DISCOs thereinafter collectiveiy referred to as the "Determinations"),, under Section 31 of Reulation Generation Tramission Distribution of Electric Power Act, 1997 (the "Act") read with Rule 17 of the WEPRA Tariff jStandards and Procedures) Rules, 1992
Please refer to the Subject and to the Determinations regarding Periothc Adjustments for XWAPDA DISCOs sent to the Federal Government by National Electric Power Regulatory Authority (the 'Authority") u/s 31 of the Act
2. Federal Government approved the Uniform Tariff Guidelines on October 2018 (AnnexI) and Guidelines for Periodic Adjustments on April 18, 2019 (Annex-Il), in terms of section 31 (4) of the Act, Accordingly, periodic adjustments on the principle of maintaining uniform tariff for XWAPDA DISCOs for each of consumer category have been regularly determined and recommended by the Authority for notification in the official Gazette, from time to time.
3. The periodic adjustments for 2 and 3 Quaers of FY 201 9-20 determined and recomrnendb by the Authority on September 24, 2020 amounted to Rs. 162 lkWh across all categces except life-line consumers. Tie Federal Government notified the said periodic adjustment through SROs 182 (1)12021 to 191 (1)12021 after incorporating the targeted quaerly subsidy / additionai charge, which are to remain effective till September, 2021 (Annex- IH).
4: Subsequently, the Authohty has determined: (a) the periodic adjustments for 4th Qua1er of FY 2019-20 and recommended the same to Federal Government, on February 10, 2021 for notification, with a proposed uniform increase of Rs. 08276/kWh across all categories including life-line consumers
(Annex-IV); and (b) the periodic adjustments for 1st and 2 Quarter of FY 2020-21 and recommended the same to Federal Government, on May 6, 2021, for notftication, with a proposed uniform increase of Rs. 0.8996/kWh across all categories including lifelin•e consumers (Annex-V).
5. National Power PoUcy, 2013 (the "Power Policy") developed by the Federal Government and approved by Council of Common Interest through decision in Case No. 1/3/2013 dated 31-07-2013 (Annex-VI) is in vogue and, inter alia, stipulates that the low-end consumers will be protected from any price escalation and tariff rationalization will be done. Similarly, in pursuance of the Power Policy, the National Power Tariff and Subsidy Policy Guidelines, 2014 (the "Tariff and Subsidy Policy") is also in vogue (Annex—Vu).
6. In terms of the provisions of the Act, as amended through Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Ordinance, 2021,, periodic quarterly adjustments are to be made by the Authority, inter a/ia, in line with policy guidelines of the Federal Government. Furthermore, per the provision of recently added section 31(8) of the NEPRA Act, the Federal Government has been empowered to impose surcharges for the purposes stipulated therein. Contrary' observations made in the Determinations with respect to the power of the Federal Government to impose surcharges is, accordingly, required to be reconsidered.
7. The Federal Government has, keeping in view the socio-economic conditions of the country as well as the prevalent policies, in past adopted tariff rationalization methodology reflected in AnnexlU. Federal Government has decided that the same tariff rationalization methodology be adopted and, accordingly, surcharge to the extent mentioned in (Annex Viii) is to be levied on categories of consumer(s) specified therein, for the purposes of fulfilling the financial obligations of the Federal Government in respect of the electric power services, which shall be whin the revenue requirement determined by the Authority. The aggregate cumulative effect of periodic adjustments mentioned in paragraph 4 above atongwith surcharge mentioned in Annex-VUI is reflected in (Annex-IX). Therefore, the revenue requirements determined by the Authority and recommended to be recovered shalt be duly accounted for and consumer end tariff shall, by and large, be maintained. Accordingly, in view of consumer interest, it is proposed that the applicability of these adjustments etc. be made applicable from October 2021 once the periodic adjustments in fi&d cease to be effective,
8. in tight of the above submissions, it is requested that the Authority may kindly re-consider the Determinations so that:
(a) the effectiveness of the recommended periodic adjustments be made with effect from October, 2021, instead of date of notification, in order to protect consumer interest and also in line with the prevalent pandemic situation and be notified as such after incorporating surcharges as per Annexure-Vill.

