MANUAL PURPOSE AND USE

The specific aim of this manual is to provide the necessary background information and documentation for realising the technical dossier to be enclosed with any application. The User Manual also provides information and recommendations on all checks that the applicant and the corresponding Competent Body have to carry out during the use phase of the eco-label. As with any other user manual, this one may be subject to amendments by the EUEB as a whole or at request of one of its members. The manual is divided into two sections. The first one (SECTION A) includes the general information concerning Ecolabel, namely information on standard contract, application fee, assessment of compliance and validity of the criteria, compliance monitoring, etc. The second (SECTION B) comprises the product group definition, the requirements of the product, and the documentation for the application. In addition three Annexes are enclosed to the User Manual: • I Commission Decision 2001/688/EC1 • II Technical Form • III Laboratories' List

SECTION A: General Information

PLEASE READ ALL THESE NOTES CAREFULLY - THEY ARE DESIGNED TO HELP YOU PREPARE THE APPLICATION CORRECTLY. AN INCOMPLETE DOSSIER MAY DELAY THE PROCESSING OF YOUR APPLICATION. A.1. Introduction The European Eco-label is the voluntary ecological quality label stated by the European Union2 whose aim is to promote products that, during their whole life-cycle, have lower environmental impacts if compared to other ones. The label offers detailed, unmisleading and scientifically based information on the key environmental impacts to the European and any other consumer. The EU Eco-label Award Scheme is to be administered by designated organisations called Competent Bodies appointed by Member States. The Competent Bodies are required to assess applications for the award of an

Eco-label against the product group definition and criteria published by the European Commission, under the provisions of Council Regulation (EC) No. 1980/2000 of 17 July 2000 on a revised Community eco-label award scheme (all documents are downloadable from the eco-label website at http://europa.eu.int/ecolabel3 or may be requested from Competent Bodies, EUEB stakeholders, the Eco-label helpdesk4 or the European Commission). Details of the general application procedure are given in Article 7 of the revised EC Regulation. Any application for an Eco-label must be made to a Competent Body (list of Competent Bodies downloadable5) in the country or the countries where the product originates. In the case of a product manufactured outside the European Economic Area (EEA), application must be made in a country in which the product is to be or has been placed on the market (compare Article 7 of the Regulation, paragraph 3 a,b,c). Products bearing the European Ecolabel, represented by the Flower logo usually are large consumables based on selection criteria stated by the Member States and the European Commission aiming to reward both environmental excellence and a high product performance. A.2. Criteria for the Award of an Eco-label The new Commission Decision (2001/688/CE, see Annex I) has established ecological criteria for the award of the eco-label to Soil Improvers (SI) and for the first time also to Growing Media (GM). The specific product must comply with all the criteria set by the decision. Products awarded the Eco-label must also comply with the general provisions of the EC Eco-label Regulation N° 1980/2000. A.3. Standard Contract If an application is successful, the Eco-label will be awarded under the terms of the 'Standard Contract', a copy of which may be downloaded from the Eco-label homepage6 or requested from any of the EUEB stakeholders mentioned before. Once an award has been made the product can be marketed with the Eco-label in any of the 18 European Economic Area countries (15 EU Member States plus Norway, Iceland and Liechtenstein). A.4. for SMEs (small and medium enterprises) and applicants from developing countries. A copy of the general decision on fees is downloadable from the website or may be obtained from any of the Competent Bodies7 or via the helpdesk. Only if an application is successful will an annual fee, based on a percentage of sales, be payable. There is a minimum annual fee of € 500 per product group per applicant. The maximum annual fee is € 25,000 per product group per applicant. Note that there are several opportunities to get reductions of up to 50 % on this annual fee e.g. as a SME, as an applicant from a developing country, if EMAS/ISO 14001 certification is achieved and/or as a 'first mover' i.e. for the first three applicants in a given product group in a Member State. It is recommended to make contact with 'your' Competent Body as early as possible on this. A.5. Applicant's Undertaking The applicant must sign the undertaking to abide by the terms and conditions contained in the standard contract for use of the Eco-label logo and the product group criteria. A.6. Assessment of Compliance with Specific Criteria The product is assessed against the specified criteria for the award of an Eco-label set in the decision. In order to demonstrate that the product fully complies with the criteria, detailed information and data relating to the performance of the product may be collated in the dossier. Application for an Eco-label is made by assessing the candidate product and providing complete documentation. The applicant must submit test results and information for which product testing has been carried out by an Independent Testing Organisation or have been approved by a third party (compare the Decision's Annex and its requirements specified in the text item by item). Information related to the assessment must be presented and is to be signed by the person(s) responsible for conducting the assessment. Certification must also be given by signing the declarations required in several cases. Test data relating to the product must demonstrate compliance with the requirements set out in the criteria. A.7. Cost of Testing All costs arising from testing and certification are to be met by the applicant and are additional to the application fee mentioned above.

