from the Manufacturers/ Importers only, on FOL destination delivery basis to PACCs in Tamilnadu for the

period from August 2016 to July 2017 or till the extension period specified by

TANFED/TCMF/NCMS after 31.07.2017.

3. Separate application for Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-

Pesticides, Bio-Fertilisers and Plant Growth Regulator, to be submitted.

4. Last date for receipt of the filled in Application Form containing Part-A ( Technical

Specifications and Supply Terms) and Part–B (Price Offer) sealed covers (separately) will be at

11.30 AM on 23.08.2016 as per office clock at TANFED, Chennai-18.

5. Date of opening of sealed covers will be at 12.00 Noon on 23.08.16 for PART-A Sealed

covers (Specifications and Commercial Terms). The Part-B (price offer) tender cover will be opened

after scrutiny of Technical Specifications and Supply Terms on the same day and will be intimated

only to the qualified Manufacturers/Importers of Part-A.

The covers will be opened by the Accepting authority at the above timings. Only one

authorised representative of each Manufacturer/Importer will be allowed to be present at the time of

opening of Covers. The authorised representatives shall produce proper authorisation to attend the

opening of Covers.

6. Application should be submitted in two parts as follows.

PART-A

With Annexures I, II, III, to be signed on all pages with necessary enclosures and should be

sent superscribed and sealed as “Application for the supply of ------------ for the period from August

2016 to July 2017” (Technical Specifications and Supply Terms) comprising Part –A of the

Application (Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-

Fertilisers and Plant Growth Regulator as the case may be).

The followings are the Annexures: Annexure – I Format for General Information of the manufacturer of Seeds, Pesticides,

Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator, and Earnest Money Deposit amount details.

7. The Earnest Money Deposit amount for this should be sent in the form of demand draft

The Earnest Money Deposit amount should be remitted for this application afresh and any previous Earnest Money Deposit amount available with TANFED will not be considered for this application. However the Manufacturers/Importers in the Cooperative sector are exempted from payment of this Earnest Money Deposit and in the participation of this offer as per directions issued in G.O.Ms.227 CF&CP Dept.14.3.1990. 9. Application received without Earnest Money Deposit amount is liable to be rejected.

10. The Earnest Money Deposit amount shall not carry any interest.

11. On acceptance of offer, the Earnest Money Deposit of the successful

Manufacturer/Importers will be refunded only after completion of statutory Audit of the institutions

for the years 2016-2017 and 2017-18 satisfactory performance of the contract and after deduction

of the amount if any due to the TANFED/TCMF/NCMS.

12.The Earnest Money Deposit will be refunded to the unsuccessful Manufacturer/Importers

within a reasonable time after finalization of the empanelment.

13. The person who signs the Application form should indicate in what capacity he is

signing the Application form and produce authorisation letter to this effect along with Part-A of the

Applications.

14. The Application Accepting Authority reserves the right to accept or reject the

Application in whole or in part without assigning any reasons thereof.

15. Any corrections/alterations in the documents have to be authenticated by the authorised

person.

16. The Manufacturer/Importer should submit the application form in the prescribed form

issued by TANFED. Application in any other form will be summarily rejected. If necessary

additional papers shall be used.

ANNEXURE II

TERMS AND CONDITIONS FOR THE SUPPLY OF SEEDS, PESTICIDES, AGRICULTURAL IMPLEMENTS, VERMI COMOST, Bio-PESTICIDES, BIO- FERTILISRS AND PLANT GROWTH REGULATOR 1. The Manufacturer/Importer shall supply the Seeds, Pesticides, Agricultural Implements,

Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator, as per the specifications

and packing required and as mentioned in each purchase order of TANFED / TCMF/NCMS to the

destinations furnished.

2. The packings shall be in tact in respect of Seeds, Pesticides, Agricultural Implements,

Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator and if any damages

noticed at the time of delivery TANFED / TCMF/NCMS has the right to reject such damaged stocks

and the Manufacturer/Importer shall replace such rejected stock within one week from the date of receipt

of intimation.

