ORDER

AND NOW, this 17 day of March, 2020, pursuant to the Order of the Supreme Court dated March 16, 2020 declaring a statewide judicial emergency, the declaration of judicial emergency dated March 16, 2020 by this Honorable Court, and Pa. R.J.A. 1952(B)(2), IT IS HEREBY ORDERED and DECREED as follows:

1. The Court is authorized to suspend time calculations for the purpose of trial computation relevant to court cases or other judicial business, as well as time deadlines, subject to constitutional restrictions.

2. The Court and related entities are hereby authorized to utilize communication technology to conduct Court proceed-ings including all matters before a hearing officer.

3. The Court hereby suspends the operation of Rule of Criminal Procedure 600 during the time period of the judicial emergency concluding April 14, 2020 unless extended by further Order of Court.

This Order shall be posted at a public location in all Court facilities, shall be made available on the County and Court website and shall be provided to the Wilkes-Barre Law & Library Association for publication in the Luzerne County Legal Register.

Hon. A. Richard Caputo (1938-2020)

It is with great sadness that The Luzerne Legal Register notes the passing of Judge Caputo of our Bar. Judge Caputo who ascended to the Federal Bench of the U.S. District Court for the Middle District of Pennsylvania in 1998, was regarded by his brethren on the Bench as a “Judge’s Judge.” Private funeral services were held for the Judge.

Judge Caputo will be memorialized by the Association and be eulogized in the In Memoriam Service to be held next year for members who passed away this year. [PLEASE REMEMBER THAT THE SERVICE THIS YEAR THAT WAS SCHEDULED FOR MARCH 27th HAS BEEN POSTPONED. See the Color Insert.]

Everyone who knew Judge Caputo knows of the great love he had for the law and the legal profession. Judge Caputo also loved holding the Federal Group Attorney Admission Ceremony each December at the Max Rosenn U.S. Courthouse. The Judge was extremely passionate about new lawyers being admitted to Federal Court, and passed along this great passion to our own Joe Burke.

In 2019, the Federal Judicial Center encouraged Federal Bar Association Chapters across the United States to adopt outreach programs in conjunction with their local Federal Courthouses. In April, the Middle District Chapter conducted a pilot Outreach at the Nealon Courthouse in Scranton.

Fueled by Judge Caputo’s vision of encouraging newly admitted attorneys to be admitted to Federal Court, the Nealon and Rosenn Courthouses (which form the Northeastern Tier of the Middle District of Pennsylvania) launched a Judicial Outreach Initiative that is designed to reach out to area pre-law and law students.

Judge Caputo was delighted with the launching of the Initiative. In our county, important groundwork has been laid out with Chairpersons of W-BLLA’s Federal Practice Committee, Jim Oschal and Pat Doyle. Similar groundwork has been made in the other counties framing the Northeastern Tier. In addition to Joe Burke, agreeing to serve as the coordinating Bar Executive for the Initiative, Judge Saporito (a Past President of the W-BLLA) has agreed to serve as the point Judge at the Rosenn Court-

house, while Judge Mehalchick (who is a Past President of the FBA Middle Chapter) has volunteered to serve as the point Judge at the Nealon Courthouse. The initiative, in the end, may serve as a model for the other Circuit Bars and is a lasting tribute to Judge Caputo, to his incredible passion, to his broad vision, and to his always warm welcome that he gave to the lawyers admitted into the Federal Fold.

Primary discussion at the Meeting was the upcoming Expungement Clinic CLE on March 18th and the Clinic itself on March 28th. Members were encouraged to send anyone they believe could benefit to the general information session that is scheduled to be held at 9AM and is open to the public.

If members knew of anyone that might qualify for legal aid and are in need of an expungement and/or sealing of their criminal record, they were encouraged to have those persons contact North Penn Legal Services to schedule an appointment for the Clinic which will take place that day from 10AM to 3PM. Chairperson Centini then discussed the circulation of emails regarding a potential CLE to be prepared and presented by the Committee for all Bar members.

