Inside ABI 70 Event Roundup ABI Hosts Top-Notch Restructuring and Insolvency Event in Italy I n mid-October, ABI hopped across the Atlantic to host the 14th Annual International Insolvency & Restructuring Symposium in Milan, Italy. Nearly 90 attendees from 16 countries enjoyed two days of global bankruptcy education and networking, includ- ing sessions organized by international partners INSOL International, TMA-Europe, International Insolvency Institute and IWIRC. Dr. Ulriike Guérot, founder and director of the European Democracy Lab, presented a keynote on Europe’s future. The program also featured conversa- tions on recent cases by U.S. Bankruptcy Judges Shelley C. Chapman (S.D.N.Y.; New York) and Kevin J. Carey (D. Del.; Wilmington). Also discussed during this global program and cultural exchange were panels on asset-trac- ing, unfair trade practices, schemes of arrangement and the growing convergence of international insolvency regimes. After the first day of programming, participants enjoyed a relaxing dinner and networking at Terrazza Aperol, overlooking the stunning Duomo. Following the conclusion of educational sessions, attendees had the opportunity to enjoy more of the city through optional events that included tours of the La Scala Theatre and Museum and Milan Duomo. In mid-October, ABI hopped across the Atlantic to host the 14th Annual International Insolvency & Restructuring Symposium in Milan, Italy. Nearly

Cross-Border Program Has a Global Focus

Wharton Wins 4th Consecutive Title at Corporate Restructuring Competition A team of students from The Wharton School at the University of Pennsylvania took top honors for the fourth consecutive year at ABI’s 15th Annual Corporate Restructuring Competition. Wharton bested six other teams at the competition, which was held on Nov. 9 at the Gleacher Center at The University of Chicago Booth School of Business. This is the school’s eighth time over-all to receive the Bettina M. Whyte Trophy, which is presented each year to the winning team.

Students were given just a week to solve a hypotheti-cal complex case and present their proposed solutions to judges representing key industry stakeholders (lenders and company board, with a final presentation during a mock confirmation hearing). A team from the University of Chicago Booth School of Business came in second place, while another team from The Wharton School took third.

ABI’s Anthony H.N. Schnelling Endowment Fund provided cash prizes of $6,000, $3,500 and $2,500 for the top three teams, respectively. Other schools compet-ing this year were Columbia Business School, Michigan State University Eli Broad College of Business and New York University Stern School of Business.

The competition concluded with awards and a cock-tail reception. William S. Sugden (Alston & Bird LLP; Atlanta) served as the chair of the event, with assis-tance from Thomas A. Morrow of the Association of Insolvency & Restructuring Advisors. Veterans Day Program in Michigan Honors Nation’s Vets

More than 200 Michigan insolvency practitioners attended the 2018 Hon. Steven W. Rhodes Consumer Bankruptcy Conference on the Veterans Day observed holiday (Nov. 12). This annual one-day program is spon-sored by ABI and the Consumer Bankruptcy Association for the Eastern District of Michigan. This year’s event tackled current issues such as racial bias in the bankruptcy process, student loan discharge-ability developments and the emerging treatment of marijuana assets in bankruptcy cases, while also offer-ing skills-based sessions on appeals and financial liter-acy. Chief Bankruptcy Judge Phillip J. Shefferly (E.D. Mich.; Detroit) also explained more about the new ABI Task Force to assist the nation’s veterans dealing with bankruptcy issues.

The competition was judged by top restructuring professionals from the U.S. and offshore, including Hon. Sage M. Sigler (U.S. Bankruptcy Court (N.D. Ga.); Atlanta).

