    AN ACT PROVIDING FOR AN ECOLOGICAL SOLID ASTE!ANAGE!ENT PROGRA!, CREATING T"E NECESSAR#

    INSTITUTIONAL !EC"ANIS!S AND INCENTIVES, DECLARINGCERTAIN ACTS PRO"IBITED AND PROVIDING PENALTIES,

    APPROPRIATING FUNDS T"EREFOR, AND FOR OT"ERPURPOSES

    Be it enacted by the Senate and House of Representative of thePhilippines in Congress assembled:

    C"APTER IBASIC POLICIES

    S(&$%)n 1Short Title- This Act shall be known as the "Ecological

    Solid Waste Management Act of 2000."

    S(&$%)n 2Declaration of Policies- It is hereb declared the !olicof the State to ado!t a sstematic com!rehensi#e and ecologicalsolid waste management !rogram which shall$

    %a& Ens're the !rotection of the !'blic health anden#ironment(

    %b& )tili*e en#ironmentall-so'nd methods that ma+imi*ethe 'tili*ation of #al'able reso'rces and enco'rage reso'rceconser#ation and reco#er(

    %c& Set g'idelines and targets for solid waste a#oidance and#ol'me red'ction thro'gh so'rce red'ction and wasteminimi*ation meas'res incl'ding com!osting reccling re-'se reco#er green charcoal !rocess and others beforecollection treatment and dis!osal in a!!ro!riate anden#ironmentall so'nd solid waste management facilities inaccordance with ecologicall s'stainable de#elo!ment!rinci!les(

    %d& Ens're the !ro!er segregation collection trans!ortstorage treatment and dis!osal of solid waste thro'gh theform'lation and ado!tion of the best en#ironmental !racticein ecological waste management e+cl'ding incineration(

    %e& ,romote national research and de#elo!ment !rogramsfor im!ro#ed solid waste management and reso'rceconser#ation techni'es more eecti#e instit'tional

    arrangement and indigeno's and im!ro#ed methods ofwaste red'ction collection se!aration and reco#er(

    %f& Enco'rage greater !ri#ate sector !artici!ation in solidwaste management(

    %g& /etain !rimar enforcement and res!onsibilit of solidwaste management with local go#ernment 'nits whileestablishing a coo!erati#e eort among the nationalgo#ernment other local go#ernment 'nits non- go#ernmentorgani*ations and the !ri#ate sector(

    %h& Enco'rage coo!eration and self-reg'lation among wastegenerators thro'gh the a!!lication of market-basedinstr'ments(

    %a& Agric'lt'ral waste shall refer to waste generated from!lanting or har#esting of cro!s trimming or !r'ning of!lants and wastes or r'n-o materials from farms or 3elds(

    %b& 4'lk wastes shall refer to waste materials which cannotbe a!!ro!riatel !laced in se!arate containers beca'se ofeither its b'lk si*e sha!e or other !hsical attrib'tes.These incl'de large worn-o't or broken ho'sehold

    commercial and ind'strial items s'ch as f'rnit're lam!sbookcases 3ling cabinets and other similar items(

    %c& 4'rea' shall refer to the En#ironmental Management4'rea'(

    %d& 4'-back center shall refer to a reccling center that!'rchases of otherwise acce!ts recclable materials fromthe !'blic for the !'r!ose of reccling s'ch materials(

    %e& 5ollection shall refer to the act of remo#ing solid waste

    from the so'rce or from a comm'nal storage !oint(

    %f& 5om!osting shall refer to the controlled decom!osition oforganic matter b micro-organisms mainl bacteria andf'ngi into a h'm's-like !rod'ct(

    %g& 5ons'mer electronics shall refer to s!ecial waste thatincl'des worn-o't broken and other discarded items s'chas radios stereos and T6 sets(

    %h& 5ontrolled d'm! shall refer to a dis!osal site at whichsolid waste is de!osited in accordance with the minim'm

    !rescribed standards of site o!eration(

    %i& 7e!artment shall refer to the 7e!artment of En#ironmentand 8at'ral /eso'rces(

    %& 7is!osal shall refer to the discharge de!osit d'm!ings!illing leaking or !lacing of an solid waste into or in anland(

    %k& 7is!osal site shall refer to a site where solid waste is3nall discharged and de!osited(

    %l& Ecological solid waste management shall refer to thesstematic administration of acti#ities which !ro#ide forsegregation at so'rce segregated trans!ortation storagetransfer !rocessing treatment and dis!osal of solid wasteand all other waste management acti#ities which do notharm the en#ironment(

    %m& En#ironmentall acce!table shall refer to the 'alit of

    being re-'sable biodegradable or com!ostable recclableand not to+ic or ha*ardo's to the en#ironment(

    %n& 9eneration shall refer to the act or !rocess of !rod'cingsolid waste(

    %o& 9enerator shall refer to a !erson nat'ral or 'ridicalwho last 'ses a material and makes it a#ailable for dis!osalor reccling(

    %!& :a*ardo's waste shall refer to solid waste management

    or combination of solid waste which beca'se of its 'antitconcentration or !hsical chemical or infectio'scharacteristics ma$

    %& ca'se or signi3cantl contrib'te to an increase inmortalit or an increase in serio's irre#ersible orinca!acitating re#ersible illness( or

    %2& !ose a s'bstantial !resent or !otential ha*ard toh'man health or the en#ironment when im!ro!erltreated stored trans!orted or dis!osed of orotherwise managed(

    %& ;eachate shall refer to the li'id !rod'ced when waste'ndergo decom!osition and when water !ercolate thro'ghsolid waste 'ndergoing decom!osition. It is contaminatedli'id that contains dissol#ed and s's!ended materials(

    %r& Materials reco#er facilit - incl'des a solid wastetransfer station or sorting station dro!-o center acom!osting facilit and a reccling facilit(

    %s& M'nici!al waste shall refer to wastes !rod'ced fromacti#ities within local go#ernment 'nits which incl'de acombination of domestic commercial instit'tional andind'strial wastes and street litters(

    %t&

    %#& ,erson%s& shall refer to an being nat'ral or 'dicials'sce!tible of rights and obligations or of being the s'bectof legal relations(

    %w& ,ost-cons'mer material shall refer onl to thosematerials or !rod'cts generated b a b'siness or cons'merwhich ha#e ser#ed their intended end 'se and which ha#ebeen se!arated or di#erted from solid waste for the !'r!oseof being collected !rocessed and 'sed as a raw material inthe man'fact'ring of reccled !rod'ct e+cl'ding materialsand b-!rod'cts generated from and b-!rod'cts generated

    from and commonl 'sed within an original man'fact'ring!rocess s'ch as mill scra!(

    %+& /ece!tacles shall refer to indi#id'al containers 'sed forthe so'rce se!aration and the collection of recclablematerials(

    %& /eco#ered material shall refer to material and b!rod'cts that ha#e been reco#ered or di#erted from solidwaste for the !'r!ose of being collected !rocessed and

