheRegistrar,allapplications,notices,replies,papershavingrepresentationaffixed,andotherdocumentsrequiredbytheActorbytheseRegulationstobeleftwithorsenttotheRegistrarshallbeinISOA4sizewhichshallhaveonthelefthandpartofthedocumentamarginofnotlessthanfourcentimeters.

Regulation8.Languageofdocumentsandtranslations.

(1)ApplicationshallbeinthenationallanguageortheEnglishlanguage.

(2)Wheretheapplicationoranydocumentformingpartofanapplicationisinalanguageother than the national language or the English language the application shall beaccompaniedbyacertifiedtranslationandthenameofthelanguage.

Regulation9.Serviceofdocuments.

(1) All applications, notices, replies, papers having representations affixed, and otherdocumentsauthorizedorrequiredbytheActortheseRegulationstobemade,leftorsent,atortotheOffice,maybesentbypost.

(2) AnyapplicationoranydocumentsosentshallbedeemedtohavebeenreceivedatthetimewhenitisreceivedattheOffice.

Regulation10.Indicationofname,address,nationalityandresidence.

(1) Namesofnaturalpersonsshallbespecifiedinfullandthenamesoflegalentitiesshallbeindicatedbytheirfullofficialdesignation.

(2) Addressesshallbeindicatedinsuchawayastosatisfythecustomaryrequirementsfor prompt postal delivery and in any case shall comprise of all the relevantadministrativeunits, including thehousenumber, telegraphic and telexaddressesandfacsimileandtelephonenumber,ifany.

(3) Thenationalityofanapplicantshallbeindicatedbythenameofthecountryofwhichheisanationalandlegalentitiesshallindicatethenameofthecountryinwhichtheentitiesareconstitutedandtheirregisteredoffice.

(4) Residenceshallbeindicatedbythenameofthestateofwhichapersonisaresident.

Regulation11.Address.

Whereanypersonis,bytheActortheseRegulations,boundtofurnishtheRegistrarwithanaddress,theaddressgivenshallinallcasesbeasfullaspossibleforthepurposeofenablingtheplaceoftradeorbusinessofsuchpersontobefoundeasily.

Regulation12.Addressforservice.

(1)Anapplicant,opponentorregisteredproprietorofageographicalindicationwhodoesnotresideorcarryonbusinessinMalaysiashallfileFormGI2givinganaddressforserviceinMalaysia and such addressmay be treated as the actual address of the person for allpurposesconnectedwiththematterinquestion.

(2)Anyotherapplicant,opponentorregisteredproprietorofageographicalindicationmay,ifhesodesires,fileFormGI2givinganaddressforserviceinMalaysia.

(3)Subjecttosubregulation6(2)andregulation13,FormGI2filedundertheseRegulationsmaybesignedbyanauthorizedagentandinanycaseinwhichtheRegistrarsorequiresshallbesignedbytheapplicant,opponent,orregisteredproprietor,asthecasemaybe.

(4)InanycaseinwhichnoaddressforserviceisfiledattheOffice,theRegistrarmaytreatthebusinessaddressinMalaysia,ifany,ofthepersonconcernedashisaddressforserviceforallpurposesconnectedwiththematterinquestion.

(5)AnywrittencommunicationaddressedtoapersonatanaddressgivenbyhimortreatedbytheRegistrarashisaddressforserviceshallbedeemedtobeproperlyaddressed.

(6)TheRegistrarmay,atanytimethatadoubtarisesastothecontinuedavailabilityofanaddressforserviceenteredintheRegister,requestthepersonforwhomit isentered,byletteraddressedtohisbusinessaddressintheRegister,toconfirmtheaddressforserviceortoprovideanotherbyfilingFormGI2,andifwithintwomonthsofmakingsucharequest,theRegistrar receivesno confirmationor substitutionof that address, hemay strike theaddressofftheRegister.

Regulation13.Signatureofdocuments.

(1)Adocumentpurportingtobesignedfororonbehalfofapartnershipshallcontainthenamesofallthepartnersinfullandshallbesigned‐

(a)byallthepartners;(b)bytheprincipalactingpartnerstatingthathesignsonbehalfofallthepartners;or

(c)byanagentoranyotherpersonwhosatisfiestheRegistrarthatheisauthorizedtosignthedocument.