3. In the case of Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-

Fertilisers and Plant Growth Regulator, the Manufacturer/Importer shall furnish the test reports of the

representative samples analysed in Government or Government approved laboratory to ascertain the

quality as per the specifications required. Apart from the above, if need arises the

TANFED/TCMF/NCMS will have right to take representative samples from the stocks supplied by the

Manufacturer/Importer and analyse/ the same in Government or Government approved laboratory other

than the one mentioned above and cost will be borne by the Manufacturer/Importer.

4. Any deficiency or variation noticed in the laboratory report of the sample drawn will be assessed

and such stock will be kept separately and informed to the concerned for which they shall replace

such stock within one week from the date of intimation by TANFED / TCMF/NCMS. The

Manufacturer/Importer shall also bear all expenses and damages caused to TANFED/TCMF/NCMS

due to the deficiency as referred above.

5. Right of rejection: Notwithstanding the approval of standard or specification of Seeds,

Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant

Growth Regulator, by the authorised representative of the Manufacturer/Importer, it shall be lawful for

the purchaser, to reject the supplies, or any part, portion thereof, within a reasonable time after actual

delivery thereof, if such part, or portion thereof is not in all respect in conformity with the terms and

conditions of the contract.

6. Removal of Rejection:

Any Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-

Fertilisers and Plant Growth Regulator, rejected shall be removed by the Manufacturer/Importer, at his

cost within two weeks of the date of receipt of intimation of such rejection. Such rejected Seeds,


Growth Regulator shall under all circumstances lie at the risk of the Manufacturer/Importer, from the

moment of such rejection.

7. TANFED/TCMF/NCMS will issue purchase order giving details of destination to which stocks

shall be delivered on FOL basis. The Manufacturer/Importer shall commence the delivery of the stock

within three days from the date of receipt of the purchase order and complete the despatch of the entire

quantity of the purchase order within seven days. The destination and programme of the supply shall be at

the discretion of TANFED/TCMF/NCMS. The supply against the purchase order shall be made evenly to

all the destinations. If the supply is made continuously to one destination neglecting the others,

TANFED/TCMF/NCMS shall have the right to move the stocks from one destination to the other to which

supply is inadequate and transport and handling charges incurred thereof shall be reimbursed by the

concerned Manufacturer/Importer.

8. CANCELLATION:

If the Manufacturer/Importer fails to deliver the Seeds, Pesticides, Agricultural Implements,

within the period fixed for such delivery or at any time repudiates the contract, before the expiry of the

period, the purchaser may without prejudice to the right to recover damages for breach of the contract,

cancel the contract or a portion thereof and if so desired purchase or authorise the purchase of Seeds,


Growth Regulator, not so delivered or others of a similar description at the time and cost of the

Manufacturer.

9. In case the Manufacturer/Importer fails to effect delivery of the Seeds, Pesticides, Agricultural

Implements, within seven days from the date of receipt of purchase order, TANFED/TCMF/NCMS is at

liberty to purchase the stock in open market or from some other Manufacturer/Importer. The differential

cost between the cost at which purchased from other sources as mentioned above and agreed Empanelled

rate will be adjusted from such defaulter’s pending payment of bills and their Earnest Money Deposit. If

any amount is leftover and above the adjustment or not available for adjustment the same shall be

reimbursed by such defaulters.

10. While transporting the Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-

Pesticides, Bio-Fertilisers and Plant Growth Regulator by the Manufacturers/Importer to

TANFED/TCMF/NCMS Godown/Depots/PACCS adequate precautions shall be made to protect the stock

from damages in the transit.

11. The stocks despatched shall be covered with full insurance from the Manufacturers/Importer

supply point to respective delivery destinations at the Manufacturers’ cost. If the stocks are not covered by

the insurance the loss incurred by TANFED/TCMF/NCMS during transit shall be made good by the

Manufacturer/Importer.

