Nursing homes are places to live where care is available forpeople who need 24-hour nursing care and supervisionoutside of a hospital. Although all nursing homes mustprovide certain basic services, some homes provide specialcare for certain types of clients. For example, some homesprovide services for the head injured, some for those who areventilator-dependent, some for people with AIDS and somespecialize in the care of children.

After you have explored alternatives and you, your family andinvolved professional health care providers agree that anursing home is required, carefully select a nursing carefacility.

Information contained in this directory will aid you inselecting the right nursing home. It is written for you, theprospective resident. If someone else must organize thesearch and make the decisions, it is important that you be asinvolved as possible in the process.

The directory is divided into three sections:

• Section I explains the things you should know when youchoose a nursing home.

• Section II provides information on what to look for whenyou visit a nursing home.

• Section III provides information on the nursing homes inyour region, including location, size, type of ownership andwhether or not the nursing home is certified by the New YorkState Department of Health to provide special services.

SECTION I

Finding aNursing HomePlanning in Advance

Finding the nursing home that will best meet yourneeds can be a difficult and time-consuming task. Themore information you have, the easier this task will beand the more likely that you will find the home that isright for you. Making the decision that a nursing homeis the right place for you and looking around at differenthomes is important to do before you are hospitalizedfor a medical crisis.

Nursing homes generally operate at close to fullcapacity and a particular nursing home may not alwayshave an available opening. It is best to have severalnursing homes in mind should the need arise. With thehelp of your doctor and the hospital discharge planningstaff, realistically assess your medical, nursing andsocial needs and seek facilities that can best meetthese needs. For example, a facility with a strongphysical therapy department might be important if youare recovering from a stroke.

Discuss nursing home placement with your family sothat the eventuality of this possibility will be fullyexplored and your feelings known before a crisisoccurs.

Watch for articles in newspapers and magazines andfor television programs that deal with nursing homes.Pick up information on nursing homes from socialservice agencies or local offices for the aging and localhealth departments. Contact community groups andadvocacy groups. Page 12 lists a number of state andvoluntary agencies that may be able to help.

Ask family and friends about their own experiences. Ifyou know someone who is in a nursing home, visit thatperson and ask questions. Ask questions of keypersonnel at the facilities you visit: the administrator,social work director, nursing director, medical director,for example. Make your own judgments. A caring homeshould welcome both your desire to visit and thequestions you ask.

AdmissionMedical need and method of payment play a large partin admission.

A medical assessment must be performed before youcan be admitted to a nursing home. This assessment isdone by a registered nurse who has been certified toperform the assessment. The assessment is a two-stepprocess and is specifically designed by the State HealthDepartment to evaluate your functional status as wellas your appropriateness for a nursing home. The staterequires that assessment forms be completed foreveryone who applies for residence in a nursing homein New York State. The forms are valid for 30 days forhospitalized individuals and 90 days for those at home.

The nursing home administrator, admissions director ordirector of social services will be able to explainarrangements for your admission to the facility. If youare receiving care in a hospital, your doctor and thehospital social worker/discharge planner will assist inmaking arrangements for your placement, hopefully inthe nursing home of your choice.

Although most people find that the need to enter anursing home comes about after a serious illnesstreated in a hospital, you will be better off if you plan inadvance. If you are applying for admission to a nursinghome from a hospital, speak with the hospital’sdischarge planner. Nursing homes typically do not havemany vacancies, so it is advisable to have severalsuitable facilities in mind. Regulations require formalapplication before you can be placed on a waiting list.Once you’ve made your choices, ask to be placed onthe waiting list. Continue to check the status of yourapplication by calling in regularly to the specific officeswhere you submitted your applications.

New York State regulations require that a hospitalizedpatient on Medicaid who no longer needs inpatienthospital care be placed in the first available bed within50 miles of the patient’s home. By telling the hospitalwhich nursing homes to apply to, you or your familycan influence the location of the eventual placement.

The admissions agreement (also called the financialagreement, admission contract, entrance contract orsome other term) is a legal agreement between thenursing home and the resident to spell out conditionsfor admission. The contract should state the costs,services included and all legal responsibilities of theresident. Ideally, it should also include care (inaccordance with intensity of need), emergencyprocedures and standards of food service (for example,availability of therapeutic diets, kosher diets, etc.).

Ask questions about the contract. Ask your attorney,the nursing home administrator or admissions directorto explain anything that is not clear. Call an advocacygroup with questions. See page 14.

Since the cost of nursing home care in New York State isso high (ranging from $3,000 to $10,000 a month), fewpeople can afford to pay out of their own pocket forvery long. Ninety percent of New York State nursinghome residents are or become reliant upon state andfederal subsidies.

If you have the means and plan to pay with your ownfunds, you will have a much better chance of gettingadmitted to the nursing home of your choice.

Meet with an elder law attorney to get advice on estateplanning, Medicaid, Medicare and long term careinsurance before you apply to a nursing home. The NewYork State Bar Association Referral Service as well asmany local bar associations will provide you with a listof elder law attorneys. Call 800-342-3661 forinformation.

Nursing homes charge a basic daily rate for theservices they provide and these vary from home tohome. Some homes have all-inclusive rates, others havea rate for room and board and add additional chargesfor physician’s services, laboratory tests, physicaltherapy, prescription drugs, etc.