Subject:METhODOLOGY FOR INCORPORATION OF QUARTERLY ADJUSTMENTS IN THE UNIFORM TARIFF OF XWDCOS N TEEMS OF THE PROVISIONS OF "REGULATION OF GENERATION, TRANSMISSION AND DISTRIBUTION OF ELECTRIC POWER ACT, 1997" (THE "ACT"I
I am directed to state that by way of Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Act, 2018 (the "Amendment Act, 2018"), section 31 was completely revised. A new uniform tahif framework under section 31(4) stand introduced, which includes the price-equalizaon and socio-economic elements, price-equalization by the uniform, cross-entity, nature of tariff itself and the sodo-economic dimension by tying grant of tariff to public consumer interest.
2. Accordingly, the Federal Government moved Motion for Reconsideration dated November 9, 2018 of Taff Determinations for FY 2016-17 and Quarterly Decisions for FY 2017-18 (the "Reconsideration Moon"). On the basis of national average PPP and the overall revenue requirement at National Level, the uniform tariff as required under Section 31(4) was determined, which incIusve of targeted subsidy and inter disco tariff rationalization culminated in final uniform consumer end tariff attached as Annex-VII of the decision dated December 19, 2018 (the "Uniform Tariff Decision"). The Uniform Tariff Decision was duly notified vide SRO Nos. 1 (1)12019 to SRO Nos. 10 (1)/2O19thtd 1Janu2ry. 2019.
3. As per the existing Tahif Methodology, Power Purchase P1ce (PPP) references are subject to adjustment on monthly and quarterly basis. The adjustment on account of vahacn in fuel cost component of PPP is undertaken on monthly basis and reflected uniformly in the consumers' monthly bill as Fuel Charges Adjustment. Whereas, adjustment on remaining component of PPP i.e.: (a) Capacity Charges, (b) transmission charges, (c) Market Operator Fee (MoF), (c) the impact of T&D losses, and (e)Vahabie O&M is to be undertaken on quarterly basis (the "Quarterly Adjustment Components").
4, ln the above background. it is pointed out that the Uniform Tariff DecIsion specified that 1 Quaerly Adjustment of FY .2018-19 to the tune of approximat&y Rs. 94 Billion and 2 Quartey Adjustment of FY-201&-19 to the tune of approximately Rs. 84 Billion in aggregate amounting to Rs. 180 Bifflon (tentatively) are subsequently to be included in the tariff.
5. It is also pointed out that the National PowerPolicy, 2013 (the "Power Policy") developed by the Federal Government and approved by CCI is in vogue. One of the essential components of the Power Policy is to safeguard the low-end consumers from any price escalation and tariff rationalization/uniformity with an aim to minimize/eliminate subsidy whin industrial, commercial and bulk consumers.
6. Similarly, in pursuance of the Power Policy, the National Power Tariff and Subsidy Policy Guidelines, 2014 (the Tariff and Subsidy Poilcy") is also in vogue. The Tariff and Subsidy Policy aim to strike a balance between the interest of consumers and the interest of providers of capital. The main objective of the Tariff and Subsidy Policy is: (a) in the context of tariff poflcy to ensure: (i) financial viability of the sector entfties while protecting interests of the consumers; and (ii) predictability in regulatory actions; and (b) in the context of national subsidy polidy: (i) subsidy policy for low income residential customers; (ii) subsidy not to exceed amount funded by the federal budget; and (iii) tariff adjustment mechanism. The Tariff and Subsidy Policy also maintains the commitment of the Federal Government for now to continue a uniform naonal tariff.
7. Furthermore, it is evident from the Uniform Tariff Decision that is based on naonal average PPP and the overall revenue requirement at National Level, leading to the uniform tariff as required under Section 31(4), which inclusive of targeted subsidy and inter disco tariff rationalization culminated in nai uniform consumer end tariff attached as Annex-Vu of the decision dated December 19, 2018.
8. Accordingly, in view of the same socio economic objectives as well as policy of maintaining uniform tariff rates across the consumers and regions, it is proposed that the same principles be adopted and followed for the purposes of passing on the impact of quartehy adjustment as adopted earlier and reflected in the Uniform Tariff Decision. Thus, the Quarterly Adjustment Components of PPPbeing determined by the Authorfty beconsolidated and thereafter be utilized for the purposes of arriving at a uniform rate tariff cross each categor3' of consumer of XWDISO (excluding life line consumers), to be recovered in the same manner as fuel price adjustment. In the instant case in order to facilitate the end consumer it is further proposed that such quarterly adjustment amount be staggered and recovered in twenty-four months instead of three months. Accordingly, the uniform quarterly adjustment amount is proposed and attached herewith as Annex - A. Once the same is considered and recommended by NEPRAnotification of such quarterly adjustment amount is to be made by the Federal Government in the official gazette within fifteen days of intimation in terms of section 31(7) of the Act.

modified by S:R.O, 01(1)/2019 dated January 01, 2019 with immediate effect:

