tions Committee in order to consult with Sec-

retary Fish about the possibility of other Gov-

ernments claiming the right to take advantageof its rirovisions. With a view to obviatingall difficulty or controversy on this jsoint, Sen-

Artillery Ke iew.A review of the artillery of the T. S. war

vessels in Port took place on the 20th of lastmonth, before His Majesty, on the Esplanade.As we were not present on the occasion, wcarc indebted to the officers in command for theparticulars of the review, which by those whowitnessed it arc said to have been very in-

teresting.On the 2Cth nit., the eighth battery of ar-

tillery, from the I". S. ships in harW, was re-

viewed by His Majesty the King, on the Es-

planade. The battery, consisting of five field

howitzers and one Gatling gun, was landed atone o'clock, and drawn up in line awaiting thearrival of the King and mi, upon whose ap-

proach a salute of twenty-on- e guns was fired,

the band playing the Hawaiian Anthem. Thebattery was then prepared for inspection, andHis Majesty and suite, accompanied by Capt.Gherardi and staff, passesd through the ranks,receiving the usual salutes from officers and

men. After tliis the battery passed in review,marching loth in quick, and in double time,with a precision which did great credit, bothto the officers commanding, and to the men in

ranks, and which showed that the instructionsof Lieut. Mason, under whose supervision thedrill took place, were carefully carried out.

After the review, with which, His Majestyexpressed himself highly pleased, severalrounds of cartridges were fired from the Gat-

ling gun, in order to exhibit the rapidity of itsfire. This, to a stranger, was the moat interesting part of the exercise. By the simpleturning of a crank, this wonderful piece scat-

tered its shot with extraordinary rapidity. Atfirst the iron buoy at the left of the Lighthousewas the mark, and the shots fell on it for atime like hailstones. Then the rotary motion

was given to the pioce, and it moved over aradius of perhaps twenty-fiv- e degrees, scat-

tering the shots into the water, which was dis-

turbed as if a shoal of fishes was movingthrough it. Some months ago, the Friend hadan item about this gun, from which we clipthe following :

" Having occasion to visit the Portsmouth wcmade enquiry for the "Gatling gun." Much toour surprise. Captain Skcrrett remarked, tbat therewas a possibility of its discharging 400 charges perminute. He furthermore sta'ed upon the anlhorityof the First Lieutenant, Mr. Clark, who witnessedthe experiment, that a "Gatling" bad been foundcapable of hitting a target at 800 yards, SOS) timesont of 400 shots. Alter the first shot, the gun wascarefully adjusted, aud this result lollowed. Suchare the facilities tbat the gun can be worked bythree men, and in its working the gun moves backaud forward so tbat the bulk-t-s will mow down a

regiment of soldiers, when In line, at a. half miledistance. one o'clock, r. at. a very pretty ceremonyof presenting a flag was enacted on the Es-

planade at the foot of Fort Street. A beauti-ful American regulation flag, six feet in lengthand made of fine silk, was presented to theofficers and men forming the battalion of theNorth Pacific Station. This handsome emblemand stand of colors, was made by Mrs. Dr. I,S. McGrew and Miss Bennett, and was present-ed through Paymaster Caswell, who acted asproxy to the ladies, at the foot of Fort Street,soon after the troops landed. On receivingthe elegant gift, Capt. Gherardi, in response,addressed in true soldierly spirit and bearing,the fair givers in the following words :

amples set us in the past, by Decatur, Ball, Stewart,Farragut, Cashing, and Longs haw; and whenever,or wherever. It becomes oar duty to carry it, wewill remember the fair bands tbat made It."

The men forming the battalion, were drawnup into line for the occasion and after tbe com-

pletion of the ceremony the battalion proceeded on to King Street in front of the Palacegrounds to be reviewed in presence of HisMajesty the King.

Review or V. S. Troop.The dress parade of the troops belonging to

the three U. 8. ships of war in port, on Wed-

nesday of last week, afforded quite an unusualmilitary display, for this quiet little town.