Private pay rates are not regulated. Homes may chargetheir private pay residents whatever they wish. Theserates can be expected to go up at least once a year. Ifyou are planning to pay for nursing home care out ofyour own pocket, ask for a list of services that arecovered by the basic daily rate. Also ask how the ratesare adjusted and how residents are notified ofadjustments. (Under current regulation, this notificationmust occur in writing 30 days prior to any upwardadjustment in the daily rate for a service beingimplemented.)

The basic daily rate must cover room and meals,housekeeping, linen, general nursing care, medicalrecords and services, recreation and personal care.There may be extra charges for items that vary fromresident to resident, such as physical therapy andmedications. Discuss with the home’s admissionsdirector, administrator or social worker what servicesare standard and what additional services might berequired and what they cost.

Homes are permitted to ask for a prepayment or asecurity deposit. The home can ask for no more thanthree months’ prepayment. Prepayment used assecurity must be deposited by the home in an interest-bearing account.

If you leave the home or die, any amount paid to thehome over the cost of services already provided mustbe refunded.

It is illegal for a nursing home to demand or acceptdonations (to a building fund, for example) from familymembers to assure placement of a relative.

Most homes require full financial disclosure fromresidents who will be paying privately. Since manynursing home residents who enter as private payresidents eventually use up their funds and go onMedicaid, the homes want to know how long theresident will be able to pay privately and when to applyfor Medicaid. Once you are eligible for Medicaid, youhave the right to have Medicaid pay for your care (if thehome accepts Medicaid). When this happens, thenursing home should assist in completing the necessaryforms.

In New York State, you may not be moved out of anursing home because you have exhausted yourpersonal resources. Also, your spouse need not spendall his/her personal resources on your care if you areinstitutionalized.

Some homes suggest that funds be placed in a trustthat the home controls, or that the resident’s SocialSecurity checks be made payable directly to the home.The law guarantees residents the right to control theirown financial affairs as long as they are willing and ableto do so, or to assign that responsibility to a friend orfamily member. The nursing home may be given controlover a resident’s finances if no one else is willing tohandle them.

Private long term care insurance policies are becomingmore and more available. They are advertised as apossible alternative to Medicaid or as a way to avoidexhausting resources when nursing home care isneeded. They vary in the coverage they provide andshould be carefully examined before purchasing. In NewYork State, only a few policies are valid. The StateInsurance Department publishes materials comparinglong term care policies offered by different companies.Call 800-342-3736 for more information.

The federal government is now permitting New YorkState to authorize Medicaid without someoneexhausting his/her assets if that person first purchasesa long term care insurance policy sponsored by thestate. Such a policy must cover at least three years oflong term care, six years of home care or an equivalentcombination of both. Once an individual purchasessuch a policy and once the benefits for such a policyare exhausted, that person, if income eligible, will beeligible for Medicaid payment for long term care for theremainder of his/her life without consideration of his/her assets. Most importantly, however, whatever assetsthat person has will be protected and will not have tobe used to meet long term care costs. You may hearthis type of insurance referred to as a "partnership"long term care policy.

Medicaid, established by Congress in 1965, is agovernment health insurance program for people of allages whose income is too low to provide for routinehealth care costs, or whose health care costs are toohigh to be covered by their income. This healthinsurance covers the cost of nursing care for as long asthe care is required, if a resident is eligible.

A comprehensive application process is used to deter-mine eligibility for the Medicaid program. This processrequires that applicants provide detailed informationand documentation regarding income and assets.

A Medicaid applicant must be a citizen or permanentresident in the United States, must meet New York Stateincome and resource limitations and must showmedical need.

Currently, a Medicaid recipient in a nursing home isallowed to retain $50 of monthly income as a personalneeds allowance to meet personal expenses that are notcovered by Medicaid. Call your local Department of SocialServices office for additional information on Medicaid.

Medicare is a federal health insurance program fordisabled people and people over age 65. Skilled nursingservices must be needed on a daily basis to be eligiblefor Medicare. Medicare will pay a maximum of 100 daysof care in an approved nursing facility for patients inneed of skilled care following a hospitalization of atleast three full days. To qualify, the patient must beadmitted to the nursing home within 30 days ofdischarge from the hospital.

Many people leave a hospital and enter a nursing homeexpecting Medicare to continue to pay for healthservices. This is generally not the case. Medicare willnot pay for a nursing home stay if it is determined thatonly custodial care is required, or if skilled nursinghome care and/or rehabilitative services are neededonly on a periodic basis. Under Medicare rules, theneed for skilled nursing care must be daily. Theprogram has a number of specifics about what servicesare included and requires that you be responsible for aco-payment. For further information, contact your localSocial Security office or call 800-772-1213 for a copy ofthe Medicare Handbook.

Visiting the Facility Call the nursing homes you are interested in and makean appointment to meet with the admissions staff(usually a social worker).

Each nursing home has its own policies andprocedures, but all must follow certain state andfederal regulations and respect residents’ rights. A copyof the home’s policies should be available uponrequest. Following is a list of some policies to check:

• complaint procedures;

• the use of personal belongings and furniture;

• the availability of ethnic foods or special dietpreferences;

• room assignments and changes;

• reserving a bed if transferred to a hospital;

• visiting hours (should cover a 10-hour period andtwo meal times);

• emergency procedures;

• self-care;

• phone calls;

• leaving the facility for short visits with family orfriends;

• procedures for handling theft;

• access to personal funds.