12. If the Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-

Fertilisers and Plant Growth Regulator, cannot be unloaded by TANFED/TCMF/NCMS/PACCS in the

godowns by reasons of riot, civil commotion or of a strike or lock out of any class of labour or workmen

essential to the unloading or by reasons of obstructions or unforeseen events or stoppages beyond the

control of the TANFED/TCMF/NCMS the loss or any extra expenditures under the above circumstances

are not to the account of receivers.

13. Seeds, Pesticides, Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-Fertilisers

and Plant Growth Regulator, are to be delivered on F.O.L. destination basis to the PACCs and

acknowledgement from the authorised employees or officers of PACCs shall be obtained by the suppliers

and sent to the respective Regional Managers of TANFED/Managing Director TCMF and Managing

Director NCMS at Udhagamandalam.

14. The Manufacturer/Importer shall furnish purchase order wise supply details to the

TANFED/TCMF/NCMS every month.

15. Invoices in duplicate shall be submitted with VAT/CST numbers.

16. Invoices shall be prepared for the actual quantity supplied based on the G.R.N of

TANFED/TCMF/NCMS is excluding the shortage quantity and submitted Regionwise and payment will be

made after availing the interest free credit period from the date of supply.

a) The suppliers invoice shall contain their own delivery document number such as DC, PA No.

etc.,

b) The invoice of the suppliers shall also contain the purchase order number and date of

TANFED/TCMF/NCMS. (Signature with seal of the Manufacturer)

C) The supplier shall raise the invoices separately for each purchase order/Region without merging

two or more purchase orders/Regions in a single invoice. Invoice copy shall not be marked to the PACCs

at any cost.

d) The supplier shall allow the rebates/discounts which are agreed under the terms and conditions

in their invoice itself.

e) the difference in quantity between Invoice and the actual receipt as per G.R.N of

TANFED/TCMF/NCMS (Shortage quantity) shall be accounted by issue of credit note by the suppliers.

17. Failure to comply with the despatch instructions without any valid reasons will result in

cancellation of the contract and reempanelling at the risk and cost of the Manufacturer/Importer apart from

forfeiting the Earnest Money Deposit Amount .

18. Stocks shall be delivered as per despatch instructions immediately on receipt or within three days

to all the destinations from the date of receipt of instructions and complete within seven days from the date

of receipt of purchase order.

19. The Empanelled Firm has to execute an agreement in twenty rupees stamp paper for the proper

performance of the contract within 15 days from the date of appointment as approved supplier. Failure to

execute the said agreement, the Earnest Money Deposit, shall be forfeited. The payment for supply made

will be withheld till execution of agreement.

20. The price shall be for delivery at the destination given by TANFED/TCMF/NCMS and C

Form will be issued on request from the Manufacturer/Importer in the case of supply from other States.

The Manufacturer/Importer shall enclose price list of Seeds, Pesticides, Agricultural Implements,

Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator inclusive of all taxes.

They shall also furnish dealer’s price as well as Maximum Retail Selling price of Seeds, Pesticides,

Agricultural Implements, Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator

The price quoted shall be on par with or less than the rate quoted to Government Departments or other

Institutional agencies or private traders. No escalation of cost shall be claimed by the

Manufacturer/Importer during the contract period.

20(a) The supplier shall arrange to pay differential margin, rebates and rate to TANFED/TCMF/NCMS

over and above the agreed terms, if any allowed to private Traders/Other Institutional agencies during the

contract period.

21. Pesticides, price shall be quoted packing wise/variety wise along with chemical name and trade

name in the order. In the case of Seeds the price shall be quoted with variety and trade name for certified

seeds only. For Agricultural Implements the price shall be quoted for items specified.

22. The Manufacturer/Importer shall not sell Seeds, Pesticides, Agricultural Implements,

Vermicompost, Bio-Pesticides, Bio-Fertilisers and Plant Growth Regulator, at a price lower than the

quoted price to any other agency. If it is brought to the notice of TANFED/TCMF/NCMS that the

Manufacturer/Importer has supplied at lower price to other agencies, TANFED/TCMF/NCMS has the right

to impose penalty and recover the same from pending Bills/adjust the same in the Earnest Money Deposit.