There were eight companies in all, comprising151 men from the Pensacola, 113 from thoPortsmouth, and 3S from the Tuscarora, ex-

clusive of the officers, band-me- n, and fire

brigade, nunuVring 42, in all 347. After thepresentation of a beautiful flag, the ceremonyof which took place upon tlie Esplanade, (be-

fore the review and not after it, as stated byour cotomporary,) the battalion, headed by the

S. McGrew, where, in honor ofthe ladies who had before presented the flag,

a niiliLary salutation was given, arms presented, nnd the colore lowered. After this neatcourtesy they moved along Fort Street to theEsplanade, and enilntrked for their resiectiveships, a numerous crowd following them to

the landing. All the movements of this body

of men showed good practice in the militarydrill and when it is renieniUTeil tliev weremerely sailors under arms, it reflects creditupon that system which has so well preparedone set of men to perform the duties of an-

The Amerioitxt Centennial.Among the officers on the flagship Pensacola

is Brevet Lieut. Col. James Forney, who is in

command of the marine forces of this vessel.He is authorized to receive and forward anyarticles destined for the Exposition at Phila-

delphia, and is prepared to give nuy informa-

tion relative to it which contributors desire to

know. So far as we can learn there is n strongdesire among Hawaiians and foreign residentshere to prepare specimens of their handiwork,but there does not yet exist the incentive to

spur them to action. We have a committee ofthree already appointed, and it has issued a

notice inviting all to participate and send in

their contributions. This is well as far as itgoes ; but something more needs to lie dono to

insure success. We would snggest that theCommittee be increased to five members, theadditional two to include such as are willingto labor for the object in view ; that each havehis duties allotted to him, and that spoiial ef-

forts lie made to disseminate the fullest infor-

mation on the subject and to enlist a more

general interest in this great national exhibi-

tion. There remain but a few months beforeall articles designed for it should be on theway to Philadelphia, and whatever is done

well, must be done soon, nis Majesty feels a

strong desire to see every branch of Hawaiianindustry fully represented on this occasion,and with this object in view has recommendedthai a national appropriation lie made to assistin providing for a display that will do honorto the people an 1 nation. In accordance withthis recommendation, the sum of four thousanddollars has lieen placed at the disposal of theCentennial Committee. It is understood thatall articles sent to tin Exposition will belongto the contributors, and may be sold for theirbenefit or withdrawn by them at its close.

Of this sum havebeen secured by subscription to tbc Centennialstock, and It Is estimated that $2,330,000 more willbe obtained in this way, leaving a million and a halfunprovided for. This last sum, covering theexpenses ol tbe United States Commission, tbeawards and police service. It is thought ought to beappropriated by tbe Government. Tbe Governmentplaus lor the exhibition to be made by tbc depart-ments will require about (V71.000, and PresidentGrant in bis message, on toe subject, recommendstbe appropriation ol this sum. On tbe whole, then,allowing for tbe success in some way of this financial pan of the matter, the Centennial appears to begoing on very well."

den death, which In our minds means, I suppose,from death for which wc are unprepared ; but whoshall say that it ever came before lis best and ap-

pointed time ?

I knew the deceased well, having made his ac-

quaintance among tbe first whom I met In thiscountry. As deputy and clerk of a former AttorneyGeneral, al a practitioner at this liar, and as a fre-

quent companion on circuits, I knew him Inti-

mately. 1 can recall in all onr acquaintance no un-

kind or ungenerous word or act of bis a great dealto say of Impetuous youth. His impulses were tineand generous, I could only hope to be as well pre-pared in all kind feelings towards those about mr,as be was. I fully concur In the resolutions.

Drowned. A report was received on Saturdayby a schooner, which was confirmed on Mouday bythe arrival of the stcimcr that Mr. Frauk HcrvcyHarris, one of tbc proprietors of tbe KiiwikiFlirtation at Hilo, was drowned in crossing iswollen stream near bis plantation, on Fridiyiftrrnoon, Feb. 3Sth. Tbe facts are briefly told in a

letter from Hilo, which wc are permitted to extract :

On Friday morning he left tbc plantation for thetown, on business, ind returned towards evening,taking tbc upper road to bia place. The water intbe gulch between Kiiwiki and Alac was very blghat the time, as it bad beeu raining for a day or twopast. Some of tbe natives saw him coming on tbcother side of the gulch, bat thought nothing of It.

