People’s Desire

Smooth and secure transport contrib-utes to regional development. It also bringsabout swift commodity flow and developmentof trade and commerce, thereby ensuring theimprovement of socio-economic life of localresidents. Therefore, a string of new roadsand river-crossing bridges are being built.

Being a commercial city, Yangon isdensely populated with a large number offinancial institutions. Thanks to Hline river-crossing bridges such as the Bayintnaung, theAungzeya and the Shwepyitha in Yangon Di-vision, local people in townships on the otherbank of the river can directly go to Yangon,resulting in the development of trade andcommerce.

Moreover, with the emergence ofTwantay Bridge across Twantay Canal, peo-ple from Yangon can now easily travel toDalla, Twantay, Kawhmu and KungyangonTownships in Yangon Division and townshipsin Ayeyawady Division. Likewise, with theemergence of new Kayan Creek Bridge inKayan Township, people from Bago,Thanatpin and Kawa Townships in BagoDivision can travel to Yangon in a short time,and sell rice, pulses and beans and marineproducts there.

At present, the Thilawa Port is beingupgraded to enable seagoing vessels with aheavy load to use it. At the same time, theYangon-Thanlyin Bridge No 2 is being con-structed for lorries with a heavy load. The4,540 feet long bridge is a 72 feet wide six-lane facility. The foundation of the bridge isof reinforced concrete type and can bear 75-ton loads.

Nowadays, major bridges are beingconstructed across the nation, spending alarge amount of funds and resources. TheYangon-Thanlyin Bridge No 2, a key to bet-ter transport, will soon emerge.

YANGON, 30 NOV—Minister for Energy Brig-Gen Lun Thi on 27 November morning inspectedproduction of gas at new Pyayi (North) Well No 2of Myanma Oil and Gas Enterprise near Pyayi Vil-lage in Thayet Township, Magway Division.

At the briefing hall, the minister heard re-ports presented by officials on production of gasand finding of gas deposits at Pyayi (North) regionand arrangements being made for drilling of newwells.

The minister gave instructions on timely com-pletion of the drilling work and attended to the re-quirements.

JAKARTA, 29 Nov— TheIndonesian Govern-menthas begun to reducereliance on westerncountries in arms purchaseand turned to EastEuropean countries assparring suppliers, anofficial said Tuesday.

The purchase of lethalweapons from Westerncountries like the UnitedStates, France and Britainwill be reduced to 60 percent from 80 per cent asthe government is nowlooking to East Europeancountries as the main

Study says sitting for long hours hurts back CHICAGO, 29 Nov—A

new form of magneticresonance imaging (MRI)has revealed that the spineundergoes a lot of strain,leading to chronic pain, if aperson sits upright in aposition for long hours.

The new study,conducted at WoodendHospital in Aberdeen,Scotland, has found that a

135-degree body-thighsitting posture wasdemonstrated to be the bestbio-mechanical sittingposition, as opposed to a 90-degree posture, which mostpeople consider normal.”

“Sitting in a soundanatomic position isessential, since the strain puton the spine and itsassociated ligaments over

time can lead to pain,deformity and chronicillness,” Waseem AmirBashir, author and clinicalfellow, department ofRadiology and DiagnosticImaging, University ofAlberta Hospital, Canadasaid. By identifying badseating postures and helpingpeople take preventivemeasures to protect the

The researcher studied22 healthy volunteers withno back pain or surgeryunder a “positional” MRImachine. Bombs kill four nearBaghdad hospital

BAGHDAD, 29 Nov— Two car bombs close to westBaghdad’s main Yarmouk Hospital killed four peopleand wounded 40 on Tuesday, a source at Baghdadpolice headquarters said. Police and Interior Ministrysources said at least one of the bombs targeted a policepatrol near the hospital and killed a police officer.Several police were also among the wounded.

Body of US warplanepilot missing in IraqBAGHDAD, 29 Nov—US forces hunted for the body

of an F-16 pilot who was killed on Monday when hiswarplane came down in a Sunni guerilla strongholdnorthwest of Baghdad.

The body of the pilot, who has not yet been identified,disappeared from the crash site before an Americanarmoured column arrived on the scene and sealed offthe area.

