ELEVATORS: THE INSPECTION BASICS

n  Most devices require an annual Category 1 inspection (also referred to as “test”), and all rope-driven devices (non-hydraulic) require a Category 5 inspection every 5 years

n  These inspections are performed by elevator vendors and witnessed by a third party elevator consultant

n  When both tests fall in the same year, owners can have the test performed at the same time and filed on the same ELV-3 form

n  Tests must be delivered to the owner within 30 days of the inspection date, and filed with the Elevator Division within 60 days of the inspection date

n  Late filings for Category 1 tests are $150/month, and $250/month for Category 5 tests

ELEVATORS: INSPECTION RESULTS

n  Accepted- Satisfactory n  This test has fulfilled the requirements for the filing year-

no further action is needed n  Accepted- Unsatisfactory

n  This test requires work outlined in an Affirmation of Correction (AOC or ELV-29) before it will count as a complete filing for the year

n  Defects must be corrected within 120 days of the original inspection date, and AOC must be filed within 60 days of the date of correction (total 180 days to correct and file)

n  Failure to file an Affirmation of Correction can lead to violations and fines

n  Submitting an approved Affirmation of Correction will update the status to “Accepted- Correction” or “Correction”

n  Rejected- Disapproved n  This test has been immediately rejected by the Division for

clerical reasons or outstanding fines

n  Administratively issued for failure to file the annual Category 1 inspection

n  Violations issued in 2013 or earlier require a penalty sheet to identify noncompliant devices and correct; later violations are issued one per noncompliant device

n  Fines for VCAT1 and LL 10/81 stand at $1,000 per noncompliant device

n  Current fine for EVCAT1 is $3,000 per noncompliant device n  IMPORTANT: Violations for the 2014 cycle were issued in

June 2015, six months after the cycle’s end. This is a much smaller window than violations for the 2013 cycle, issued in October 2014 (10 months), and violations for the 2012 cycle, issued in March 2014 (15 months)

n  Administratively issued for failure to file an Affirmation of Correction for an Unsatisfactory Category 1 inspection

n  Violations issued in 2013 or earlier require a penalty sheet to identify noncompliant devices and correct; later violations are issued one per noncompliant device

n  Fines for the ACC1 are $3,000 per noncompliant device- same as if you never filed the inspection report at all

n  IMPORTANT: Due to a technical error, the DOB has rescinded all fines associated with ACC1 violations issued in 2014- if you have already paid the fine for 2014 ACC1 violations, you are eligible for a refund

ELEVATORS: ALTERNATE VIOLATIONS n  PVT (E-ELEVATOR) violations

n  DOB hires third party inspectors to perform periodic inspections of elevator devices. PVTs may be issued for failure to maintain the device

n  You can clear nonhazardous PVTs by submitting an AOC or maintaining satisfactory Category 1 compliance

n  Available PVT copies can be found and instantly downloaded in your SiteCompli account

n  DOB-ECB violations n  These violations are issued by DOB inspectors typically

following a 311 complaint n  Require a Certificate of Correction and a potential ECB

hearing/subsequent fine n  Can escalate into additional penalties if Certificate of

Correction goes unfiled

BOILERS: THE INSPECTION BASICS

n  The DOB requires annual inspections for low pressure boilers to be filed by 12/31 of each year

n  Inspections (BO-9 form) must be submitted to the Boiler Division 45 days after the test date, and must be performed by a qualified boiler inspector either authorized by the DOB or employed by an authorized insurance company

n  Late penalties of $50/boiler/month are assessed for reports submitted after the 45 day period

n  If the report is filed with status “Defects Exist,” correction paperwork must be filed within 180 days of the initial inspection

n  High pressure boilers have two inspections within the annual cycle: internal and external

BOILERS: WHAT IS DDPROJ?

n  The DOB has made recent efforts to remove duplicate boilers in their system

n  Boilers that list “DDPROJ NEW BLR # ISSUED” have been assigned a new boiler number and have no previous inspection history on file

n  The “inspection date” listed is not a traditional annual date, and according to the DOB, these entries do not require an inspection and should not receive violations for failure to file within the year the new number was issued

n  LBLVIO OR LL 62/91 n  Administratively issued violation for failure to file

an annual boiler inspection report n  Fines for LL 62/91 (issued in 2009 and earlier) are

$500 per building for properties 6 stories and under, and $1500 per building for properties 7 stories and over

n  Fines for LBLVIO violations (issued since 2010) are $1,000 per boiler regardless of property size

n  Closing either violation requires payment of the fine and printouts from DOB BIS showing that the current annual inspection is in compliance

BOILERS: DECOMMISSIONING

n  Many buildings undergo renovations or demolitions without removing active boilers n  This can result in violations for failure to file

inspections on nonexistent devices n  To remove or disconnect a boiler, you must

submit the OP-49 form and $45 filing fee to the Boiler Division n  This process requires a visit from an authorized

master plumber to confirm and certify removal n  This is highly important to prevent unnecessary

violations that may take time to administratively remove

BEST PRACTICES

n  Communicate with your vendors n  Request date-stamped copies of filings and

corrections n  Add them to SiteCompli for equipment related

n  The DOB’s delay in processing inspection paperwork can make keeping track of devices difficult- create an automatically recurring SiteCompli report to stay up-to-date on all filings