TANFED/TCMF/NCMS will deduct the difference amount from the invoice of the Manufacturer/Importer

and make payment only for the balance amount besides recommending for black listing the firm to the

Director of Agriculture and State Government.

23. The Manufacturer/Importer shall supply stocks which have maximum self life. The date of

Manufacture/Importer Payment should be almost the date of supply. The invoices should contain details of

date of Manufacturer/Importer, shelf life, batch number and date of expiry. The Manufacturer/Importer

shall take back the nearing date expiry stock if intimated two months in advance and replace them with

fresh stocks within seven day’s time. If it is not replaced within seven day’s time the value of such stock to

be replaced will be adjusted from such defaulters pending payments and their Earnest Money Deposit. It

shall be competent for the Officers of TANFED/TCMF/NCMS to check the quality of the products at

anytime during the movement of stocks at the destination Point.

24. The Unsold stocks remaining for more than two months should be taken back by the supplier at his

own cost.

25. Sales Tax Liability:

As per the terms and conditions of the contract, the price quoted by Firm will be inclusive of tax

under Tamil Nadu Value Added Tax Act and it will be the responsibility of the Manufacturer/Importer to

pay the tax as per the provisions of the above said Act.

Therefore, the Manufacturer/Importer while preferring the claims for the payment of the stocks

supplied will have to necessarily raise the invoice by making provision for the taxes within the Quoted

price under the above said Act for all transactions. In case the Manufacturer/Importer fails to make clear

provisions for the taxes under above said Act, the taxes payable on such transactions will be deducted from

their bills as per the provisions of the Tamil Nadu VAT Act and the amount due for payment to the

Manufacturer will be arrived at.

25. Failure to comply with the terms and conditions of the contract or in the event of unsatisfactory

performance, the contract is liable to be cancelled and re-Empanelled at the risk and cost of the

Manufacturer/Importer and the damages will be recovered in addition to forfeiture of Earnest Money

Deposit.

27. Address of Manufacturer/Importer:

For all purposes of these terms and conditions, including Arbitration hereunder, the address of the

Manufacturer/Importer, mentioned in the offer shall be the address to which all communications addressed

to the Manufacturer/Importer shall be sent, unless the Manufacturer/Importer, has notified a change by

separate letter containing no other communication and sent by Registered Post, Acknowledgement due, to

the TANFED/TCMF/NCMS. The Manufacturer/Importer shall be solely responsible for the consequence

of an omission to notify a change of address in the manner aforesaid.

28. Change in the Firm of Manufacturer/Importer:

If the Manufacturer/Importer is a partnership firm, a new partner shall not be introduced in the firm

except with the previous consent in writing of the TANFED/TCMF/NCMS, which may be granted only

upon execution of a written undertaking by the new partner to perform the contract and accept all liabilities

incurred by the firm under the contract prior to the date of such undertaking.

29. If any dispute or differences of any kind whatsoever will arise between the Manufacturer/Importer

and TANFED/TCMF/NCMS in connection with or arising out of this contract, it shall in the first place be

settled by direct negotiation by both parties. If the parties fail to reach an amicable settlement within 30

days from the date of commencement of the direct negotiations, the dispute shall be referred to arbitration

by two arbitrators, to be nominated one each by every party, with an umpire to be included by the two

arbitrators. The decision of the arbitrators shall be final and binding on two parties.

30. In the event of any dispute arising out of the contract such dispute would be subject to the

jurisdiction of the Civil Courts within the city of Chennai.

31. The minimum credit period availing by TANFED/TCMF/NCMS is 30 days for all the products

from the date of receipt of stock. The Manufacturer/Importer shall quote for minimum 30 days credit

period in Sl. NO.4 of the price offer (Part B – price Bid). If less than 30 days offered such offers will be

rejected by the purchase Committee.

32. The liability for all losses or damages due to failure on the part of the supplier to perform the

contract in accordance with the terms and conditions in the Contract documents is fixed on the supplier.