Film taken by a local journalist shortly after thecrash showed the bloodied and clearly dead body ofwhat appeared to be a man in a flight suit wearing aparachute harness lying in a field strewn with thewreckage of the plane.

LANZHOU, 30 Nov — Eleven people wereconfirmed dead in a coal mine gas blast Wednesdaymorning in northwest China’s Gansu Province, saidlocal work safety bureau.

The explosion occurred at 6:20 in the No1 coalmine in Tanshanling Town, Wuwei City, more than180 kilometres from Lanzhou, the provincial capital.

of Union Kayin League presented by U Saw San Shweof the league on the detailed basic principles thatshould be adopted for the chapters “Election”,“Political Parties” and “Provisions on State ofEmergency” to be included in drafting the StateConstitution at the Plenary Session of the NationalConvention held at Pyidaungsu Hall of NyaunghnapinCamp in Hmawby Township, Yangon Division, on 28-11-2006.

I wish you the esteemed Chairman and membersof the Panel of Chairmen, the Chairman of NationalConvention Convening Commission and members,the Chairman of National Convention Convening WorkCommittee and members, the Chairman of NationalConvention Convening Management Committee andmembers and National Convention delegates to beblessed with health and happiness and auspiciousness.

I am U Saw San Shwe, a National Conventiondelegate of Union Kayin National League.Mr Chairman,

The chapter “Election” is included in the 15chapters adopted by the National Convention to writea new constitution. The fundamental principlesconcerning the chapter are as follows:

(a) Every citizen shall have the right to vote andto stand for election according to law.

(b) Voters concerned shall have the right, inaccord with provisions of the State Constitution, torecall elected people’s representatives. The sphere ofthese basic principles is quite wide. Concerning thepoints the Chairman of the National ConventionConvening Work Committee referred to the 1947Constitution, 1974 Constitution, 1948 ParliamentaryDemocracy Election Act, 1975 Pyithu Hluttaw Act,1935 Myanmar Administrative Act, 1961 ElectionAct, the Act to amend the constitution in explaining thedetailed basic principles concerning the chapter.Mr Chairman,

The Work Committee Chairman has explainedin detail the matters concerning the persons who havethe right to vote and have no right to vote and thevoting system; the right to stand for election and theright to recall elected representatives; the formationof the Pyidaungsu Election Commission, its dutiesand the qualifications of its members; the matterconcerning the filing of charges against a member ofthe commission; the appointment of duties for a postvacant due to termination of duties, death or otherreasons; and the resolutions of the commission,functions, responsibilities, powers, rights anddesignation of official position. When we studiedthem we have come to understand the fact the nationwill be able to hold a free and fair election in thefuture.

We agree that the 14 points concerning thechapter should be adopted as detailed basic principles.Mr Chairman,

The Work Committee Chairman recounted therequired qualifications of the MPs in clarifying thedetailed basic principles for the chapters concerningthe formation of the legislature, executive and judiciaryat the plenary session of the National Convention heldfrom 28 to 30 March 1996.

We would like to suggest that the expression“Provided that the period of staying in foreign countriesunder State permission should be deemed to have

settled in the Union” should be added to the point“having settled in the Union of Myanmar for at least10 consecutive years up to the time of being elected asPyithu Hluttaw representative”.Mr Chairman,

The Work Committee Chairman explained thatthe fundamental principle “The State shall enactnecessary law for systematic formation of politicalparties for flourishing of genuine multiparty democracysystem” has already been laid down.

In his explanation, the Chairman said, “It isnecessary for the National Convention to lay downdetailed basic principles in connection with politicalparties to be prescribed in the Constitution. Explanationwill be made on the matter in three parts as mentionedin the following to assist the task of laying down thesaid detailed basic principles.

“(a) Objectives;“(b) Procedures;“(c) No right to exist.”

Mr Chairman,Myanmar has already witnessed the

weaknesses and loopholes of the parliamentarydemocracy when she practised the system afterregaining Independence. The public’s wishes will befulfilled only if the nation practises democracy thatis suitable to her history, social level, economiccondition, and customs.

