CONVENTION ON THE PROHIBITION OF MILITARY OR AIrt OTHER HOSTILE USE OF ENVIRONMENTAL MODIFICATION TECHNIQUES

The States Parties to this Convention,

Guided by the interest of consolidating peace, and wishing to contribute to

the cause of halting the arms race, and of bringing about general and complete

disarmament under strict and effective international control, and of saving

mankind from the danger of using new means of warfare,

Determined t o continue negotiations with a view to achieving effective

progress towards further measures in the field of disarmament,

Recognizing that scientific and technical advances may open new possibilities

with respect to modification of the environment,

Recalling the Declaration of the United Nations Conference on the Human

Environment , adopted at Stockholm on 16 June 1972,

Realizinc that the use of environmental modification techniques for peaceful

purposes could improve the interrelationship of man and nature and contribute to

the preservation and improvement of the environment for the benefit of present and

future generations,

Recognizing, however, that military or any other host ile use of such

teChniques could have effects extremely harmful to human welfare,

Desiring to prohibit effectively military or any other hostile use of

environmental modification techniques in order to eliminate the dangers to ~ankind

from such use, and affirming their willingness to work towards the achievement of

this objective,

Desiring also to contribute to the strengthening of trust among nations and

to the further improvement of the international situntion in accordance with the

purposes and principles of the Charter of the United Nations,

Have agreed as follows:

Article I

1. Each State Party to this Convention undertak _s not to engage in military

or any other hostile use of environmental modification techniques having

wide~pread, long-lasting or severe effects as the means of destruction, d~~ge or

injury to any other State Party.

2. Each State Party to this Convention undertakes not to assist, encourage

or induce any State, _sroup of States or international organizat i on to engage in

activities contrary to the provisions of paragraph 1 of this article.

Article II

As used in article I, the term "environmental modification techniques"

refers to any technique for changing - through the deliberate manipulation of

natural processes - the dynamics, composition or structure of the earth, including

its biota, lithosphere, hydrosphere and atmosphere, or of outer space.

Article III

1. The provisions of this Convention shall not hinder the use of

environmental modification techniques for peaceful purposes and shall be without

prejudice to the generally recognized principles and applicabl e rules of

international law concerning such use.

2. The States Parties to this Convention undertake to facilitate, and have

the right to participate in, the fullest possible exchange of scientific and

technological information on the use of environmental modification techniques for

peaceful purposes. States Parties in a position to do so shall contribute, alone

or together with other States or international organizations, to international

economic and scientific co-operation in the preservation , improvement and

peaceful utilization of the environment, vith due consideration for the needs of

the developing areas of the vorld.

Article IV

Each State Party to this Convention undertakes to take any measures it

considers necessary in accordance vith its constitutional processes to prohibit

and prevent any activity in violation of the provisions of the Convention

anywhere under its jurisdiction or control.

Article V

1 . The States Parties to this Convention undertake to cQnsult one another

and to co-operate in solving any problems vhich roay arise in relation to the

objectives of, or in the application of the provisions of. the Convention.

Consultation and co-operation pursuant to this article may also be undertaken

through appropriate international procedures within the framevork of the United

Nations and in accordance with its Charter. These international procedures may

include the services of appropriate international organizations, as vell as of a

Consultative Committee of Experts as provided for in paragraph 2 of this article.

2 . For the purposes set forth in paragraph 1 of this article, the

Depositary shall, within one month of the receipt of a request from any State

Party to this Convention , convene a Consultative Committee of Experts. Any State

Party may appoint an expert to the Committee whose functions and rules of

procedure are set out in the annex, which constitutes an integral part of this

Convention. The Committee shall t r ansmit to the Depositary a summary of its

findings of fact, incorporating all views and information presented to the

Committee duri ng its proceedings . The Depositary shall distribute the summary

to all States Parties.

3. Any State Party to this Convention which has reason to bel ieve that any

other State Party is acting in breach of obligations deriving from the provisions

of the Convention may lodge a complaint vith the Security Council of the United

Nations. Such a complaint should include all relevant information as veIl as all

possible evidence supporting its ' validity.

4. Each State Party to this Convention undertakes to co- operate in carrying

out any investigation which the Security Co~ncil may initiate, in accordance with

the provisions of the Charter of the United Nations, on the basis of the complaint

received by the Council. The Security Council shall inform the States Parties

of the results of the investigation.