Electric Power Regulatory Authority (the Authori".), inclusive of GoP Tariff
Rationalization, of Quetta Electric Supply Company Limited (QESCO), is substituted
with the final tariff dated February 12, 2021 intimated by the Authority, based on
uniform tariff determined by the Authoty in 'terms of sub-section (4) of section 31
both of which the Federal Government is pleased to notify as Schedule-l&Jl in terms
of sub-section 7 of section 31 of the Act. Provided that any modification in the targeted
subsidy shall accordingly be reflected in the applicable variable charge specified in
the Schedule-i,
3. In the aforesaid notification the Annex-It and hA, Annex-i and IA, Annex-ill, Annex-
IV, Annex-V mentioned in paragrapi no, I are respectively substituted with the Fuel
Price Adjustment Mechanism and Quarterly/Biannual Adjustment Mechanism at
Anne.x4 and IA, Order dated 08-12-2020 of the Authoty at Annex-Il and UA, QESCO

Rationalization, of Hyderabad Electric Supply Company Lirñited (HESCO), is
substituted with the final tariff dated February 12, 2021 intimated by the Authority,
based on uniform tariff determined by the Authority in terms of sub-section (4) of
section 31, both of which the Federal Government is pleased to notij as Schedule-
l&H in terms of subsection 7 of section 31 of the Act. Provided that any mcd ifiction
in the targeted subsidy shall accordingly be reflected in the applicable variable charge
specified in the Schedue-I.
3. In the aforesaid notification the Annex-Il and HA, Annex-I and IA, Annex-HI, Annex-

adjustment in tariff components for the PY 2016-17 an.d FY 2017-18 a11owe4 PP? variations fr the F? 2017-I.aadi.inder/oer,recovery.oftheallowed Distrfoution Margin forthe F? 2016-17 and F? 2017-18., as Prior Year Adjtisttnent. The said decisions were intimated to the Federal Government for notification in the offictal Gazette.

The Federal Govermnen, agiost the afornilcoed de rrr.ination.s/decisions, Jed a motion.dared November 09, 2018., under Section 7, 31(4) and 31(7) of the NEFFA Act 1997 read with Rule 17 of. the.:EPRA (Tariff Standards and Procedure) Rules, 1998 for recommendation of uniform cpnsurner ed triE at national level, which was decided by the Authority on December 19, 2019. The utifor tariff so déterntied by the Authority was notified by the Federal Government vide S.RO.1(i)/2019.to. SRO 12(1)12019 dated Tarriy 01, 2019, to be effective froth January 01, 20:19.
3. Based on the adjustment mechanism, as prescribed in the notified tariff, NEPPA has already determined the quarterly adjustments of XWDiSCOs for the F? 2018-19 & F? 2019-20 (first three quarters only), which have since been notified by the Federal Government.

6. The Authority initially scheduled the hearing on Nove her 24, 2020, however, due to non-preparation of DISCOs and C'PPA-G, the same was rescheduled on December 01, 2020, for which advertisement was published in newspapers and seoarate noticed were also sent to the stakeh,oiders for

at CPPA-G level,
9. Hearing was held as per the Schedule on 01.12.2020, which. was attended by XWDISCOs,
CPPA-G and other stakeholders includIng APTMA General public and media.
10, CPPA-G during the hearing submitted that Market Operation Pee, Use of System charges of
NTDC and Capacity charges of Generation companies are hilled tO XWDiSCOs as per the
determInations/decisions of NEPRA. CP?A-G, while justifying the instant adjustment request,
submitted that the projected Power Purchase Price (PPP) references included inthenorified base tariff,
di riiricide capacity charges for certain power .p1ts e,g Neelum jh1lLTn :}iydrc, HSR. (Sahil)
Coal, China Hub Power. COal, Engro Poer Ge'n Thar Coal, Port Qasim Coal and various Solar and
Wind based pOwer .plantsetc., as these plants were not operational.at that time. However, subsequently
theseplants becameoperational and have accordingly started invoicing their capacity charges tOCPPA-
G, which is being reflected in the quarterly adjustment requests.
II. The Authority on the concerns raised by the commentators durir)g the. hearing regarding .:pymnr.,tcfcapac.itl:charges.to power plants without fully utiliting their available capacities, observed
that as per'the. Take OR Pay agreements with the iP?s, the Capacity is paid to the IPPS based to the
availability of plants, iresective of their utilization factor.
12. The Authority, in order to work out the amount of ocarterly adjustments of X/DiSCOs,
obtained details of actual Power Purchase cost billed by CPPA-G to DISCOs for inc relevant period.
CPPA-G provided the information for the period i.e. April to June 2020 and also certified that;

