Dear Mr. Aljabiry:

Enclosed for your review and approval is Amendment #7 (Type 3) to the 2019 Federal Transportation Improvement Program (FTIP).

Documentation associated with this amendment is provided as indicated below:

• Project List: Attachment 1 includes a summary of programming changes that result from Amendment #7 to the 2019 FTI P. The project and/or project phases are consistent with the 2018 Regional Transportation Plan (RTP), as amended. The attachment also includes the CTIPs printout for the project changes to the 2019 FTIP via Amendment #7.

• Updated Financial Plan: Attachment 2. The Financial Plan from the 2019 FTIP has been updated to include the project list as provided in Attachment 1. The financial plan confirms that, with this amendment, the 2019 FTIP remains financially constrained.

• Public Involvement: Attachment 3 includes the Public Notice and Adoption Resolution.

• Attachment 4 includes the Grouped Project and/or Back Up Listing.

• Conformity Requirements: The proposed project changes have been determined to be exempt from the requirement that a conformity determination and/or regional emissions analysis be performed per 40 CFR 93.126, 93.127, or 93.128. In addition, the projects and/or project phases contained in Amendment #7 do not interfere with the timely implementation of any approved Transportation Control Measures (TCMs).

• Transportation Performance Management: Attachment 5. The 2012 Federal transportation authorization legislation, 'Moving Ahead for Progress in the 21st Century' (MAP-21) established new requirements for performance management and reporting to ensure the most efficient investment of Federal transportation funds. To incorporate the new Federal performance requirements for Safety (PM 1); Pavement and Bridge Conditions (PM2); and System Performance, Freight, and Air Quality (PM3) into the Federal Transportation Improvement Program (FTIP), Madera County Transportation Commission (MCTC) is required to show (1) that the FTIP "makes progress towards achieving the region's performance targets", and (2) that the FTIP includes, "to the maximum extent practicable, a description of the anticipated effect of the FTIP towards achieving the performance targets."

The MCTC Board voted on February 21, 2018 to approve the Madera safety targets (PM 1) consistent with the state targets and Federal methodology established by the Moving Ahead for Progress in the 21st Century Act. On October 17, 2018 the MCTC Board voted to approve the PM 2 and PM 3 targets. The projects contained in this FTIP Amendment have been developed in accordance with the applicable provisions and requirements of 23 CFR Part 450 and is expected to support the achievement of these targets. These targets will be achieved through the implementation of investment priorities through the programming of transportation projects in the 2019 FTIP, this FTIP Amendment, and subsequent FTIP Amendments and Administrative Modifications.

A 7-day public review and interagency consultation period was completed on August 30, 2019. A public hearing was held at our regularly scheduled Board meeting on September 18, 2019. The final document has been updated to address public comments received. The public participation process for Amendment #7 to the 2019 FTIP is consistent with the MCTC Board adopted Public Participation Plan. On September 18, 2019, the MCTC Board of Directors approved Amendment #7 to the 2019 FTIP. State and Federal approval is required.

Included with this letter are two hard copies of Amendment #7 to the 2019 FTIP. An electronic copy of the four year financial plan will be sent via email. Amendment #7 to the 2019 FTIP is also available on the MCTC Website.

PUBLIC NOTICE AND RESOLUTION

NOTICE OF PUBLIC HEARING ON THE DRAFT AMENDMENT #7 TO THE 2019 FEDERAL TRANSPORTATION

IMPROVEMENT PROGRAM

NOTICE IS HEREBY GIVEN that the Madera County Transportation Commission (MCTC) will hold a public hearing on September 18, 2019, at 3:00 p.m. at the MCTC Board Room at 2001 Howard Road, Suite 201, Madera, CA 93637 regarding the Draft Amendment #7 to the 2019 Federal Transportation Improvement Program. The purpose of the hearing is to receive public comments.

The 2019 FTIP is a listing of capital improvement and operational expenditures utilizing federal and state monies for transportation projects in Madera County during the next four years that are eligible to proceed without a conformity determination.

The Draft Amendment #7 to the 2019 FTIP is a Type 3 amendment that contains project phases and/or projects that have been determined to be exempt from the requirement that a conformity determination and/or regional emissions analysis be performed per 40 CFR 93.126, 93.127, or 93.128. Because the projects are exempt, no further conformity determination is required.