The supplier agrees to pay TANFED/TCMF/NCMS towards such losses or damages together with interest

at 18.5% per annum. It shall be endeovur of the supplier to ensure the stock in transit is adequately

insured.

33. The supplier shall comply with all laws and statutory regulations of State and Central Government

applicable to the contract, labour laws and other laws and shall indemnify TANFED/TCMF/NCMS for all

losses/expenses which TANFED/TCMF/NCMS may sustain by reasons of suppliers failure to comply with

any of those statutory obligations.

3. Last date for receipt of the Sealed Tender form

containing Part-A (Specifications and Commercial Terms) and Part-

B (Price Offer) sealed covers separately at 11.30AM on

23.08.2016 as per office clock available at the chamber of

Managing director, TANFED, Chennai-18. Two samples of Neem Oil

Cake in the sealed cover should be submitted in separate covers

along with the Analysis report of the given sample from the Govt.

approved laboratory on 22.08.2016 itself. The Part-B (Price

Offer) sealed Tender cover will be opened after scrutiny of the

specification and commercial terms, and after the receipt of

sample test results. After scrutiny of Part-A only the samples

of the qualified Manufacturers of Part-A received along with the

Sealed Tender will be tested in the Government approved

laboratory and on receipt of test report the qualified

manufacturers, based on the test report only will be called for

opening of Part-B (Price Offer) Sealed Tender.

The Part-B (Price Offer) Sealed Quotations of the

disqualified Manufacturers in the scrutiny of the Part-A

(Specification and commercial terms) as well as even though who

are qualified in Part-A scrutiny and whose samples does not

conform to Indian Standard Specifications for Neem Oil Cake for

manuring as per the laboratory report will be rejected at the

opening stage itself. Further Sealed Tender received without two

samples along with laboratory report of the given sample from the

Govt. approved laboratory will be treated as incomplete and

liable for rejection for Part-A itself.

4. Date and time of opening of Sealed Tender at 12.00 Noon

on 23.08.2016 for Part-A tender cover (Specifications and

Commercial Terms). The time and date of opening of Part-B (price

Offer) will be intimated to the qualified Manufacturers after

obtaining test results.

6. The Earnest Money Deposit of Rs.1,00,000/- for Neem Oil

Cake for this Sealed Tender should be sent in the form of demand

draft drawn on any Nationalised Bank payable at Chennai in favour

of “The Tamil Nadu Cooperative Marketing Federation Ltd.,

Chennai-18”.

7. Earnest Money Deposit should be remitted for this Sealed

Tender by all the Manufacturers/Government undertakings/SSI Units

and exemption of any nature will not be accepted. However the

Cooperative sector is exempted from the payment of EMD as per

G.O.Ms. 227 CF&CP Dept., dt.14.3.1990.

8. Sealed Tender received without E.M.D is liable to be

rejected.

9. Earnest Money Deposit shall not carry interest.

10. On acceptance of offer, the Earnest Money Deposit of the

successful Manufacturer will be treated as security Deposit,

which will be refunded only after satisfactory performance of the

contract and after deduction of the amount if any due to the

TANFED/TCMF/NCMS/PACCS.

11. Earnest Money Deposit will be refunded to the

unsuccessful Manufacturer within one month’s time from the date

of finalisation of tender.

12. The person who signs the Sealed Tender form should

indicate in what capacity he is signing the documents and produce

authorisation letter to this effect along with Part-A of the

Sealed Tender.

