DEGREE OF DOCTOR OF PHILOSOPHY

In Commercial Law:Caroline Wambui MwauraThesis Title: Examining the role of intellectual property law in Kenya’s oil and gas sector

Caroline Mwaura holds an LLB degree from the University of Nairobi and an LLM degree from UCT. She began her PhD studies in 2015. Caroline Mwaura’s thesis analyses how Kenya should use intellectual property (IP) law to regulate the country’s oil and gas sector to drive innovation and economic growth within the country’s development plan, Kenya Vision 2030. Her study finds that both IP law and competition law try to accommodate the public interest and the interests of investors. She also finds that regulation of Kenya’s oil and gas sector using IP law is likely to promote innovation and economic growth if the relevant IP laws provide for the protection of IP and public interest. Furthermore, she finds that protection of traditional knowledge (TK) is likely to be relevant to the upstream oil and gas sector in Kenya for environmental resource management;

and she makes proposals for an IP regulatory environment that is likely to address the interests of investors in the industry, local communities in the context of TK and the general public.

DEGREE OF DOCTOR OF PHILOSOPHY

In Education:Garth Francis ShawThesis: Replicating a habitus: trans-planting capital, habitus and doxa in a school start-up

Garth Shaw completed his BSc (Ed) and BEd (Hons) qualifications at Stellenbosch University. Garth Shaw’s thesis considers a case in which the start-up of a new school was led by an existing school. He explains that while the new school sought to serve poorly positioned, historically disadvantaged learners the school leading the start-up served middle class learners. In his thesis he examines the strategies of this school-planting interaction and interrogates the responses of various groups within the new school. In doing so, his study examines the implicit assumptions in practices and arrangements that are considered to be exemplary in a high performing school, and the ways in which these relate to the different needs and experiences of middle class and working-class learners. Garth Shaw’s thesis finds that while there were practical benefits to providing systemic support to the new school there was also a profound disjuncture between assumptions about what constitutes ‘good practice’ in a middle class school as compared to a school that serves the needs and experiences of poorer learners.

Supervisor: Dr H Jacklin (School of Education)

Robyn Dyan ThompsonThesis Title: Teaching intra-active comprehension with picturebooks in a grade three South African classroom

Robyn Thompson has a Bachelor of Education Degree with Honours and a master’s degree in Education from the University of the Witwatersrand. She began her PhD in 2014 whilst teaching at a primary school in Gauteng. Robyn Thompson’s research materialises the notion of Intra-Active Comprehension as a way to describe the rhizomatic, entangled processes of children making meaning through the posthuman pedagogies of philosophy with children and Reggio Emilia. This reconfiguration of comprehension provides a more just and ethical understanding than previously of how the teaching of comprehension e/merges when taking account of how human and nonhuman bodies affect and are affected in a classroom, and how knowledge is always produced relationally. Robyn Thompson’s thesis shows how the use of pedagogical documentation and response-able listening disrupts both humanist binaries and the inequalities set up by the national curriculum, inequalities exacerbated by a didactic, assessment driven school environment. Through the concept of child as phenomenon she explores how the discursive-materiality of the classroom environment, school time practices, and the movements of human and nonhuman bodies affect teaching and learning.