5. Each State Party to this Convention undertakes to provide or support

assistance, in accordance with the provisions of the Charter at the United Nations,

to any State Party which so requests, if the Security Council decides that such

Party has been harmed or is likely to be harmed as a result of violation ot the

Convention .

Article VI

1. Any State Party to this Convention m~ propose amendment3 to the

Convention. The text of any proposed amendment shall be submitted to the

Depositary, who shall promptly circulate it to all State3 Parties.

2. An amendment shall enter into force for all States Parties to this

Convention which have accepted it, upon the deposit with the Depositary of

instruments of acceptance by ~ majority of States Parties. 1hereafter it shall

enter into force for any remaining State Party on the date of deposit of its

instrument of acceptance.

Article VIr

This Convention shall be of unlimited duration.

Article VIII

1. Five years after the entry into force of this Convention, a conference

of the States Parties to the Convention shall be convened by the Depositary at

Geneva, Switzerland. The conference shall review the operation of the

Convention with a view to ensuring that its purposes and provisions are being

realized. and shall in particular examine the effectiveness of the provisions of

paragraph 1 of article I in eliminating the dangers of military or any other

hostile use of environmental modification techniques .

2. At intervals of not less than five years thereafter, a majority of the

States Parties to this Convention may obtain, by sUbmitting a proposal to this

effect to the Depositary, the convening of a conference with the same objectives.

3. If no conference has been convened pursuant to paragraph 2 of this

article within ten years folloving the conclusion of a previous conference, the

Depositary shall solicit the views of all States Parties to this Convention,

concerning the convening of such a conference. If one third or ten of the

States Parties, whichever number is less, respond affirmatively, the Depositary

shall take immediate steps to convene the conference.

Article IX

1. This Convention shall be open to all States for signature. Any State

which does not siBn the Convention before its entry into force in accordance with

paragraph 3 of this article may accede to it at any time .

2. This Convention shall be subject to ratification by signatory States.

Instruments of ratification or accession shall be deposited vith the Secretary­

General of the United Nations.

3. This Convention shall enter into force upon the deposit of instruments

of ratification by twenty Governments in accordance wi th paraeraph 2 of this

article.

4. For those States whose instruments of ratification or accession are

deposited after the entry into force of this Convention, it shall enter into

force on the date of the deposit of their instruments of ratification or accession .

5 . The Depositary ShBll prouptly inform all signatory and accedins States

of the date of each signature, the date of deposit of each instrument of

ratification or accession and the date of the entry "into force of this Convention

and of any amendments thereto, as veIl as of the receipt of other notices.

6. This Convention shall be registered by the Depositary in accordance

with Article 102 of the Charter or the United Nations.

Article X

Thie Convention, of vhich the English, Arabic, Chinese, French, Russian and

Spanish texts are equally authentic, shall be deposited with the Secr~tary­

General of the United Nations, vho sball send duly certified copies thereof to

the Governments of the signatory and acceding States .

IN WITNESS WHEREOF. the undersigned, being duly authorized thereto by their

respective Governments, have signed this Convention. opened for signature at

Geneva on the eighteenth day of May, one thousand nine hundred and seventy-seven.

Annex to the Convention

Consultative Committee of Experts

1. The Consultative Committee of Experts sha.l.l undertake to make

appropriate findings of fact and provide expert vievs relevant to any problem

raised pursuant to paragraph 1 of article V of this Convention by the State

Party requestinR the convening of the Committee.

2 . The york of the Consultative Committee of Experts shall be organized

in such a yay as to permit it to perform the functions set forth in paragraph 1

of this annex. The Committee shall decide procedural questions relative to the

organization of its work, vhere possible by consensus, but otliervl.se by a

majority of those present and voting. There shall be no votine on mattera of

substance.

3. The Depositary or his representative shall serve aa the Chairman ot

the Committee.

4. Each expert may be assisted at meetings by one or more advisers.

5. Each expert shall have the right, through the Chairman, to requeat

from States, and from international organizationa, sueh information and

assistance as the expert eonsiders desirable for the accomplhhment of the

Committee's York.

Guides par les interets du renforcement de 1a p~x et desireux de contribuer

aoua un centrale international strict et efficace, ainsi qu'~ preserver l'humanite

du danger de voir uti1iser de nouveaux moyena de guerre.

