    NOTICE OF FILING OF RESPONSE TO PUBLIC COMMENTS OF SOUTH EASTERN WATER ASSOCIATION, INC.

    Comes SBA Towers IX, LLC (SBA), a Delaware Limited Liability Company, by and

    through the undersigned counsel, and hereby tenders its Response to public comments received

    from South Eastern Water Association, Inc. A copy of SBA's Response to South Eastern Water

    Company Association, Inc.'s public comments, dated June 17, 2019, is attached hereto as

    "Exhibit A." As presented in the subject Application and as discussed in the response attached,

    there is no ground for denial of the subject Application and substantial evidence supports

    approval of the requested Certificate of Public Convenience and Necessity (CPCN).

    WHEREFORE, there being no ground for denial ofthe subject Application and

    substantial evidence in support of the requested CPCN, Applicant respectfully requests the

    Kentucky Public Service Commission:

    1. Accept this Response for filing;

  • 2. Issue an Order granting a certificate of public convenience and necessity to SBA to

    construct the Wireless Communications Facility and tower at the location set forth in

    the subject Application in Pulaski County, Kentucky; and

    3. Grant Applicant all other relief to which it is entitled.

    Please allow this letter to acknowledge receipt of a courtesy copy of your letter to the Kentucky Public Service Commission submitting comments on behalf of South Eastern Water Association, Inc. (hereinafter SEW A), in regard to the above referenced matter. Therein, SEW A comments regarding its easement and water line in an area of the proposed site. SEW A requests "that access to the proposed cell tower avoid any activity which would disrupt or cause damage to the main distribution line."

    It is our understanding that on or around February 2019, representatives of SEWA and/or its attomey(s) conducted site visit(s) in correlation with survey work, and initial site development work, being performed by SBA contractors and/or agents at the proposed site. At that time, SEWA requested that the main water valves be marked on the survey. Additionally, there was some discussion regarding the access road and location of same near the water valve(s), specifically located near the 1155 and/or 1160 elevation line, and the possibility of moving the access road over to accommodate for same.

    As noted in the site plans and drawings, Exhibit J (Sheet T-4) to SBA's Application, an additional site survey was performed, on or about March 27, 2019, and "water valve" was added to the legend. Moreover, the location ofthe existing water valves have been marked and noted in the site plans and drawings, see Exhibit J (Sheet C-3 & C-4), including notes "lines to be noted before commencement of construction activities & great care taken to be avoided."

    A review of the site plans and drawings also reveals that the proposed access road has been moved over to accommodate SEW A's concerns regarding same and the water valves. For your convenience, a copy of the site plans and drawings (Exhibit J) filed with SBA's Application is enclosed herein
