SECTION 2 BACKGROUND In November 2004 the Code of Practice on the Police use of firearms and less lethal weapons came into effect. The code makes specific reference to the standardisation and accreditation of firearms training to specified levels. The National Police Firearms Training Curriculum (NPFTC) was published alongside the codes of practice. This curriculum provides the nationally agreed learning modules and outcomes for all areas of Firearms training. Since May 2004 when the Curriculum was first published Nottinghamshire Police Firearms training team have undertaken extensive work to ensure that the training provided is fully compliant with the requirements of the Curriculum. The National Police Improvement Agency (NPIA) are now commencing a licensing process of Forces to deliver the products in the NPFTC. SECTION 3 AIMS / OBJECTIVES The purpose of this document is to clearly identify the processes and systems to ensure that Firearms training within Nottinghamshire Police is designed, delivered and assessed to meet the requirements of the Force Strategic Threat & Risk Assessment, National Occupational Standards and the National Police Firearms Training Curriculum. This Procedure links to specific Standard Operating Procedures (SOPs) that have been developed for critical processes and practices involved in the provision of Firearms Learning & Development. These are maintained within the Firearms Training Unit. An index of these SOPs is at Appendix A for reference.

SECTION 4 DETAILS ESTABLISHING THE ANNUAL TRAINING REQUIREMENT The annual training plan is devised taking into account a number of key local and national documents, in particular the Force Strategic Threat and Risk Assessment, the National Police Firearms Training Curriculum (NPFTC) and the Manual of Guidance on the Police Use of Firearms. The training plan is devised to ensure that training is provided for all operational AFO roles aligned to the identified modules in the NPFTC. The plan will ensure that all core skills in the NPFTC are refreshed over a maximum 18-month period. This is monitored through management information obtained from the Chronicle data-base The Strategic Threat and Risk Assessment is a key linked document to ensure the training plan is reflective of current and forecasted needs. This includes ensuring the training plan supports any changing tactical deployment requirements, changes to AFO core and specialist role requirements, and succession planning needs for new AFOs and specialist Firearms roles. The key internal roles responsible for developing and maintaining the training plan are the Chief Firearms Instructor HQ(L&D) and L&D Manager – Operational Training HQ(L&D). This is in conjunction with the Chief Inspector for Armed Response HQ(OSD) and the key operational ‘customer’. The Firearms Training and Tactical Review Forum meeting has been established as a formal mechanism to discuss and examine operational needs, to help determine the requirements for the annual training plan, to monitor progress and agree any required changes to the plan. This forum meets on a bi-monthly basis and is chaired by the Chief Inspector for Armed Response. It is recognised there may be circumstances requiring urgent changes to the training plan outside of a scheduled meeting date. In such circumstances these will be agreed between the Chief Firearms Instructor and the Chief Inspector Armed Response and reviewed at the next planned meeting. The Firearms Tactical & Training Forum reports directly to the bi-monthly Firearms Silver Commanders Operations Meeting chaired by the Head of OSD. If significant risks are identified at any stage in being able to deliver the required training to meet Force needs (e.g. insufficient resources) that cannot be managed through agreed adjustment to the training plan, the identified risk should be referred through the Firearms Tactical & Training Forum meeting to the appropriate strategic decision group e.g. the Learning & Development Executive

TRAINING COURSES / EVENTS Appendix A contains details of the course and activities delivered by the Firearms Training team. In considering the most effective means of meeting the training requirement any potential benefits of regional collaboration should be identified. If deemed worthy of further consideration the Chief Firearms Instructor would take these to the Regional Firearms Conference.