Resolus a poursuivre des negociationa en vue de realiser des progr~s

efrectifs vers de nouvelles mesures dans le domaine du desarmement,

Reconnaissant que 1es progres de 1& science et de la technique peuvent ouvrir

de nouvelles possibilites en ce qui concerne la modification de l'environnement.

Rappelant la Declaration de 1a Conrerence des Nations Unies sur l'environ­

nement, adoptee a Stockholm le 16 juin 1912.

Conscients du fait que l'uti1iaation dea techniques de modification ne

l'environnement a des fins pacifiques pourrait ameliorer lea relations entre

l'bomme et la nature et contribuer a proteger et a ame1iorer l'environnement

pour le bien des generations actuelles et a venir,

Reconnaissant. toutefois, que 1 'utilisation de ees techniques a des tins

militaires ou toutes autres tins hostilec pourrait avoir des etfets extremement

prejudiciables au bien-itre de l'homme.

r>esireux d'interdire efficacement l'utiliaatiOD des techniques de

modification de l'environnement a des fins militaires au tautes autres rina

hostiles. afin d' eHminer les dangers que cette utilisation presente pour

l'humanite, et affirmant leur volonte d'oeuvrer ~ 1& realisation de cet objectif.

Article premier

1. Chaque Etat partie a la pr~sente Convention s'engage a ne pas utili~er

a des tins militaires ou toutes autres tins hostiles des techniques de modification

de l'environnement -rant des effeta etendUl, durable. ou graves, en tant que

moyen. de causer des destructions, des dommages ou des prEjudices a tout autre

Etat partie.

2. Cbaque Etat partie a la presente Convention .'engage a n'aider,

encourager ou inciter aucun Etat, sroupe d'Etats ou organisation internationale a mener des activites contraires aux disposition. du paragraphe 1 du present article.

Article II

2. Les Etats parties a la presente Convention s'engagent ~ faciliter un

echange aussi complet que possible d'intormations scientifiques et techniques

sur l'utilisation des techniques de modification de l'environnement ~ des fins

pacifiques, et ont Ie droit de participer ~ cet echange. Les Etats parties qui

soot en mesure de Ie f&ire devront contribuer. A titre individuel ou conjoin­

tement avec d I autres Etats ou des organis ations internationa.les. a une cooperation

internationale economique et scientifique en vue de la protection. de llamelio­

ration et de llutilisation pacifique de 11 environnement I compte di'irnent tenu des

besoins des regions en developpement du monde.

Article IV

Chaque Etat partie a la presente Convention s'engage ~ prendre toutes les

mesures qu'il jugera necess&ires contormement a ses procedures constitutionnelles

pour interdire et prevenir toute activite contrevenent aux dispositions de la

presente Convention en tous lieux relevant de sa juri diction ou de so~ controle.

Article V

1. Lea Etats parties ~ la presente Convention s'engagent ~ se consulter

mutuel1ement et a cooperer entre eux pour resoudre tous problemes qui pourraient

se poser Ii propos des objectifs de la presente Convention ou de l'application de

ses dispositions. Les activites de consultation et de cooperation visees au

present article peuvent ega.1.ement etre entreprises grace a des procedures inter­

nationales appropriees dans Ie cadre de l'Organisation des Nations Unies et

conformement a. sa Charte. Ces procedures internationales peuvent comprendre les

services d'organisations internationa.1.es appropriees. ainsi que ceux d'un comite

consultatif d'experts comme prevu dans Ie paragraphe 2 du present article.

2. Aux fins enoncees dans Ie paragraphe I du present article, Ie

Depositaire. dans Ie mois qui suivra la reception d'une demande emanant d'un

Etat partie. convoquera un conri.te consultatif d'experts. Tout Etat partie

peut designer un expert audit comite, dont les fonctions et Ie reglement

interieur sont enonces dans l'Annexe. laquelle fait partie integrante de la

Convention. Le Comite consultatif communiquera au Depositaire un resume de ses

constatations de fait ou figureront toutes les opinions et informations

presentees au Comite au ~ours de ses deliberations. Le Depositaire distribuera

Ie resume a tous les Etats parties.