Finding him so long time in crossing OTcr, one ofthe employees went out on tbc bridge, and seeingno signs of him, he turned towards tbcand there his eye met tbc Major's horse, sweptdown by tbc water, abont two hundred fathoms ormore below tbe road. Tbe alarm was given at once,and search wis made, bnt no trace was found ofbim. Tbls was abont 5:30 r m. Scireb wis keptup till late at night, Next morning bis body was

found by two men washed ashore oa Honolii, bisface badly bruised, no clothing of any sort wasfoand ou tbe upper part of his body, except biscollar. He hid bis pants, boots and spars on. That

is, in brief, tbe story relating to bis death."Mr. Harris was about thirty years ol age, and tbc

son of Justice C. C. Harris of the Supreme Court,

who left here on Monday Ust for Hilo. Tbc bodywill probably be brought to Honolulu for interment,by the side of his mother's remains in Nuuanucemetery. Thus, in the prime of life, one of onrmost active and energetic citizens has been calledaway. Tbc widow, father and relatives of the de-

The plaintiff alleire that he inherited thinestate irom one Koo, his father, who diedin the year loSS; that immediately on hisfather's tleecvse, the plaintiff eutored uponthe land and has; continued ever since in

open, notorious, peaceable, uninterrupted,continuous ami adverse, exclusive posses-rao- n

and occupancy, talcing to his own usethe rents and profits, up to the "th of Jan-uary. 1 on which day Kanwa, one of thedefendants, entered upon a portion of theland which had been prepared bv the plaintiff for the cultivation of rice, nod plantedit with kalo, which kalu the plaiutiff imme-diately removed: whereupon Kanwa suedthe plaintiff in the District Court for tres-pass, and the Matristratc gave judgment infavor of the plaintiff.

The bill alleircs that Koo derived his titleas follows : Koo was the original occupierof the land ; that in 1K4A he orally gavehi- - sister Kalnahine, Mauwelc's wife, a lifeinterest in this land ; that in It Kalua-hinedie- d.

and her hnsliand Mauwele sur-rendered the land again to Koo, and him-self died in 1848; in 1851, plaintiff, by di-

rection of his father Koo, pointed out theboundaries of the land to Turner, the gov-ernment surveyor; that in 1853, plaintiff,by direction of his father, went to the LandCommission and took out the Award No.:i71 7. and paid the fee of six dollars; that naidAward was issued in the name of Mauweleby mistake of the party issuing it, and thatit has remained in his possession ever since ;

that said Kanwa. who claims to bo the heirof Mauwele, has made a deed of said landto Koa, one defendants with

suit has liecu brought in regard to this mat-ter and more are threatened by the defend-ant Koa to obtain possession of the land,and as the Award to Mauwele remains as acloud upon the plaintiffs' title to this land,he prays that the deed of Kanwa to Koamay be delivered up to lie cancelled andthat defendants may be enjoined againstbringing any suits at law for possessionof the land in question.

The answer, in brief, asserts thnt thepossession is interrupted because that oneNika lived on the laud after Koo's death,by Kauwa's consent that in 18tt! therewas a proposition made between plaintiffand Kauwa to cvchaniye the land for a landtif plaintiffs' mother-in-la- nnd. on this, theplaintiff lived on land; that Mauweleapplied for the Award nnd diet! in 1851,and that the alleged deed from Kauwa toKoa is only a mortgage.

The allegation in the bill that AwardNo. ;5 1 was issued to Mauwele by mistake,is not insisted on in this appeal.

The plaintiffs' alleged title is by prescrip-tion.

The defendant's alleged title is inherit-ance from Mauwele, to whom the land wasawarded, and the Court is asked by theplaintiff to adjudge his possession to havebeen notorious, exclusive, eaceable and ad-verse for twenty years, and therefore a per-fect title, and to enjoin the defendant fromasserting his tide against this.

The jurisdiction of Courts of Equity togrant injunctions of this character, "isfounded upon the equity of relieving a manfrom the neeessitv of brinirine action afteraction at law for every violation of a common law right, and of finally quieting theright, after a ease has received 6uch fulldecision as entitles a man to be protectedagainst further trials of the right." Kerr'sInjunc, p. 225. But before the injunctioncan be granted the legal right must be es-tablished.