    'sed as a raw material in the man'fact're of a reccled!rod'ct(

    %*& /ecclable material shall refer to an waste materialretrie#ed from the waste stream and free fromcontamination that can still be con#erted into s'itablebene3cial 'se or for other !'r!oses incl'ding b't notlimited to news!a!er ferro's scra! metal non-ferro's

    scra! metal 'sed oil corr'gated cardboard al'min'mglass o=ce !a!er tin cans and other materials as ma bedetermined b the 5ommission(

    %aa& /eccled material shall refer to !ost-cons'mer materialthat has been reccled and ret'rned to the econom(

    %bb& /eccling shall refer to the treating of 'sed or wastematerials thro'gh a !rocess of making them s'itable forbene3cial 'se and for other !'r!oses and incl'des an!rocess b which solid waste materials are transformed intonew !rod'cts in s'ch a manner that the original !rod'ctma lose their identit and which mabe 'sed as rawmaterials for the !rod'ction of other goods orser#ices$ Provided That the collection segregation and re-'se of !re#io'sl 'sed !ackaging material shall be deemedreccling 'nder this Act(

    %cc& /eso'rce con#ersation shall refer to the red'ction of theamo'nt of solid waste that are generated or the red'ction ofo#erall reso'rce cons'm!tion and 'tili*ation of reco#eredreso'rces(

    %dd& /eso'rces reco#er shall refer to the collectione+traction or reco#er of recclable materials from thewaste stream for the !'r!ose of reccling generatingenerg or !rod'cing a !rod'ct s'itable for bene3cial'se$ Provided That s'ch reso'rce reco#er facilities e+cl'deincineration(

    %ee& /e-'se shall refer to the !rocess of reco#ering materialsintended for the same or dierent !'r!ose witho't thealteration of !hsical and chemical characteristics(

    %& Sanitar land3ll shall refer to a waste dis!osal sitedesigned constr'cted o!erated and maintained in amanner that e+erts engineering control o#er signi3cant!otential en#ironment im!acts arising from thede#elo!ment and o!eration of the facilit(

    %gg& Sched'le of 5om!liance shall refer to an enforceablese'ence of actions or o!erations to be accom!lished within

    a sti!'lated time frame leading to com!liance with alimitation !rohibition or standard set forth in this Act or anr'le of reg'lation iss'ed !'rs'ant thereto(

    %hh& Secretar land3ll shall refer to the Secretar of the7e!artment of En#ironment and 8at'ral /eso'rces(

    %ii& Segregation shall refer to a solid waste management!ractice of se!arating dierent materials fo'nd in solidwaste in order to !romote reccling and re-'se of reso'rcesand to red'ce the #ol'me of waste for collection anddis!osal(

    %& Segregation at so'rce shall refer to a solid wastemanagement !ractice of se!arating at the !oint of origindierent materials fo'nd in solid waste in order to !romotereccling and re-'se of reso'rces and to red'ce the #ol'meof waste for collection and dis!osal(

    %kk& Solid waste shall refer to all discarded ho'seholdcommercial waste non-ha*ardo's instit'tional andind'strial waste street swee!ings constr'ction debrisagric'lt'ral waste and other non-ha*ardo's?non-to+ic solid

    waste.

    )nless s!eci3call noted otherwise the term "solid waste"as 'sed in this Act shall not incl'de$

    %& Waste identi3ed or listed as ha*ardo's waste of asolid li'id contained gaseo's or semisolid formwhich ma ca'se or contrib'te to an increase inmortalit or in serio's or inca!acitating re#ersibleillness or ac'te?chronic eect on the health of!ersons and other organisms(

    %2& Infectio's waste from hos!itals s'ch ase'i!ment instr'ments 'tensils and fomites of adis!osable nat're from !atients who are s's!ectedto ha#e or ha#e been diagnosed as ha#ingcomm'nicable diseases and m'st therefore beisolated as re'ired b !'blic health agencieslaborator wastes s'ch as !athological s!ecimens%i.e. all tiss'es s!ecimens of blood elements

    e+creta and secretions obtained from !atients orlaborator animals& and dis!osable fomites that maharbor or transmit !athogenic organisms ands'rgical o!erating room !athologic materials fromo't!atient areas and emergenc rooms( and

    %>& Waste res'lting from mining acti#ities incl'dingcontaminated soil and debris.

    %ll& Solid waste management shall refer to the disci!lineassociated with the control of generation storagecollection transfer and trans!ort !rocessing and dis!osal

    of solid wastes in a manner that is in accord with the best!rinci!les of !'blic health economics engineeringconser#ation aesthetics and other en#ironmentalconsiderations and that is also res!onsi#e to !'blicattit'des(

    %mm& Solid waste management facilit shall refer to anreso'rce reco#er sstem or com!onent thereof( ansstem !rogram or facilit for reso'rce conser#ation( anfacilit for the collection so'rce se!aration storagetrans!ortation transfer !rocessing treatment or dis!osalof solid waste(

    %nn& So'rce red'ction shall refer to the red'ction of solidwaste before it enters the solid waste stream b methodss'ch as !rod'ct design materials s'bstit'tion materials re-'se and !ackaging restrictions(

    %oo& So'rce se!aration shall refer to the sorting of solidwaste into some or all of its com!onent !arts at the !oint ofgeneration(

    %!!& S!ecial wastes shall refer to ho'sehold ha*ardo'swastes s'ch as !aints thinners ho'sehold batteries lead-acid batteries s!ra canisters and the like. These incl'dewastes from residential and commercial so'rces thatcom!rise of b'lk wastes cons'mer electronics whitegoods ard wastes that are collected se!aratel batteriesoil and tires. These wastes are 's'all handled se!aratelfrom other residential and commercial wastes(

    %& Storage shall refer to the interim containment of solidwastes after generation and !rior to collection for 'ltimatereco#er or dis!osal(

    %rr& Transfer stations shall refer to those facilities 'tili*ed torecei#e solid wastes tem!oraril store se!arate con#ert orotherwise !rocess the materials in the solid wastes or totransfer the solid wastes directl from smaller to larger#ehicles for trans!ort. This term does not incl'de an of thefollowing$

    %& a facilit whose !rinci!al f'nction is to recei#estore se!arate con#ert or otherwise !rocess inaccordance with national minim'm standardsman're(

    %2& a facilit whose !rinci!al f'nction is to recei#estore con#ert or otherwise !rocess wastes whichha#e alread been se!arated for re-'se and areintended for dis!osals and

    %>& the o!erations !remises of a d'l licensed solid

    waste handling o!erator who is recei#es storestransfers or otherwise !rocesses wastes as anacti#it incidental to the cond'ct of a ref'secollection and dis!osal b'siness.