A.8. Compliance Monitoring If the application is successful, the product is subject to a regime of compliance monitoring. The applicant has to agree to the terms set out in the standard contract concerning the full use of the Eco-label logo (box 1 and 2). The applicant must also sign the undertaking of this application form agreeing to maintain the product in conformity with the product group criteria and abide by the terms and conditions laid down in the contract for use of the Eco-label, during the period of the contract. Please note that the standard contract has hardly changed from the previous one. A.9. Validity of Criteria The product group definition and the specific ecological criteria are valid from 12.9.2001 for 5 years i.e. until 12.9.2006. The previous and prolonged criteria on SI (1998, not including GM) stay valid until 30.9.2002 (2001/157/CE), concurrently with the new ones, in order to allow sufficient time for companies that have been awarded the eco-label for their products prior to the adoption of this new Decision to adapt these products to comply with the new criteria. SECTION B: Ecolabel for Soil Improvers and Growing Media

B.1. Product Group definition

Article 1 of the Commission Decision specifies that an application is possible for the following two product groups as similarly defined also in the CEN reports, in particular in CR 13455:

Soil Improvers

Materials to be added to the soil in situ primarily to maintain or improve its physical properties, and which may improve its chemical and/or biological properties or activity

Growing Media

Material, other than soils in situ, in which plants are grown.

The product group is generally open to all products both for the professional and amateur use.

B.2. Product requirements: definitions and notes

B.2.1 General Objectives And Requirements

The eco-label may only be awarded to products that fall into the definition and successfully pass the corresponding criteria essentially aiming to promote the use and re-use of organic matter and to reduce risks from heavy metals and other hazardous substances.

B.2.2 Terms and Definitions

In this section terms and definitions recurring in the Decision and in the User Manual are reported. The glossary is regarded to be useful for a uniform comprehension and in order to keep univocal interpretation on general principles, materials, test methods, etc. Air volume: that part of the volume of a sample filled by air measured under standard suction conditions (suction pressure: 10 cm). Ash: The inorganic matter or mineral residue of total solids that remains when a sample of SI or GM is combusted at 450±10°C in the presence of excess air. The ash (%) is equal to 100 % of the dried sample minus the VS (volatile solids) in the dried sample. Bark and composted bark: residual materials from primary machining of wood, used raw (without performing any biological treatment) or composted; mainly used as a mulch (mulching: materials which applied to the surface of the soil reduce the loss of moisture, control weed growth, reduce the erosion