The clarification of the Work CommitteeChairman includes matters relating to the flourishingof disciplined multiparty democracy, the emergenceof political parties that can correctly lead the people,the systematic formation of political parties, thepolitical, economic, security and social conditions ofthe nation and the traditions and the emergence of amodern and all-round developed nation. The mattersstated in the clarification will surely benefit the futurenation.

Hence, the six points explained by the WorkCommittee Chairman should be adopted as detailedbasic principles for the chapter “Political Parties”.Mr Chairman,

Among the chapters adopted for the formulationof the Constitution, the Provisions on a State ofEmergency has been adopted as a separate chapter.The Work Committee Chairman in presenting hisstudy of the required fact explained the followingfundamental principles:

“(a) When there arises a state of emergencycharacterized by inability to perform executivefunctions in accord with provisions of the StateConstitution in a region or state or a self-administeredarea, the President of the State is empowered toexercise executive power in that region, state or self-administered area and if necessary in doing so, thePresident of the State is empowered to exerciselegislative powers concerning that region, state orself-administered area in accord with provisions ofthe State Constitution;

“(b)when there arises or there is sufficientreason to arise a state of emergency endangeringlife and property of the people in a region, a state ora self-administered area, the Tatmadaw has theright, in accord with provisions of the StateConstitution, to preempt that danger and provideprotection;

“(c) when there arises a state of emergency that

could cause disintegration of the Union, disintegrationof national solidarity and loss of national sovereignty,due to take over of sovereign State power or attemptsthrough wrongful forcible means such as insurgencyor violence, the Defence Services Commander-in-Chief has the right to take over and exercise Statepower in accord with provisions of the StateConstitution.”

A state of emergency occurs in a nation whenthere arises a threat endangering the national defenceand security and the rule of law in some regions orin the entire nation, or a foreign military intervention,or a worsening political and economic situation anda natural calamity such as the storm, flood, fire andearthquake. In this situation, the Head of State willhave to declare a state of emergency and takenecessary measures to restore the situation intonormalcy as he is entrusted with the power to do soby the Constitution.

The constitutions of a large number of nationsprescribe that it is necessary for the Head of State afterdeclaring a state of emergency to present the measurestaken by him and by the organizations and persons hehas empowered to exercise executive power during theemergency period to the parliament concerned forapproval, and that a state of emergency can be declaredonly for a specific period.

The study also shows that a state of emergencycan be declared because of war, foreign invasion,armed insurgency, natural disasters, economy and thePresident’s assumption that a grave situation isendangering the security of the entire nation or any partof the nation.

The President should declare a state of emergencyafter consulting with the National Defence and SecurityCouncil in advance. It will be more effective if thePresident issues an ordinance having the force of thelaw to declare a state of emergency.Mr Chairman,

The Work Committee Chairman made referencesto the 1947 Constitution and the 1974 Constitution inpresenting the detailed basic principles for the chapter“Provisions on a State of Emergency”.

As we find the detailed basic principlescomprehensive and to be in order, we have no furthersuggestions concerning them.

We would like to suggest that the 23 pointsshould be adopted as detailed basic principles of thechapter.

The writing of a State constitution in the drivefor transforming the nation into a democratic onewith flourishing democracy should focus on theinterests of the nation and the people.

In that regard, the delegates have helddiscussions and made positive suggestions foradopting detailed basic principles. Now, theadoption of the detailed basic principles is nearingcompletion.

We have listened to the findings of the WorkCommittee for enabling the delegates to continueto give advice and make suggestions for theremaining chapters.

We found that all the points the WorkCommittee chairman presented are positive andpractical and are in conformity with the political,security, economic and social sectors and customsof our nation.Mr Chairman,

We would like to present our views aboutthe findings of the Work Committee for theChapter “Election”, the Chapter “Political Parties”and the Chapter “Provisions on State ofEmergency”. The points for the Chapter“Election”—

1, include the right to vote and to stand forelection in accordance with the law,

2. represent the democratic election system,3. prescribe principles of election,4. includes principles to recall a Hluttaw

member due to his disqualification,5. manifest the formation of the Pyidaungsu

Election Commission, functions, power andprivileges of the chairman and members ofthe commission.