Section II of this directory provides more detailedinformation on what you should look for when you visita nursing home.

Nursing homes may be owned by state/localgovernments (public nursing homes), individuals,corporations and religious or charitable organizations.Most nursing homes are not-for-profit businesses(voluntary nursing homes) or businesses operated forprofit (proprietary nursing homes). An individual or anonprofit organization may own or operate more thanone nursing home.

or owner (proprietary nursing home). The governingbody (the board of directors or trustees) is legallyresponsible for the home. The governing body meets toset policies and to adopt and enforce rules andregulations for the health care and safety of theresidents. The type of ownership and management arenot necessarily an indication of the quality of servicethat you would receive.

The person in charge of the day-to-day management of anursing home is called the administrator; theadministrator is appointed by the governing body orowner. Other key personnel include the director ofnursing services, the medical director, the director ofsocial services and the director of admissions.

The administrator of the nursing home must belicensed by New York State, the director of nursingservices must be a registered nurse and licensed byNew York State and the medical director must be alicensed New York State physician.

When you visit a nursing home, look for its license. Itwill be prominently displayed, usually in the lobby.

Standards governing the operation of a nursing homeare set by state regulation (Part 415 of 10NYCRR) andfederal regulation (Part 483 of 42CFR). These standardsintend to assure the highest possible quality of care andmost meaningful quality of life for all residents innursing homes. Standards cover a range ofrequirements including but not limited to residents’rights, clinical services (including nursing, dietary,medical and rehabilitation services, for example), andadministrative (including quality assurance and thephysical environment, for example). Optional servicesare also covered by law (rehabilitation services forresidents with head injuries, long term care services forpeople with AIDS and for ventilator-dependentresidents) and adult day health care services.

Look for the latest state survey (inspection) report ofhow the home met the state and federal standards.

Administration, has the responsibility to monitorquality of care in nursing homes. State surveyorsinspect each New York State nursing home every nineto 15 months. Surveyors interview residents, reviewresidents’ records, inspect the premises and assesscompliance with state and federal standards (seeAppendix A). Surveyors may issue statements ofdeficiencies any time they visit a nursing home. If theneed arises, state or federal survey staff may visitnursing homes more often to respond to complaints byresidents or families or to monitor the progress asnursing homes correct deficiencies.

Based on the results of the inspection and theseriousness of problems noted, the Department ofHealth decides whether to take enforcement action.Repeat problems can result in fines and, in extremecases, closure.

Remember, deficiencies are not necessarily the onlyindication of the quality of the care and administrationof the home. Ask to look at the results of a few surveysso you can see if there is a pattern of deficiencies incertain areas.

Complete results of the most recent survey must beavailable in the facility in a place readily accessible toresidents and visitors without staff assistance. Askquestions about deficiencies, if any, and how they werecorrected. If you have additional questions after leavingthe home, call back with follow-up questions. Or,contact the local office of the New York StateDepartment of Health (see page 21) or the New YorkState Office for the Aging Long Term CareOmbudsman at 800-342-9871.

Illness and the possibility of death are subjects fewpeople find easy to discuss. Yet, these issues deserveconsideration by both you and your family becausethey often involve decisions that may have to be madeif life-sustaining procedures become necessary. Thiskind of decision does not have to be left to the family todecide. Decide in advance with the help of your family.Any course of treatment for you will be much easier todetermine if your wishes are known in advance (seeAppendix E).

Under the New York State Health Care Proxy Law, adultsmay appoint someone they trust to decide aboutmedical treatment should they become unable todecide on their own. See Appendix C for a copy of theHealth Care Proxy form and information about theHealth Care Proxy Law. This form can be duplicated anddoes not have to be executed by an attorney. Additionalcopies are available from the nursing homeadministrator or from the New York State Departmentof Health. Most attorneys in New York State also havethese forms.

Adults can also give specific instructions abouttreatment in advance. Those instructions can be verbalor written, and are referred to as Advance Directives.

The right to decide about treatment also includes theright to decide about cardiopulmonary resuscitation(an emergency treatment to restart the heart and lungswhen breathing or circulation stops). You and yourdoctors should decide in advance whether or not youwant resuscitation measures taken. If you wish, thedoctor will give the medical staff a “do-not-resuscitate”(DNR) order. An explanation of DNR including yourrights under New York State law is included asAppendix D.

Some nursing homes' moral or religious philosophy mayconflict with your wishes about advance directives. Askabout the home's policy regarding advance directives.

Policies covering the rights of residents are establishedby state and federal regulations. The nursing homemust implement and explain these policies to itsresidents and must post a summary of residents’ rights(a residents’ bill of rights) in the building for easyreading. Be sure to notice it and ask any questions youhave about its provisions.

Every resident in a nursing home should receiveappropriate care, be treated with courtesy and enjoycontinued civil and legal rights.

When You VisitA Nursing

HomePhysical Appearance

Take a good look around at everything.

[ ] Do residents have personal belongingsdecorating their rooms?

[ ] Does each resident have at least one comfortablechair?

[ ] Does each resident have his/her own dresser andcloset space with a locked drawer or othersecured compartment?