4.3.0 4.3.1

DEVELOPMENT OF TRAINING PACKAGES (A detailed Standard Operating Procedure has been developed on ‘Preparing Training Delivery Packs. SOP FAP001. This sets out the process and documents required to ensure the design process are in accordance with the requirements of the NPFTC and the NPIA QA processes.) If it is identified at any stage in the learning design process that there are concerns with the requirements in the NPFTC these should be raised with the Chief Firearms Instructor. Examples of this may include additions that are considered essential to the area of learning, or concerns over requirements in the curriculum. It will be the responsibility of the Chief Firearms Instructor to if they consider appropriate take such issues to the Regional Firearms Conference, and subject to the outcome of the discussion ensure that recommendations to of any changes be made to the NPIA for changes to the NPFTC. (Also see 4.2)

4.3.3 All packages will be stored on the dedicated Firearms drive on the Force LAN.

4.3.4 Packages should be retained for 25 years. This retention time recognises that the

content of a learning event could be needed for considerable years after the event, in the case of a post-incident inquiry, or for issues related to an officer’s health.

4.4.0 ASSESSMENT & VERIFICATION OF STUDENT COMPETENCE

4.4.1 The agreed outcomes for assessment will be those contained in the NPFTC related to the module/area of learning being developed.

4.4.2 If assessment outcomes, other than those in the NPFTC are utilised these must be authorised by the Chief Firearms Instructor prior to use. The reason for their inclusion should be clearly recorded in the training package/assessment documentation.

4.5.0 4.5.1

INITIAL FIREARMS COURSE/INITIAL SPECIALIST COURSES ASSESSMENT A student will be allocated a Firearms Instructor as a mentor (coach/assessor), who will be responsible for the ongoing monitoring and assessment of their development during the course.

4.5.2 Students will be formatively assessed against all significant areas of development

in the course. Feedback on development is on an ongoing basis.

4.5.3 A formative assessment of development will be recorded on a Training Assessment & Progress Record form (Appendix C. Form 2). During the Initial Firearms Course such assessment and form will be completed on an almost daily basis. The record of assessment will be provided to the student once completed. Any development plans will be formulated at that stage.

4.5.4 The student will retain the records of assessment in their training portfolio for the duration of the course.

4.5.5 At the end of each week of training during the initial course/initial specialist training, the student will have a Weekly Review with their mentor (coach/assessor). The purpose of this meeting is to review the student’s overall development against the required standards, the formulation of agreed development plans, and the opportunity for the student to discuss any concerns related to their development needs and progress.

4.5.6 The outcome of the meeting will be recorded on a Course Tutorial form (Appendix C Form 1). The preparation, format, and recording of the meeting will usually be as follows:

- The student will be asked to prepare prior to the meeting by completing their self-assessment of their performance and development on a Course Tutorial form. This will then be provided to their mentor.

- The mentor (coach/assessor) will record their summary feedback of development to date on the same form.

- The mentor and student will then meet to discuss the performance to date. - The outcome of the meeting will be the formulation of an agreed

Development Plan. This will be recorded on the tutorial form. - The student will have the opportunity to make a written response/comment

on the form. - The record of the tutorial will then be passed to the Chief Firearms

Instructor for their written endorsement/comments. - The student will maintain the completed tutorial review form in their

portfolio for the duration of the course.

4.5.7 At critical stages of development during the Initial Firearms Course student will be subject to a Summative Assessment of their performance. These will be in the following areas:

- Qualification shoot for pistol, carbine, baton gun, taser. - Specified tactical training modules

A record of this summative assessment will be made on a Training & Assessment Record Form (Appendix C Form 3)

4.5.8 The summative assessment sets the minimum standards required at a particular point in the development programme. In the case of the Initial Firearms Course and other specialist initial courses if a student fails to achieve the required standards in a summative assessment, they will not be allowed to continue with the course and their development for the role.

4.6.0 ACTIONS RE. STUDENT WHO ARE UNABLE TO ACHIEVE THE SUMMATIVE ASSESSMENT STANDARDS

4.6.1 If a student is unable to meet the required standards in a summative assessment

the assessor will be expected to provide feedback to the candidate of their assessment decision, and support the candidate by providing an explanation of the process that will follow.

4.6.2 The assessor will record their assessment and decision on a Training & Assessment Record, and provide the student with a copy.

