Syphax Special Konfeksiyon irketinin ve ayn zamanda Wibotex irketinin kanuni

temsilcisi olan Erol YEN Beyin istei ile, 2800 adet askeri adet askeri elbise (pantolon

ceket) ihra edeceklerini b ana sylemilerdi. hracat iin Kanuni Muvafakat a lndktan sonra

ihracat yapacaklard. Bundan dolay benden, bu iki irketin yerlerine gidip bu sz edilen

Bu talep zerine ben efik elAjili bu iki irketin yerlerine gittim ve kontrol ettim.

Erol Yein Bey iki irketin tz bana teslim etti. Grevli gmrk memuru Sfaxtaki

Gmrkler Mdrln telefonla arad. Gmrkler Birlii de bu ii aratracan ve haber

verileceini syledi. Daha sonra bu iki irketin temsilcisi bu mallarn bulunduu yerin

kaplarn kontrol amacyla almasn istedi. Bizde beklemeye dururken Gmrk gitti ve

yetkili k ii gelip Gmrkler Mdrlnn bu maln ihracatnn yaplmasna msaade ettiini

bildirdi. Bu iki irketin temsilcileri irkete gidip bu mallar gtrecek kamyonu ieri soktular.

Tam kapy aarken irkette alan kadnlarn hepsi gelip kapnn nnde durup irket

temsilcilerinin bu ii yapmalarn engellediler ve yle dediler. Bu iki irketin mallar ihra

etmesi mmkn deildir. Zira bizim terimiz bu mallarda vardr. Bu mallarn irketten

kmamas iin lm bile gze a ldk dediler. Bu mallar irketin deildir, bizimdir dediler.

Benim orada bulunduum srede olanlar yazdm ve bunu her trl kanuni sorumluluklar

gze alarak yaptm.

Wibotex, Special konfeksiyon irketinin kanuni temsilcisinin talebi zerine kendisi

Trkiyeden dnd zaman bu iki irketin kapatlm olduunu ve i yapmadn ve bu iki

irketin avukatnn khr Semawi Bey tarafndan anahtarlarn teslim alndn syledi.

Bunun iin Erol Yein Bey benden irkete beraber gitmemizi ve irketin alp almadn

kontrol etmemizi ve iindeki alet ve edevatn kontrol edilmesini istedi. Bu istek zerine bende

noter Muhammet olarak sanayi sitesindeki irketin yerine gittiimizde irketin kaplarnn

kapal olduunu grdk. Kap anahtarlar vastasyla kap pervazndan ald. eriye giriimle

kontroller sonucu unlar grdm.

lk olarak st kattaki Wibotex irketinin fabrikasnn yeni yeri olan yerde fabrikann

almadn ve ierisinde de iilerin olmadna tank oldum. eride diki aletleri,

hazrlanm paketler ve kutular grdm. Diki makinelerinin yannda da hazrlanmam mallar

vard. Oradaki kiinin belirttiine gre makinelerin ierisinde 12 Adet PIFAF marka y ksek

kalitede makine mevcuttu.

Yaplan bu istek zerine Merkezi 29. Cad. No. 13 Pudrer Sfaxta bulunan S.S.C. a dl

irkete gittim, aa diki atlyesine girdiimde bir ok kadn iilerin ii braktn grdm

ve bu ounun da i yerlerinde deil alanlarla birlikte avluda veya atlyenin yanlarnda

toplanm bir ekilde de grdm. Sorduumda paramz istiyoruz diye bardlar. irketin

yasal temsilcisinden sorulduunda bunlarla hibir maddi sorununun olmadn, aylklarna

avans verme imkan olduunu, kadn iiler tarafndan yaplan bu tr basklar kabul

etmediini, ve e demeyeceini bildirmitir. Fabrikadan kmzda tamam ii brakarak

idareye doru yrye gemitir ve para istemilerdir.

Bunun zerine, sorunun zm iin aylklar zerine avans verilmesi amacyla

idareye talimat verildii yetkili tarafndan beyan edilmitir.

Bylece muayene tamamland ve her trl yasal ilerde faydalanlmak zere tutanak

tarafmdan dzenlenmitir.

