DESCRIPTION

This matter was dismissed for Lack of Probable Cause. This is the Dismissal Findings of Fact, Conclusions of Law and Oder of April 13, 2015 based on the Evidenciary hearing of February 26, 2015 before Judge Christian S. Wilton in the Matter of the State of Minnesota vs Don Mashak on a bogus Disorderly Conduct 19HA-CR-14-1019 Charge for the purpose of Oppressing Freedom of the Press. Though Judge Christian S. Wilton ruled correctly that the matter should be dismissed for lack of Probable Cause. He erred is ruling on at least two points. 1) that Don Mashak had been loud and disruptive of the Court in the Morning; 2) in failing to mention that Don Mashak was attending the hearing of Sperling vs Sperling as a member of the Press. The letter to Judge Christian S. Wilton and the Prosecutor pointing out these errors and the reasons why they do not comport with the "Facts in Evidence" will be posted on ScribD shortly.