1. To establish a cause of action for medical malpractice in Pennsylvania, the plaintiff must show that: (1) the physician owed a duty to the patient; (2) the physician breached that duty; (3) the breach of the duty was the proximate cause of, or a substantial factor in bringing about the harm suffered by the patient; and (4) the damages suffered by the patient were a direct result of the harm.

2. A new trial will be awarded on the ground that the verdict is against the weight of the evidence, when the jury’s verdict is so contrary to the evidence as to shock one’s sense of justice, and the award of a new trial is imperative so that right may be given another opportunity to prevail.

3. A new trial will not be granted on the ground that the verdict was against the weight of the evidence where the evidence is conflicting and the jury could have decided in favor of either party.

4. In the matter sub judice, the jury’s failure to find that any negligence on the part of the Defendants, was a factual cause of any harm to the Plaintiff, did not shock the Court’s sense of justice so as to merit the awarding of a new trial.

5. With respect to the Plaintiff ’s second basis for requesting a new trial, under the circumstances of the case, the Court is of the opinion that the Plaintiff has waived his right to appeal this issue. Even if the Plaintiff has not waived the issue, it is within the Court’s discretion whether the facts of the case warrant giving the instruction.

6. The Court was convinced that the medical record alteration in this matter was not of the type or degree which supported the adverse inference instruction.

7. Even if the Plaintiff has not waived the issue, as the Subcommittee Note to Instruction 14.40 of Pennsylvania Suggested Standard Civil Jury Instructions explains, it is within the Court’s discretion whether the facts of the case warrant giving the Instruction.

8. Finally, under the circumstances in this case, any alleged error by the Court in declin-ing to give the Instruction would not be anything other than harmless error.

9. On appeal, the Order of the Trial Court was AFFIRMED.

Opinion

This Opinion is furnished pursuant to the require-ments of Pa. Rule of Appellate Procedure No. 1925(a).

This is a Medical Malpractice Action in which Plain-tiff claimed that the Defendant Physicians mismanaged his post-surgical care and knee infection, leading to his pain and suffering and acceleration of arthritis in his surgical knee.

In general, “[t]o establish a cause of action for medical malpractice in Pennsylvania, the plaintiff must show: (1) [t]he physician owed a duty to the patient; (2) the physi-cian breached that duty; (3) the breach of the duty was the proximate cause of, or a substantial factor in bring-ing about the harm suffered by the patient; and (4) the damages suffered by the patient were a direct result of the harm.” Kurian ex rel. Kurian v. Anisman, 851 A.2d 152, 156-57 (Pa. Super. 2004).

A jury trial was conducted beginning on May 29, 2018, and on June 1, 2018, the jury returned a verdict in which they answered “yes” as to both Defendant Physicians in response to “Question 1” of the Jury Verdict Inter-rogatories, but “no” as to both in response to “Question 2.” In other words, the jury determined that both Dr. O’Brien and Dr. Mattucci were negligent but concluded that their negligence was not a “factual cause of any harm” to the Plaintiff.

Plaintiff filed a Motion for Post-Trial Relief pursuant to Pa. R.C.P. No. 227.1 in which he requested a new trial. By Order dated December 13, 2018, the Court denied the Motion. Plaintiff subsequently entered judgment in favor of the Defendants on the jury verdict and filed a Notice of Appeal.

In his Motion for Post-Trial Relief, Plaintiff alleged two bases for requesting the Court to grant a new trial. First, Plaintiff asserted that the jury’s determination with respect to the issue of causation was “against the weight of the evidence.” Second, the Plaintiff alleged that the Court erred in refusing to give an “adverse inference” jury instruction regarding “alteration of records under the MCARE Act.”

