NOTICE INVITING APPLICATIONS FOR EMPANELMENT OF ADVOCATES

Employees' Provident Fund Organisation (EPFO), on behalf of the Centra l Board, Employees' Provident Funds, a statutory body of the Ministry of Labour & Employment, Government of India, proposes to engage Panel Counsel(s) to respresent the Central Board, EPF before High Court of Madhya Pradesh Bench at Indore and Central Government I ndustrial Tribunal, Jabalpur.

The practicing advocates who are registered with Bar Council of I ndia/State Bar Council are eligible for empanelment. The qualification, experience, schedule of fees, other terms and conditions and the application format in which the application has to be made, have been prescribed.

The Advocates who are on the existing panel of EPFO shall cease to be on the panel of EPFO after new panel is finalized against this notice. Therefore, they may also apply afresh in response to this notice.

Eligible practicing advocate must submit application in the format prescribed in Annexure "A" and Annexure "B" enclosed herewith, along with all supporting documents in a sealed envelope to :-

The last date of receiving Applications in the prescribed format alongwith supporting documents is 10th Feb., 2018 till 16.00 hours.

Application for empanelment at EPFO does not confer any right/assurance whatsoever, to an applicant that he/she will be empanelled on the panel of EPFO. Letters to advocates confirming their empanelment will be issued by EPFO separately.

GUIDELINES FOR EMPANELMENT OF AQVOCATES

Following guidelines are designed to provide and regulate the manner· and procedure fOf empanelling the advocates to represent end assist EPFO -before var.ious courts and for regulating the referrals of the cases and payment o,f ·fee'remuneration. These guidelines shall supersede all existing instructions In this regard. if any, and is suqect to change wtthout aaalgnlng any reason. ·

1. Eltalbllltv of Empanelment

Before filling the application form, the candidates are advised to carefully read and follow the

eligibility criteria, instructions and terms & conditions for ernpanelment of Advocates In EPFO mentioned herein below :-

For designation of an advocate to handle the cases before the Hon'ble Court:-

1} Be enrolled/ registered as an advocate wtth 1he Bar Cou."ldl d ffidia / tt,e State 8ar Councii

ii) Be enrolled / registered and currently practising .as an Advocate-on Record,

iii) Have a minimum, relevant experience of Ttn years of h~ Civil, Criminal, Service,

Labour matters, Arbitration matters and other cases before Hott"ble Court of India with a fair knowledge of labour laws with spec_iaj reference to ~es· Provident Funds and Miscellaneous Provisions Act, 1952 (E.P.F. and M.P. Act. 1952).

2. Tenure or Empaoelment

The iriifial empanelment will be for the period of two year, Le. for the period 01 .04.2017 to 31.03.2019, Performance of empanelled advocates shall be re'fiewed at regular interval for continuance in the panel of Advocate. i..

3. Payment of Fee and Other Conditions

(1) T_he fee payable to the Advocates shall be governed by the guideines Issued from the Head

Office, New Delhi and as amer,ded from time to time. However. at present there is no seperate fee defined for the panel advocate of EPFO, Who are designated as Senior Advocate by the Hon'ble Court.

2) The Competent Authority shall have the right in exceptional cases to approve the payment of a higher fee than the fee mantioned in the annexed shcedule keeping i!'I view the importance of the matter and the efforts put in by the advocate in a particular case.

3) No retainer fee shall be paid to any panel Advocate merely because such advocate has been empanelled.

4. Procedure for Empanelment

9. Depending upon the requirement and !'!Umber of application, .recei ... ed, EPFO re1ervea the right to shortllat the candidates to be called for Interview/interaction and to be empanelled

f. Merely fulfllHng the eligibility criteria will not confer any right on an appllicant advocate to be called for Interview/interaction and to be selected. .

g.The decision of the competent authority regarding short listing and selection of !he candidates shall be final. ·

h. Canvassing in any form thall ~ treated as a diequallflcatlon. The candidature of such applicants shall be forthwith.

J. The applllcant advocate shall bring original document, at the time of Interview.

k.Letter to applicant advoetes confirming their empanelment will be issued by EPFO separately.

!5. Dutt,. of tb• Empanelled Advocate• :

a. The Advocate 1h11l not advise any p•rty or- accept any case against the EPFO in which he/she has appeared or Is likely to be called upon to appear for or advise. which Is likely to afftict or lead to litigation agai1nt the EPFO .

b. Timely appearance of the Counsel to contest the eases for EPFO in the Court is a must. His/her absence in the Court. wit~ut any reasonalble ground and notice In advance, will not be accepted.

c. EPFO ahall only engage empanelled Senior Advocate In a case (as and when required) by providing him an advocate for assistance from the approved penel.

c. EPFO aend1 the Information to the panel advocatu through email regarding entrustment of a case and after receiving the e-mail, it is duty of the panel Advocate,, to collect the brief/copy of petition along with assignment letter from the concerned office of EPFO at the ear11est

f. The advocate,. a.hall accept Ule terms and oonditions -of the empanelment as determined by the EPFO from time to time.

g. In order to ensure that there la effective check on t'he cases being conducted, the Advocates on the panel must report the status of-the cases after eaGh date of hearing. Failure to submit status report wlll be a ground for remova1 ot the ,,--ame·of 1tMt lawyer ooncemed from the

panel.

h. In cases where on th.e request of the Union of India, Ministry of Labour & Employment have also to be represented, no extra fee shall be pajd to the tdvocate to wa1oh and safeguard the interests of Union of India, Ministry of Labour & Employment.

I. If required, render all assi&tfflce to Special or SenlQr CooJ1Jfl engaged -in a pearticular caaas before the Hon'ble Supreme Court. H\gh Court sod other judicial bodies.

J. Keep EPFO Informed and updated on all-importa'tlt ,developments in the designated cases. dates of hearing, order of the court on the date of lts pronouncement, supplying copy of

orders/judgment etc.

k. Furnish monthly statement about the cases_rep,-ented by himfher before the High Court,

CAT, SCDRF, DCDRF, Lower Court or any other authority and their outcomes.

I. When any case attended by him/her is decided against the Organisation, th.e Advocate concerned must give considered opnlon :-egarding the r.ea&ons for such adverse order and thtnKMsability of filing an appeal from s·uch a decision nQt taler than 5 working daye of the

m. 30% of the feea payable to the counsel shall be de.duded, if ·the, certified copy of the judgment 11 not handed over to the LegaJ cen of EPfO·wtthfn three days (excluding the time

s. Remoyal from Panel

· EPFO reserves the right to terminate the empanelment of a Coun&el with one month's notice in

writing without aaalgning any reason. The counsel may also resign from the Organi&atlon by serving one month's notice.

Empanelrnent shall be liable to be cancelled due to occurring of any of ,the following disablements on the part of the Advocate.