[ ] Is there an out-of-doors area where residents canwalk or sit and is it used?

[ ] Does the equipment—wheelchairs, therapydevices—appear in good condition?

[ ] Is there a lounge or other area where residentscan entertain visitors privately?

State standards require that a home provide a safeenvironment for residents whether they are mobile orin wheelchairs, whether they are confused or have pooreyesight.

Look for:

[ ] handrails in hallways and other critical places;

[ ] wide, clear walking areas;

[ ] the absence of hazards that might causeaccidents;

[ ] good lighting;

[ ] telephones and large print notices placed so thatwheelchair-bound residents can make use ofthem;

[ ] appropriate inside temperature and whether ornot residents are dressed appropriately;

[ ] clearly marked exits and well-lighted elevators.

Find out if the local fire department participates in firedrills and how often drills are held in the home.

A good home should be clean. Look in the corners ofresidents’ rooms, bathrooms, kitchens, nurses’ stations,

etc., as well as in the main visiting lounges. Look forcleanliness EVERYWHERE.

Unpleasant odors reflect problems. If there is an odor ina particular section of the home, go back to see if it hasbeen eliminated within a reasonable amount of time.This will give you an idea of how long it takes the hometo deal with the cause of the unpleasant odor.

The average nursing home resident is old, sick and frail.A good home is aware that even frail elderly people canhave good days and bad days and can be encouraged tobe more active when they are feeling better andcomforted when they are feeling poorly.

You may be able to judge how successful a home is incaring for residents by observing them withoutinfringing on their privacy.

[ ] Do residents socialize with each other?

[ ] Is there activity in the corridors?

[ ] Are residents engaged in doing things or justsitting in a lounge or in the hallways?

[ ] Are residents neatly dressed and do they appearto be wearing their own clothing?

[ ] Are residents out of bed?

[ ] Do staff interact with residents in a warm andfriendly manner?

[ ] Do staff address the residents by name?

[ ] Do staff respond to someone calling for help?

[ ] Are people assisted in walking for the purpose ofexercising or retraining?

Ask several residents how they keep occupied and whatthey particularly like doing at the facility.

[ ] Do residents share rooms? How many people to aroom?

[ ] Does the facility try to select compatible roommates?

[ ] Are rooms assigned based on severity of illness?

[ ] How does the facility deal with problemsbetween roommates?

Mealtime is an important part of the residents’ day. Tryto visit during meal time and observe the way food isserved and how the staff and residents interact.

[ ] Is food appetizing and of good quality?

[ ] Do residents have an alternative to the mainmenu?

[ ] Are residents encouraged and assisted witheating (if necessary) while the food is served?

[ ] Is this a time when socializing is encouraged?

[ ] Is the dining room clean, attractive and colorful?

Many facilities try to be less “institutional” and usetablecloths, china and silver, enhancing mealtime.

It is hard to observe medical/nursing practices, but youcan ask questions:

[ ] Does the same nurse or aide care for the residentduring each shift?

[ ] Will your family doctor be able to care for you inthe facility?

[ ] If you do not have a private doctor, who will thephysician be and what relationship will you or afamily member have with this doctor?

[ ] How often will visits be made, and how willmedical emergencies be handled?

If you need more than routine medical care, ask if aspecialist can be called in and how this is done. Findout with which hospital(s) the nursing home may beaffiliated.

If you might need speech, physical or special therapy,look at the therapy rooms. If possible, speak to the staffperson in charge.

[ ] How frequently will therapy be offered?

[ ] Can therapies be provided on an optional basisor a for-private-pay basis?

[ ] Is the physician involved in assessing thetherapy and your response to it?

All homes are required to offer activities for residents.As you visit homes, you may find a great difference inthe way activities are offered. Ideally, a program shouldbe designed to fit the interests and skills of each personand be available on a daily basis at various times of theday including weekends.

[ ] Ask if residents are taken out for events in thecommunity. How often? Where do they go?

[ ] Do people in wheelchairs get to participate?

[ ] How often are outside events brought in for theentertainment of residents?

[ ] What activities are provided for bed-boundresidents?

If you will be paying privately for care, ask about the feeschedule and be sure you find out what services andsupplies ARE NOT INCLUDED and what these items willcost.

To determine how often fees increase, ask how oftenfees increased in the past and what the increases were.

State law prohibits residents from being asked to paymore than three months in advance upon admission.(People admitted under Medicare do not have to payanything in advance.)

The last state inspection report (survey) should beavailable to you in a place within the facility that isreadily accessible. It will tell you if the facility failed tomeet any areas of the state’s health code. Look for thisreport. If there are any deficiencies noted, specificallyask what steps have been taken to correct theseviolations.

GlossaryAdvance DirectivesA verbal or written instruction plan in advance of incapacitating illness or injury, whichensures that the resident’s wishes about treatment will be followed. This includes but is notlimited to a health care proxy, a do-not-resuscitate (DNR) order recorded in the resident’smedical record and a living will.