28 Temmuz 2001 ylnn sabah saat 1 0da Sfax Special Konfeksiyon irketinin kanuni

temsilcisi Erol Yein Beyin istei zerine bendeniz Mustafa el Hadji kendisiyle beraber

arlan tercman Habib Tayyiple beraber ad geen irkete gittik ve o rada bulunan depolar,

depoda bulunan kumalar ve dier mallar, maddi tutarn hesaplama amacyla yapld. Ben

noter olarak ve istek zerine kontrol yapacam yere gittim ve u mallarn var olduunu

grdm. 1(bir) oda, odada kumalarn konulaca raflar, bu raflarda 55 para dikilmi elbise.

Askeri elbiseler, ayakkab, anta, pantolonlar ve dierleri. irkette de iik amala kullanlan

ofisler mevcuttur. Mdr odas, muhasebe odas, 5 ii odas, ve bu odalarda bilgisayarlar

vardr. Mutfak, revir. Byk salonda ise diki yerleri vardr. 163 adet diki makinesi deiik

boyutlarda 7 sra zerine dizilmi masalar vardr. Demir kapnn ardnda ise byk kemiyette

kumalar, kesilmeye hazr 50 para kuma, kartonlar ierisinde dikite kullanlacak

malzemeler.

Demir mahzenin zerinde Franszca u ibare vardr DEPOT DE MATIERE

PREMARE ve onun tam karsnda tamir odas onda da u ibare vardr : SALLE

MECANIQUE. erisinde 4 adet diki makinesi masalaryla birlikte mevcuttur. Dier tarafta

tamir edilecek iki makine vardr. Ayrca tamir aletleri vardr.

Depoda ise 282 adet ambalajlanm karton ve h er kartonda ise 10 para dikilmi

kuma. Tabi btn bunlar muhatap olduum Gmrk ileri sorumlusu Ahmet Elhseyin

tarafndan sylenmitir. Ayn ekilde ek olarak 12 tane diki makinesi bulundu. O gnk

kontrollerin neticesinde yukarda belirttiim gn ve saatte yazdm eylerin bulunduunu

kanun namna zikrediyorum.

temsilcisi Erol Yein Beyin isteiyle bendeniz noter Mustafa el Hudeyci ve tercman El

Habib Tayyip Bey ve Erol Beyin rehberiyle beraber ad geen irkete gittik ve muayene

sonucu irkette diki yerine 9 sra zerinde 105 adet diki makinesi olduu ayryeten PFAPF

markal byk boy diki makinesi mevcuttur. Ayn ekilde her diki makinesinin yannda

dikilmemi kumalar var. Diki alannn tozlu toprakl olduunu grdm. Burann yanndaki

salonda ise 286 adet ambalajlanm karton her kartonda 10 adet pantolon vard. Gmrk

memuru Ahmet el seylinin onayna gre bu mallarn hepsi ihracat iin hazrlanm. Ayn

ekilde ambalajlanmam dikili elbiseler grdm. Yukarda belirttiim gn ve saattegrdm eyleri yazdm.

13 February 2001 yl pazartesi gn sabah saat 9:00da Erol Yein Beyin kendisinin

yukarda belirtilen irketlere girmesinin iiler tarafndan ve Semos irketine bal beki

tarafndan engellendiini belirtmesi ve onun talebi zerine.

89625 sayl karar. Bu karar 27.01.2001 yl Mahkeme kararyla Erol Yein Beyle

ben Sxphax irketine gittik. Noterin gelmesiyle ve Sxphax irketinin iktisadi ve mali iler

uzman Rauf GHORBEL Beyin de gelmesiyle unu kefettik ki; kapnn arkasnda

noterlerin geliiyle ilgili belgeler bulduk. Erol Yein Bey benden bu ile ilgili kontroln

yaplp yazlmasn istedi. Bunun zerine b endeniz Halife el Fakih kontrol yaparak

aadakileri yazyorum.

Sxphax irketinin kapsn atmda nemli belgelere rastladk. Bu b elgeler adli

memurlar tarafndan Sxphax ve Wibotex irketine gnderilen belgelerdi. Semos irketinebal beki bize; kendisine yle talimat verildiini ifade ederek noter temsilcisi olmakszn

kimsenin bu irkete girmemesi konusunda kendisine talimat v erildiini syledi. Erol Bey ise

bekiye yle dedi:

irkete gelen evraklar kapnn arkasnda deil de beki kulbesine braklmas

gerektiini ve bekinin kendi zimmetine almasn ve teslim etmesini syledi. Orada

bulunmam hesabyla kontrol sonucu yukarda anlatlanlar yazlmtr.