4.6.3 The assessor will present a copy of their assessment report to the Chief Firearms

Instructor. 4.6.4 The Chief Firearms Instructor will be responsible for examining the assessment

record and validating the assessment decision. In order to validate the decision they may wish to speak individually to the assessor and the student.

4.6.5 If the assessment decision is validated, the Chief Firearms Instructor will meet

with the student to inform them of their decision. In the case of the Initial Firearms Course and other specialist initial courses if a student fails to achieve the required standards in a summative assessment, they will not be allowed to continue with the course and their development for the role.

4.6.6 4.6.7 4.6.8

It is recognised that if a student is not able to meet the required standards and continue training for a new AFO role that this may be a difficult and emotional experience and every effort will be made to support them through the process. The Chief Firearms Instructor will ensure that the OSD Chief Inspector for Armed Response (or if not available a member of OSD senior management), the officers line manager and Departmental/Divisional HR are informed. It is to be expected that the officer may clearly have concerns about their future role (notably if a student on an initial Firearms Course) and in helping the student every effort should be made to manage the process through which such decision will be made and the timescales. If the assessment decision is not validated then the reasons should be clearly recorded on the assessment record by the Chief Firearms Instructor. The grounds for not validating are:

- The evidence presented does not support the assessment decision - The summative assessment has not been conducted fairly

4.6.9 If the decision is not validated the student will be deemed they have either met the

required standards, or another summative assessment will be organsised. 4.7.0 4.7.1

TACTICAL REFRESHER TRAINING ASSESSMENT AFO’s attend training on a regular basis to provide the opportunity for them to maintain, practice and develop their existing firearms skills in the tactical areas related to their role or specialist skill.

4.7.2 All tactical refresher days will have learning packages prepared in line with

Section 3.0 and the separate SOP (Preparing Training Delivery Packs).

4.7.3 Students will be monitored throughout the learning activity and their learning checked.

4.7.4 It is not intended that individual students will be formally re-assessed during the refresher days, but the trainers for the day will be expected to record areas of noteworthy performance by individuals.

4.7.5 This could be evidence of displays of ‘excellence’. It could also be where the performance is significantly below the required standards and the student therefore subject to a development plan.

4.7.6 Any noteworthy evidence of performance by an individual will be recorded on a Training Assessment & Record form. The individual student will be provided with feedback and provided with a written record on a Training & Assessment Record form (Appendix C FORM 3) during or as close to the refresher day as possible. Any development plans should be agreed on the Training & Assessment record form.

4.7.7 The Training & Assessment Record of the ‘noteworthy’ performance should then be presented to the Head of Firearms training for their review and endorsement.

4.7.8 A copy of the Training & Assessment Record form will be provided to the officer and their line manager. The original copy will be retained with the officer’s training record.

4.7.9 In the case of evidence of noteworthy performance that is below the required standards, it is recognised that the evidence could bring into question the AFO’s ability to perform competently operationally. The Chief Firearms Instructor will ensure that the AFO’s line manager is informed and provided with a copy of the record as soon as possible. The officer’s Inspector and Ch/Insp (Armed Response) should also be notified.

4.8.0 4.8.1

QUALIFICATION SHOOT ASSESSMENT The assessment of Qualification shoots is recorded on a Training & Assessment record form (Appendix C. Form 2)

4.8.2 4.8.3

The requirement for annual qualification shoots and weapon handling skills tests in the various weapon disciplines is contained in the Force Operational Firearms Procedure. This also includes the action if an individual fails to meet the required standards. Firearms Instructors will qualify on all operational weapon types a minimum of twice within any twelve-month period up to, or exceeding, the National minimum standard required for Instructors.