Basic ServicesThose services included in the daily rate. At the time of admission, a written copy of thefollowing basic services must be made available to all residents:

• the daily, weekly or monthly rate;

• board, including therapeutic or modified diets, as prescribed by a doctor;

• lodging—a clean, healthful, sheltered environment, properly outfitted;

• 24-hour-per-day nursing care;

• the use of all equipment, medical supplies and modalities used in the care of nursinghome residents, including but not limited to catheters, hypodermic syringes andneedles, irrigation outfits, dressings and pads, etc.;

• fresh bed linen, as required, changed at least twice weekly, including sufficientquantities of necessary bed linen or appropriate substitutes changed as often asrequired for incontinent residents;

• hospital gowns or pajamas as required by the clinical condition of the resident, unlessthe resident, family member or designated representative elects to furnish them, andlaundry services for these and other launderable personal clothing items;

• general household medicine cabinet supplies, including but not limited tononprescription medications, materials for routine skin care, dental hygiene, care ofhair, etc., except when specific items are medically indicated and prescribed forexceptional use for a specific resident;

• assistance and/or supervision, when required, with activities of daily living, including butnot limited to toileting, bathing, feeding and assistance with getting from place to place;

• services, in the daily performance of their assigned duties, by members of the nursinghome staff assigned to resident care;

• use of customarily stocked equipment, including but not limited to crutches, walkers,wheelchairs or other supportive equipment, including training in their use whennecessary, unless such items are prescribed by a doctor for regular and sole use by aspecific resident;

• activities program, including but not limited to a planned schedule of recreational,motivational, social and other activities together with the necessary materials andsupplies to make the resident’s life more meaningful;

• social services as needed;

• physical therapy, occupational therapy, speech pathology services, audiology servicesand dental services, on either a staff or fee-for-services basis, as prescribed by adoctor, administered by or under the direct supervision of a licensed and currentlyregistered physical therapist, occupational therapist, speech pathologist, qualifiedaudiologist or registered dentist.

Designated RepresentativeThe individual or individuals designated to receive information and to assist and/or act onbehalf of a particular resident to the extent permitted by New York State law. Therepresentation occurs by a court of law if sought; by the resident if he or she has thecapacity to make such a designation; or by family members and others who have an interestin the well-being of the resident. The name of the designated representative must be notedin the resident’s clinical record at the facility.

The designated representative: (1) receives any written and verbal information required tobe provided to the resident if the resident lacks the capacity to understand or make use ofthe information, and receives any information required to be provided to both the residentand the designated representative; (2) participates (to the extent authorized by New YorkState law) in decisions and choices regarding the care, treatment and well-being of theresident if such resident lacks the capacity to make decisions and choices. These decisionsare not the same as those made by a health care agent unless the same person has beenappointed both the designated representative and the health care agent.

Governing BodyThe policymaking body of the facility, the board of directors or trustees of the facility or theowner or owners of the facility.

Health Care AgentSomeone appointed by the resident to decide about treatment if the resident becomesincapable of making decisions for himself or herself. The resident has the right to appointsomeone by filling out a form called a Health Care Proxy. These forms should be available atthe facility, should be kept at the facility and made known to the medical staff.

Health Care ProxyA document that delegates the authority to another individual known as a Health CareAgent to make health care decisions on behalf of the resident when that resident isincapacitated.

Nursing HomeA facility (subject to Article 28 of the New York State Public Health Law) providing lodgingfor 24 or more consecutive hours to three or more nursing home residents who are notrelated to the facility operator by marriage or by blood, who need regular nursing servicesor other professional services, but who do not need the services of a general hospital.

ResidentAn individual who has been admitted to and who resides in a long term care facility(nursing home) and is entitled to receive care, treatment and services required by New YorkState law.

Appendix ANursing Home InspectionsThe U. S. Department of Health and Human Services has developed a national process fornursing home inspections to ensure quality care. In New York State this is carried out by theDepartment of Health. The state's survey team most often includes a nurse, dietitian,sanitarian and social worker, but other health professionals such as physicians, physicaltherapists and pharmacists may also participate. Surveyors spend most of their timeevaluating the care and services residents receive. Surveyors observe meals, drugadministration and recreational activities and also speak with residents and their familiesregarding the treatment they receive and their opinions about the nursing home.

The inspection survey includes the following steps:

• touring the nursing home;

• meeting with staff and administrators;

• meeting with members of the resident council and/or other residents;

• assessing the safety of the building;

• observing meals to assure that residents' nutritional needs are being met;

• interviewing nursing home residents, examining residents' medical records andobserving clinical procedures; and

• summarizing the results of the survey and reporting findings to the nursing homeadministrator.

Every nursing home receives a copy of the Department of Health's most recent surveyreport and federal law guarantees the report be made available for inspection by the public.

How can I appoint a health care agent?All competent adults can appoint a health careagent by signing a form called a Health CareProxy. You don’t need a lawyer, just two adultwitnesses. You can use the form printed here,but you don’t have to.

When would my health care agent beginto make treatment decisions for me?Your health care agent would begin to maketreatment decisions after doctors decide thatyou are not able to make health care decisions.As long as you are able to make treatmentdecisions for yourself, you will have the right todo so.