(2)Adocumentpurportingtobesignedfororonbehalfofabodycorporateshallbearthesealofthebodyandbesigned‐

(a)byadirectororthesecretaryorotherprincipalofficerofthebodycorporate;or(b)byanagentoranyotherpersonwhosatisfiestheRegistrarthatheisauthorizedtosignthedocument.(3)AdocumentpurportingtobesignedfororonbehalfofanassociationofpersonsotherthanapartnershipmaybesignedbythesecretaryoranagentoranyotherpersonwhosatisfiestheRegistrarthatthepersonisauthorizedtosignthedocumentonbehalfoftheassociation.(4)TheRegistrarmay,wheneverhedeemsitnecessary,requestevidenceofauthorizationtosign.

Regulation14.Agency.

(1)ExceptasotherwiserequiredbytheActortheseRegulations‐

(a)anyapplication,requestornoticewhichisrequiredorpermittedtobemadeorgiventotheRegistrar;(b)allothercommunicationsbetweenanapplicantorapersonmakingsuchrequestorgivingsuchanoticeandtheRegistrar;and(c)allothercommunicationsbetweentheregisteredproprietorofthegeographicalindicationandtheRegistraroranyotherperson,

maybesigned,madeorgivenbyorthroughanagentandtheRegistrarmay‐

(aa) in any particular case, require the personal signature or presence of theapplicant,opponent,registeredproprietororotherperson;(bb)bynotice inwriting sent toanagent, requirehim toproduceevidenceofhisauthority.

(2)WhereapartytoproceedingsbeforetheRegistrarappointsanagentforthefirsttimeorappointsoneagentinsubstitutionforanother,theagentappointedshallfileFormGI2withtheRegistraronorbeforethefirstoccasiononwhichheactsasanagentforthatpartyintheproceedings.

(3)Nopersonmayappointmorethanoneagenttoactforhimconcurrentlyinrespectofthesamegeographicalindication,whetherinrespectofthesameordifferenttransactions;andwheremorethanoneagentisonrecord,theRegistrarshallrecognizeonlythelatestagentdulyappointed.(4)TheRegistrarmaydeclinetorecognizeanypersonasanagentwhoisnotcurrentlyintheRegisterofGeographicalIndicationsAgentsmaintainedunderregulation14A.Regulation14A.Registrationofagents.(1)AnapplicationtoberegisteredasageographicalindicationagentshallbemadetotheRegistrarinFormGI15accompaniedbypaymentoftheprescribedfee.

(2)Forthepurposeofregistrationasageographicalindicationagentunderthisregulation,theapplicantshallsatisfytheRegistrarthatheiseitherdomiciledorresidentinMalaysiaorhasaprincipalplaceofbusinessinMalaysia,and

(a)isintheRegisterofPatentsAgentsmaintainedpursuanttotheregulationsmadeunderthePatentsAct1983[Act291];

(b) is in the Register of Trade Marks Agents maintained pursuant to theregulationsmadeundertheTradeMarksAct1976[Act175];

(c)isanadvocateandsolicitorpractisinginMalaysia;

(d)holds a recognized degree in any field of studies and has acquired thenecessaryknowledgeorexperienceinthefieldofindustrialproperty;or

(e)hasatleastthreeyearsofexperienceinthefieldofindustrialpropertybyvirtueofhimbeinganex‐officeroftheOffice.

(3)TheRegistrarshall,uponbeingsatisfiedthattheapplicantfulfillstheconditionsundersubregulation(2),registertheapplicantforatermexpiringeveryyearonthe31Decemberofthatyear.(4)TheRegistrarshallnotregisteranypersonwhohasbeenconvictedofanyregistrableoffenceoranycriminaloffenceinvolvingfraudordishonesty.

Regulation14B.Removalofagents.