3. Tout Etat partie a la presente Convention qui a des raisons de croire

qu'un autre Etat partie agit en violation des obligations decoulant des dispo­

sitions de la Convention peut deposer une plainte aupres du Conseil de securite

de 1 'Organisation des Nations Unies. Cette plainte doit etre accompagnee de

tous les renseignements pertinents sinsi que de tous les elements de preuve

possibles confirmant sa validite.

4. Chaque Etat partie a 1a presente Convention s 'engage a cooperer a toute enquete que Ie Conseil de securite pourrait entreprendre. conformeroent

8l.1X dispositions de la Charte des Nations Uoies. sur 1a base de la plainte

re~ue par Ie Conseil. Ce dernier communique 1es resu1tats de l'enquete aux

Etats parties.

5. Chaque Etat partie a la presente Convention s'engage a venir en aide

ou a preter son appui. conformement aux dispositions de Is. Chs.rte des

Nations Unies, a tout Etat partie qui en fait la demande. si le Conseil de

securite decide que ladite partie a ete lesee ou risque d'etre lesee par suite

d'une violation de la Convention.

Article VI

1. Tout Etat partie a la presente Convention' peut proposer des amendements

a 1a Convention. Le texte de tout emendement propose sera soumis au Depositaire,

qui le communiquera sans retard a tous les Etats parties.

2. Un amendement entrera en vigueur ~ l'€gard de tous les Etats parties a 18. presente Convention qui I' auront accepte des le depot aupres du Depositaire

des instruments d' acceptation par une majori te des Etats parties. Par la suite.

il entrera en vigueur a l'egard de tout autre Etat partie a la date du depot de

80n instrument d'acceptation.

Article VII

La presente Convention a une duree illimitee.

Arti cle VIII

1. Cinq ans apres l'entree en vigueur de la presente Convention, le

Depositaire convoquera une conference des Etats parties a 1a Convention, a Geneve (Suis~e). Cette conference examinera le fonctionnement de la Convention

en vue de s'assurer que ses objectifs et ses dispositions sont en voie de

realisation; elle examinera en particulier l'efficacite des dispositions du

paragraphe 1 de l'article premier pour eliminer les dangers d'une utilisation

des techniques de modification de l'environnement a des fins militaires ou

toutes aut res rins hostiles.

2. Par 1a suite, a des intervalies non inferieurs a. C1nq ansi une

majorite des Etats parties a. la presente Convention pourra, en soumettant

une proposition a cet eftet au Depositaire. obtenir la convocation d'une

eonrerence ayant lea memes objectifs.

3. 5i aucune conference n'a ete convoquee conformement au paragraphe 2

du present article dans les dix ans ayant suivi la fin d'une precedente

conference, le Depositaire demanders l'avis de tous les Etats parties a 1&

presente Convention au sujet de la convocation d'une telle conference. 5i un

tiers des Etats parties ou dix d'entre eux, le nombre a retenir etant le plus

f&ible des deux. repondent par l'affirmative, le Depositaire prendra immedia­

tement des mesures pour convoquer la conference.

Article IX

1. La presente Convention est ouverte a la sign~ture de tous les Et&ts.

Tout Etat qui n'aura pas signe la Convention avant son entree en vigueur

conformement au paragraphe 3 du present article pourra y adherer a tout moment.

2. La presente Convention sera solllllise a la ratification des Etats

signataires. Les instruments de ratification ou d'adhesion serent deposes

aupres du 5ecretaire general de I' Organisation de:; Nations Unies.

3. La presente Convention entrera en vigueur apres le depot des instruments

de ratification par vingt gouvernements, conformement au paragraphe 2 du present

article.

4. Pour les Etats dont les instruments de ratification ou d'adhesion aeront

deposes apres l'entree en vigueur de 1& presente Convention, cel1e-ci entrera en

vigueur a 1a date du depot de leurs instruments de ratification ou d' adhesion.

5. Le Depositaire informera sans dHai tous 1es Etats qui auront signe 1&

presente Convention ou qui y auront adhere de 1a date de chaque signature. de 1&

date de depot de chaque instrument de ratification ou d'ad.hesion, de 1a date

d'entree en vigueur de la presente Convention et de tous amendements y re1atifs,

ainsi que de la reception de toute autre communication.