and the evaporation) Composted pine bark or poplar is also used as a constituent of GM. Bark is the most commonly used non-peat material. The quality of composted barks depends on tree species, grading and maturity. Batch: see product (or production) batch. Batch code: identification code (progressive number) which marks the product (or production) batch. Bulk density: ratio of the dry mass and volume of the sample in grams per litre measured under standard suction conditions (suction pressure: 10 cm); it is sometimes referred to as “apparent density”. Carbon to Nitrogen ratio (C:N): the numerical ratio of the weight of total organic carbon to that of the sum of organic nitrogen plus inorganic nitrogen (N-NH4 and N-NO3). Compost from biowaste: Product obtained by composting organic fraction of municipal solid waste (food scraps and ‘green’ waste), obtained by separated source collection; mainly used as a soil improver and secondly as a constituent for growing media. Compost: the product resulting from the controlled biological decomposition of organic wastes in aerobic conditions (see composting process), that has been sanitised, stabilised and humified to a degree which is potentially beneficial to plant growth when used as a SI or GM. Composted from green waste (or Yard Waste Compost or Green Compost) Composting process: a managed biological process that controls aerobic biological decomposition and transformation of biodegradable materials into end product called compost. Dry matter: the portion of substance that is not comprised of water. The dry matter content (%) is equal to 100 % minus the moisture content %. Dry Weight Basis: calculated on the basis of having been dried at 105 °C until reaching a constant mass, i.e. 100 % solids content. Electrical Conductivity: measure of a solution’s capacity to carry an electrical current; it varies both with the number and type of ions contained in the solution; it is an indirect measure of salinity. Fertiliser: Refer to materials which are primarily sources of plant nutrients (e.g. nitrogen, phosphate and potassium as main plant nutrients). These materials may be inorganic or organic, but they rarely have any direct effect on soil physical properties or organic matter content. For this reason, it is intended that products that solely provide fertilising effects be excluded from the definition of soil improvers. Fertility: soil aptitude to host plant life in order to maximise qualitative and quantitative features of crops and other vegetation. Phytotoxicity: property which produces harmful effects on growing plants. Growing Media: materials, other than soil in situ, in which plants are grown. Growing Media constituent material which is suitable as an ingredient of growing media. Heavy Metals: elements whose specific gravity is approximately 5 or higher. They include lead, copper, cadmium, zinc, mercury, nickel, arsenic, chromium,

molybdenum, fluorine, and selenium. High concentrations of one or more heavy metals in a soil may lead to toxic effects in plants and animals. Maturity/Maturation: refers to an organo-chemical condition of the materials (generally composted materials) which indicate the presence or lack of organic phytotoxic chemicals in stable to very stable products. The degree to which a biomass sample is free of organic phytotoxic compounds that can cause delayed seed germination or inhibit plant growth when used as soil amendment. Moisture content: the liquid fraction (%) of SI and GM that evaporates at 103 ± 2°C (EN 13040). Mulches: materials, which are, applied to the surface of soil to reduce moisture loss, control weed growth, improve visual appearance, improve bearing strength and minimise erosion and water run-off. Organic material: material of plant and animal origin. Organic matter (OM): The carbon fraction of a sample of SI or GM which is free from water and inorganic substances, clarified in EN 13039 as ‘loss on dry incineration’ at 450 ± 10 °C. Peat: largely organic residues of plants, incompletely decomposed through lack of oxygen. The result of the partial decomposition of sphagnum, other mosses and sedges. Physical contaminants: non biodegradable material (often termed ‘inert’ or ‘impurities’ ) such as plastics, glass and metals. Porosity (total pore space): total volume of voids filled with water and/or air measured under standard conditions (suction pressure: 10 cm). Product (or Production) batch: a defined quantity of SI and GM produced, manufactured and packaged in the same facilities, with the same process technology and blend, and in the defined period (recommended maximum two months). Sewage Sludge: means residual sludge, whether treated or untreated, from urban waste water treatment plants, see definition set by the European Directive Dir. 86/278. Soil improver: can loosely be used to describe any material which improves the physical, chemical and biological properties of soil. However, the more usual interpretation relates to materials which are added to soils to enhance their physical properties. Such materials include bulky organic manures, and various types of composted materials which may or may not also provide some useful quantities of plant nutrients. They can be subdivided in soil conditioner, planting materials or mulches. Soil Improver constituent: material which is suitable as an ingredient of a soil improver. Stability/Stabilisation: refers to a stage in the decomposition of organic matter during composting. The stability is measured as residual biological activity (i.e. oxygen consumption as determined using a Respiration Index, Self-heating test, Solvita test, or other suitable methods ). Material that is not stable, but still putrescent, gives rise to nuisance odours and may contain organic phytotoxins.