    %ss& Waste di#ersion shall refer to acti#ities which red'ce oreliminate the amo'nt of solid waste from waste dis!osalfacilities(

    %tt& White goods shall refer to large worn-o't or brokenho'sehold commercial and ind'strial a!!liances s'ch as

    sto#es refrigerators dishwashers and clothes washers anddrers collected se!aratel. White goods ate 's'alldismantled for the reco#er of s!eci3c materials %e.g.co!!er al'min'm etc.&(

    %''& ard waste shall refer to wood small or chi!!edbranches lea#es grass cli!!ings garden debris #egetableresid'e that is recogni*ed as !art of a !lant or #egetable

    and other materials identi3ed b the 5ommission.

    C"APTER IIINSTITUTIONAL !EC"ANIS!

    S(&$%)n ational Solid !aste "anagement Commission- Thereis hereb established a 8ational Solid Waste Management5ommission hereinafter referred to as the 5ommission 'nder the

    %i& 7e#elo! a mechanism for the im!osition of sanctions forthe #iolations en#ironmental r'les and reg'lations(

    %& Manage the Solid Waste Management 1'nd(

    %k& 7e#elo! and !rescribe !roced'res for the iss'ance ofa!!ro!riate !ermits and clearances.

    %l& /e#iew the incenti#es scheme for eecti#e solid wastemanagement for !'r!ose of ens'ring rele#ance and

    e=cienc in achie#ing the obecti#es of this Act(

    %m& 1orm'late the necessar ed'cation !romotion andinformation cam!aign strategies(

    %n& Establish after notice and hearing of the !artiesconcerned standards criteria g'idelines and form'la thatare fair e'itable and reasonable in establishing ti!!ingcharges and rates that the !ro!onent will charge in theo!eration and management of solid waste managementfacilities and technologies.

    %o& 7e#elo! safet nets and alternati#e li#elihood !rogramsfor small recclers and other sectors that will be aected asa res'lt of the constr'ction and?or o!eration of solid wastemanagement reccling !lant or facilit.

    %!& 1orm'late and '!date a list of non-en#ironmentallacce!table materials in accordance with the !ro#isions ofthis Act. 1or this !'r!ose it shall be necessar that !ro!ercons'ltation be cond'cted b the 5ommission with allconcerned ind'stries to ens're a list that is based ontechnological and economic #iabilit.

    %& Enco'rage !ri#ate sector initiati#es comm'nit!artici!ation and in#estments reso'rce reco#er-basedli#elihood !rograms for local comm'nities.

    %r& Enco'rage all local go#ernment agencies and all localgo#ernment 'nits to !atroni*e !rod'cts man'fact'red 'singreccled and recclable materials(

    %s& ,ro!ose and ado!t reg'lations re'iring the so'rcese!aration and !ost se!aration collection segregatedcollection !rocessing marketing and sale of organic anddesignated recclable material generated in each localgo#ernment 'nit( and

    %t& St'd and re#iew of the following$

    %i& Standards criteria and g'idelines for !rom'lgationand im!lementation of an integrated national solidwaste management framework( and

    %ii& 5riteria and g'idelines for siting designo!eration and maintenance of solid wastemanagement facilities.

    S(&$%)n 6"eetings- The 5ommission shall meet at least once amonth. The !resence of at least a maorit of the members shallconstit'te a 'or'm. The chairman or in his absence the #ice-chairman shall be the !residing o=cer. In the absence of the headsof the agencies mentioned in Sec. @ of this Act the ma designate!ermanent re!resentati#es to attend the meetings.

    S(&$%)n The ational (cology Center- There shall beestablished a 8ational Ecolog 5enter 'nder the 5ommission whichshall !ro#ide cons'lting information training and networkingser#ices for the im!lementation of the !ro#isions of this Act.

    In this regard it shall !erform the following f'nctions$

    %a& 1acilitate training and ed'cation in integrated ecologicalsolid waste management(

    %b& Establish and manage a solid waste managementinformation data base in coordination with the 7TI andother concerned agencies$

    %& on solid waste generation and managementtechni'es as well as the management technicaland o!erational a!!roaches to reso'rce reco#er(and

    %2& of !rocessors?recclers the list of materials beingreccled or bo'ght b them and their res!ecti#e!rices(

    %c& ,romote the de#elo!ment of a reccling market thro'ghthe establishment of a national reccling network that willenhance the o!!ort'nit to reccle(

    %d& ,ro#ide or facilitate e+!ert assistance in !ilot modeling ofsolid waste management facilities( and

    %e& 7e#elo! test and disseminate model wasteminimi*ation and red'ction a'diting !roced'res fore#al'ating o!tions.

    The 8ational Ecolog 5enter shall be headed b the director of the4'rea' in his e# o$cioca!acit. It shall maintain a m'lti-sectoralm'lti-disci!linar !ool of e+!erts incl'ding those from theacademe in#entors !racticing !rofessionals b'siness andind'str o'th women and other concerned sectors who shall bescreened according to 'ali3cations set b the 5ommission.

    S(&$%)n Role of the Departmen)- 1or the f'rtherance of theobecti#es of this Act the 7e!artment shall ha#e the followingf'nctions$

    %a& 5hair the 5ommission created !'rs'ant to this Act(

    %b& ,re!are an ann'al 8ational Solid Waste ManagementStat's /e!ort(

    %c& ,re!are and distrib'te information ed'cation andcomm'nication materials on solid waste management(

    %d& Establish methods and other !arameters for themeas'rement of waste red'ction collection and dis!osal(

    %e& ,ro#ide technical and other ca!abilit b'ilding assistanceand s'!!ort to the ;9)s in the de#elo!ment andim!lementation of local solid waste management !lans and!rograms(

    %f& /ecommend !olicies to eliminate barriers to wastered'ction !rograms(

    %g& E+ercise #isitorial and enforcement !owers to ens'restrict com!liance with this Act(

    %h& ,erform s'ch other !owers and f'nctions necessar toachie#e the obecti#es of this Act( and

    %i& Iss'e r'les and reg'lations to eecti#el im!lement the!ro#isions of this Act.

    S(&$%)n 9*isitorial Po&ers of the Department)- The 7e!artmentor its d'l a'thori*ed re!resentati#e shall ha#e access to and theright to co! therefrom the records re'ired to be maintained!'rs'ant to the !ro#isions of this Act. The Secretar or the d'la'thori*ed re!resentati#e shall likewise ha#e the right to enter the!remises of an generator reccler or man'fact'rer or otherfacilities an time to 'estion an em!loee or in#estigate an factcondition or matter which ma be necessar to determine an#iolation or which ma aid in the eecti#e enforcement of this Actand its im!lementing r'les and reg'lations. This Section shall nota!!l to !ri#ate dwelling !laces 'nless the #isitorial !ower is

    otherwise 'diciall a'thori*ed.

