Subject: Comments and objections on the half backed and biased Inquiry report.

Sir,

Kindly refer to the Board letter No. HRB/Admn/EA-1/ 4766 dated 29-5-2014 read with the No.HRB/Admn/EA-2/ 1730 dated 4-6-2013 (CE order dated 25-4-2013 conveyed with delay and

1730 over writing doubtful), same date of issuing charge sheet vide No.1735-36 dated 4-6-2013,

appeal before Hon’ble Chairman bearing diary No. 1653 dated 18-7-2013, No. 2963 dated 21-

10-2013 and No. 2966 dated 21-10-2013 along with the complete descriptions of registeredmedical practitioner, which were not placed on record by the Inquiry officer and disease

countersigned by the Civil Surgeon, Faridabad.

It is humbly submitted that the Inquiry report in question, is totally confusing, baseless, half

backed and biased and I strongly opposed and protest against it, because:

1. The Inquiry officer is a retired person, suffering from high blood pressure and short tempered

because many times he threatened me to send back all papers to the Board and not accepted

registered medical practitioner descriptions willingly, where as he is not a qualified medical practitioner, to identity and check the disease along with descriptions, besides it he never

examine the medical practitioner, who issued the sickness and fitness certificates, which wasnecessary.

2. Yes, I was very much present at head office, to inquire about release of my pay, which were

illegally with held, with out any orders, passed by the Competent Authorities, May I ask actionagainst the defaulter official, responsible for this, It would be pertinent to mention here that I can

move at my cost and risk, what is the harm to the Board?

3. When I was under treatment from 4-3-2013 to 1-5-2013 and disease duly countersigned by the

CMO and I have submitted my joining report on 2-5-2013, later I came to know about my

suspension order dated 29-4-2013 then how can I join and where, due to suspension?.

4. The Inquiry officer lost his senses, while quoting leave rejection because order were passed on

25-4-2013 conveyed on 4-6-2013 along with charge sheet, where as I have submitted my joiningreport on 2-5-2013, hence his finding on these rejection order is baseless and half backed, biased

as well because there were three appeal were pending with the Establishment Branch and these

appeal were not entertained willingly, to harass and mental torture because Hon’ble Chairmanhas asked to put up with file then who is responsible for not obeying the orders of worthy

Chairman passed on my appeal, which were duly registered with No. 2963 and 2966 dated 21-



10-2013, another appeal bearing No. 1653 dated 18-7-2013. It would be pertinent to mention

here that during inquiry of similar nature charge sheet, Board officials admitted that my appeal

against rejection of leave on medical grounds was pending with the branch then who is

responsible for not submitting the relevant files before the Hon’ble Chairman, where as Inquiryreport concealed these facts that 3 appeals against rejection of leave is pending.

5. The Inquiry report describing that I was on leave from 19-3-2012 to 2-4-2012 and same

registered medical practitioner issued the sickness and fitness certificates, admitted by the Board

and sanctioned leave on medical grounds then why these were not accepted, in case of leavefrom 4-3-2013 to 1-5-2013 and how Inquiry officer claimed that these are wrong documents?

6. In fact both charge sheets on same reasons were biased, baseless and illegal, unnecessary misuseof manpower, Board money as well because two different Inquiry officers were deputed against

payment, unnecessary burden on the Board.

Hence you are humbly requested to sanction leave on medical grounds, if compulsory then

personnel hearing may kindly be granted, in the interest of natural justice.

Shri O.P. Gupta, who don’t know the spelling, quoting himself Enquiry Officer needs rest andhappy retirement life along with treatment and care because he in not fit to conduct departmental

Inquiries due to his blood pressure and short temperateness, sathiyagaye hai.