RETENTION/STORAGE/ACCESS REQUIREMENTS FOR ASSESSMENT RECORDS In all cases, student assessments and training records are created in electronic template format and are linked to NPFTC Learning Outcomes. All subsequent student records, including assessments, are created in electronic format, printed and then stored in hard copy in a training record folder for each student. Hard copy records are held in a secure filing system at Firearms Training and are marked Restricted in line with in accordance with procedures and the Government Protective Marking guidelines. Student assessment and training records will be retained in accordance with the Force Disposal Schedule. The Chief Firearms Instructor will be responsible for ensuring that the records are maintained in accordance with the above guidelines and Force Procedures. This post holder will also ensure the records maintained are reviewed on an annual basis, and that those records outside the required retention period are disposed of in accordance with the Force disposal procedure. This will require the shredding of all records due for disposal. The following posts will be allowed to have access to the training records for necessary purposes in accordance with the duties of their role:

- Chief Firearms Instructor - Firearms Trainers - Line Manager of an AFO for that officer’s record - Firearms Gold & Silver Commanders - Head of L&D - L&D Manager - Operational Training - Training Administration for specified access authorised by the Chief

Firearms Instructor It is also recognised that in the case of an investigation, a post incident enquiry, or other exceptional circumstances that other people may reasonably require access to the records e.g. Professional Standards, IPCC, Force Legal representatives etc. In most cases it would be expected that this would be authorised and arranged through the Chief Firearms Instructor (or nominated deputy), or in other exceptional circumstances through the Head of Operational Support or a Firearms Gold Commander. The physical access to view the records will be coordinated through the Chief Firearms Instructor, to maintain security of the records. Documents will not be copied or moved from the Firearms Training Department without the authorisation of the Chief Firearms Instructor.

Individual AFOs will be allowed to view their own records by a request made through the Chief Firearms Instructor.

APPEALS PROCESS There may be occasions when a student is not satisfied with the judgment of their competence during an assessment, or may feel that they have been denied the opportunity for assessment or not dealt with fairly.

4.10.2 It is recognised that complaints can often be resolved between the student and the assessor. If however, this proves not possible then the following process should be followed by the student

4.10.3 The student should contact the Chief Firearms Instructor (or nominated deputy)

who will meet with all parties and attempt to resolve the matter. This will be completed within 2 working days of the appeal.

4.10.4 In the case of a student still not being satisfied with the outcome at this stage they have the opportunity to put their appeal in writing to the Head of Learning & Development. The Head of Learning & Development will consider the grounds of the appeal. This may involve speaking to the student, training staff and viewing the assessment documentation. This process may also require liaison with OSD management.

The Head of Learning & Development will notify the individual of the decision in writing within 5 working days. If the appeal is upheld the Head of L&D will make a recommendation as to any course of future action required for the assessment areas subject of the appeal. If as a result of an appeal as assessment decision is changed then the reasons for this must be clearly recorded with the assessment record. The assessor must be informed of the appeal decision. The decision of the Head of Learning & Development will be final within this procedure. CANCELLATION OF PLANNED TRAINING EVENTS The annual training plan is devised to maximise the use of training resources, and there is limited scope to provide additional training to that planned. Therefore any cancellation of scheduled training events should be kept to a minimum. However it is recognised there will be circumstances of critical operational needs that mean scheduled training will need to be cancelled, or situations where the availability of training resources mean that it would be unsafe to proceed with the training event. In the case of the need to cancel a scheduled training event due to critical operational needs the operational decision and notification to the Chief Firearms Instructor (or nominated deputy) must be by an Officer not below the rank of Chief Inspector in HQ(OSD) or HQ(FCD) in the case of Tactical Unit. A formal written record of the decision, and a brief description of the operational need and considerations must also be sent by email to the Chief Firearms Instructor. This information will be retained by the Chief Firearms instructor for review at the next Firearms Tactical & Training Forum meeting.