    S(&$%)n 10Role of +,-s in Solid !aste "anagement- ,'rs'ant tothe rele#ant !ro#isions of /.A. 8o. DC0 otherwise known as the;ocal go#ernment code the ;9)s shall be !rimaril res!onsible forthe im!lementation and enforcement of the !ro#isions of this Actwithin their res!ecti#e 'risdictions.

    Segregation and collection of solid waste shall be cond'cted at thebaranga le#el s!eci3call for biodegradable com!ostable andre'sable wastes$ Provided That the collection of non-recclable

    materials and s!ecial wastes shall be the res!onsibilit of them'nici!alit or cit.

    S(&$%)n 11Provincial Solid !aste "anagement Board- A,ro#incial Solid Waste Management board shall be established ine#er !ro#ince to be chaired b the go#ernor. Its members shallincl'de$

    %a& All the maors of its com!onent cities and m'nici!alities(

    The ,ro#incial ,lans shall reGect the general !rogram ofaction and initiati#es of the !ro#incial go#ernment andim!lementing a solid waste management !rogram that

    wo'ld s'!!ort the #ario's initiati#es of its com!onent citiesand m'nici!alities.

    %2& ,ro#ide the necessar logistical and o!erational s'!!ortto its com!onent cities and m'nici!alities in consonancewith s'bsection %f& of Sec.D of the ;ocal 9o#ernment 5ode(

    %>& /ecommend meas'res and safeg'ards against !oll'tionand for the !reser#ation of the nat'ral ecosstem(

    %@& /ecommend meas'res to generate reso'rces f'ndingand im!lementation of !roect and acti#ities as s!eci3ed inthe d'l a!!ro#ed solid waste management !lans(

    %B& Identif areas within its 'risdiction which ha#e commonsolid waste management !roblems and are a!!ro!riate'nits are !lanning local solid waste management ser#ices inaccordance with Section @ hereof(

    %C& 5oordinate the eorts of the com!onent cities andm'nici!alities in the im!lementation of the ,ro#incial SolidWaste Management ,lan(

    %D& 7e#elo! an a!!ro!riate incenti#e scheme as an integralcom!onent of the ,ro#incial Solid Waste Management ,lan(

    %& 5on#ene oint meetings of the !ro#incial cit andm'nici!al solid waste management boards at least e#er'arter for !'r!oses of integrating snchroni*ingmonitoring and e#al'ating the de#elo!ment andim!lementation of its !ro#incial solid waste management!lan(

    S(&$%)n 16+ocal ,overnment Solid !aste "anagement Plans-The !ro#ince cit or m'nici!alit thro'gh its local solid wastemanagement boards shall !re!are its res!ecti#e 0-ear solidwaste management !lans consistent with the national solid wastemanagement framework$ Provided That the waste management!lan shall be for the re-'se reccling and com!osting of wastes

    generated in their res!ecti#e 'risdictions$ Provided further Thatthe solid waste management !lan of the ;9) shall ens're thee=cient management of solid waste generated within its'risdiction.     S(&$%)n 1The Components of the +ocal ,overnment Solid !aste

    "anagement Plan- The solid waste management !lan shallincl'de b't not limited to the following com!onents$

    %a& 5it or M'nici!al ,ro3le - The !lan shall indicate thefollowing backgro'nd information on the cit or m'nici!alitand its com!onent barangas co#ering im!ortant highlightsof the distinct geogra!hic and other conditions$

    %& Estimated !o!'lation of each baranga within thecit or m'nici!alit and !o!'lation !roect for a 0-ear !eriod(

    %2& Ill'stration or ma! of the cit?m'nici!alitindicating locations of residential commercial andind'strial centers and agric'lt'ral area as well asd'm! land3lls and other solid waste facilities. Theill'stration shall indicate as well the !ro!osed sitesfor dis!osal and other solid waste facilities(

    %b& Waste characteri*ation - 1or the initial so'rce red'ctionand reccling element of a local waste management !lan

    the ;9) waste characteri*ation com!onent shall identif theconstit'ent materials which com!rise the solid wastegenerated within the 'risdiction of the ;9). The informationshall be re!resentati#e of the solid waste generated anddis!osed of within the area. The constit'ent materials shallbe identi3ed b #ol'me !ercentage in weight or its#ol'metric e'i#alent material t!e and so'rce ofgeneration which incl'des residential commercialind'strial go#ernmental or other materials. 1't're re#isionsof waste characteri*ation st'dies shall identif theconstit'ent materials which com!rise the solid wastedis!osed of at !ermitted dis!osal facilities.

    %c& 5ollection and Transfer - The !lan shall take into acco'ntthe geogra!hic s'bdi#isions to de3ne the co#erage of thesolid waste collection area in e#er baranga. The barangashall be res!onsible for ens'ring that a 00 collectione=cienc from residential commercial ind'strial andagric'lt'ral so'rces where necessar within its area ofco#erage is achie#ed. Toward this end the !lan shall de3neand identif the s!eci3c strategies and acti#ities to be'ndertaken b its com!onent barangas taking intoacco'nt the following concerns$

    %& A#ailabilit and !ro#ision of !ro!erl designedcontainers or rece!tacles in selected collection !ointsfor the tem!orar storage of solid waste whileawaiting collection and transfer to !rocessing sites orto 3nal dis!osal sites(

    %2& Segregation of dierent t!es of solid waste forre-'se reccling and com!osting(

    The !lan shall de3ne and s!ecif the methods and sstemsfor the transfer of solid waste from s!eci3c collection !ointsto solid waste management facilities.

    %d& ,rocessing - The ,lan shall de3ne the methods and thefacilities re'ired to !rocess the solid waste incl'ding the'se of intermediate treatment facilities for com!ostingreccling con#ersion and other waste !rocessing sstems.& other a!!ro!riate waste red'ction technologiesthat ma also be considered !ro#ided that s'ch

    technologies conform with the standards set!'rs'ant to this Act(

    %@& the t!es of wastes to be red'ced !'rs'ant toSec. B of this Act(

    %B& the methods that the ;9) will 'se to determinethe categories of solid wastes to be di#erted from

    dis!osal at a dis!osal facilit thro'gh re-'sereccling and com!osting( and

    %C& new facilities and e+!ansion of e+isting facilitieswhich will be needed to im!lement re-'se recclingand com!osting.

    The ;9) so'rce red'ction com!onent shall incl'de thee#al'ation and identi3cation of rate str'ct'res and fees forthe !'r!ose of red'cing the amo'nt of waste generated another so'rce red'ction strategies incl'ding b't not limitedto !rograms and economic incenti#es !ro#ided 'nder Sec.@C of this Act to red'ce the 'se of non-recclable materialsre!lace dis!osable materials and !rod'cts with re'sablematerials and !rod'cts red'ce !ackaging and increase thee=cienc of the 'se of !a!er cardboard glass metal andother materials. The waste red'ction acti#ities of thecomm'nit shall also take into acco'nt among others localca!abilit economic #iabilit technical re'irements socialconcernsJ dis!osition of resid'al waste and en#ironmentalim!act$ Provided That !roection of f't're facilities neededand estimated cost shall be incor!orated in the !lan.