Gabriel R. MacConaill, 42, died Oct. 14, 2018, in Los Angeles. He grew up in Dover, N.H., and earned his undergraduate degree summa cum laude in 2002 from the University of North Carolina at Charlotte. In 2005, Mr. MacConaill received his J.D. summa cum laude from The Pennsylvania State University Dickinson School of Law. He joined Sidley Austin LLP’s Los Angeles office in 2009 and was named partner in 2014. Mr. MacConaill was a member of the firm’s Restructuring Practice and chaired of the office’s Summer Associate Programs Committee. He was known for providing clients with practical solutions in complicated restructurings and developed a reputation for understanding and putting his clients’ business interests first. Mr. MacConaill was named among The Best Lawyers in America. He is survived by his parents, Susan Treleaven and Stephen Blakney; his wife, Joanna Mae Litt; and his brother Noah Blakney and family. ABI has created a new member committee with a focus on claims trading. The mission of the Claims Trading Committee is to promote the nonpartisan

reporting, analysis and clarification of regulations, laws, court decisions and trends involving claims trading for the benefit of ABI members and all stakeholders in the bank-ruptcy system. In fulfillment of its mission, the Claims Trading Committee is committed to creating a multi-disciplinary community of professionals and thought leaders in the area of claims trading through undertaking meaningful research, producing high-quality educational materials and provid-ing other opportunities for committee members to advance their general knowledge of claims trading.

Finally, the Young & New Members Committee orga-nized a Nov. 20 webinar on the continuing questions sur-rounding the jurisdiction of the bankruptcy courts. Although Congress expanded the power of the courts to decide mat-ters that were “related to” bankruptcy cases four decades ago, the U.S. Supreme Court’s decisions in Stern and Wellness have created uncertainty about bankruptcy court jurisdiction, with which lower courts still struggle, and any litigator handling ancillary matters that relate to bank-ruptcy estates must understand and analyze jurisdictional strategies for the benefit of their clients. The panelists — Ethan J. Birnberg (Ballard Spahr LLP; Denver), Jeffrey C. Krause (Gibson, Dunn & Crutcher LLP; Los Angeles) and Joel A. Gaffney (William F. Davis & Associates, PC; Albuquerque, N.M.) — discussed key issues regarding the limitations of bankruptcy jurisdiction, which include fre-quently litigated issues concerning “related to” jurisdiction, consent for the bankruptcy court to issue final orders, the bankruptcy court’s power to enjoin litigation against non-debtors, the impact of jury demands, standards and strate-gies in withdrawing the reference of matters from the dis-trict court, and issues concerning the appellate process.

New Edition of Preference Defense Handbook Now Available in ABI Store

The preference provi-sions of the Bankruptcy Code are Congress’s attempt to provide equal treatment for pre-peti-tion creditors by allow-ing the trustee or debtor in possession to avoid or recover certain payments made to creditors during the 90 days prior to filing a bankruptcy petition. late moot court competition in the nation, and enjoys an international reputation. This year’s complex case problem involves sev-eral consumer issues arising from circuit conflicts. The problem was developed by Hon. John T. Gregg (U.S. Bankruptcy Court (W.D. Mich.); Grand Rapids) and Paul R. Hage (Jaffe Raitt Heuer & Weiss; Southfield, Mich.). The final-round bench includes Hon. Michael J. Melloy (Eighth Circuit Court of Appeals; Cedar Rapids, Iowa), Hon. Pamela Pepper (U.S. District Court (E.D. Wis.); Milwaukee), Hon. Carla E. Craig (U.S. Bankruptcy Court (E.D.N.Y.); Brooklyn) and Hon. Cecelia G. Morris (U.S. Bankruptcy Court (S.D.N.Y.); Poughkeepsie). More than 15 bankruptcy judges from around the nation will judge the preliminary rounds before the finals. This year, there are two more regional competitions being held ahead of the Duberstein Competition to better assist students in their preparation for New York. CARE CornerCARE Founder Judge Ninfo Honored with Lifetime Achievement Award by NCBJ Credit Abuse Resistance Education (CARE) founder Hon. John C. Ninfo, II has been honored with a Lifetime Achievement Award from the National Conference of Bankruptcy Judges (NCBJ). The award was presented during the “Broken Bench TV Awards,” a plenary session held during the NCBJ Annual Conference in San Antonio in late October. During the award ceremony, Judge Ninfo presented CARE with a $5,000 check and challenged members of the