The jurisdiction in respect to titles ofmil estate is in courts of common law.which courts of equity should hesitate toinvade; especially so in the case at bar,where the plaintiff's title is alleged to beby prescription and this is traversed by theansw-er- , and therefore the decision of thecase depends upon facts nnd questions pe-culiarly suitable for trials at law, whereparties can have a jury of the country topass npon the facts.

A title by prescription, if well proven, isa good defense at law, and statutes of lim-itation are enacted to make certain thelength of time of possession which consti-tutes such a title.

The statute of limitations relied upon bythe plaintiff's counsel (Acts of 1870, p. 28,)is entitled "An Act limiting the time with-in which actions may be brought to recoverpossession of land ; and as Washburn saysin his Real IVoperty, 8 vol., p. 440, " Thestatute of limitations in respect to lands,operates as the extinguishment of the one,though not as a gift of the estate to theother."

The operation of this statute would beto extinguish the remedy of the defendantin obtaining possession of the land in ques-tion, unless he brought his action withintwenty years, but it does not make a gift ofthe estate to the plaintiff.

The text-write- rs treat " " asa plea or defense, not as a title npon whichto base a cause of action in cquitv.

Story in his Equity Jurisprudence, S894,states the doctrine thus "A defense cannotbe set up as the ground for a bill in equityfor an injunction, which has been fully andfairly tried at law, although it may be theopinion of the Court that the defense oughtto have been sustained at law."

If, however, the plaintiff in this case hadsuccessfully established this defense in acourt of law to an action brought by thedefendant for the possession of the'land.he would have then some ground for askingthis Court to enjoin the defendant againstbringing further like suits. Bnt it is notcertain if one suit would be sufficient asthe ground of an injunction.

Kerr on Injunctions, p. 134. savs that" the question should depend in all casesupon the fact whether the conscience of thecourt is satisfied as to the result of the trialand not on the number of trials which mayhave taken place."

In the case before us, however, the onlysuit which has been had between the par-ties was the suit in trespass before themagistrate, the gist of which is injury tothe possession, and where the title to thereal estate could not be determined.

The decision of the case at bar requiresadjudication at law.

In Great Britain it required a statute(25 and 26 Virttrria, c 42) to authorizecourts of chancery to pass upon questionsof law and fact, on the determination of

which title to relief or remedy in equitydepends.

In the absence of any such statute inthis country, we feel obliged to decline ju-

risdiction.Having nrrived at this conclusion it is

not necessary to examine and pass upon theproofs offered as to the plaintiff's title byprescription.

King Kalnkana's visit appears to haveput the people and theprees in good humortowards himself and people, so that the dis-

approbation of constituents is less to befeared now by members of Congress in thematter of the Treaty than at any formerperiod j but should the treaty fail the King'svisit will not be lost, for it has raised him-

self and his people in the estimation of hisfriends, and at the same time disabused theminds of those who remember the Sand-wich Islands only as they were in the daysof Captain Cook.

Very important information has reachedus from what we deem an authentic source,to the effect that overtures have licen madeby the Mexican government to that of theUnited States to cede all the territory ofthe former lying north of a Jine of latitudedrawn directly from the mouth of the RioGrande to the Pacific Ocean, and that thematter will engross the attention of Con-

gress at its next session, with the greatestprobability of its acceptance. What arc tobe the considerations for this cession of territory wc are not informed, and it is likelythat the point has not yet been settled.One thing is positive, a number of ourheaviest capitalists and bold operators havevery recently been actively in pursuit ofmines lying in the territory to be ceded.Several in Lower California have alreadychanced hands, and mining engineers havebeen dispatched to Sonora and Chihuahua.It is evident to us that much commotionexists about this matter in certain circles,and that there is good foundation for thereport. By this arrangement the UnitedStates will acquire Nueva Leon, Coahuila,Chihuahua, Sonora, Lower California, andportions of Sinaloa and Durango. It isprobable that the postponement of final de-

cision by the Mexican and American JointCommissions was based upon this consider-ation, and it is not unlikely that the MexicanGovernment may have been influenced bythe attitude of tie United States Govern-ment in reference to Mexican inroads uponour territory. Mexico has need of money,the States named are distant from thecapital, and there are no raitroeds or othereven moderate means of twinei ti..n ; theycannot be controlled by their Federal au-

thorities, and are almost constantly in anuproar. In these and similar reasons maybe found Jie inducements which have ac-