    %f& /eccling - The reccling com!onent shall incl'de a!rogram and im!lementation sched'le which shows themethods b which the ;9) shall in combination with so'rcered'ction and com!osting com!onents red'ce a s'=cientamo'nt of solid waste dis!osed of in accordance with thedi#ersion re'irements set in Sec .20.

    The ;9) reccling com!onent shall describe the following$

    de#elo!ing the markets for reccled materials incl'dingb't not limited to an e#al'ation of the feasibilit of!roc'rement !references for the !'rchase of reccled!rod'cts. Each ;9) ma determine and grant a !rice!reference to enco'rage the !'rchase of reccled !rod'cts.

    The 3#e-ear strateg for collecting !rocessing marketingand selling the designated recclable materials shall takeinto acco'nt !ersons engaged in the b'siness of reccling or!ersons otherwise !ro#iding reccling ser#ices before theeecti#it of this Act. S'ch strateg ma be base '!on theres'lts of the waste com!osition analsis !erformed

    !'rs'ant to this Section or information obtained in theco'rse of !ast collection of solid waste b the localgo#ernment 'nit and ma incl'de recommendations withres!ect to increasing the n'mber of materials designated forreccling !'rs'ant to this Act.

    The ;9) reccling com!onent shall e#al'ate ind'strialcommercial residential agric'lt'ral go#ernmental andother c'rbside mobile dro!-o and b'-back reccling!rograms man'al and a'tomated materials reco#erfacilities *oning b'ilding code changes and rate str'ct'reswhich enco'rage reccling of materials. The Solid WasteManagement ,lan shall indicate the s!eci3c meas'res to be'ndertaken to meet the waste di#ersion s!eci3ed 'nder Sec.20 of this Act.

    /ecommended re#isions to the b'ilding ordinancesre'iring newl-constr'cted b'ildings and b'ildings'ndergoing s!eci3ed alterations to contain storage s!acede#ices or mechanisms that facilitate so'rce se!aration andstorage of designated recclable materials to enable thelocal go#ernment 'nit to e=cientl collect !rocess marketand sell the designated materials. S'ch recommendations

    shall incl'de b't shall not be limited to se!arate ch'tes tofacilitate so'rce se!aration in m'lti-famil dwellingsstorage areas that conform to 3re and safet codereg'lations and s!eciali*ed storage containers.

    The Solid Waste Management ,lan shall indicate the s!eci3cmeas'res to be 'ndertaken to meet the reccling goals!'rs'ant to the obecti#es of this Act.

    %g& 5om!osting - The com!osting com!onent shall incl'de a!rogram and im!lementation sched'le which shows themethods b which the ;9) shall in combination with theso'rce red'ction and reccling com!onents red'ce as'=cient amo'nt of solid waste dis!osed of within its'risdiction to com!l with the di#ersion re'irements ofSec. 20 hereof.

    The ;9) com!osting com!onent shall describe thefollowing$

    %& The t!es of materials which will be com!osted'nder the !rograms(

    %2& The methods for determining the categories ofsolid wastes to be di#erted from dis!osal at adis!osal facilit thro'gh com!osting( and

    %2& An !ermitted dis!osal facilit which will bea#ailable d'ring the 0-ear !lanning !eriod( and

    %>& All dis!osal ca!acit which has been sec'redthro'gh an agreement with another ;9) or thro'ghan agreement with a solid waste enter!rise.

    The !lan shall identif e+isting and !ro!osed dis!osal sitesand waste management facilities in the cit or m'nici!alitor in other areas. The !lan shall s!ecif the strategies forthe e=cient dis!osal of waste thro'gh e+isting dis!osalfacilities and the identi3cation of !ros!ecti#e sites for f't're

    'se. The selection and de#elo!ment of dis!osal sites shallbe made on the basis of internationall acce!ted standardsand on the g'idelines set in Sec. @ and @2 of this Act.

    Strategies shall be incl'ded to im!ro#e said e+isting sites tored'ce ad#erse im!act on health and the en#ironment andto e+tent life s!an and ca!acit. The !lan shall clearl de3ne!roections for f't're dis!osal site re'irements and theestimated cost for these eorts.

    D ofthis Act. As an alternati#e sanitar land3ll sites shall bede#elo!ed and o!erated as a 3nal dis!osal site for solid ande#ent'all resid'al wastes of a m'nici!alit or cit or acl'ster of m'nici!alit and?or cities. Sanitar land3lls shallbe designed and o!erated in accordance with the g'idelinesset 'nder Secs. @0 and @ of this Act.

    %i& Ed'cation and !'blic information - The ed'cation and!'blic information com!onent shall describe how the ;9)will ed'cate and inform its citi*ens abo't the so'rcered'ction reccling and com!osting !rograms.

    The !lan shall make !ro#isions to ens're that information onwaste collection ser#ices solid waste management andrelated health and en#ironmental concerns are widel

    disseminated among the !'blic. This shall be 'ndertakenthro'gh the !rint and broadcast media and othergo#ernment agencies in the m'nici!alit. The 7E5S and the5ommission on :igher Ed'cation shall ens're that wastemanagement shall be incor!orated in the c'rric'l'm of!rimar secondar and college st'dents.

    %& S!ecial Waste - The s!ecial waste com!onent shallincl'de e+isting waste handling and dis!osal !ractices fors!ecial wastes or ho'sehold ha*ardo's wastes and theidenti3cation of c'rrent and !ro!osed !rograms to ens'rethe !ro!er handling re-'se and long-term dis!osal of

    s!ecial wastes(

    %k& /eso'rce re'irement and f'nding - The f'ndingcom!onent incl'des identi3cation and descri!tion of !roectcosts re#en'es and re#en'e so'rces the ;9) will 'se toim!lement all com!onents of the ;9) solid wastemanagement !lan(

    The !lan shall likewise indicate s!eci3c !roects acti#itiese'i!ment and technological re'irements for which o'tsideso'rcing of f'nds or materials ma be necessar to carr o'tthe s!eci3c com!onents of the !lan. It shall de3ne thes!eci3c 'ses for its reso'rce re'irement s and indicate itscosts. The !lan shall likewise indicate how the !ro#ince citor m'nici!alit intends to generate the f'nds for theac'isition of its reso'rce re'irements. It shall also indicateif certain reso'rce re'irements are being or will be so'rcedfrom fees grants donations local f'nding and other means.This will ser#e as basis for the determination andassessment of incenti#es which ma be e+tended to the!ro#ince cit or m'nici!alit as !ro#ided for in Sec. @B ofthis Act.