ANNEXURE – II

TERMS AND CONDITIONS FOR SUPPLY OF NEEM OIL CAKE IN BAGS 1. Bags utilised for filling the Neem Oil Cake shall be NEW HDPE bags as per specifications given in the Annexure IV of the Sealed Tender documents. 2. The bags shall be machine stitched after filling. 3. The weight of each bag after filling shall be 40Kgs. for Neem Oil Cake (Net) which will be taken for assessment of quantity supplied by the Manufacturer for all purpose of the contract. 4. Representative sample shall be taken by the authorised representative of the Manufacturer on each day of delivery and analysed in Government or Government approved laboratory to ascertain the quality/nutrient content of the said Neem Oil Cake as per ISI specifications. Apart from the above, the TANFED/TCMF/NCMS will take representative sample from the stocks supplied by the Manufacturer and analyse in Government approved laboratory other than the one mentioned above and cost will be borne by the Manufacturer. 5. Any deficiency in the nutrient content or variation in the percentages of those nutrients noticed in the report of the sample drawn will be assessed and such stock will be kept separately and informed to the concerned for whom they shall replace such stock within seven days from the date of intimation by TANFED/TCMF/NCMS. If the stocks are not replaced within seven days, then the proportionate cost will be deducted from the supplier for the non-movement of that particular stock. If similar situation occurs more than twice no further new purchase orders will be issued to the supplier and the respective company will also be black-listed. The manufacturer shall also bear all expenses and damages caused to TANFED/TCMF/NCMS due to the deficiency as referred above. (Signature with Seal of the Manufacturer)

Right of Rejection: Not withstanding the approval of standard or specification or Neem Oil Cake by the authorised representative of the Manufacturer, it shall be lawful for the purchase, to reject the supplies, or any part, portion thereof, within a reasonable time after actual delivery thereof if such part, or portion thereof is not in all respects in conformity with the terms and conditions of the contract. 7. Removal of Rejected stock: Any stocks, rejected shall be removed by the Manufacturer, within two weeks of the date of receipt of intimation of such rejection. Such rejected stocks shall under all circumstances lie at the risk of the Manufacturer, from the moment of such rejection. 8. TANFED/TCMF/NCMS will issue purchase order giving the details of destination to which stocks shall be delivered on FOL basis. The Manufacturer shall commence the delivery of the stock within three days from the date of receipt of the purchase order and complete the despatch of the entire quantity of the purchase order within seven days. The destination and programme of the supply shall be at the discretion of TANFED/TCMF/NCMS. The Supply against the purchase order shall be made evenly to all the destinations. If the supply is made continuously to one destination neglecting the others TANFED/TCMF/NCMS shall have the right to move the stocks from one destination to the other to which the supply is inadequate and the transport and handling charges incurred thereon shall be reimbursed by the concerned Manufacturer. 9. Cancellation: If the Manufacturer, fails to deliver the stocks within the period fixed for such delivery or at any time repudiates the contract, before the expiry of the period, the TANFED/TCMF/NCMS may without prejudice to the right to recover damages for breach of the contract, cancel the contract or a portion thereof and if so desired purchase or authorise the purchase of Neem Oil Cake not so delivered from others of a similar description at the time and cost of the Manufacturer. 10. In case the Manufacturer fails to effect delivery of the stock within seven days from the date of receipt of purchase order TANFED/TCMF/NCMS is at liberty to purchase the stock in open market or from some other Manufacturer. The differential cost between the cost at which purchased from other sources as mentioned above and agreed tender rate will be adjusted from such defaulter’s pending payment of bills and their EMD. If any amount is left over and above the above adjustment or not available for adjustment the same shall be reimbursed by such defaulter. 11. While transporting the bags by the suppliers to the TANFED/TCMF/NCMS godowns / depots / PACCs / Warehouses, adequate precautions shall be made such as providing cover with good tarpaulins etc. 12. The stocks despatched shall be covered with full insurance from the Manufacturer’s supply point to the respective TANFED / TCMF / NCMS godowns / depots/PACCs /Warehouses, at Manufacturer’s cost. If the stocks are not covered by insurance, the loss incurred by TANFED/TCMF/NCMS during transit shall be made good by the Manufacturer. 13. If the stocks cannot be unloaded by the TANFED/TCMF/NCMS in the godowns/depots/PACCs by reasons of riot, civil commotion or of a strike or lock out of any class of labour or workmen essential to the unloading and stocking of bags or by reason of obstructions or unforeseen events or stoppages beyond the control of the TANFED/TCMF/NCMS the loss or any extra expenditures under the above circumstances are not to the account of the receivers. 14. Stocks are to be delivered on FOL destination basis and proper acknowledgement in the delivery challan of the supplier shall be obtained from the competent officer in addition to the second copy of the GRN from the buffer godown of TANFED/TCMF/NCMS and in case of direct supply to PACCs in addition to the acknowledgement in suppliers delivery challan second copy of the GRN of the PACCs shall be obtained by the suppliers. 15. The Manufacturer shall furnish purchase order wise supply details to the TANFED/TCMF/NCMS every fortnight. 16. Invoices in duplicate shall be submitted with TIN/CST Numbers. Invoices shall be prepared for the actual quantity supplied based on the GRN of TANFED/TCMF/NCMS (i.e) excluding the shortage quantity and submitted Region-wise to the General Manager (Finance and Accounts), TANFED/Managing Director TCMF/NCMS. 90% payments will be made after availing the interest free credit period from the date of supply and the balance 10% will be released only after the receipt of the test report from the Govt. approved laboratory conforming the specification of the material in annexure III and if the specifications are not of the requirements proportionate amount will be deducted in the 10% amounts to be given to the supplier. 17 a. The Supplier’s invoice shall contain their own delivery document numbers such as D.C. NO./W.D.N. NO./P.A.NO. In case of bulk supplies the above details shall be annexed alongwith the invoices by the suppliers. b. The invoice of the suppliers shall also contain the purchase order No. and date of TANFED/TCMF/NCMS. c. The supplier shall raise the invoices separately for each Region without merging two or more Regions in a single invoice. d. The supplier shall allow the rebates which are agreed under the terms and conditions in their invoice itself. e. In case of direct supply to the PACCs, the name of the PACCs and the name of the Regional Office shall be mentioned in the invoice clearly. f. The difference in quantity between Invoice and actual receipt as per the GRN of TANFED/TCMF/NCMS (Shortage quantity) shall be accounted by issue of credit note by the suppliers. 18. In the event of receipt of damaged bags at the time of delivery, expenses incurred for standardisation and re-stitching the bags at the receiver’s end on delivery shall be recovered from the Manufacturer. 19. A certificate from the TANFED/TCMF/NCMS that no expenses are incurred for re-stitching or re-bagging, etc., at the destination point is to be invariably attached with the bill to avoid delay in payment. 20. Failure to comply with the despatch instructions without any valid reasons will result in cancellation of the contract and re-tendering at the risk and the cost of the Manufacturer apart from forfeiting the E.M.D. (Signature with Seal of the Manufacturer)

