PROCLAMATION No. 799/2013

A PROCLAMA nON TO PROVIDE FOR VEHICLE INSlJRANCE AGAINST THIRD PARTY RISKS

WHEREAS, the occurrence of accidents caused by vehicles are escalating from time to time;

WHEREAS, loss of lives, bodily injuries and damages to properties caused by vehicle accidents are creating social problems;

WHEREAS, it is necessary to establish a system for facilitating the provision of emergency medical treatments to victims of vehicle accidents, and to require owners of vehicles to have third party insurance coverage against third party risks;

WHEREAS, during the implementation of the existing proclamation on vehicle insurance against third party risks therein identified problems and issues not incorporated, as a result it has been found necessary to have a law adressing these issues and other related issues;

NOW, THEREFORE, in accordance with Article 55( I) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

1. Short Title

PART ONE

GENERAL

This Proclamation may be cited as the "Vehicle Insurance Against Third Party Risks Proclamation No. 799/2013".

2. Definitions

In this Proclamation unless the context otherwise requires:

II "certificate of insurance" means a document issued to a vehicle owner or other person having legal obligation ascertaining that the said vehicle has an insurance coverage against third party risks in accordance with the provisions of this Proclamation;

2/ "insurance company" means a company licensed to undertake general insurance business in accordance with the relevant law;

3/ "insured" means any person to whome insurance is issued in accordance with this Proclamation against third party risks due to vehicle;

4/ "insurer" means an insurance company ISSUing the appropriate Insurance coverage In accordance with this Proclamation against third party risks due to vehicle;

51 "vehicle" means any wheeled motor vehicle, semi trailer or trailer for use on the road with the exception of wheelchair and bicycle;

6/ "motor vehicle" means a vehicle moving on a road by mechanical or electrical power;

71 "trailer" or "semi-trailer" means a vehicle which has not its own motor power and which is capable of being attached and drawn by a motor vehicle;

8/ "insurance policy" means a contract whereby an insurer undertakes to pay compensation and cost of emergency medical treatment to any third party for death, ·bodily injury or damage to property caused by the vehicle of an insured person;

9/ "road" means any highway, urban or rural street, parking or tenninal. bridge or any other passage used by a vehicle;

10/ "third party" means any person other than the insured person, member of the insured person's family, the driver or employee of the insured person to which an insurance policy applies at the time when vehicle accident occurred giving rise to liabi lity under such insurance policy;

I 1/ "yellow card" means a certificate issued for the payment of compensation as per the protocol signed in relation to vehicle insurance against third party risks by member states of the Common Market for Eastern and Southern Africa;

12/ "Ministry" means the Mini~try of Transport;

13/ "family" means the spouse, child, father or mother of the insured person or a person under the support of the insured person;

14/ "premium tariff' means payment, the amount of which to be detennined by the government, made by the insured to the inSurer to purchase the insurance policy provided under this Proclamation;

15/ "fund tariff' means a contribution to the Il,surance Fund collected by applying percentage or any alternative means on top of the premium tariff detennined by the government;

16/ "emergency medical treatment" means a medical service provided to any person who have sustained injury as a result of vehicle accident at the site of the incident,' while on the route to a medical institution and in the emergency ward of the medical institution;

17/ "compensation" means the amount of money to be paid by an insurance company or by the Agency, as the case may be. to victim of vehicle accident;

18/ "boJil)' injury" means any bodily injury or functional disorder on any part of the body's natural order sustained by a victim of vehicle accident and includes temporary, partially permanent or fully pennanent bodily injury;

19/ "Agency" means the Insurance Fund Administration Agency to be established by regulation of the Council of Ministers;

20/ "Board" means Board ofthe Agency;

21/ "person" means any natural or juridical person;

22/ any expression in the masculine gender includes the feminine.

3. Requirement of Vehicle I nsurance Coverage

1/ No person may drive, use or cause or permit any other person to drive or use a vehicle on a road unless he has a valid vehicle insurance coverage against third party risks in relation to such vehicle.

2/ Notwithstanding the provision of sub­article (I) of this Article, the Ministry may determine vehicles to be drived or to be used on a road without requiring vehicle insurance coverage against third party risks; the Ministry shall issue directive implementing compensation to victims .

PART TWO

INSURANCE POLICY

4, Issuance of Insurance Policy Against Third Party Risks

1/ Vehicle insurance policy against third party risks shall be issued by insurance companies.

2/ A policy issued pursuant to sub-article ( I ) of this Article shall cover the compensation payable for death, bodily injury, damage to property and the expenses of emergency medical treatment arising from the insured vehicle.

31 Any insurance company transacting general insurance business shall be obliged to issue the vehicle insurance policy . against third party risks provided under this Proclamation.

41 The premium tariff applicable to vehicle insurance policy against third party risks shall be determined by the Council of Ministers based on the study carried out and submitted by the Agency.

51 Notwithstanding the provision of sub­article (4) of this Article, with regard to insured persons and drivers with repetitive vehicle accidents, the Ministry shall issue directive as to the applicable measure based on the study carried out by the Agency.