    %l& ,ri#ati*ation of solid waste management !roects - The!lan shall likewise indicate s!eci3c meas'res to !romote the!artici!ation of the !ri#ate sector in the management ofsolid wastes !artic'larl in the generation and de#elo!mentof the essential technologies for solid waste management.S!eci3c !roects or com!onent acti#ities of the !lan whichma be oered as !ri#ate sector in#estment acti#it shall beidenti3ed and !romoted as s'ch. A!!ro!riate incenti#es for!ri#ate sector in#ol#ement in solid waste management shalllikewise be established and !ro#ided for in the !lan inconsonance with Sec. @B hereof and other e+isting laws!olicies and reg'lations( and

    %m& Incenti#e !rograms - A !rogram !ro#iding for incenti#escash or otherwise which shall enco'rage the !artici!ation ofconcerned sectors shall likewise be incl'ded in the !lan.

    S(&$%)n 11&ner and 1perator- /es!onsibilit for com!liancewith the standards in this Act shall rest with the owner and?oro!erator. If s!eci3call designated the o!erator is considered to

    ha#e !rimar res!onsibilit for com!liance( howe#er this does notrelie#e the owner of the d't to take all reasonable ste!s to ass'recom!liance with these standards and an assigned conditions.When the title to a dis!osal is transferred to another !erson thenew owner shall be noti3ed b the !re#io's owner of the e+istenceof these standards and of the conditions assigned to ass'recom!liance.

    S(&$%)n 19!aste characteri2ation- The 7e!artment incoordination with the ;9)s shall be res!onsible for theestablishment of the g'idelines for the acc'rate characteri*ation ofwastes incl'ding determination of whether or not wastes will be

    com!atible with containment feat'res and other wastes andwhether or not wastes are re'ired to be managed as ha*ardo'swastes 'nder /.A. CFCF otherwise known as the To+ic S'bstanceand :a*ardo's and 8'clear Wastes 5ontrol Act.

    S(&$%)n 20(stablishing "andatory Solid !aste Diversion- Each;9) !lan shall incl'de an im!lementation sched'le which showsthat within 3#e %B& ears after the eecti#it of this Act the ;9)shall di#ert at least 2B of all solid waste from waste dis!osalfacilities thro'gh re-'se reccling and com!osting acti#ities andother reso'rce reco#er acti#ities( Provided That the waste

    di#ersion goals shall be increased e#er three %>& earsthereafter(Provided further That nothing in this Section !rohibits alocal go#ernment 'nit from im!lementing re-'se reccling andcom!osting acti#ities designed to e+ceed the goal.

    S(&$%)n 21"andatory Segregation of Solid !astes- The ;9)sshall e#al'ate alternati#e roles for the !'blic and !ri#ate sectors in!ro#iding collection ser#ices t!e of collection sstem orcombination of sstems that best meet their needs$ Provided Thatsegregation of wastes shall !rimaril be cond'cted at the so'rce toincl'de ho'sehold instit'tional ind'strial commercial andagric'lt'ral so'rces$ Provided further( That wastes shall besegregated into the categories !ro#ided in Sec. 22 of this Act.

    %b& notif the occ'!ants of each b'ildings of there'irements of this Act and the reg'lations !rom'lgated!'rs'ant thereto.

    S(&$%)n 22Re3uirements for the Segregation and Storage of

    Solid !aste- The following shall be the minim'm standards andre'irements for segregation and storage of solid waste !endingcollection$

    %a& There shall be a se!arate container for each t!e ofwaste from all so'rces$ Provided That in the case of b'lkwaste it will s'=ce that the same be collected and !lacedin a se!arate designated area( and

    %b& The solid waste container de!ending on its 'se shall be!ro!erl marked or identi3ed for on-site collection as

    %a& All collectors and other !ersonnel directl dealing withcollection of solid waste shall be e'i!!ed with !ersonal!rotecti#e e'i!ment to !rotect them from the ha*ards ofhandling wastes(

    %b& 8ecessar training shall be gi#en to the collectors and!ersonnel to ens're that the solid wastes are handled!ro!erl and in accordance with the g'idelines !'rs'ant tothis Act( and

    %c& 5ollection of solid waste shall be done in a manner which!re#ents damage to the container and s!illage or scatteringof solid waste within the collection #icinit.

    S(&$%)n 2Re3uirements for the Transport of Solid !aste- The'se of se!arate collection sched'les and?or se!arate tr'cks orha'lers shall be re'ired for s!eci3c t!es of wastes.

    collected se!aratel and f'rther screened and sent to a!!ro!riateha*ardo's waste treatment and dis!osal !lants consistent with the!ro#isions of /.A. 8o. CFCF.

    S(&$%)n 29on.(nvironmentally /cceptable Products- Within one%& ear from the eecti#it of this Act the 5ommission shall after!'blic notice and hearing !re!are a list of nonen#ironmentallacce!table !rod'cts as de3ned in this Act that shall be !rohibited

    according to a sched'le that shall be !re!ared b the5ommission$Provided ho&ever That non-en#ironmentallacce!table !rod'cts shall not be !rohibited 'nless the 5ommission3rst 3nds that there are alternati#es a#ailable which are a#ailableto cons'mers at no more than ten !ercent %0& greater cost thanthe dis!osable !rod'ct.

    8otwithstanding an other !ro#isions to the contrar this sectionshall not a!!l to$

    %a& ,ackaging 'sed at hos!itals n'rsing homes or othermedical facilities( and

    %b& An !ackaging which is not en#ironmentall acce!tableb't for which there is no commerciall a#ailable alternati#esas determined b the 5ommission.

    The 5ommission shall ann'all re#iew and '!date the list of!rohibited non-en#ironmentall acce!table !rod'cts.

    S(&$%)n 30Prohibition on the -se of on.(nvironmentally/cceptable Pac0aging- 8o !erson owning o!erating or cond'ctinga commercial establishment in the co'ntr shall sell or con#e at

    retail or !ossess with the intent to sell or con#e at retail an!rod'cts that are !laced wra!!ed or !ackaged in or on !ackagingwhich is not en#ironmentall acce!table !ackaging$ Provided Thatthe 5ommission shall determine a !haseo't !eriod after !ro!ercons'ltation and hearing with the stakeholders or with the sectorsconcerned. The !resence in the commercial establishment of non-en#ironmentall acce!table !ackaging shall constit'te a reb'ttable!res'm!tion of intent to sell or con#e the same at retail toc'stomers.

    An !erson who is a man'fact'rer broker or wareho'se o!eratorengaging in the distrib'tion or trans!ortation of commercial!rod'cts within the co'ntr shall 3le a re!ort with the concernedlocal go#ernment within one %& ear from the eecti#it of this Actand ann'all thereafter a listing of an !rod'cts in !ackagingwhich is not en#ironmentall acce!table. The 5ommission shall!rescribe the form of s'ch re!ort in its reg'lations.

    A #iolation of this Section shall be s'=cient gro'nds for there#ocation s's!ension denial or non-renewal of an license for theestablishment in which the #iolation occ'rs.