AnagentshallberemovedfromtheRegisterofGeographicalIndicationsAgentifhe‐

(a)isnolongerdomiciledorresidentinMalaysiaornolongerhasaprincipalplaceofbusinessinMalaysia;

(b) is convictedof a registrableoffenceorany criminaloffence involving fraudordishonesty;

(c)isanundischargedbankrupt;or

(d)hasbeenstruckofffrom,andnotrestoredto,orissuspendedforthetimebeingfromtheRegisterofPatentsAgents,theRegisterofTradeMarksAgentsortheRollofAdvocatesandSolicitors.

Regulation14C.Renewalofagents.

(1)AnapplicationfortherenewalofregistrationasageographicalindicationagentshallbemadetotheRegistrarinFormGI16accompaniedbypaymentoftheprescribedfeeby31Januaryofeveryyear.

(2)TheRegistrarshall,uponbeingsatisfiedthattheconditionsspecifiedinsubregulations14A(2)and(4)continuetobesatisfied,renewtheregistrationofthegeographicalindicationagentforatermexpiringeveryyearon31Decemberofthatyear.

Regulation14D.RegisterofGeographicalIndicationsAgents.TheRegistrarshallmaintainaRegisterofGeographicalIndicationsAgents.Regulation15.Numberingofgeographicalindications.

(1)Eachgeographicalindicationcontainedinanapplicationshallbegivenanumber.

(2)Thenumberingshallappearinthemarginnexttoeachrepresentation.

(3) The application number allotted under subregulation (1) shall be quoted in allsubsequentcommunicationsconcerningtheapplication.

Regulation16.Acceptanceofapplication.

(1) Upon the Registrar being satisfied that the application has complied with therequirementsofsections11and12andthatthegeographicalindicationisnotcontrarytopublicorderandmorality,theRegistrarshallnotifytheapplicantandrequestpaymentoftheappropriatefeebywayoffilingFormGI3;andiftheapplicantdoesnotpaythefeewithinonemonthofreceiptoftheRegistrar'srequest,heshallbedeemedtohaveabandonedhisapplication.

(2)Uponthereceiptofthefeereferredtoinsubregulation(1)withinthestipulatedtime,theRegistrarshallproceedtopublishtheapplicationsettingout:

(i)thegeographicalindicationforwhichregistrationissought;(ii)thename,addressandnationalityofthenaturalpersonorlegalentityfilingtheapplication,andthecapacityinwhichtheapplicantisapplyingforregistration;(iii)thenameandaddressoftheagent,ifany;(iv)theaddressforserviceifanyagenthasnotbeenappointedinaccordancewithsubsection11(2)oftheAct;(v) thedemarcationof thegeographical area towhich thegeographical indicationapplies;(vi)thegoodsforwhichthegeographicalindicationisused;(vii) the quality, reputation or other characteristic of the goods for which thegeographicalindicationisused,andanyconditionsunderwhichtheindicationmaybeused;and(viii)thefilingdateandnumberoftheapplication.

Regulation17.Noticeofoppositiontoregistration.

(1) Any person may within two months from the date of advertisement referred to insubregulation16(2)givenoticeinwritingtotheRegistrar,onFormGI4accompaniedbytheprescribedfeeofoppositiontotheregistrationandinanysuchcaseshallatthesametimesendacopyofthenoticetotheapplicant.

(2)Anoticeofoppositiontotheregistrationshallincludeastatementofthegroundsuponwhichtheopponentobjectstotheregistrationoftheapplicant'sgeographicalindication.

Regulation18.Reply.

(1)Within twomonthsof thereceiptofanoticeofopposition to theregistration filed inaccordancewithregulation17,theapplicantshallfileareplyonFormGI5settingoutthegroundsonwhichhereliesassupportinghisapplicationandthefacts,ifany,allegedinthenoticeofoppositiontotheregistrationwhichheadmits,andshallatthesametimesendacopyofthereplytotheopponent.

(2)Ifnoreplyisfiledinaccordancewithsubregulation(1),theapplicationshallbedeemedabandoned.

Regulation19.Evidenceinsupportofopposition.

(1)Withintwomonthsofthereceiptofthereply,theopponentshallfilewiththeRegistrarsuch evidence byway of statutory declaration as he desires to adduce in support of hisopposition,andshallatthesametimesendacopyofthatevidencetotheapplicant.