5. Restrictions on the Scooe of Application of Insurance Policy

A certificate of ' insurance issued in accordance with this Proclamation may not make restrictions on the obligations of the insurer to pay compensation on grounds of:

I I the age or physical or mental conditions of the person driving the vehicle;

21 the conditions, the horsepower, cylinder capacity or value of the vehicle;

31 the number of persons, the weight or physical characteristics of the goods or the particular apparatus, that the vehiele carries; or

41 the time at which or the area within which the vehicle is used.

6. Conditions of Insurance Policy

1/ Any condition In insurance policy providing:

a) no liability may arise under such policy; or

b) any liability so arising shall cease in the event of some specified thing being done or not to be done after the happening of the event giving rise to a claim under the pol icy;

may have no effect.

2/ Nothing in sub-article (I) of this Article shall be deemed to render void any provision in insurance policy requiring the person insured to repay to the insurer any sum which the latter may have compensated under the policy and which have been applied to the satisfaction of the claims of third parties.

7. Exclusions From Insurance Policy Coverage

With respect to the following vehicle insurance policy against third party risks may not be applicable:

1/ death or bodily injury or damage to property of the insured person or member of the insured person's family;

2/ collision or death or bodily injury or damage to property caused to a person hired by the insured person and occurred in the course of such employment;

3/ damage to the insured vehicle;

4/ liability in respect of damage to goods carried on the insured vehicle on the basis of rent or payment;

5/ liability in respect of damage to the personal property of insured person covered by insurance policy or damage to property under the control or responsibility or custody of the insured person;

6/ liability in respect of vehicle accident occurred outside the territory of Ethiopia.

8. Prohibitions

No person may, for the purpose of obtaining a vehicle insurance policy, make any false statements resulting in the non-applicability of such policy or commit any act which disentitles him to claim under such policy.

CERTI FlCATE OF INSURANCE

9. Issuance of Certificate of Insurance

1/ An insurance company shall issue a certi ficate of insurance to the insured person at the same time when it issues an insurance policy.

2/ A certificate of insurance issued pursuant to sub-article (I) of this Article shall include the following particulars:

a) name and address of the insured;

b) identification plate, chassis and motor numbers of the vehicle;

c) the time of commencement and expiry of the insurance policy;

d) conditions subject to which the insurance policy is issued;

e) persons or parties entitled under the insurance policy; and

f) name and address of the insurer.

3/ The insurer shall endorse on the certificate of insurance a declaration to the effect that the insurance policy to which the certificate is issued complies with the requirements of this Proclamation.

4/ Upon termination or the expiry of the insurance policy, the insured person shall immediately hand over to the insurer the certificate · of insurance and the insurance sticker.

10. Validity of Certificate of Insurance

1/ A certificate of insurance issued in accordance with Article 9 of this Proclamation shall be valid for not less than one year from the date of issuance.

2/ Notwithstanding the provisions of sub­article (I) of this Article a certificate of insurance may be issued for a period that correspond to the period of insurance policy issued for less than one year on the basis of sufficient grounds. The Ministry shall, when necessary, issue directive on the implementation of same based on the recommendation submitted by the Agency.

I I. Duty to Give Information

1/ The insured person shall, where requested by or on behalf of a person entitled to compensation, provide information on:

a) whether the vehicle is insured or not; and

b) the conditions speci fied in the certificate of insurance pursuant to Article 9 of this Proclamation.

2/ Without prejudice to sub-article (I) of this Article, the insurer shall furnish the necessary information to the Agency in accordance with the directive to be issued by the Ministry.

3/ When requested by any law enforcement body or medical institution as to the certificate of insurance issued by the insurer, it shall provide the appropriate information within 24 hours.

12. Insurance Stickers

1/ Any insurer shall provide the insured insurance sticker together with corresponding certificate of insurance.

2/ In case of a vehicle having windscreen the insurance sticker issued for the vehicle shall be displayed fully on the windscreen.

3/ The insurance sticker for a trai ler or a vehicle without windscreen shall always be kept with the driver.

1/ The non-possession of an insurance sticker shall constitute a prima facie evidence that the vehicle has not been insured and the police shall have the power to detain such vehicle until the appropriate certificate of insurance is presented.

21 The absence of valid insurance stick-er shall indicate absence of valid insurance pol icy when the vehicle is dri ven or being used on a road. Unless the appropriate certificate of insurance is presented' it shall be deemed that the owner of such vehicle or the person legally responsible or the person who caused or pennitted the vehicle to be dri ven or used on a road or the person driving or using the vehicle, as appropriate, violated the provision of this Proclamation.

14. Issuance of Replacement

The insurer shall, upon the request of the insured person, issue a replacement certificate of insurance or an insurance sticker where it is lost or mutilated.

PART FOUR

LIABILITY TO BE COVERED BY INSllRANCE

15. Obligation of the Insured

The insured shall secure insurance coverage for liabilities arising from:

II collision, fire or explosion caused by the insured vehicle;

21 the fall of objects carried by the vehicle, its accessories or tools being used in connection with the vehicle; and

31 any damage resulting from the movement of the vehicle.