What decisions can my health care agentmake?Unless you limit your health care agent’sauthority, your agent will be able to make anytreatment decision that you could have made ifyou were able to decide for yourself. Your agentcan agree that you should receive treatment,choose among different treatments and decidethat treatments should not be provided, inaccord with your wishes and interests. If yourhealth care agent is not aware of your wishes

Why should I choose a health care agent?If you become too sick to make health caredecisions, someone else must decide for you.Health care professionals often look to familymembers for guidance. But family members arenot allowed to decide to stop treatment, evenwhen they believe that is what you wouldchoose or what is best for you under thecircumstances. Appointing an agent lets youcontrol your medical treatment by:

• allowing your agent to stop treatmentwhen he or she decides that is what youwould want or what is best for you underthe circumstances;

• choosing one family member to decideabout treatment because you think thatperson would make the best decisions orbecause you want to avoid conflict orconfusion about who should decide; and

• choosing someone outside your family todecide about treatment because no one inyour family is available or because youprefer that someone other than a familymember decide about your health care.

A law called the New York Health Care Proxy Law allows you to appoint someone youtrust — for example, a family member or close friend — to decide about treatment if youlose the ability to decide for yourself. You can do this by using a Health Care Proxy formlike the one inside, to appoint your “health care agent.”

This law gives you the power to make sure that health care professionals follow yourwishes. Your agent can also decide how your wishes apply as your medical conditionchanges. Hospitals, doctors and other health care providers must follow your agent’sdecisions as if they were your own.

You can give the person you select, your health care agent, as little or as much authorityas you want. You can allow your agent to decide about all health care or only certaintreatments. You may also give your agent instructions that he or she has to follow.

Can my health care agent be legally liablefor decisions made on my behalf?No. Your health care agent will not be liable fortreatment decisions made in good faith on yourbehalf. Also, he or she cannot be held liable forcosts of your care, just because he or she is youragent.

Is a health care proxy the same as a livingwill?No. A living will is a document that providesspecific instructions about health care treatment.It is generally used to declare wishes to refuse life-sustaining treatment under certain circumstances.

In contrast, the health care proxy allows you tochoose someone you trust to make treatmentdecisions on your behalf. Unlike a living will, ahealth care proxy does not require that you knowin advance all the decisions that may arise.Instead, your health care agent can interpret yourwishes as medical circumstances change and canmake decisions you could not have known wouldhave to be made. The health care proxy is just asuseful for decisions to receive treatment as it is fordecisions to stop treatment. If you complete aHealth Care Proxy form, but also have a living will,the living will provides instructions for yourhealth care agent, and will guide his or herdecisions.

Where should I keep the proxy form after itis signed?Give a copy to your agent, your doctor and anyother family members or close friends you want.You can also keep a copy in your wallet or purseor with other important papers.

APPOINTING A HEALTH CARE AGENT IS ASERIOUS DECISION. MAKE SURE YOUTALK ABOUT IT WITH YOUR FAMILY,CLOSE FRIENDS AND YOUR DOCTOR.DO IT IN ADVANCE, NOT JUST WHEN YOUARE PLANNING TO ENTER THE HOSPITAL.FILLING OUT A HEALTH CARE PROXY ISVOLUNTARY. NO ONE CAN REQUIRE YOUTO DO SO.

about artificial nutrition and hydration(nourishment and water provided by feedingtubes), he or she will not be able to makedecisions about these measures. Artificialnutrition and hydration are used in manycircumstances, and are often used to continuethe life of patients who are in a permanentcoma.

How will my health care agent makedecisions?You can write instructions on the proxy form.Your agent must follow your oral and writteninstructions, as well as your moral and religiousbeliefs. If your agent does not know your wishesor beliefs, your agent is legally required to act inyour best interests.

Who will pay attention to my agent?All hospitals, doctors and other health carefacilities are legally required to honor thedecisions by your agent. If a hospital objects tosome treatment options (such as removingcertain treatment) they must tell you or youragent IN ADVANCE.

What if my health care agent is notavailable when decisions must be made?You can appoint an alternate agent to decide foryou if your health care agent is not available orable to act when decisions must be made.Otherwise, health care providers will maketreatment decisions for you that followinstructions you gave while you were still ableto do so. Any instructions that you write on yourHealth Care Proxy form will guide health careproviders under these circumstances.

What if I change my mind?It is easy to cancel the proxy, to change theperson you have chosen as your health careagent or to change any treatment instructionsyou have written on your Health Care Proxyform. Just fill out a new form. In addition, youcan require that the Health Care Proxy expire ona specified date or if certain events occur.Otherwise, the Health Care Proxy will be validindefinitely. If you choose your spouse as yourhealth care agent and you get divorced or legallyseparated, the appointment is automaticallycancelled.

About the Health Care ProxyThis is an important legal form. Beforesigning this form, you should understandthe following facts:

1. This form gives the person you choose asyour agent the authority to make allhealth care decisions for you, except tothe extent you say otherwise in this form.“Health care” means any treatment,service or procedure to diagnose or treatyour physical or mental condition.

2. Unless you say otherwise, your agent willbe allowed to make all health caredecisions for you, including decisions toremove or provide life-sustainingtreatment.

3. Unless your agent knows your wishesabout artificial nutrition and hydration(nourishment and water provided by afeeding tube), he or she will not beallowed to refuse or consent to thosemeasures for you.

4. Your agent will start making decisions foryou when doctors decide that you arenot able to make health care decisionsfor yourself.

You may write on this form any informationabout treatment that you do not desire and/or those treatments that you want to makesure you receive. Your agent must followyour instructions (oral and written) whenmaking decisions for you.

