    It appears that the 326 federally recognized AmericanIndian reservations (according to the Bureau of IndianAffairs) have been given the green light to grow and sellmarijuana on tribal lands without fear of prosecution.

    The Department of Justice recently released a threepage memo announcing that the federal governmentwill not prosecute Native Americans growing and sellingmarijuana on tribal lands. The new federal policy will allow

    tribes interested in growing and selling marijuana to do so,if they maintain robust and effective regulatory systems,according to John Walsh, the U.S. attorney for Colorado.

    The memo says the federal ban on marijuana sbut federal authorities will focus its limited inand prosecutorial resources on the preventiocircumstances:

    distribution of marijuana to minors; revenue from marijuana from going to criminal en diversion of marijuana to states where it is not leg marijuana activity being used as a pretext for traf

    rections:reheat oven to 350 degrees F (175 degrees C). Spray a baking sheet with cooking spray. Clean mushrooms withdamp paper towel. Carefully break off stems. Chop stems extremely fine, discarding tough end of stems. Heat oila large skillet over medium heat. Add garlic and chopped mushroom stems to the skillet. Fry until any moistures disappeared, taking care not to burn garlic. Set aside to cool.

    When garlic and mushroom mixture is no longer hot, stir in cream cheese, Parmesan cheese, black pepper, onionwder and cayenne pepper. Mixture should be very thick. Using a little spoon, fill each mushroom cap with anerous amount of stuffing. Arrange the mushroom caps on prepared cookie sheet. Bake for 20 minutes in theeheated oven, or until the mushrooms are piping hot and liquid starts to form under caps.

    Directions:Place cubed potatoes into a large kettle and cover with water. Bring to a boil over medium-high heat, then

    to medium-low, cover, and simmer until the potatoes are just tender, 15 to 20 minutes. Drain and spread onto baking sheets in a single layer. Chill the potatoes in the refrigerator until cold, about 2 hours.

    Colorado Residents may receive a windfall tax refundor credit next year in the range of $60 to $107 milliondue to the new tax on recreational cannabis. The states

    Taxpayer Bill of Rights, or TABOR, sets limits on how muchthe government can tax its residents, and if that limit isexceeded, refunds may be given out.

    The actual amount will not be determined until the end ofthe 2015 fiscal year. The rebate or credit would then beapplied on the 2016 tax forms. However, the ColoradoLegislature will determines how the rebate will be used ordistributed.

    While most Colorado residents would prefer a cashrebate, a direct refund may not be given at all. Rather,several options of how the State would keep anddistribute the money are on the table. Residents might begiven a credit on next years tax bill, or be given a lowersales tax rate.

    Another major concern for Colorado and Washingtonalike is the arduous tax on recreational marijuana incompetition with the lower rate for the medical marijuanacounterpart. The number of medical marijuana patientshas increased significantly, instead of the expecteddecrease, since recreational use has become legal.Officials are looking into ways to bridge the gap of taxationover recreational use verses medical use of marijuanaequitably without over burdening current medical patients.Rick Garza of the Washington Liquor Control Board raisedthe question, How can you have two parallel systems, onethats regulated, paying taxes, playing by the rules, and theother thats not doing any of those things?

    Many residents using recreational marijuana arecontinuing to be labeled as medical patients, meaning theypay lower tax rates. An equitable solution for this gap maybe part of the Legislatures discussions over what to do withthe rebate funds.
