CHAPTER 1. PROJECT DISCRIPTION

1.1 EXISTING CONDITION OF PROJECT PLAN

Gedong Tataan substation is a substation that was built as an effort to improve the

reliability of the electricity system in Lampung Province. The plan of this substation will

connect to the network SUTT of Natar to Gedong Tataan and from Teluk Ratai to

Gedong Tataan. This substation is one of substation that will be financed by IBRD. This

effort will enable improved security and reliability of electric energy distribution

capacity to meet electric energy needs in Sumatra, especially in the areas through which

the transmission (the Province of Lampung).

A location planned for the construction of substation is a underbrush and former ice

factory buildings which are no longer operated for many years. The closest settlement

location are at + 200 m. Therefore there is no resettlement plan (RP).

1.2 PROJECT LOCATION

Gedong Tataan substation is located in Binong Kampung, Way Layap village, Pesawaran

Regency, Lampung Province. In geographical location, the substation is located at 05 °

23'51, 4 "LS and E 105 ° 03'53, 5" BT.

Current site conditions LARAP survey conducted in November 2011 in the form of

shrub land utilized by the watchman of productive land for seasonal crops of cassava,

maize, vegetables and some coconut trees. The plan to around the location these

substations will be built settlements, boarding school and adjacent to the local

government-owned office building plans.

Building 150 kV Substation consist of 2 line bay, 1 trafo bay 30 MVA and 1 future trafor.

1.4 Land Needed

To build a Gedong Tataan substation is need a land about + (200m x 100m) / 20.000 m2.

CHAPTER 2. INVENTORY OF PEOPLE AND ASSETS AFFECTED

2.1 Inventory of Land and Affected People of Gedong Tataan Substation Location

The total requirement of land needed to build the Gedong Tataan substation is 20,000

m2. All parcels of land to be released is underbrush land and old buildings owned by

private individuals. Landowners location of substation there are 4 brothers listed in one

certificate.

Location data, land owners and land use types that will be used for the construction of

Gedong Tataan Substation are presented in Table 2.1.

Although the need for construction of substations only 20.000m2, all this land will be

purchased by PLN. The owner is the citizen who does not live in that location. They live

in the city and run a trading business. Economically, there was no significant effect on

the owners of this land because it is not used for productive activities. Choice of

compensation form allows them to choose the replacement land, but the initial

consultation at the time of the survey indicate that they prefer cash as a replacement for

the lost land.

All this land was planted by the watchman of land with crops for their own needs. In the

initial consultation, watchman expressed enthusiasm if anyone bought this land because

it will also benefit.

2.2 Land/Building Ownership Status

Ownership status of land is land owned by residents is now a land that has been certified.

In a land certificate owner's name, there are four brothers chinese descent

Most of the land that will be released is the scrub and former ice factory building that has

been damaged. Most of the land was used by watchman of productive land by planting

seasonal crops such as cassava, maize, vegetable oil and there are some plants to meet

their own needs.

2.4 Plants / trees affected by development projects Gedong Tataan Substation

At the initial consultation process with landowners , they just tell that the owner sold the

land without taking account plant contained in the land. Based on survey results in

November 2011, there is no productive hard plants are deliberately planted by the

landowner. Most of the land was used by watchman of productive land by planting

seasonal crops such as cassava, maize, vegetables and there are some coconut trees.

CHAPTER 3. THE VALUE OF ASSETS AND COMPENSATION SCHEME

3.1 Compensation Alternative

The options of replacement for land to be used for build 150 kv Gedong Tataan main

substation has been offered to affected persons.

Option for compensation are as follows :

1. Replacement in form of land the same width and qualities

2. Replacement in form of cash money, according to the market value of assets

affected

3. A combination of the forms described above

4. Forms of other compensation in accordance with the agreement residents.

This is in accordance with Presidential Decree No. 36/2005, Article 13. These choices

also represent an alternative compensation to be offered by PT. PLN (Persero).

3.2 Land Price

To assess the price of land, PLN will use Appraisal Team to deermine the price

established by the local government. The results of land price forecasts issued by the

appraisal team represent comensation prices used during negotiations between PLN,

government and affeced persons. With reference to market prices, The affected land

owners are expected to receive land with a value equivalent to the land previously

owned.