CARE Recognizes National Volunteer Awards for 2018 Each year, CARE presents three awards during its holiday reception, held in conjunction with ABI’s Winter Leadership Conference in December. The awards pre-sented include Volunteer of the Year, which is given to an outstanding individual for their contributions to CARE; Chapter of the Year, which is given to a CARE chapter that has made an outstanding impact in its community; and Rising Star, which is given to an individual who has made a major impact immediately upon joining CARE. In 2018, CARE is honored to present the following winners of those three award categories. The Volunteer of the Year award goes to Hon. Karen A. Overstreet (ret.), who serves as the coordinator of CARE Seattle. She founded the CENTS Program, a local nonprofit organization that focuses on providing financial education to at-risk populations throughout the community. In partner-ing CARE and the CENTS program, Judge Overstreet has grown its mission to include teacher training and support, assistance for cancer patients experiencing financial trouble and incarcerated populations. Her work has led to one of the first-ever studies of the connections between a cancer diagnosis and filing for bankruptcy. In addition to her deep commitment to local financial education, Judge Overstreet advocates on the state level in Washington to improve and support financial-education efforts. She also serves on the CARE Advisory Board of Directors, leading the CARE Technology and Innovation Committee.

In November, ABI received a kind note from Ed Creel, who was one of ABI’s founders and served as the organization’s first president: “I received the 2018 Annual Report. I was awed by the scope and breadth of the many activities and services offered by ABI. The financial report was certainly different from the early ones I remember. Wow! [ABI Executive Director Sam Gerdano], the staff and the multitude of well-organized members/volunteers should be proud of ABI’s overwhelming success under your leadership. Congratulations!” The Annual Report mailed with the November 2018 issue of the Journal. The Chapter of the Year award goes to CARE Chicago. This chapter has consistently led the way in innovations and reaching as many youths as possible in the commu-nity. During the first half of 2018, the chapter had reached 21 venues with 69 unique presentations, and in the 2018-19 school year has already presented 31 times to area schools. The chapter has also led the way in pioneering a digital way to manage and schedule volunteer opportuni-ties through a program called “Volgistics.” CARE Chicago has additionally aided in the creation of chapters in mul-tiple regions throughout the country, notably Indiana, New Hampshire and Texas.

The recipient of the Rising Star award is Leslie Medina with CARE’s Los Angeles Chapter. Even though she joined in mid-summer 2018, her presence was quickly felt in the area as she worked to revitalize the Los Angeles Chapter with CARE Board Member (and past ABI presi-dent) Jeffrey N. Pomerantz (Pachulski Stang Ziehl & Jones LLP; Los Angeles). Her initial projects included the re-establishment of the chapter’s volunteer database, volunteer training coordination, presentation scheduling and chapter marketing. Her leadership in coordinating the CARE mission in the Los Angeles area has helped the chapter secure several new presentation opportunities.

During the reception, Chicago CARE was presented with its Volunteer Awards for the 2017-18 school year. Winning Volunteer of the Year, Bryan Jacobson of Chapman and Cutler LLP, presented 15 times this past year — the most presentations of a volunteer for the 2017-18 school year. CARE Hero Awards were present-ed to Mark F. Hebbeln of Foley & Lardner LLP and Tony Natale for their tremendous efforts, commitment

and enthusiasm about CARE’s mission. The award for Company of the Year was presented to Transunion for its continued partnership with Chicago CARE. During the 2017-18 school year, Transunion provided 14 volunteers to staff 22 presentations. This dedication to CARE’s com-mon goal has been incredible. Chicago CARE also had a great start to the 2018-19 school year, as it has provided 31 presentations and counting to the Chicago area.