“A new trial will be awarded on the ground that the verdict is against the weight of the evidence, when the jury’s verdict is so contrary to the evidence as to shock one’s sense of justice, and the award of a new trial is im-perative so that right may be given another opportunity to prevail.” S.N.T. Industries, Inc. v. Geanopulos, 367 Pa. Super. 97, 104, 525 A.2d 736, 740 (1987) (citations omitted). In addition, “a new trial will not be granted on the ground that the verdict was against the weight of the evidence where the evidence is conflicting and the jury could have decided in favor of either party.” Id. at 104-105, 525 A.2d at 740. A review of the record in the present case, and specifically the testimony of defense orthopedic surgery expert Dr. Jack Henzes and defense physiatrist expert Dr. Michael Wolk, reveals that there was conflicting testimony among the experts regarding whether the timing of the treatment by Dr. Mattucci and Dr. O’Brien caused any harm to the Plaintiff (T.T. pp. 285-86, 360). Under these circumstances, the jury’s

failure to find that any negligence on the part of the De-fendants was a factual cause of any harm to the Plaintiff did not “shock” the Court’s “sense of justice” so as to merit the awarding of a new trial.

With respect to Plaintiff ’s second basis for request-ing a new trial, the Court would initially note that while Plaintiff did file a “Supplemental Pretrial Statement” on May 22, 2018, in which he requested Instruction 5.70 (Intentional Alteration or Destruction of Documents) of the Pennsylvania Suggested Standard Civil Jury In-structions be given to the jury, at no time prior to the conclusion of the trial did he file a Point for Charge requesting the Court to charge the jury with Instruction 14.40 (Alteration or Destruction of Medical Records). In addition, following the Court’s charge to the jury, the Court inquired of counsel for the parties if there were “any other submissions with regards to the Court’s charge,” to which Plaintiff ’s counsel responded “None, Your Honor.” (T.T. p. 495.) Under these circumstances, the Court is of the opinion that Plaintiff has waived his right to appeal this issue. See Jones v. Ott, 648 Pa. 76, 191 A.3d 782 (2018); Krepps v. Snyder, 112 A.3d 1246, 1254-55 (Pa. Super. 2015); Pa. R.C.P. No. 227(b).

Furthermore, even if Plaintiff has not waived the issue, as the Subcommittee Note to Instruction 14.40 explains, it is within the Court’s discretion whether the facts of the case warrant giving the Instruction. Upon a review of Dr. Mattucci’s testimony and the medical records at issue in this case, the Court was convinced that the medical record “alteration” in this matter was not of the type or degree which supported the “adverse inference” instruction. See pages 177-84 and pages 429-32 of the Trial Transcript. Accordingly, in the exercise of its discretion, the Court declined to give the Instruction.

Finally, insofar as the “adverse inference” instruc-tion, if given in the present case, would have primarily related to the issue of negligence, and the jury found both Defendant Physicians to have been negligent, it is difficult to understand how any alleged error in declin-ing to give the Instruction would be anything other than “harmless error.” See generally, Harman ex rel. Harman v. Borah, 562 Pa. 455, 467, 756 A.2d 1116, 1122 (2000) (“The harmless error doctrine underlies every decision to grant or deny a new trial.”).

ORDER

It is hereby ORDERED and DECREED as follows:

1. The Clerk of Judicial Services and Records (Pro-thonotary) of Luzerne County is ORDERED and DI-RECTED to docket this Order and Opinion of record and to forthwith transmit the same to the Superior Court of Pennsylvania.

2. The Clerk of Judicial Services and Records (Pro-thonotary) of Luzerne County is ORDERED and DI-RECTED to serve a copy of this Order and Opinion on all counsel of record and each party, if unrepresented, pursuant to Pa. R.C.P. No. 236.

Pursuant to Section 601(d) of the Real Estate Tax Sale Law, 72 P.S. §5860.601(d), prospective bidders must certify that they have not had a landlord license revoked in any municipality in Luzerne County and that they are not acting as an agent for a person whose landlord license has been revoked.

PAYMENT BY THE SUCCESSFUL BIDDER IS DUE THE DAY OF SALE AND SHALL BE MADE IN THE FORM OF CASH, CERTIFIED CHECK, OR MONEY ORDER.