As refference, Harga Nilai Jual Obyek Pajak (NJOP) and the market price for the land

affected by the project presented in the following table:

3.3 Land Certification

All land required for Gedong Ta substation and tower site will be certified after the

entire land acquisition process has been completed. This process will be the

responsibility of PT PLN (Persero). The certification process will be done by the Notary

appointed by PT. PLN (Persero). Since the entire land will be purchased by the project,

then there is no obligation PLN for the certification process or refund the remaining

land to the owner of the land certificate.

CHAPTER 4. CONSULTATION AND DELIBERATION PROCESS

Early socialization of the project has been carried out by distributing questionnaires to

the residents around and meeting with landowners have been conducted in November

2011. Initial consultation to individual landowners who will likely be affected by the

project has been carried out by PLN to obtain preliminary data that exposed assets. At

this early socialization is represented by one landowner named in the certificate of land

which will be used as a substation location plan. From the results of consultations

obtained results basically landowners welcomed the willingness of the PLN to want to

sell their land to be used as building sites Gedong Tataan substation plan with

appropriately priced.

Socialization process that will be done next is to hold a meeting which organized by a

team of Socialization PT. PLN (Persero) UIPRING SMT II. The meeting is expected to

be attended by the Land Procurement Committee consisting of government officials

and village officials, affected people’s (land owners), society in general if necessary

and the PT. PLN (Persero). Will further be an inventory of land and plants that will be

released witnessed by the local village government.

After surveying, consulting and land inventory, then the PT. PLN (Persero) will hold a

meeting of negotiations with the affected people. The meeting will be facilitated and

witnessed by district officials and local villages, compensation payments before being

implemented. Further payment of compensation, in accordance with the form of and

amount of negotiations, openly and knowledge / presented by district officials and

village / local village.

All meeting and inventories results, including minutes of meetings will be documented

and people whose assets are affected by the project will get a copy.

CHAPTER 5. INSTITUTIONAL ARRANGEMENT

5.1 The Main Institution Involved

In accordance with regulation which prevail in the Republic of Indonesia, as well as PLN

policies, the main institution involed in implementing LARAP are follows:

1. Head of PT. PLN (Persero) is responsible for final reporting to the World

Bank.

2. PT. PLN (Persero) UIPRING SMT II is responsible for preparing the

document LARAP, assist in the process of land acquisition and make a

report on the implementation LARAP to head of PT PLN (Persero).

3. Land Acquisition Team PT. PLN (Persero) UPKJS Reg.III responsible for

coordinating the implementation of land acquisition in the field of PT PLN

(Persero).

4. Land Procurement Committee of the Regional Government is a party to

mediate between parties PT PLN (Persero) with affected peoples which

are responsible for overseeing and coordinating the implementation

process of land acquisition of inventory, consultation, deliberation and

negotiation, payment and certification of land.

5. Assessment Team responsible for assessing the price of land assets that

will be affected by the project.

In the process of land acquisition for development projects 150 kV substation, the land

procurement committee which was formed by decree regent / mayor will be involved

because the area for build Gedong Tataan substation swicthyard more than 1 hectare.

The sub-district office and village on the location in question will facilitate the meetings

in the framework of the project as well as dissemination of negotiations between the PT

PLN (Limited) and owners of household land to be used for the location of substation.

5.2 Complain Handling Mechanism

The process of socialization, participation and consultation with affected people’s is

expected to minimize complaints from the public in the future. However, a complaint

handling mechanism has been established so that every affected people’s can be served

and any complaints or problems that arise can be followed up appropriately.

All complaints should be dealt with first by the PT. PLN (Persero) UPKJS Reg.III. in

Lampung. Complaints can be submitted in writing to:

Based on the complaints to be received, PT. PLN (Persero) UPKJS REG III will conduct

research related to the complaints submitted by affected people and will further

respond to the complaint no later than 10 (ten) working days after the complaint is

received.

When people feel less satisfied with the continuation of the PT. PLN (Persero), then the

citizens the right to put a complaint to the Regent.

If the above steps have passed, but residents remain dissatisfied with the decision of the

Regent, then the citizens right to file a complaint / lawsuit to the court to resolve. This

grievance mechanism will be informed to the citizens.

5.3 Monitoring and Reporting

Monitoring the implementation of land acquisition internally by PT. PLN (Persero) in

this case by PT PLN (Persero) UIPRING SMT II and UPKJ S Reg.III. PT. PLN

(Persero) UIP RING SMT II will submit a report on the implementation of land

acquisition to the head PLN and World Bank for any progress or changes that occur in

the field.