Stocks shall be delivered as per despatch instructions immediately on receipt or within three days to all the destinations from the date of receipt of instructions and complete within seven days from the date of receipt of purchase order. 22. The successful tenderer has to execute an agreement in twenty rupees stamp paper for the proper performance of the contract within 15 days from the date of appointment as approved supplier. Failure to execute the said agreement, the E.M.D. shall be forfeited. The payment for supply made will be withheld till execution of agreement. 23. The price shall be for delivery at the destination given by TANFED/TCMF/NCMS and C –Form will be issued on request from the Manufacturer in the case of supply from other states. The Manufacturer shall quote only for the packing mentioned in the tender document. The price quoted shall be on par with or less than the rate quoted to Government Departments or other Institutional agencies or private dealers. 24. The Manufacturer shall arrange to pay the differential margin, rebates and rates to TANFED/TCMF/NCMS over and above the agreed terms, if any allowed to private traders/other institutional agencies during the contract period. 25. No escalation of cost shall be claimed by the Manufacturer during the contract period. The Manufacturer shall supply without any hindrance in the supply throughout the contract period. 26. If there is any abnormal rise/fall in the price of the product with in the tender period, then the committee may again negotiate with the supplier to fix the revised price and other terms and conditions. 27. Sales Tax Liability: As per the terms and conditions of the tender/contract, the price quoted by tenderer will be inclusive of tax under Tamil Nadu VAT Act and it will be the responsibility of the Manufacturer to pay the tax as per the provisions of the above said Act. Therefore, the Manufacturer while preparing the claims for the payment of the stocks supplied will have to necessarily raise the invoice by making provision for the taxes within the Quoted price under the above said Act for all transactions for which the invoice is raised. In case the Manufacturer fails to make clear provisions for the taxes under above said Act, the taxes payable on such transactions will be deducted from their bills as per the provisions of the Tamil Nadu VAT Act and the amount due for payment to the Manufacturer will be arrived at. Failure to comply with the terms and conditions of the contract or in the event of unsatisfactory performance, the contract is liable to be cancelled and re-tendered at the risk and cost of the Manufacturer and the damages will be recovered in addition to forfeiture of Earnest Money Deposit.