Test methods: Analytical methods approved by Member States, institutions, standardising bodies (CEN, UNI, DIN, BSI, AFNOR, OENORM etc.) or by reliable manufacturers’ associations (BGK in Germany, TCA in UK, etc.). Waste: shall mean any substance or object which the holder discards or intends or is required to discard. Water volume: that part of the volume of the sample filled by water under standard conditions (suction pressure: 10 cm). Weed seeds: all viable seeds and propagules of undesired plant species found in end products

B.2.3 Test methods

The annex of the decision specifies the adoption of test methods approved or in progress of approval by CEN8. Other test methods may be used if their equivalence is accepted by the Competent Body. For instance, if other consolidated and approved test methods for SI or GM are used in Member States or third countries, (i.e. fertiliser analysis) they may substitute some of those set by CEN. In such a case the applicant should request approval for use from the Competent Body (CB) sufficiently in advance and provide a reasonable justification in writing underpinning the equivalence and comparability of such methods. The Competent Body can ask for additional documentation if appropriate. Where required testing is not covered by CEN standards or CEN standards in progress of approval, other test methods are pointed out in this User Manual. These methods are indicative by nature and, as stated above, may be substituted by other methods in use. Again, request for approval for their use shall be addressed to the CB sufficiently in advance, accompanied by written justification. Analysis should be carried out by reliable laboratories having some years of experience in the corresponding areas. To facilitate work of Competent bodies and applicants an indicative, but non-exclusive list of institutions, associations and laboratories is reported in Annex III. This part may be updated in future manual versions and by the EUEB as a whole or at the request of its members.

B.2.4 Criteria explanatory tables

This chapter reports the ecological criteria established by the specific Commission Decision (2001/688/EC) to be fulfilled for the award. Compliance with these criteria and the limit values must be reported in detail in the Technical Form. Criteria are listed below in the following table:

− column “Requirements” contains the required characteristics for each ecological criterion;

Ecological criterion no.1: Organic ingredients

a) A product shall only be considered for the award of an eco-label if its organic matter content is derived from the processing and/or re-use of waste materials. The definition of waste is stated in Directives 75/442/EEC and 91/156/EEC9.

Processing is, for example, biological treatment like composting and anaerobic digestion.

‘Re-use of waste materials’ is, for example, the use of organic waste from primary manufactures, which can be employed as SI or GM, or as an ingredient in such products, due to its physio-chemical characteristics. Examples of such are: bark remaining from timber mechanical manufacturing; rice hulls; coconut fibre; and residuals from the food industry.

b) Products shall not contain sewage sludge.

Sewage sludge (as defined in the glossary and by the existing European and national legislation) is not allowed to be used either as main constituent or as an ingredient in any materials considered for award of this eco-label.

The applicant shall provide the CB with a detailed composition of the product and a declaration of compliance with criteria 1 a and 1 b.

b) Products shall not contain bark which has been treated with pesticides.

Applicant shall declare compliance of the product with criterion 2b to the CB stating that the product either does not include bark or only contains bark exclusively arising from physical-mechanical processes, where pesticides have not been used at any stage. If the product does not contain bark, the manufacturer shall provide a declaration saying so.

Where sample analysis for the presence of pesticide(s) is deemed necessary, the CB can refer to a relevant method specified by the U.S. Composting Council.

Ecological criterion no.3: Physical contaminants

Such products (for example many mulches) are defined as those having a C:N greater than 30:1.

In order to comply with upper limits for nutrient loading, the equivalent maximum amount of SI per unit area (m2 or ha) must be included in the information accompanying the product. ECOLABEL USER MANUAL

-SOIL IMPROVERS AND GROWING MEDIA-

In order to evaluate product compliance with ecological criteria, applicants shall assess product features by test methods specified in the Commission Decision 2001/688/EC. In the case of parameters for which test methods are unspecified in this decision, the test method shall be approved in advance by the CB. Analysis should be carried out by reliable laboratories having some years of experience in analysing samples of soils, Soil Improvers and Growing Media. The present annex contains a list of reliable Member State Laboratories to facilitate the work of Competent Bodies and new applicants.