If you want to give your agent writteninstructions, do so right on the form. Forexample, you could say:

If I am in a coma or unconscious, with nohope of recovery, then I do/don't want....

Talk about choosing an agent with yourfamily and/or close friends. You shoulddiscuss this form with a doctor or anotherhealth care professional, such as a nurse orsocial worker, before you sign it to makesure that you understand the types ofdecisions that may be made for you. Youmay also wish to give your doctor a signedcopy. You do not need a lawyer to fill outthis form.

You can choose any adult (over 18),including a family member, or close friend,to be your agent. If you select a doctor asyour agent, he or she may have to choosebetween acting as your agent or as yourattending doctor; a physician cannot doboth at the same time. Also, if you are apatient or resident of a hospital, nursinghome or mental hygiene facility, there arespecial restrictions about naming someonewho works for that facility as your agent.You should ask staff at the facility to explainthose restrictions.

You should tell the person you choose thathe or she will be your health care agent. Youshould discuss your health care wishes andthis form with your agent. Be sure to givehim or her a signed copy. Your agent cannotbe sued for health care decisions made ingood faith.

Even after you have signed this form, youhave the right to make health care decisionsfor yourself as long as you are able to do so,and treatment cannot be given to you orstopped if you object. You can cancel thecontrol given to your agent by telling him orher or your health care provider orally or inwriting.

Appendix DDeciding about CPR: Do-Not-Resuscitate (DNR) OrdersA Guide for Patients and Families

What do CPR and DNR orders mean?CPR — cardiopulmonary resuscitation —refers to the medical procedures used torestart a patient’s heart and breathing whenthe patient suffers heart failure. CPR mayinvolve simple efforts such as mouth-to-mouth resuscitation and external chestcompression. Advanced CPR may involveelectric shock, insertion of a tube to openthe patient’s airway, injection of medicationinto the heart and in extreme cases, openchest heart massage.

A do-not-resuscitate (DNR) order tellsmedical professionals not to perform CPR.This means that doctors, nurses andemergency medical personnel will notattempt emergency CPR if the patient’sbreathing or heartbeat stops.

DNR orders may be written for patients in ahospital or nursing home, or for patients athome. Hospital DNR orders tell the medicalstaff not to revive the patient if cardiacarrest occurs. If the patient is in a nursinghome or at home, a DNR order tells the staffand emergency medical personnel not toperform emergency resuscitation and not totransfer the patient to a hospital for CPR.

Why are DNR orders issued?CPR, when successful, restores heartbeatand breathing and allows patients to resumetheir previous lifestyle. The success of CPRdepends on the patient’s overall medicalcondition. Age alone does not determinewhether CPR will be successful, althoughillnesses and frailties that go along with ageoften make CPR less successful.

When patients are seriously ill or terminallyill, CPR may not work or may only partiallywork, leaving the patient brain-damaged orin a worse medical state than before theheart stopped. In these cases, some patientsprefer to be cared for without aggressiveefforts at resuscitation upon their death.

Can I request a DNR order?Yes. All adult patients can request a DNRorder. If you are sick and unable to tell yourdoctor that you want a DNR order written, afamily member or close friend can decidefor you.

Is my right to request or receive othertreatment affected by a DNR order?No. A DNR order is only a decision aboutCPR and does not relate to any othertreatment.

Are DNR orders ethically acceptable?It is widely recognized by health careprofessionals, clergy, lawyers and othersthat DNR orders are medically and ethicallyappropriate under certain circumstances.For some patients, CPR offers more burdensthan benefits, and may be against thepatient’s wishes.

Is my consent required for a DNR order?Your doctor must speak to you beforeentering a DNR order if you are able todecide, unless your doctor believes thatdiscussing CPR with you would cause yousevere harm. In an emergency, it is assumedthat all patients would consent to CPR.However, if a doctor decides that CPR willnot work, it is not provided.

How can I make my wishes about DNRknown?An adult patient may consent to a DNRorder orally by informing a physician, or inwriting, such as a living will, if twowitnesses are present. In addition, theHealth Care Proxy Law allows you toappoint someone you trust to makedecisions about CPR and other treatments ifyou become unable to decide for yourself.

Before deciding about CPR, you shouldspeak with your doctor about your overallhealth and the benefits and burdens CPRwould provide for you. A full and earlydiscussion between you and your doctorwill assure that your wishes will be known.

If I request a DNR order, must my doctorhonor my wishes?If you don’t want CPR and you request aDNR order, your doctor must follow yourwishes or:

• transfer your care to another doctorwho will follow your wishes; or

• begin a process to settle the dispute ifyou are in a hospital or nursing home.

If the dispute is not resolved within 72hours, your doctor must enter the order ortransfer you to the care of another doctor.

If l am not able to decide about CPR formyself, who will decide?First, two doctors must determine that youare unable to decide about CPR. You will betold of this determination and have the rightto object.

If you become unable to decide about CPR,and you did not tell your doctor or othersabout your wishes in advance, a DNR ordercan be written with the consent of someonechosen by you, by a family member or by aclose friend. The person highest on thefollowing list will decide about CPR for you:

• the person chosen by you to makehealth care decisions under New York’sHealth Care Proxy Law;

• a court appointed guardian (if there isone);

• your closest relative (spouse, child,parent, sibling);

• a close friend.