A concurrent 7-day public review and comment period will commence on August 23, 2019 and conclude August 30, 2019 at 3:00 p.m. The draft documents are available for review at the MCTC office, located at 2001 Howard Road, Suite 201, Madera, CA 93637 and on the MCTC Website.

Public comments are welcomed at the hearing or may be submitted in writing by 3:00 p.m. on August 30, 2019 to Jeff Findley at the address below.

This public notice of public involvement activities and time established for public review and comments on the FTIP development process will satisfy the FTA’s Program of Projects requirements.

After considering the comments, the documents will be considered for adoption, by resolution, by the Madera County Transportation Commission at a regularly scheduled meeting to be held on September 18, 2019. The documents will then be submitted to state and federal agencies for approval.

THE 2019 FEDERAL TRANSPORTATION

In the matter of Formal Amendment Type 3 IMPROVEMENT PROGRAM

WHEREAS, the Madera County Transportation Commission (MCTC) is a Regional Transportation Planning Agency and a Metropolitan Planning Organization, pursuant to State and Federal designation; and

WHEREAS, Federal planning regulations require that Metropolitan Planning Organizations prepare and adopt a short range Federal Transportation Improvement Program (FTIP) for their region; and

WHEREAS, Amendment #7 to the 2019 Federal Transportation Improvement Program (2019 FTIP) has been prepared to comply with Federal and State requirements for local projects through a cooperative process between the Federal Highway Administration (FHWA), the Federal Transit Administration (FTA), the State Department of Transportation (Caltrans), principal elected officials of general purpose local governments and their staffs, and public owner operators of mass transportation services acting through the Madera County Transportation Commission forum and general public involvement; and

WHEREAS, Amendment #7 to the 2019 FTIP program listing is consistent with : 1) the 2018 Regional Transportation Plan, 2) the 2018 State Transportation Improvement Program; and 3) the Corresponding Conformity Analysis, as amended; and

WHE-REAS, Amendment #7 to the 2019 FTIP contains the MPO's certification of the transportation planning process assuring that all federal requirements have been fulfilled; and

WHEREAS, Amendment #7 to the 2019 FTIP meets all applicable transportation planning requirements per Title 23 CFR Part 450; and

WHEREAS, projects submitted in Amendment #7 to the 2019 FTIP must be financially constrained and the financial plan affirms that funding is available; and

WHEREAS, Amendment #7 to the 2019 FTIP meets the transportation conformity provisions of 40 CFR Part 93; and

WHEREAS, Amendment #7 to is consistent with the adopted Conformity Analysis for the 2019 and 2018 RTP; and

WHEREAS, Amendment #7 to the 2019 FTIP does not interfere with the timely implementation of the Transportation Control Measures; and

WHEREAS, Amendment #7 to the 2019 FTIP conforms to the applicable SIPs; and

WHEREAS, a 7-day public review process occurred from August 23, 2019 to August 30, 2019 consistent with the MCTC adopted Public Participation Plan; and

WHEREAS, a public hearing was conducted on September 18, 2019 to hear and consider comments on Amendment #7 to the 2019 FTIP; and

NOW, THEREFORE, LET IT BE RESOLVED,

TRANSPORTATION PERFORMANCE MANAGEMENT

Madera County Transportation Commission Transportation Performance Management

The 2012 federal transportation authorization legislation, ‘Moving Ahead for Progress in the 21st Century’ (MAP-21) established new requirements for performance management and reporting to ensure the most efficient investment of Federal transportation funds. To incorporate the new federal performance requirements for Safety (PM1); Pavement and Bridge Conditions (PM2); and System Performance, Freight, and Air Quality (PM3) into the Federal Transportation Improvement Program (FTIP), Madera County Transportation Commission (MCTC) is required to show (1) that the FTIP “makes progress towards achieving the region’s performance targets”, and (2) that the FTIP includes, “to the maximum extent practicable, a description of the anticipated effect of the FTIP towards achieving the performance targets.”

The MCTC Board voted on February 21, 2018 to approve the Madera safety targets (PM1) consistent with the state targets and federal methodology established by the Moving Ahead for Progress in the 21st Century Act. On October 17, 2018 the MCTC Board voted to approve the PM 2 and PM 3 targets. The projects contained in this FTIP Amendment have been developed in accordance with the applicable provisions and requirements of 23 CFR Part 450 and is expected to support the achievement of these targets. These targets will be achieved through the implementation of investment priorities through the programming of transportation projects in the 2019 FTIP, this FTIP Amendment, and subsequent FTIP Amendments and Administrative Modifications.