16. Extent of Liability

liThe amount of compensation to be covered by vehicle insurance policy against third party risks shall be:

a) an amount not less than Birr 5,000 and not exceeding Birr 40,000 in respect of the death of one person;

b) an amount not exceeding Birr 40,000 in respect of bodily injury of one person; or

c) an amount not exceeding Birr I 00,0 flO in respect of damage to property.

2/ The medical expenses incurred for the injured person and costs related to other compensations in accordance with the relevant law shall be considered as part of the amount of compensation to be paid in respect of penn anent bodily injury or death of the victim.

3/ Any person who alleges to be entitled to compensation above the limit provided for under sub-article (I) of this Article shall have the right to claim same from the insured person or from other having legal liability in accordance with the relevant law.

4/ The extent of pennanent bodily injury caused to a person by a vehicle accident may be determined by a medical board.

5/ The Council of Ministers is hereby empowered to amend the extent of liability limit provided under sub-article (1) of this Article.

17. Notice of Accident and Claim for Com pensation

1/ The insured person shall, unless prevented by the existence of force majeure, give to the insurer notice of an accident caused by the insured vehicle immediately or at the latest within 10 days from the date of the occurrence of such accident.

2/ Any third party entitled to compensation may submit his claim, together with supporting evidences, directly to the insurer.

18. Duty to Execute Court Judgement

1/ Where a judgement is rendered against an insured person in respect of any liability covered by insurance policy, the insurer shall, notwithstanding that it may be entitled to avoid or cancel or may have avoided or cancelled the policy, pay to the judgement creditors any sum payable under the judgement including costs and interest.

2/ The court that renders the judgement shall issue execution order accordingly.

PART FIVE

INSURANCE FUND

19. Establishment

An Insurance Fund (hereinafter the "Fund") is hereby established as a pennanent source of finance to be deposited in a special bank account to be opened at the National Bank of Ethiopia.

20, Objectives of the Fund

II The Fund shall have objectives, in case of accident caused by uninsured or untraced vehicle, to:

a} provide emergency medical treatment to a person who has sustained injury;

b} provide compensation to a person who has sustained bodily injury; and

c} provide compensation to family members ofa deceased person.

21 The amount of compensation to be paid from the Fund in accordance with sub­article (I) of this Article shall be equivalent to the extent of liability to be covered by vehicle insurance policy against third party risks in accordance with Article 16 of this Proclamation.

31 The Agency shall be entitled to claim its cost incurred in compliance with sub­article (I) and (2) of this Article from the person responsible for the accident.

21. Administration of the Fund

The Fund shall be administered by the Agency.

22. Power and Duties of the Ministry

The Ministry shall have the powers and duties to:

23. Source of the Fund

II The source of the Fund shall be the fund tariff and other additional source to be detennined by the Council of Ministers.

21 The amount of fund tariff to be collected in accordance with sub-artic1e (I) of this Article shall be determined by the Council of Ministers based on the study undertaken by the Agency.

24. Disbursement

Disbursements of the Fund to be made for purposes specified under Article 20 of this Proclamation shall be made in accordance with procedures establ ished by the Board.

25. Audit

The accounts of the Fund shall be audited annually by external auditor to be appointed by the Board.

PART SIX

MISCELLANEOUS PROVISIONS

26. Foreign Registered Vehicle

II The driver of any foreign registered vehicle pennitted to be driven on the roads of Ethiopia shall possess a valid certificate of insurance and insurance sticker or, where the insurance policy is not issued by a local insurance company, he shall produce a yellow card or an equivalent proof of insurance coverage.

21 The insurance coverage agai nst third party risks with respect to an accident caused by foreign registered vehicle while driven on the Ethiopian road may not be less than the extent of liability provided under Article 16 of this Proclamation.

27. Emergency Medical Treatment

II Any person who has sustained injury caused by a vehicle accident shall be entitled to emergency medical treatment costing up to Birr 2,000 whether he is a third party or not as defined under this Proclamation.

21 Any medical institution shall have the duty to provide emergency medical treatment to any victim of a vehicle accident when approached by such victim. .

31 The medical institution shall be entitled to claim its expenses for the emergency medical treatment due to vehicle accident in accordance with the directive to be issued by the Ministry upon the recommendation of the Agency.

41 The medical institution shall be entitled to claim its expenses for the medical treatment due to an accident occurred by uninsured or untraced vehicle directly from the Fund as provided under Article 24 of this Proclamation.

28. Applicable Laws

The provisions of the Commercial Code anq other laws pertaining to insurance shall, in so far as they are not inconsistent with this Proclamation, be applicable with respect to vehicle insurance against third party risks,

29. Power to Issue Regulation and Directive

II The Council of Ministers may issue regulations necessary for the implementation of this Proclamation.

21 The Ministry may issue directives necessary for the implementation of this Proclamation and regulations issued pursuant to sub-article (I) of this Article.

30. Penalty

Any person who violates the provision of this Proclamation or regulations issued pursuant to this Proclamation shall be punished with a fine from Birr 3,000 up to Birr 5,000 or with imprisonment from one year up to two year.

31. Repealed Law

The Vehicle Insurance Against Third Party Risks Proclamation No. 559/2008 is hereby repealed.

33. Effective Date