Annexe a la Convention

Comite consultatif d'experts

1. Le Comite consultatif d'experts entreprendra de faire les constatations

de fait appropriees et de fournir des avis autorises concernant tout probleme

souleve. conformement au paragraphe 1 de l'article V de 1& presente Convention,

par l'Etat partie ~ui demande 18 convocation du comite.

2. Les travaux du Comite consultatif d'experts seront organises de f~on a lui permettre de s'ac~uitter des fonctions enoncees au paragraphe 1 de la

presente Annexe. Le Comite prendra les decisions sur des ~uestions de pFocedure

relatives a l'organisation de ses travaux si possible par consensus maJ.s. sinon.

a la majorite de ses membres presents et votants. II ne sera pas pro cede a des

votes sur des ~uestions de fond.

3. Le Depositaire ou son representant exercera les ronctions de President

du Comite.

4. Chaque expert peut etre assiste l ors des seances par un ou plusieurs

conseillers.

5. Chaque expert aura le droit. par l'intermediaire du President, de

demander aux Etats et aux organisations internation&les l es renseignements et

l'assistance qu'il jugera souhaitables pour permettre au Comite de s 'acquitter

de sa te.che.

Han convenido en 10 siguiente:

Artlculo I

1. Cada Estado Parte en Ie. presentc Convene ion se comprornete a no utilizar

tecnicas de modificaci6n ambiental con fines militares u ptros fines hostiles que

tenean efectos vastos, duraderos 0 eraves, como medios para producir

destrucciones, da~os 0 perjuicios a otro Estado Parte.

2. Cada £stado Parte en Ie. presente Cenvencion se compromete a DO ayudar.

Artlculo II

A los erectos del artlculo I, 1a expresion "t~cnicas de mOdificaci6n

ambiental" comprende todas las t~cnicns que t-ienen por obJeto alternr - mediante

la manipulaci6n deliberada de los procesos natur~les - la dinSmica. la composici6n

o estructura de la Tierra , incluida su bi6tica., 5U litosfera. au hidroatera y IU

atmosfera, 0 del espacio ultrnterrestre.

Artl culo II I

1 . Las dispoaiciones de la prcscnte Convenci on no ~pedir'n le utilizaci6n

de t~cnic8s de modificaci6n m~uiental con fines paclficos ni contravcndran 108

principios generalmente reconocidos y las normas ap1icableo del derecho

internacional relativos a esn utilizacion .

2. Los Estados Partes en la presente Convencion se comprometen a facilitar

el intercambio mas amplio posible de informacion cient£fica y tecno16gica sobre

la utilizaci6n de tecnicas de modificacion ambiental con fines padficos. y

tienen derecho a participar en ese intercambio. Los Estados Partes que puedan

hacerl0 contribuiran, individual 0 conjuntamente can otros Estados u

oreanizaciones internacionales, a la cooperacion economica y cientifica

internacional en Is preservacion. mejora y utilizacion del medio ambiente con

fines paclficos. teniendo debidamente en cuenta las necesidades de las regiones

en desarrollo del mWldo.

Articulo IV

Cada Estado Parte en 1& presente Convene ion se compromete a tomar las

medidas que considere necesarias. de conformidad con sus precedimientos

constitucionales. para prohibir y prevenir teda actividad contraria a las

disposiciones de la Convencion, en cualquier lugar situado bajo su jurisdiccion

o control.

Art1culo V

1. Los Estados Partes en 1& presente Convenci6n se comprometen a

consultarse rnutuamente y a cooperar en la sOluci6n de cualquier problema que

surja en relacion con los objetivos de la Convenci6n 0 en la aplicacion de sus

disposiciones. Las consultas y la cooperaci6n previstas en el presente nrt£culo

podrM llevarse a cabo tarnbien mediante los procedimientos internacionsles

apropie.dos dentro del marco de las Naciones Unidas y de conformide.d con su

Carta. Entre esos procedimientos internacionales pueden figura.r los servicios

de las org!Ulizaciones internacionale3 competentes. as! como los de un Comite

Consultivo de Expertos como ~e preve en el parrafo 2 del presente articulo.

Artlculo VI

1. Cualquier Estado Parte en 1~ presente Convencion podrs proponer

enmiendas a la Convencion . El texto de cualquier enmiende. propueste. debers.

ser presentado al Depositario, quien 10 distribuirs sin dilacion entre todos

los Estados Partes.