    S(&$%)n 31Recycling "ar0et Development- The 5ommissiontogether with the 8ational Ecolog 5enter the 7TI and the7e!artment of 1inance shall establish !roced'res standards andstrategies to market recclable materials and de#elo! the localmarket for reccle goods incl'ding b't not limited to$

    %a& meas'res !ro#iding economic incenti#es and assistanceincl'ding loans and grants for the establishment of

    !ri#atel-owned facilities to man'fact're 3nished !rod'ctsfrom !ost-cons'mer materials(

    %b& g'arantees b the national and local go#ernments to!'rchase a !ercentage of the o't!'t of the facilit( and

    %c& maintaining a list of !ros!ecti#e b'ers establishingcontact with !ros!ecti#e b'ers and re#iewing and makingan necessar changes in collecting or !rocessing thematerials to im!ro#e their marketabilit.

    In order to enco'rage establishments of new facilities to !rod'cegoods from !ost-cons'mer and reco#ered materials generatedwithin local go#ernment 'nits and to conser#e energ b red'cingmaterials trans!ortation whene#er a!!ro!riate each localgo#ernment 'nit ma arranged for long-term contracts to !'rchasea s'bstantial share of the !rod'ct o't!'t of a !ro!osed facilitwhich will be based in the 'risdiction of the local go#ernment 'nitif s'ch facilit will man'fact're s'ch 3nished !rod'cts form !ost-cons'mer and reco#ered materials.

    S(&$%)n 32(stablishment of +,- "aterials Recovery 'acility)-There shall be established a Materials /eco#er 1acilit %M/1& ine#er baranga or cl'ster of barangas. The facilit shall beestablished in a baranga-owned or -leased land or an s'itableo!en s!ace to be determined b the baranga thro'gh itsSangg'nian. 1or this !'r!ose the baranga or cl'ster of barangasshall allocate a certain !arcel of land for the M/1. The M/1 shallrecei#e mi+ed waste for 3nal sorting segregation com!osting andreccling. The res'lting resid'al wastes shall be transferred to along term storage or dis!osal facilit or sanitar land3ll.

    S(&$%)n 33,uidelines for (stablishment of "aterials Recovery'acility- Materials reco#er facilities shall be designed to recei#esort !rocess and store com!ostable and recclable materiale=cientl and in an en#ironmentall so'nd manner. The facilitshall address the following considerations$

    %a& The b'ilding and?or land lao't and e'i!ment m'st bedesigned to accommodate e=cient and safe materials!rocessing mo#ement and storage( and

    %b& The b'ilding m'st be designed to allow e=cient and safee+ternal access and to accommodate internal Gow.

    Ar$%&'( C)/)+$%n4

    S(&$%)n 34nventory of "ar0ets of Composts- Within si+ %C&months after the eecti#it of this Act the 7A shall !'blish anin#entor of e+isting markets and demands for com!osts. Saidin#entor shall thereafter be '!dated and !'blishedann'all$ Provided That the com!osting of agric'lt'ral wastes andother com!ostable materials incl'ding b't not limited to gardenwastes shall be enco'raged.

    S(&$%)n 3,uidelines for Compost 5uality- 5om!ost !rod'ctsintended to be distrib'ted commerciall shall conform with thestandards for organic fertili*ers set b the 7A. The 7A shall assistthe com!ost !rod'cers to ens're that the com!ost !rod'ctsconform to s'ch standards.

    %b& The site m'st be accessible from maor roadwas orthoro'ghfares(

    %c& The site sho'ld ha#e an ade'ate 'antit of earth co#ermaterial that is easil handled and com!acted(

    %d& The site m'st be chosen with regard for the sensiti#itiesof the comm'nitJs residents(

    %e& The site m'st be located in an area where the land3llJso!eration will not detrimentall aect en#ironmentallsensiti#e reso'rces s'ch as a'ifer gro'ndwater reser#oiror watershed area(

    %f& The site sho'ld be large eno'gh to accommodate thecomm'nitJs wastes for a !eriod of 3#e %B& ears d'ringwhich !eo!le m'st internali*e the #al'e of en#ironmentallso'nd and s'stainable solid waste dis!osal(

    %g& The site chosen sho'ld facilitate de#elo!ing a land3llthat will satisf b'dgetar constraints incl'ding sitede#elo!ment o!eration for man ears clos're !ost-clos're care and !ossible remediation costs(

    %h&

    %a& ;iners - a sstem of cla laers and?or geosnthethicmembranes 'sed to contain leachate and red'ce or !re#entcontaminant Gow to gro'ndwater(

    %d& 9ro'ndwater monitoring well sstem - wells !laced at ana!!ro!riate location and de!th for taking water that arere!resentati#e of gro'nd water 'alit(

    %e& 5o#er - two %2& forms of co#er consisting of soil andgeosnthetic materials to !rotect the waste from long-termcontact with the en#ironment$

    %i& a dail co#er !laced o#er the waste at the close ofeach daJs o!erations and(

    %ii& a 3nal co#er or ca! which is the material !lacedo#er the com!leted land3ll to control in3ltration ofwater gas emission to the atmos!here and erosion.

    %f& 5los're !roced're with the obecti#es of establishing lowmaintenance co#er sstems and 3nal co#er that minimi*esthe in3ltration of !reci!itation into the waste. Installation of

    contaminated and controlling land3ll gas migration oremission.

    S(&$%)n 21perating Criteria for Sanitary +andlls- In theo!eration of a sanitar land 3ll each site o!erator shall maintainthe following minim'm o!erating e'i!ments$

    %2& /ecords of e+ca#ations which ma aect the safeand !ro!er o!eration of the site or ca'se damage toadoining !ro!erties(

    %>& 7ail log book or 3le of the following information$3res landslides earth'ake damage 'n's'al ands'dden settlement in'r and !ro!ert damage

    accidents e+!losions recei!ts or reection of'n!ermitted wastes Gooding and other 'n's'alocc'rrences(

    %@& /ecord of !ersonnel training( and

    %B& 5o! of written noti3cation to the 7e!artmentlocal health agenc and 3re a'thorit of namesaddresses and tele!hone n'mbers of the o!erator orres!onsible !art of the site(

    %b& Water 'alit monitoring of s'rface and gro'nd watersand eK'ent and gas emissions(

    %c& 7oc'mentation of a!!ro#als determinations and otherre'irements b the 7e!artment(

    %d& Signs$

    %& Each !oint of access from a !'blic road shall be!osted with an easil #isible sigh indicating thefacilit name and other !ertinent information asre'ired b the 7e!artment(

    %2& If the site is o!en to the !'blic there shall be aneasil #isible sign at the !rimar entrance of the siteindicating the name of the site o!erator theo!eratorJs tele!hone n'mber and ho'rs ofo!eration( an easil #isible sign at an a!!ro!riate!oint shall indicate the sched'le of changes and thegeneral t!es of materials which will either be

    acce!ted or not(

    %>& If the site is o!en to the !'blic there shall be aneasil #isible road sign and?or tra=c controlmeas'res which direct tra=c to the acti#e face andother areas where wastes or recclable materials willbe de!osited( and