How can I select someone to decide forme?The Health Care Proxy Law allows adults toselect someone they trust to make all healthcare decisions for them when they are nolonger able to do so themselves, includingdecisions about CPR. You can namesomeone by filling out a health care proxyform, which you can get from yourphysician or other health careprofessionals.

Under what circumstances can a familymember or close friend decide that a DNRorder should be written?A family member or close friend canconsent to a DNR order only when you areunable to decide for yourself and you havenot appointed someone to decide for you.Your family member or friend can consentto a DNR order when:

• you are terminally ill; or

• you are permanently unconscious; or

• CPR will not work (would be medicallyfutile); or

• CPR would impose an extraordinaryburden on you given your medicalcondition and the expected outcome ofCPR.

Anyone deciding for you must base thedecision on your wishes, including yourreligious and moral beliefs, or if your wishesare not known, on your best interests.

What if members of my family disagree?In a hospital or nursing home, your familycan ask that the disagreement be mediated.Your doctor can request mediation if he orshe is aware of any disagreement amongyour family members.

What if I lose the ability to make decisionsabout CPR and do not have anyone whocan decide for me?A DNR order can be written if two doctorsdecide that CPR would not work or if acourt approves of the DNR order. It wouldbe best if you discussed your wishes aboutCPR with your doctor in advance.

Who can consent to a DNR order forchildren?A DNR order can be entered for a child withthe consent of the child’s parent orguardian. If the child is old enough tounderstand and decide about CPR, thechild’s consent is also required for a DNRorder.

What happens if I change my mind after aDNR order has been written?You or anyone who consents to a DNR orderfor you can remove the order by telling yourdoctor, nurses or others of the decision.

What happens to a DNR order if I amtransferred from a nursing home to ahospital or vice versa?The DNR order will continue until a doctorexamines you and decides whether theorder should remain or be canceled. If thedoctor decides to cancel the DNR order, youor anyone who decided for you will be toldand can ask that the DNR order be enteredagain.

If I am at home with a DNR order, whathappens if a family member or friendpanics and calls an ambulance toresuscitate me?If you have a DNR order and familymembers show it to emergency personnel,they will not try to resuscitate you or takeyou to a hospital emergency room for CPR.

What happens to my DNR order if I amtransferred from a hospital or nursinghome to home care?The order issued for you in a hospital ornursing home will not apply at home. You,your health care agent or family membermust specifically consent to a home DNRorder. If you leave a hospital or nursinghome without a home DNR order, a DNRorder can be issued by a doctor for you athome.

Your Right to Decide About TreatmentAdults in New York State have the right toaccept or refuse medical treatment,including life-sustaining treatment. OurConstitution and state laws protect thisright. This means that you have the right torequest or consent to treatment, to refusetreatment before it has started and to havetreatment stopped once it has begun.

Planning In AdvanceSometimes because of illness or injurypeople are unable to talk to a doctor anddecide about treatment for themselves. Youmay wish to plan in advance to make surethat your wishes about treatment will befollowed if you become unable to decide foryourself for a short or long time period. Ifyou don’t plan ahead, family members orother people close to you may not beallowed to make decisions for you andfollow your wishes.

In New York State, appointing someone youcan trust to decide about treatment if youbecome unable to decide for yourself is thebest way to protect your treatment wishesand concerns. You have the right to appointsomeone by filling out a form called aHealth Care Proxy. A copy of the form andinformation about the Health Care Proxy areavailable from your health care provider.

If you have no one you can appoint todecide for you, or do not want to appointsomeone, you can also give specificinstructions about treatment in advance.Those instructions can be written, and areoften referred to as a Living Will.

You should understand that generalinstructions about refusing treatment, evenif written down, may not be effective. Yourinstructions must clearly cover thetreatment decisions that must be made. Forexample, if you just write down that you donot want “heroic measures,” theinstructions may not be specific enough.You should say the kind of treatment thatyou do not want, such as a respirator orchemotherapy, and describe the medicalcondition when you would refuse thetreatment, such as when you are terminallyill or permanently unconscious with nohope of recovering. You can also giveinstructions orally by discussing yourtreatment wishes with your doctor, familymembers or others close to you.

Putting things in writing is safer than simplyspeaking to people, but neither method is aseffective as appointing someone to decidefor you. It is often hard for people to knowin advance what will happen to them orwhat their medical needs will be in thefuture. If you choose someone to makedecisions for you, that person can talk toyour doctor and make decisions that theybelieve you would have wanted or that arebest for you, when needed. If you appointsomeone and also leave instructions abouttreatment in a Living Will, in the spaceprovided on the Health Care Proxy formitself, or in some other manner, the personyou select can use these instructions asguidance to make the right decision for you.

Deciding About CardiopulmonaryResuscitationYour right to decide about treatment alsoincludes the right to decide aboutcardiopulmonary resuscitation (CPR). CPRis emergency treatment to restart the heartand lungs when your breathing orcirculation stops.

Sometimes doctors and patients decide inadvance that CPR should not be provided,and the doctor gives the medical staff anorder not to resuscitate (DNR) order. If yourphysical or mental condition prevents youfrom deciding about CPR, someone youappoint, your family members or othersclose to you can decide. A brochure on CPRand your rights under New York law isavailable from your health care provider(see Appendix D).
