Solon seeks inquiry on the status of the “Ecological Solid Waste Management Act of 2000” A lawmake r has asked the Hous e Commit tee on Ecology to conduc t an inquir y on the status and implementation of Republic Act No. 9!" also known as the #Ecological $olid %aste &anagement Act of '.( Re p. )e ah $. *a qui+ ,*ar ty-list" AN NAR$/ sou ght the inqui ry thr ough House Resolution 0111" saying there is a need to assess and e2aluate the implementation of RA 9! in order to ascer tain the applica tion" scope" eff ecti2e ness" efficie ncy and success of the ecolog ical solid waste management program. #3he present en2ironmental solid waste crisis such as the more than 4 tons of wastes generated daily by &etro &anila alone calls for immediate action considering the peril it gi2es to life that affects human health and decline of natural resources and degradation of en2ironment that aggra2ates climate change"( *aqui+ said. According to *aqui+" $ection ' of RA 9! mandates for the adoption of a systematic" compre hensi2e and ec olo gi cal solid waste ma nageme nt pr ogr am that targets solid waste a2oidance and 2olume reduction through source reduction and waste minimi+ation measures while gi2ing primordial consideration to and ensuring the protection of the public health and en2ironment. *aqui+ said $ection ' ,d/ of the same law mandated to ensure the proper segregation" collec tion" transport" storage" treatment and disposa l of solid waste through the formu lation and adoptio n of the be st en2i ronmental pr ac ti ce in ec olo gic al wast e ma nagement e5clu di ng incineration. #%hile $ection ! ,dd/ of RA 9! pro2ides that resource reco2ery shall refer to the collection" e5traction or reco2ery of recyclable materials from the waste stream for the purpose of recycling" generating energy or producing a product suitable for beneficial use" pro2ided that such resource reco2ery facilities e5clude incineration"( *aqui+ said. 3o ensure the effecti2e implementation of RA 9!" *aqui+ said 2arious offices was created such as the $olid %aste &anagement Commission specifically tasked to fund and study standards" criteria and guidelines for the promulgation and implementation of an integrated national solid waste management program. $he sa id $ect ion 1 of the law establ ished the Na tio nal Ecolo gy Cent er under the Commission which shall pro2ide consulting" information" training and networking ser2ices for the implementation of the pro2isions of this Act and promote the de2elopment of a recycling" ma rket thr ough the est ablis hment of a na tio nal re cycli ng networ k that wil l enha nce the opportunity to recycle. A lawmaker has asked the House Committee on Ecology to conduct an inquiry on the

status and implementation of Republic Act No. 9!" also known as the #Ecological $olid %aste

&anagement Act of '.(

Rep. )eah $. *aqui+ ,*arty-list" AN NAR$/ sought the inquiry through House

Resolution 0111" saying there is a need to assess and e2aluate the implementation of RA 9! in

order to ascertain the application" scope" effecti2eness" efficiency and success of the ecological

solid waste management program.

$he said $ection 1 of the law established the National Ecology Center under the

Commission which shall pro2ide consulting" information" training and networking ser2ices for

market through the establishment of a national recycling network that will enhance the

opportunity to recycle.

6urther" *aqui+ cited Chapter 4" $ection 78" *aragraph 0 of RA 9!" which prohibits the#littering" throwing" dumping of waste matters in public places" such as roads" sidewalks" canals"

esteros or parks" and establishment" or causing or permitting the same.

#%hile the &etropolitan &anila e2elopment Authority ,&&A/ reinforced the same by

issuing Regulation Number 99-4 that prohibits littering and throwing of garbage or any kind of 

waste in open or public places" it also requires all business establishments" public or pri2ate" tomaintain the cleanliness of their frontages and immediate surroundings"( *aqui+ stressed.

*aqui+ also cited $ection 0 of RA 9!" which pro2ides that the ):s shall be primarily

responsible for the implementation and enforcement of the pro2isions of this Act within their 

respecti2e ;urisdiction.

#$egregation and collection of solid waste shall be conducted at the barangay le2el

specifically for biodegrable" compostable and reusable wastes" pro2ided that the collection of 

non-recyclable materials and special wastes shall be the responsibility of the municipality or 

city"( *aqui+ said.

*aqui+ said these laws and policies seek the much needed adoption of the best

en2ironmental practices in ecological waste management and e5plicitly e5cludes waste

incineration as an ecological option considering that polluting disposal facilities are ma;or 

sources of greenhouse gas emissions to the atmosphere" which adds to global warming. ,!/  lvc