    %@& Additional signs and?or meas'res ma be re'iredat a dis!osal site b the 7e!artment to !rotect!ersonnel and !'blic health and safet(

    %e& Monitoring of 'alit of s'rface gro'nd and eK'entwaters and gas emissions(

    %f& The site shall be designed to disco'rage 'na'thori*edaccess b !ersons and #ehicles b 'sing a !erimeter barrieror to!ogra!hic constraints. Areas within the site where o!enstorage or !o'nding of ha*ardo's materials occ'rs shall bese!aratel fenced or otherwise sec'red as determined bthe 7e!artment. The 7e!artment ma also re'ire that

    %g& /oads within the !ermitted facilit bo'ndar shall bedesigned to minimi*e the generation of d'st and thetracking of material onto adacent !'blic roads. S'ch roadsshall be ke!t in safe condition and maintained s'ch that#ehicle access and 'nloading can be cond'cted d'ring

    inclement weather(

    %h& Sanitar facilities consisting of ade'ate n'mber oftoilets and handwashing facilities shall be a#ailable to!ersonnel at or in the immediate #icinit of the site(

    %i& Safe and ade'ate drinking water s'!!l for the site!ersonnel shall be a#ailable(

    %& The site shall ha#e comm'nication facilities a#ailable tosite !ersonnel to allow 'ick res!onse to emergencies(

    %k& Where o!erations are cond'cted d'ring ho'rs ofdarkness the site and?or e'i!ment shall be e'i!!ed withade'ate lighting as a!!ro#ed b the 7e!artment to ens'resafet and to monitor the eecti#eness of o!erations(

    %l&

    %o& An dis!osal site o!en to the !'blic shall ha#e anattendant !resent d'ring !'blic o!erating ho'rs or the siteshall be ins!ected b the o!erator on a reg'larl sched'ledbasis as determined b the 7e!artment(

    %!& )nloading of solid wastes shall be con3ned to a smallarea as !ossible to accommodate the n'mber of #ehicles'sing the area witho't res'lting in tra=c !ersonnel or!'blic safet ha*ards. Waste materials shall normall bede!osited at the toe of the 3ll or as otherwise a!!ro#ed bthe 7e!artment(

    %& Solid waste shall be s!read and com!acted in laers withre!eated !assages of the land3ll e'i!ment to minimi*e#oids within the cell and ma+imi*e com!action. The looselaer shall not e+ceed a de!th a!!ro+imatel two feet

    before com!action. S!reading and com!acting shall beaccom!lished as ra!idl as !racticable 'nless otherwisea!!ro#ed b the 7e!artment(

    %r& 5o#ered s'rfaces of the dis!osal area shall be graded to!romote lateral r'no of !reci!itation and to !re#ent!o'nding. 9rades shall be established of s'=cient slo!es toacco'nt for f't're settlement of the 3ll s'rface.

Theg'idelines shall be based on the following$

    %a& the si*e and location of areas which sho'ld be incl'ded(

    %b& the #ol'me of solid waste which wo'ld be generated(

    %c& the a#ailable means of coordinating local go#ernment!lanning between and among the ;9)s and for theintegration of s'ch with the national !lan( and

    %d& !ossible lifes!an of the dis!osal facilities.

    S(&$%)n (stablishment of Common !aste Treatment andDisposal 'acilities- ,'rs'ant to Sec. >> of /.A.DC0 otherwiseknown as the ;ocal 9o#ernment 5ode all !ro#inces citiesm'nici!alities and barangas thro'gh a!!ro!riate ordinances arehereb mandated to consolidate or coordinate their eortsser#ices and reso'rces for !'r!oses of ointl addressing commonsolid waste management !roblems and?or establishing commonwaste dis!osal facilities.

    The 7e!artment the 5ommission and local solid wastemanagement boards shall !ro#ide technical and marketingassistance to the ;9)s.

    C"APTER IVINCENTIVES

    S(&$%)n 4ncentives)-

    %a& /ewards monetar or otherwise shall be !ro#ided toindi#id'als !ri#ate organi*ations and entitles incl'ding non-go#ernment organi*ations that ha#e 'ndertakeno'tstanding and inno#ati#e !roects technologies!rocesses and techni'es or acti#ities in re-'se reccling

    and red'ction. Said rewards shall be so'rced from the 1'ndherein created.

    ;9)s are entitled to a#ail of the 1'nd on the basis of their a!!ro#edsolid waste management !lan. S!eci3c criteria for the a#ailment ofthe 1'nd shall be !re!ared b the 5ommission.

    The 3nes collected 'nder Sec. @F shall be allocated to the ;9)where the 3ned !rohibited acts are committed in order to 3nancethe solid waste management of said ;9). S'ch allocation shall bebased on a sharing scheme between the 1'nd and the ;9)concerned.

    In no case howe#er shall the 1'nd be 'sed for the creation of!ositions or !ament of salaries and wages.

    S(&$%)n /uthority to Collect Solid !aste "anagement 'ees-The local go#ernment 'nit shall im!ose fees in amo'nts s'=cientto !a the costs of !re!aring ado!ting and im!lementing a solidwaste management !lan !re!ared !'rs'ant to this Act. The feesshall be based on the following minim'm factors$

    %a& t!es of solid waste(

    %b& amo'nt?#ol'me of waste( and

    %c& distance of the transfer station to the wastemanagement facilit.

    The fees shall be 'sed to !a the act'al costs inc'rred b the ;9)in collecting the local fees. In determining the amo'nts of the feesan ;9) shall incl'de onl those costs directl related to theado!tion and im!lementation of the !lan and the setting andcollection of the local fees.

    C"APTER VIPENAL PROVISIONS

    S(&$%)n Prohibited /cts- The following acts are !rohibited$

    %& ;ittering throwing d'm!ing of waste matters in !'blic!laces s'ch as roads sidewalks canals esteros or !arksand establishment or ca'sing or !ermitting the same(

    %2& )ndertaking acti#ities or o!erating collecting ortrans!orting e'i!ment in #iolation of sanitation o!erationand other re'irements or !ermits set forth in established!'rs'ant(

    %>& The o!en b'rning of solid waste(

    %@& 5a'sing or !ermitting the collection of non-segregated or

    'nsorted wastes(

    %B& S'atting in o!en d'm!s and land3lls(

    %C&

    %D& )na'thori*ed remo#al of recclable material intended forcollection b a'thori*ed !ersons(

    %& The mi+ing of so'rce-se!arated recclable material with

    other solid waste in an #ehicle bo+ container or rece!tacle'sed in solid waste collection or dis!osal(

    %F& Establishment or o!eration of o!en d'm!s as enoined inthis Act or clos're of said d'm!s in #iolation of Sec. >D(