Rules & Regulations.
13. Accordingly for working out the quarterly adjustments for the 4th quarter of F'f 2019-20, the
information provided by CP?A-G and the requests flied by DISCOs have been considered. Hera it is .tietto mention the Authority in its determination in th matter of C?PA-G Market Operation
f dated No ember 13, 20.1.9 noted that CPPA-G reflects the costs incurred on account of legal /
litigation charges in the capacity costs billed to.DISCOs. Accordingly.CPPA-G was directed to include
the said cost in its market operaion fees and be got approved from the Authority. However, CPPA-G
in its costs billed to DISCOs for the 4th quarter of FY 2019-20 has again include4 such costs as part of
capacity charges billed to D1SCQ. Therefore, while working cut the instant qurcerIyadjustmntsthe
amoun of legal / htganon charges of Ra 2814 mill on perttnmg to the 4 cuane of Fl 2019-20 has
been not been considered.
14. Accordingly, based on the iniormation submrted by CPPA-G and the adjustment request filed
by DiSCOs, the following amount of ouarterly adjustments has been worked cut for vsiation in
Caacimy charges Variable O&M 1se of System Charges, Market Operator Fee and FCA impact on
T.&D losses, for the 4th quarter of Fl 2019-20 i.e. April to lure 2020.

1.6. The categ9ry wie: component of the aflowed quarterly adjustment of each XWDISCO along- with the uniform rate is attached as Anna-I with the instant decision :Sinc€, through amendment in
NEPRA Act, the power to.im.pose surcharges by the Federal Gcvermment• has been removed, therefore,
the Federal Government shall not rationalize the alio'Aed 'jnifrm rste of Rs.0276fkWh upwards

17. Having said that, the Authority in its uniform tariff determination dated December 19, 2018
has categorically held that. although the petition flied by the Federal Government falls short of the legal
requirements of section 31 (4) of the Act but in view of pragmatic considerations, it would be
ine,uitab1e and unconscionable for the Authority to dismiss the uniform tariff motion on the basis of
non-exhaustive com1iance of the procedural elements thereof. The Authority further issued directions
to the Federal Government in para 34 of the December 19, 2018 itermination to be compiid by the
Federal Government for its subsequent submissions. Although, the said directions still remain to be
complied with by th Fdra1 Government, however, considering that the 1natter is an
adjustment in the aIredy approved uniform tariff by the Authority, therefore; without prejudice to

The Authority detennined tariffs for seven XWDISC.Os for the Fl 201&47 & Fl 2017-18 inddually .inder the:Si.ngie Year Tariff Regime (S?i'). For:XWDISCOs under the Multi
Year Tariff (Ml) regime, i.'e FESCO, LESCO and, 'JESCO, the A through is decisions regarding adjustment in tariff components for the FY 20.16-17 and F 20.17-1.8
allowed PPP Variations for the Fl 2017-18, and under/over recovery of the allowed Distribution Margin for the Fl 2016-17 and Fl 2017-18, as Prior Year Ad)ustment. The said decisions were intimated to the Federal Governmen for notffication.in the official Gazette.
2. The Federal Government, against the aforementioned .deterrninations/decii'cn filed .,a motion datedNovernber 09, 20.i8 under Section 7, al(4)'and 31(7) of 'the NE'PRA Act 1997 read with Rule 17 of the NEPR (Tariff Standards and Procedure) Rules, 1998 for recorrenda on o" uuo'm con—er eric taritc a1 a iona1 lee, wCi as decided by me Authority on December 19, 2019. The uniform tariff so determined by the Authority notified by the Federal Government vide SRO. 1(1)12019 to SRO. 12(1)12019 dated January01> 2019, to be effctiv.efrom January 01, 2019.

Based on the adjustment mechaitism as prescribed in the notified tariff, EPRA has aireedy determined the quarterly adfustrnents f X ISCOs for the F! 2018-19 & FY 20i-20 which have since been noffied by the Federal Government, except icr the 4 quarter of the Fl 2019-20, which was determined by the Authority or. 10.02.2.021 but is pending notification by the Federal overr.ment.