2. Una enmienda entrars en vigor, p~re. todos 103 Estados Partes en Ie.

presente Convencion que la hayan aceptado, cuando la mayorla de los Estados

Partes hayan depositado en poder del Depositario los instrumentos de aceptaci6n.

A partir de entonces entrars. en vieor para cU.::I.lquiera de los demss Est&dos

Partes en 1.::1. fecha en que este deposite su instrumcnto de aceptaci6n.

Artlculo VII

La presente Convenci6n tendrs duracion ilimitnda.

Artrculo VIII

1 . Transcurridos cinco snos desde Ie. entrada en vigor de Ie. presente

Convenci6n, el Depositario convocara s una conferencia de los Estados Partes

en 18 Convellci6n, que se celebrars en Ginebrs. (Suiza). La Conferencia revisara

la aplicaci6n de la Convene ion para asegurarsc de que se estan cumpliendo sus

tines y disposiciones y , en particular, estudiara la eficacia de las

disposiciones del parrafo 1 del art!culo I en'cuanto a la eliminacion de los

peligros de la utilizacion de tecnicas de modific&cion ambiental con fines

militares u otros fines hostiles .

2. A partir de ese momento, con intervalos no menores de cinco anos,

1& mayor18 de los Estados Partes en la presente Convene ion pqdra conseguir que

se convoque Wl8 conferencia con los mismos objetivos mediante la presentaci6n

de una propuesta al efecto al Depositario.

3. Si no hubiera sido convocada ninguna conferencia, con arreglo al

parrafo 2 del presente articulo, dentro de los diez anos siguientes a Is

conclusion de una conferencia precedente, el Depositario solid tara las

opiniones de todos los Estados Partes en 1& presente Convenci6n sobre Is

convocaci6n de tal conferencia. Si un tercio 0 diez de los Estados Partes,

segUn el nilmero que sea menor, responden &firlllativamente, el Depositario

adopta1'a innediatNllente rr.eaidas para convoco.r a In confcrencia.

Artlculo IX

1. La presente Convencion est~ra abierta a la firma de todos los Estadoa.

£1 Estado que no firmare 1& Convencion antes de su entrada en visor de

conformidad con el parrafo 3 del presente artlculo. podrs. adherirse a ella en

cualquie l' momento .

2. La presente Convencion estarn sUJeta a ratificacion por los Estadoa

sienatarios. Los instrumcnLos de ratificacion 0 de adhesion se depositaran en

}joder del Secretario General de las Nnciones Unidas.

3. La pres cnte Convencion entrara en vif,or una vez que hayan depositado

sus instrumcntos de ratificacion veinte gobiernos . de conformidad con el

parrafo 2 del prcsente articulo.

4. Para 10!l Estados cuyos instrumentos de ratificacion 0 de adhesi6n

se dcpositaren despucs de la entrada en vir,or de la presente Convenci6n . la

Convcnci6n entrara en vir;or en la fecha del deposito de sus instrumcnto8 de

ratificaci6n 0 de c.dhe~i6n.

5. El Depositario infornarn sin dilncion a todos los Estados

signatarios y a todos los Estados que se hayan adherido a 1& presente Convencion

ue la fechn de cada finr.a, de la fcchn de deposito de cada inst rumento de

ratificaci6n 0 de adhesion y de la fecho. de entrada en vieor de la preaente

eonvencion y de las enmicndas a la mismn, aSl como de la recepcion ~e otras

1. El Comite Consultivo de Expertos se encargare. de establecer las

conclu3iones facticas pertinentes y de facilitar opinioMs de expertos en

relacion can cualquier problema que, con forme a 10 dispuesto en el parrafo 1

del art!culo V de la p rescnte Convencion, plantee el Estado Parte que solid te

la convocacion del Comite.

2. Los trabajos del Comite Consultivo de F..xpertos se orr,anizariln de

modo que le permita desempenar las funciones establecidns en el pe.rrefo I del

presente Anexo. Cuando sea posible. el Comite tomara por consenso decisiones

sobre las cuestione3 de procedimiento relativas a 1a organizaci6n de sus

trabujos; si no es posible, las decisiones se tomaran par mnyorla de los

miembros presentes y votantes. No se someteran a votacion las cuestiones de

:fondo.

3. El Presidente del Comite sera el Depositario 0 su representante.