(2) If no evidence is filed in accordance with subregulation (1), the opposition shall bedeemedabandoned.

Regulation20.Evidenceinsupportofapplication.

(1)Withintwomonthsofthereceiptoftheopponent'sevidence,theapplicantshallfilewiththe Registrar such evidence by way of statutory declaration as he desires to adduce insupportofhisapplicationandshallat thesame timesendacopyof thatevidence to theopponent.

(2) If no evidence is filed in accordancewith subregulation (1), the application shall bedeemedabandoned.

Regulation21.Evidenceinreply.

(1)Within twomonths from the receiptby theopponentof the copiesof theapplicant'sevidencefiledinaccordancewithregulation20,theopponentmayfileevidenceinreplybywayofstatutorydeclarationandshall,atthesametime,sendacopyofthatevidencetotheapplicant.

(2)Evidenceinreplyshallbeconfinedtomattersstrictlyinreplytotheapplicant'sevidence.

Regulation22.Furtherevidence.

Nofurtherevidencemaybefiledbyeitherside,exceptthatinanyproceedingsbeforehim,theRegistrarmayatanytimeifhethinksfitgiveleavetoeitherpartytofilesuchfurtherevidenceuponsuchtermsastocostsorotherwiseashemaythinkfit.

Regulation23.Exhibits.

(1)Wherethereareexhibitstoanystatutorydeclarationfiledasevidenceinanopposition,thepartyfilingthemshall,ontherequestandatthecostoftheotherparty,sendtohimacopyorimpressionofeachexhibit.

(2)Inallcases,theoriginalexhibitsfiledwiththeRegistrarshallbeopenedforinspectionattheOfficebytheotherside.

Regulation24.Extensionoftime.

Whereinoppositionproceedingsanyextensionoftimeisgrantedtoanyparty,theRegistrarmaythereafter,ifhethinksfit,withoutgivingthatpartyahearing,granttotheotherparty,onpaymentbyhimoftheprescribedfeeonFormGI13,anyreasonableextensionoftimeinwhichtotakeanysubsequentstep.

Regulation25.Writtensubmission.

(1)UponcompletionoftheevidencetheRegistrarshallgivenoticetothepartiesofadatebywhichtheymaysendtohimanysubmissionsinwriting.

(2)Thedatementionedinsubregulation(1)shallbeat leastonemonthafterthedateofreceiptbythepartiesofthenoticegivenbytheRegistrar.

Regulation26.Registrar'sdecision.

Assoonasmaybeaftertheexpirationoftheperiodnotifiedinaccordancewithregulation25,theRegistrarshallconsidertheevidenceandanywrittensubmissionsandshallwithintwomonths communicate to the parties inwriting of his decision in thematter and thegroundsforhisdecision.

Regulation27.Securityforcosts.

WheretheopponentortheapplicantdoesnotresideorcarryonbusinessinMalaysia,theRegistrarmayrequirehimtogivesecurityforthecostsoftheoppositionproceedingsforsuchamountastheRegistrarthinksfit.

Regulation28.Notification.

WheretheRegistrardecidestoregisterthegeographicalindication,asprovidedinsection19oftheAct,heshallnotifytheapplicantinwritingrequestinghimtopaytheregistrationfeewithinonemonthfromthedateofthenotification.

Regulation29.Registrationandissuanceofcertificate.(1)Assoonasmaybeaftertheexpirationoftwomonthsfromthedateofthepublicationoftheapplicationundersubregulation16(2)anduponpaymentoftheregistrationfeeunderregulation 28, the Registrar shall register the geographical indication and enter thegeographicalindicationintheRegisterinaccordancewithsection19oftheActandtheseRegulations.

(2)Theregistrationofthegeographicalindicationshallinclude‐

(i)thegeographicalindicationregistered;(ii) thedemarcationof thegeographicalarea towhich thegeographical indicationapplies;(iii)thenameandaddressofthenaturalpersonorlegalentityinwhosenametheindicationisregistered;(iv)thenameandaddressoftheagent,ifany;(v) theaddress for service if anagenthasnotbeenappointed inaccordancewithsubsection11(2)oftheAct;(vi)thegoodsforwhichthegeographicalindicationisused;(vii) the quality, reputation or other characteristic of the goods for which thegeographicalindicationisusedandanyconditionsunderwhichtheindicationmaybeused;and(viii)thefilingdateandnumberoftheapplicationaswellasthedateofregistration.