6. Hearing in matter was scheduled on March. 30, 2021 for which adveisement was published
in newspapers and separate notices were also sent to the st.akehoiders for initingomments
from the rnteretedJ affected parties Salient reatwes and detai1s or the proposed adustents were uploaded on NEPRAs Webare for information of all concerned Four DISCOs i e

7, Ministry of Enrgy (MoE) vide letter dated April 08, 2020 has requested to allow impact of
the quarterly adjustments on uniform basis across each category of consumers (exdudLog life
ithe consurners)i to be reflected in the monthly bills of consumers of all XWDISCOs till its
final recovery and any excess and less adjustment would be settled between DISCOs at OPPA-
C level.
Heari was held as et the Schedule on 30 032021, which was attended by X0i)lSCOs,
CPPA-G, and other stakeholders including APTMA, General public and: media.
9. C?PA-G during the hearing submitted 'that Market 0e:arion Fee, Use of System charges of
NIDC and Capacity charges of Generation cornasues are billed to XWDiSCCs as pe.r the
determinations/decisions of NEPRA. CPPA-G, while justifying the instant adjustment
request,. submitted that thp projected Power Purchase Price (P?P) references indluded in the
notified base tariff, did not include capacity charges or certain power plants. e.g. eeiurn Jhelum Hydro, HSR (Siwai) Coal, China hub Power Coal. Engr Power G€i r
Port Qastm Coal and various Solar ano Vi triO basco power plants. etc., as these plants were
not operational at mat time. However, subsequenoy these panms became operational and
have accordingly started invoicing ther capacity charges to CPPAG, which is being
reflected in the quarterly adjustment requests.

10. The Authority on the concerns raised by the commentatQr.s during the hearing .regardirg payrnenL of caoacity clr'arges to power plart whou uh1 utillzmg Pheir availab1 e capaclhes observed that as per the Take OR Pay agreements with the IPPs, the Capacity is paid to the
IPPs based to the availability of plants, irrespective of their utilizatica factor.
11. The Authority in order to work out the amount of quarterly adjustments .f XWDlSCOs,
obtained details QI actual Power Purchase costbilledbyCPPA-G o'DiSQ.s for th.e rélevan.t

to December 2020, and also. certified that;

1. Invoices of all Capacity Purchase have been processed in accordance with rates, Terms & Conditions as determined by NPPA. Payments related to periodical adjustments are aLso mad.e as per decision of NEPRA.
il. The above statementis true based on facts and from verifible documentaryevidences In case of any de'viationivariation observed if not rectified at later stage, CPPA-G will be
responsible for the consequences arising cut of any misstatement under NEPRA Act.

i, invoices of all Capacity Purchase have been made strictiyirt accordance with the tates,
terms & conditions as stipulated in the respective Power Purchase Agreeinert.
ii. All payments to IPPs are being made after observing all formalities provided in the

iii. All purchase have been made in accordance with the Power Purchase agreement.
iv, Th aboyetatement is true, based on facts and from verifiable documentary evidences. In
case of any deviaticrilvariation observed if not rectified at later stage, CPPA-G will be responsible for the consequences arising out of any misstatement under NEPRA Act and its Rules & Regulations.
12 Accordingiy for working out the quarterly adjustments for the l• & .2 quarters of the FY 2020-21, the information provided. by CPPA-G and the requests filed by DISCOs have been considered. Here it I pertinent to mention that the Authority in the det niniations of CPPA-G Market Operation fee observed that CPPA-G reflects th costs incurred on account of legal / litigation charges in the capacity costs billed to DISCOs. Accordingly C?PA-G was directed to include the said cost in its market oceration fees and be got aproved froto the

1.6. .Sie through: amendme.nt in NE.PRA Act, the power to impose. surchags by the Federal
-Government. has been removed, therefore, the Federal Government shall not rationalize the allowed uniform rate of Rs0.8966/kWh ipwards for any consumer category. Having said that, the Authority in its uniform tariff determination dated 19.12.20.18 and 12.02.2021 has categorically held that although the petition filed by the Federal Government falls shçrt of the legal requirements of Section 31 (4) cf the Act but in view of pragmatic considerations, it would be ineuitabie and unconscionable for. the Authority to dismis the uniform tariff motion on the basis of nonexhaustive con pliance of the procedural elements thereof The Authrity further issued directions to th Federal Government in pars 34 of tne iJ2.2018 and 12.02.2021 determinations to be complied by the Federal Government for its subsequent submissions. Although, the said directions still remain to be complied with by the Federal Government, however, considering that the instant matter is an adjustment in the already approved uniform tariff by the Authority1 therefore, without prejudice to the said observations and directions of -the Authority, the quarterly adjustments have been determined in .a uniform manner. The -instant determination fdecision shall not in any way operate to modif alter, rescind or waive f the ohsertions and the directions of the Authority in the determination dated 19.32.2018 and 32.02.2021.