In the case of the need to cancel a scheduled training event due the unavailability of sufficient training resources (e.g. Instructors, facilities or equipment) the Chief Firearms Instructor (or nominated deputy) ,should alongside the notification of students, inform the Chief Inspector for Armed Response and the L&D Manager - Operational Training. The reasons for the cancellation should be recorded by the Chief Firearms Instructor for review at the next Firearms Tactical & Training Forum meeting. Information on any cancelled training events, and the established reasons, will be reviewed at the Firearms Tactical & Training Forum. This will include identification of any action required to avoid any further disruption, and the establishment of a plan to meet any training gap for individuals as a result of the cancellation of the particular training event. MANAGEMENT OF HEALTH & SAFETY/RISK ASSESSMENTS The Chief Firearms Instructor will be responsible for ensuring that effective documented risk assessments are conducted for all training activities. This will include both activity based risk assessments and risk assessments of training and tactical training venues. The risk assessments will be recorded in line with the procedure for the management of Health & Safety within the organisation. The Chief Firearms Instructor will also be expected to maintain a register of risk assessments completed for the Firearms training area. The purpose of the register is to provide an overview of the risk management process in place, identify gaps where new risk assessments are required, to ensure that risk assessments are reviewed and updated as required. A copy of the risk assessment register will be provided on an annual basis (in April) to the L&D Manager - Operational Training who will review the risk management processes with the Chief Firearms Instructor. The Chief Firearms Instructor will also meet with the Force Health & Safety Advisor at least once a year to discuss the risk management process for Firearms training. The involvement of the H&S Advisor is in recognition of the complexity of risks involved in this training area, and as a means of seeking to continually improving the processes in place.

4.13.0 TRAINER QUALIFICATIONS COMPETENCE 4.13.1 All trainers involved in the design, delivery and assessment of Firearms training &

development will have successfully have completed a nationally approved programme/qualification as a Firearms Trainer. They will also be expected to hold or be working towards an NVQ Level 3 Qualification in Learning & Development (or equivalent).

4.13.2

In addition they will be expected to be occupationally competent in the area of delivery and assessment. They are also expected to be able to demonstrate and

ongoing programme of continuing professional development to maintain and update their training and operational competence in the subjects they deliver and assess. Assessors, if not already NVQ A1 or L20 accredited, will be required to undertake approved assessor training to NPIA standards.

4.13.4 The Chief Firearms Instructor will plan an annual programme of formal trainer observation, in accordance with L&D departmental procedure, to monitor and quality assure the deliver of training by each trainer. This will also include the monitoring of assessment standards and practices to ensure standardisation of assessments across the team. The plan will also incorporate the monitoring of the quality of Firearms Tactical Advice.

4.14.0 OFFICERS CHANGING AFO ROLES – CONSIDERATION OF LEARNING & DEVELOPMENT NEEDS

4.14.1 It recognised there will be circumstances where an officer changes their AFO role

during their period of service as a Firearms Officer. Each different AFO role is assigned specific skills/modules under the NPFTC. It is therefore important that any change of role is planned so that any individual development needs can be effectively addressed.

4.14.2 In case of it being proposed that an officer should change to a different AFO role

the Departmental Manager responsible for the change should ensure that at the earliest opportunity contact is made with Firearms training through the Chief Firearms Instructor. This is to enable the a gap analysis to be initiated to look at the officer’s AFO training record against the skill/modules required for the proposed new role. This process should be open and transparent to the Officer(s) concerned.

4.14.3 When an officer formally changes AFO role the Chief Firearms Instructor should

be notified by email by the new Line Manager. The change of role will be recorded on the Chronicle database.

4.14.4 Any development required by an officer should be recorded and initiated using the

established PDR processes. Firearms training will be able to provide guidance on the learning & development opportunities required and available.

SECTION 5 LEGISLATIVE COMPLIANCE This document has been drafted to comply with the general and specific duties in the Race Relations (Amendment) Act 2000, Data Protection, Freedom of Information Act, European Convention of Human Rights and other legislation relevant to the area of policing such as, Employment Act 2002, Disability Discrimination Act 1995, Sex Discrimination Act 1975 and Employment Relations Act 1999.