(3)ThecertificateofregistrationofthegeographicalindicationshallbeissuedonFormGI6.Regulation29A.Renewalofregistrationofgeographicalindication.

(1)AnapplicationfortherenewaloftheregistrationofageographicalindicationshallbemadebytheregisteredproprietororhisagentinFormGI17accompaniedbypaymentoftheprescribedfeewithinaperiodofnotlessthanthreemonthsbeforetheexpirationofthelastregistrationofthegeographicalindication.

(2) If the person who files Form GI 17 is other than the registered proprietor or hisauthorizedagent,thepersonshallenterintheformhisnameandaddressandshallattachaletterofauthorityfromtheregisteredproprietorauthorizinghimtorenewtheregistrationofthegeographicalindication.

Regulation29B.Reminderofrenewalofregistrationofgeographicalindication.(1) If on a date of not less than onemonth and not more than twomonths before theexpirationofthelastregistrationofageographicalindication,FormGI17accompaniedbypaymentoftheprescribedfeehasnotbeenreceived,theRegistrarshallnotifytheregisteredproprietorinwritingoftheimpendingexpirationofthelastregistrationofageographicalindication.(2)Anysuchnotificationmaybemadeinaccordancewithsubregulation12(5).Regulation29C.Laterenewalsofregistrationofgeographicalindication.

IfwithinsixmonthsfromtheexpirationofthelastregistrationofageographicalindicationtherenewalfeehasnotbeenpaidandifFormGI18isfiledaccompaniedbypaymentofthelate renewal fee, the Registrar shall renew the registration without removing thegeographicalindicationfromtheRegister.

Regulation29D.Removalofgeographicalindication.

TheRegistrarshall,ontheexpirationof the lastregistrationofageographical indication,removethegeographicalindicationfromtheRegisterifthelaterenewalfeehasnotbeenpaidbytheendoftheperiodofsixmonthsreferredtoinregulation29C.

Regulation29E.Restorationofgeographicalindication.

The Registrar may, upon such conditions as he may think fit, restore the geographicalindicationthathasbeenremovedfromtheRegisterandrenewitsregistrationifFormGI19isfiledtogetherwithFormGI18accompaniedbypaymentofthelaterenewalfeewithintwelvemonthsfromtheexpiryofthelastregistrationofageographicalindication.

Regulation29F.Recordofremovalofgeographicalindication.

WhereageographicalindicationhasbeenremovedfromtheRegisterfornon‐paymentoftherenewalfeeorlaterenewalfee,theRegistrarshallenterintheRegisterarecordofsuchremoval and the cause of the removal and shall advertise the fact of the removal in theGazette.

Regulation29G.Noticeandadvertisementofrestorationofgeographicalindication.TheRegistrarshall,upontherestorationofageographicalindication,notifytheregisteredproprietorofsuchrestorationandadvertisesuchrestorationintheGazette.Regulation30.Cancellationorrectificationofregistration.

(1) An application to the Registrar under section 22 of the Act for the cancellation orrectificationofregistrationofaregisteredgeographicalindicationfromtheRegistershallbemadeonFormGI7andshallbeaccompaniedbyaprescribedfeeandastatementsettingoutfullythenatureoftheapplicant'sinterest,thefactsuponwhichhebaseshiscaseandthereliefwhichheseeks.

(2)AcopyofFormGI7shallbeservedbytheapplicantontheregisteredproprietor.

(3)UponreceiptofFormGI7theRegistrarshallnotifyallpersonshavingtherighttousethegeographicalindicationundersection21oftheActbywayofadvertisementinatleastonenationallanguageandoneEnglishlanguagenationaldailynewspapersandthecostoftheadvertisementshallbebornebytheapplicant.

