The Chancellor’s Budget…If we were looking for something in the budget to stimulate the housing market, then unfortunately, George Osborne did not take any steps to achieve that. There were virtually no changes all round to the taxation on house purchase and sale other than the imposition of a new band of Stamp Duty Land Tax at the rate of 7% for residential property transactions in excess of £2,000,000 (not too many of those in rural North Aberdeenshire). In addition we
transactions now have a starting level of £125,000 for the tax to apply. Accordingly the current levels of SDLT for residential properties are as follows:
Value up to £125,000 – NIL Over £125,000 to £250,000 – 1% Over £250,000 to £500,000 – 3% Over £500,000 to £1,000,000 – 4% Over £1,000,000 to £2,000,000 – 5% Over £2,000,000 – 7%
Certain areas designated as disadvantaged do not fall into the chargeable band if the value is under £150,000. Check with your Solicitor if you are buying in such an area although there are none in Aberdeenshire.
As far as Capital Taxes are concerned there has been little change. The Capital Gains Tax Annual Exemption is frozen at £10,600 for 2012/2013 and the Inheritance Tax nil rate band remains at £325,000 until April 2015. Capital Gains Tax rates remain at 18% to the extent of
There may be unforeseen tax implications if selling any property other than your main residence and therefore early advice should be sought from your Solicitor or Accountant before embarking on the disposal of any property which does not form your main residence.
There will be a new reduced rate of Inheritance Tax for an estate where a minimum level of legacy has been left by the deceased to charity. The legacy itself remains exempt from IHT if it is to a charity and it is the rate of tax on the balance of the estate that is reduced from 40% to 36%. The reduced rate applies where the charitable bequests are a minimum of 10% of

The budget also saw some changes to the rules on VAT on approved alterations on listed buildings. Currently the repair and maintenance of a listed building is standard rated but the approved alteration of a listed building is zero rated. The new rules brought in at the budget will result in all building materials and construction services supplied in the course of an approved alteration to a listed building becoming subject to VAT at the standard rate. This can be a complex area and advice from a specialist in VAT taxation should be taken before embarking on any such alterations.

Collaborative Family Law - We now have lawyers trained in collaborative family law and each person appoints their own lawyer who is trained in collaborative family law. Instead of negotiations between you and your partner by letter of phone, you meet to work things out face to face. This prospect is easier for some than others, but our family lawyers are trained to handle the difficulties than can arise.
You will meet with your own lawyer to discuss what to expect in the collaborative meetings and in order to prepare for the first “four way meeting”.