We considered that the points the WorkCommittee chairman explained are consistent withthe State constitution.

So, we would like to suggest that these pointsbe adopted as detailed basic principles.

Mr Chairman,We would like to present our views about

the Chapter “Political Parties”.The State has adopted a basic principle that

necessary laws should be promulgated to formpolitical parties systematically for the flourishingof genuine multi-party democracy system in thenation.

That basic principle demonstrates the role ofthe political parties in the administrative machineryof the future nation.

The Work Committee chairman’sclarification to the points for the Chapter “PoliticalParties” are complete with—

1. firm and democratic objectives,2. concepts and convention to be followed,3. disallowing continued existence of a political

party.Mr Chairman,

Our party considers that our nation will beable to stand tall in the world only when a rulingparty or government is capable of effectivelydischarging national duties, and serving the interestsof the nation and the people rather than grabbingthe power.

If so, the people will come to recognize suchgovernment’s performances in the interests of thenation and the people and cooperating withinternational community.

The proposal “political parties are to becapable enough of playing a leading role for theentire Union, or Region- or State-wise inaccordance with the political, security, economicand social sectors and customs of our nation forensuring the flourishing of genuine democracy” isin conformity with the prevailing politicalconditions of our nation as well as with the stanceof our party.

7. principle that during the time a state ofemergency has been declared, the measurestaken officially by a local administrativebody or a member of the body, or a civilbody or a member of the body, or a militarybody or a member of the body, formed inorder to take measures to restore security,stability, community peace and the rule oflaw soon on behalf of the President orduring the period the Commander-in-Chiefexercising the State power or during theperiod the National Defence and SecurityCouncil is exercising the State power, shallbe legitimate. So, these points should beadopted as detailed basic principles.

Mr Chairman and NC delegates,In conclusion, we representatives of the

Kokang Democracy and Unity Party suggest thatthe points the Work Committee chairman clarifiedfor the Chapter “Election”, the Chapter “PoliticalParties” and the Chapter “Provisions on State ofEmergency” to be included in the Stateconstitution should be adopted as detailed basicprinciples.

people will emerge. If a nation has political partieswhere pure and firm politics flourishes and good personsare elected to the parliament, it is sure that the politicalinfrastructure of that nation will be stable and strong.Mr Chairman,

Political parties have the duty to serve the interestof the nation and the people resolutely. It is importantfor them to correctly lead the people.

The political parties should have the capability toeducate and organize their members and the public asthey have relations with the people. In addition,discipline-flourishing genuine democracy will flourishin the nation only if there are parties that can maintainand realize their political aims.

A nation will develop only if it is headed by firmand systematically-established political parties. Asfor the existence of such parties, appropriate principlesshould be adopted to the constitution, and the politicalparties should be formed systematically according tothe provisions contained in the constitution withoutundermining the essence of multiparty democracy.

As it was explained by the Work CommitteeChairman, we agree that there should be a law tosystematically establish political parties for flourishingof discipline-flourishing genuine multipartydemocracy system and emergence of political partiesthat will correctly lead the citizens. Only then will theparties become organizations giving priority to servingthe interest of the nation and the people.Mr Chairman,

We would like to present a suggestion concerningthe chapter “Political Parties”. Political parties shouldbe the organizations capable of heading towardsflourishing of discipline-flourishing genuinemultiparty democracy in the entire Union in accordwith the nation’s political, security, economic andsocial conditions and traditions and customs. And it isa must. The parties will have to launch organizationalcampaigns to strengthen themselves in all aspects.But the parties will face a problem and obstacles ifthere is a prescription saying that all matters andfunctions should be free from politics. Suchprescription is also against the objective — flourishingof genuine multiparty democracy system — of the sixobjectives of the National Convention. We would liketo suggest that there should be no such prescription inour nation that will practise multiparty democracy inthe future.

