    Demolition of Buildings/StructuresDevelopment Guide No. 8

    Demolition of a building/structure will require Development Approval from Council. DevelopmentApproval comprises both Development Plan Consent (Planning consent) and Building RulesConsent (Building consent). The application may be made for both consents together or separately.

    The demolition of residential developments that require Building Consent only are exempt fromPlanning Consent and are lodged using Development Guide No. 8A.

    IntroductionMost residential demolition matters requirebuilding consent but not planning consent. For the

    demolition to fall into this category, it needs tomeet all the conditions that are relevant as listedbelow. If you are not sure please contact Council.

    Does Demolition require Approval?Yes, approval to demolish building(s)/structure(s)is required in all instances. Hence, adevelopment application will need to be lodged.

    Planning ConsentDemolition of a building(s)/structure(s) is deemedto be a complying form of development, meaning

    that planning consent must be granted. The onlyvariance to this is when a building has either acontributory item, local heritage or state heritagelisting. In these cases demolition is deemed non-complying.

    Building ConsentAn application for Building Consent is assessedagainst the technical requirements of the BuildingCode of Australia and other relevant standards toensure that during demolition of any part, ordemolition of the whole building, is carried out sothat structural sufficiency, fire safety, health and

    amenity are maintained. To determine the feesapplicable refer to Councils DevelopmentApplication form.

    How is an Application made?An application is made by submitting a completedDevelopment Application Form, which is availablefrom the Council Offices or can be downloadedfrom Council's website at www.portenf.sa.gov.autogether with information relevant to your proposaland payment of the appropriate fees.

    Plans for Demolition Work (2 copies)An application for Building Rules Consent fordevelopment consisting of or involving the

    demolition or removal of a building (or part of abuilding) must be accompanied by: a description in writing of the construction of

    the building (or relevant part) to bedemolished or removed;

    a site plan drawn to a scale of not less than1:500 showing: allotment boundaries, dimensions and

    position of any easements; position and dimensions of buildings in

    relation to the boundaries of the site andany other features such as otherbuildings or trees on the site, or onadjoining land or public places that mightbe affected by the work or affect the workproposed to be performed;

    the location of any significant trees; a copy of the certificate of title; and dimensioned floor area of the building to

    be demolished. if only part of the building is to be demolished

    or removed, calculations or other informationin writing to show that the remainder of thebuilding will comply with the Development Act1993, either as the building remains after theproposed demolition or removal takes place,or after the building work is performed;

    a description in writing of the demolitionprocedure, including details of the measuresto be taken to provide satisfactory levels ofsafety on or about the site;

    and detailing the extent of demolition work(eg. whether demolition is just internal orexternal or both, whether there is removal ofroof structure, load bearing or non loadbearing walls, floors, fences etc).

    Elevations (2 copies)Where required (eg. when partial demolition onlyis applied for), elevations (drawn to a scale 1:100)showing front and side views of the structure,

    including construction materials and height to theeaves and the ridge of the roof.

    Other InformationSignificant TreesAny work, including the demolition ofbuildings/structures, that may affect a SignificantTree will also require approval from Council.Please refer to Development Guide No. 6 for

    further details.

    Demolition Precautions Demolition contractors or persons carrying out

    the work should take precautions to ensurethat the safety and health of persons onprivate or public property is maintained.

    Where necessary demolition contractors orpersons responsible for carrying out the workshall take precautions such as temporaryfencing, bunting or scaffolding to preventaccess onto the site.

    To avoid unnecessary delay in the processing ofyour application, the information submitted withyour application form should include the following: a description in writing of the demolition

    procedure, including details of the measuresto be taken to provide satisfactory levels ofsafety on or about the site.

    any asbestos identified is required to beremoved in accordance with the provisions ofthe Occupational Health Safety and WelfareAct 1986 and Australian standard 2601.

    enquires relating to the identification, removal,and transportation of asbestos can be madeby contacting SafeWork SA.

    Please note: For their protection building ownersare advised to employ licensed builders andcontractors only who are listed with SafeWork SAfor the work intended to be undertaken.

    EasementsAny person carrying out demolition work thataffect easements must obtain approval from theauthority that has control of the easement. YourCertificate of Title contains information about the

    location and nature of easements that may be onyour property.

    How long does it take?Council will endeavour to deal with demolitionapplications as quickly as possible, however,approval should be granted within 20 workingdays.

    Please note: a longer period may be needed ifadditional information is required to supplementyour application.

    How much does it cost?Please refer to fees schedule on the reverse sideof the Development Application Formto findthe appropriate application fee.

    In some special cases a referral, consultation or

    public notification fee may be required. Councilstaff will advise if this is necessary.

    If the cost of the construction work exceeds$15,000 the Construction Industry Training Formand Levy must be supplied.

    Building indemnity insurance is required if the costof construction work exceeds $12,000 for

    domestic building work and you employ aRegistered Building Work Contractor.