(4) Within one month from the date of the advertisement any persons mentioned insubsections22(3)and(4)oftheActmayapplytobejoinedasapartytotheproceedingbyfilingFormGI8withtheprescribedfeestatingthenatureofhisinterestandanywrittensubmission relating to the application, and a copy of Form GI 8 shall be served on theapplicant.

(5)UponreceiptoftheFormGI8andthewrittensubmission,theapplicantmaysubmitawrittenreplyinFormGI9togetherwithsubmissionandprescribedfee,andshallservethedocumentsontheRegistrarandallpartiestotheproceedings.

(6)TheRegistrar shall upon receiptof all the submissionanddocuments fixedadateofhearingtodeterminewhetherornottheregistrationofgeographicalindicationsshouldbecancelledorrectified.

(7)AtanytimebeforethedateofthehearinganypartiesmaysubmitanyotherdocumentstotheRegistrarforthepurposeofthehearing.

(8)ThedecisionoftheRegistrarshallwithintwomonthsbecommunicatedinwritingtothepartiesandhemayawardanycosttobepaidtoanypartiestotheproceeding.

Regulation31.Publication.

ParticularsofgeographicalindicationsandotherproceedingsundertheActandanyotherinformationrequiredtobeadvertisedundertheActortheseRegulationsshallbepublishedintheGazette.

Regulation32.Amendmentofapplication.

Anyrequesttoamendanapplicationforregistration,whetherornottheamendmentismadetoovercomeanobjectionbytheRegistrar,shallbemadeonFormGI10accompaniedbytheprescribedfee.

Regulation33.Excludeddays.

WhenthelastdayfordoinganyactortakinganyproceedingfallsonadaywhentheOfficeisnotopentothepublicforbusiness,itshallbelawfultodotheactortotaketheproceedingonthedaywhentheOfficeisnextopenforbusiness.

Regulation34.Requestforcopiesofextractsanddocuments.

Requests for certified copies of extracts from the Register or for certified copies ofdocumentsshallbemadeonFormGI11totheRegistrarinwritingandshallbesubjecttopaymentoftheprescribedfee.

Regulation35.EntriesofchangesintheRegister.

The Registrar shall cause to be entered in the Register in respect of each geographicalindicationinadditiontotheinformationindicatedinsubregulation29(2),anychangeswith

respecttosuchinformation,relatingtothename,oraddress,oraddressforserviceindicatedthereininFormGI12withprescribedfees.

Regulation36.Correctionsoferrors.

Correctionsoferrors,referredtoinsection23oftheAct,maybemadebytheRegistrareitheruponreceiptofarequestinwritinginFormGI12withtheprescribedfeesandsubjecttosuchtermsashemayconsiderappropriate,oronhisowninitiative.Anycorrectionshallbecommunicatedinwritingtoallinterestedpersons,and,whereconsiderednecessary,shallbepublishedbytheRegistrar.

Regulation37.Requestforextensionoftime.

Requestforanextensionoftimereferredtoinsection24oftheActshallbesubjecttothepaymentoftheprescribedfeeonFormGI13.

Regulation38.Hearing.

(1)BeforeexercisingadverselytoanypersonanydiscretionarypowergiventotheRegistrarby theAct or theseRegulations, theRegistrar shall notify suchperson, inwriting, of theopportunitytobeheardthereon,andindicatingatimelimit,whichshallnotbelessthanonemonth,forfilingarequestforahearing.

(2) The request for a hearing shall be inwriting on FormGI 14 and shall be subject topaymentoftheprescribedfee.

(3)Uponreceivingsuchrequest,theRegistrarshallgivethepersonapplying,andanyotherinterestedpersons,atleasttwoweeks'notice,inwriting,ofthedateandtimeofthehearing.

(4)Afterhearing thepartyorpartiesdesiring tobeheard, theRegistrar shalldecide thematterandshallnotifyallpartiesofhisdecisionand,ifanypartysodesires,shallgivehisreasonsforthedecision.

(2)TheRegistrarmay,ifhethinksfit,inanyparticularcase,takeoralevidenceinlieuoforinadditiontosuchevidenceandshallallowanywitnesstobecross‐examinedonhisaffidavitordeclaration.