We agree that all the 6 points explained by theWork Committee Chairman should be adopted asdetailed basic principles for the chapter.Mr Chairman,

I will now discuss the chapter “Provisions on aState of Emergency”. The plenary session of theNational Convention adopted the followingfundamental principles concerning the chapter:

“(a) When there arises a state of emergencycharacterized by inability to perform executivefunctions in accord with provisions of the StateConstitution in a region or state or a self-administeredarea, the President of the State is empowered toexercise executive power in that region, state or self-administered area and if necessary in doing so, thePresident of the State is empowered to exerciselegislative powers concerning that region, state orself-administered area in accord with provisions ofthe State Constitution;

“(b)when there arises or there is sufficient reasonto arise a state of emergency endangering life andproperty of the people in a region, a state or a self-administered area, the Tatmadaw has the right, inaccord with provisions of the State Constitution, topreempt that danger and provide protection;

Thematter should not be decided by a single person.Failure to declare a state of emergency in time will leadthe problem to spread to other areas till it becomes outof control. If necessary issuance of the declaration isdelayed because a heedless decision will harm thepolitical, economic and social stability of the State.Hence, it will be more beneficial to the State if thePresident issued the declaration only after making dueconsideration with an organization or a personresponsible for the nation’s defence and security.

China, Philippines pledge to strengthenPress cooperation

China, Italy ink MoU to boostbusiness cooperation

BEIJING, 30 Nov— China and Italy signed amemorandum of under-standing (MoU) here Wednesday,aiming to push forward their cooperation in exhibitionindustry, managerial training and business visits.

The MoU was signed between the China Councilfor the Promotion of International Trade (CCPIT) andItalian Trade Commission (ITC).

According to the MoU, the two sides will bolsterthe development of middle- and small-sized enterprises,organize Chinese and Italian experts to train youngmanagers, and facilitate the visits of businessdelegations.

Vietnamese legislature eyes GDP growthof 8.5% in 2007

HANOI, 30 Nov—TheNational Assembly ofVietnam, the country‘s toplegislature, approvedWednesday a resolution ona national socio-economicdevelopment plan for2007, targeting a grossdomestic product (GDP)growth of 8.2-8.5 per cent.

The plan also includesan export turnover increaseof 17.4 per cent, an importturnover rise of 15.5 percent, and consumer priceindex growth to be lowerthan the economic growth,Vietnam News Agencyreported.

The legislature plans toreduce Vietnam's povertyrate to 16 per cent; create

jobs for 1.6 million people,of whom 80,000 will workabroad; provide clean waterto 67.2 per cent of the ruralpopulation and 80 per centof the urban one; and lowerthe malnutrition rate ofchildren under five to 22.3per cent.

To achieve the goals,the National Assemblyproposed major solutionswhich centre on improvingthe investment environ-ment, encouraging theeconomic sector to investin production andbusiness, and ensuringtimescales for key nationalprojects. Vietnam will,next year, continue toboost agricultural and rural

economic development,and intensify investmentin disadvantaged regionsto narrow the economicgap between localities.

The legislaturerequested the govern-ment to developindustries with comp-etitive edges, supportingindustries, informationtechnology, and high-technology sectors;accelerate the restructureof state-owned enter-prises; and improvemanagement policies forthe financial andmonetary sector toactively curb inflation.

China conducts science cooperation with 152 countries, regionsBEIJING, 1 Dec— China has conducted science cooperation with 152 countries and regions, and will

further boost exchanges in the field in next five years, Xu Guanhua, Minister of Science and Technology,said here Thursday.

“China’s inter-national science co-operation has reached anunprecedented de-velopment period,” saidXu, at the ministry’snational conference onforeign affairs openedhere Thursday. “So far,the country has signedgovernmental sciencecooperation agreements

with 99 countries, and abasic cooperationplatform has been set up.”

China has gainedresults through co-operation with manycountries, including theUnited States, Russia,France, Germany, Italy,especially in the past fiveyears, Xu said.

In 1995 China and

Russia worked together indeveloping a remote-controlled submarinerobot; the two sides havejoined again in upgradingthe deep sea robot thatcan operate at a depth of7,000 metres.

Since 2005, the country

has signed a number oftechnological developmentand service contracts withthe European Union relatingto the 3.5-billion-euroGalileo system, a networkof 30 satellites intended forcivilian use.