29. Address of Manufacturer: For all purposes of these terms and conditions, including Arbitration hereunder, the address of the Manufacturer mentioned in the tender shall be the address to which all communications to the Manufacturer shall be sent, unless the Manufacturer, has notified a change by separate letter containing no other communication and sent by Registered post, acknowledgement due, to the TANFED/TCMF/NCMS. The Manufacturer shall be solely responsible for the consequence of an omission to notify a change of address in the manner aforesaid. 30. Changes in the Firm of Manufacturer: Where the Manufacturer is a partnership firm, a new partner shall not be introduced in the firm except with the previous consent in writing of the TANFED/TCMF/NCMS, which may be granted only upon execution of a written undertaking by the new partner to perform the contract and accept all liabilities incurred/to be incurred by the firm under the contract prior to the date of such undertaking. 31. If any dispute or differences of any kind whatsoever will arise between the Manufacturer and TANFED/TCMF/NCMS in connection with or arising out of this contract, it will be in the first placeand it will be settled by direct negotiation by both parties. If the parties fail to reach an amicable settlement within 30 days from the date of commencement of the direct negotiations, the dispute will be referred to the arbitration by two arbitrators to be appointed by each party and an umpire to be appointed by each arbitrator. The decision of the arbitrator is binding on the parties and it will be final. 32. In the event of any dispute arising out of the contract such dispute would be subject to the jurisdiction of the civil courts within the city of Chennai. 33. The minimum credit period availing by TANFED/TCMF/NCMS is 30 days for Neem Oil Cake from the date of receipt of stock at their respective godowns. The Manufacturer shall quote for minimum 30 days credit period in Sl.No. 10 in the price offer (Part B- Price Bid). If less than 30 days offer such tenders will be rejected by the purchase committee.

34. The liability for all losses or damages due to failure on the part of the supplier to perform the contract in accordance with the terms and conditions in the tender documents is fixed on the supplier. The supplier agrees to pay TANFED/TCMF/NCMS liquidated damages as arrived at by TANFED/TCMF/NCMS towards such losses or damages together with interest at 18.5% per annum. 35. The supplier shall comply with all laws and statutory regulations of State and Central Government applicable to the contract, labour laws and other laws and shall indemnify TANFED/TCMF/NCMS for all losses/expenses which TANFED/TCMF/NCMS may sustain by reasons of supplier's failure to comply with any of those statutory obligations.

1.SCOPE:- 1.1 This standard prescribes the requirements and methods of sampling and test for NEEM OIL CAKE for manuring. The oil cake obtained by all processes, including solvent extraction is covered in this standard. 2.REQUIREMENTS:- 2.1 Description – The material shall be of uniform texture, clean and free from adulteration, such as sand, dust and metallic pieces. 2.2 The material shall pass wholly through 2.36mm Is sieve of which not less than 70 percent shall pass through 850 microns Is sieve (See IS: 460-1962*). 2.3 The material shall comply with the requirements given when tested according to the methods prescribed in IS: 7874 (Part I) -1975 and Appendix A. Reference to relevant clauses of IS: 7874 (Part-I) 1975 is given in Col.5 of the table.
