BETWEEN THE UNITED STATES OF AMERICA
AND THE UNITED ARAB EMIRATES
ARTICLE I
All classified military information communicated directly or indirectly between the government of the United States of America and the government of the United Arab Emirates including that subsequently released to contractors and provided herein shall be protected in accordance with the following principles
A The recipient government will not release the information to a third-country government person or firm without the prior approval of the releasing government
B The recipient government will afford the information a degree of protection equivalent to that afforded it by the releasing government consistent with the requirements in Article IV
c The recipient government will not use the information for other than the purpose for which it was given and
D The recipient government will respect private rights such as patents copyrights or trade secrets which are involved in the information
ARTICLE II
Classified military information material or equipment shall be transferred only on a government-to-government basis and only to persons who have an appropriate security clearance and an official need-to-know
ARTICLE I II
For the purpose of this agreement the term classified military information is that official military information material or equipment which in the interest of the national security of the releasing government and in accordarice with applicable national laws and regulations has been designated as classified by the appropriate security authority and which requires protection against any unauthorized disclosure These
me a s ur1~s apply to any classified military information in what ever [orm be it written oral or visual Material or egu i pment may be any document product or substance on or in which information may be recorded or embodied or from which information may be derived regardless of its physical character or makeup including but not limited to documents writing hardware software machinery apparatus devices models photographs recordings reproductions notes sketches plans prototypes designs configurations maps and letters
ARTICLE IV
Military information classified by one government and furnished to the other government will be assigned a security classification by the appropriate security authorities of the receiving government which will assure a degree of protection equivalent to that required by the releasing government in the following manner
A Information classified by the government of the United States as TOP SECRET or SECRET will be marked TOP SECRET ( d-- I J s ) in Arabic by the government of the United Arab Emirates and protected as TOP SECRET in accordance with laws and regulations of the government of the United Arab Emirates Information classified by the government of the United States as CONFIDENTIAL will be marked SECRET ( s ) in Arabic by the government of the United Arao Emirates and protected as SECRET in accordance with the laws and regulations of the government of the United Arab Emirates
B Information classified by the government of the United Arab Emirates as TOP SECRET ( 4-I 11 - ) wi 11 be marked SECRET in English by the government of the United States and protected as SECRET in accordance with United States laws and regulations Such information may be marked TOP SECRET in English by the government of the United States and protected accordingly when officially requested by the government of the United Arab Emirates Information classified by the government of the United Arab Emirates as SECRET ( ~ s ) will be marked in English as SECRET by the government of the United States and protected as SECRET in accordance with United States laws and regulations Information classified by the government of the United Arab Emirates as CONFIDENTIAL ( I ) will be marked in English as CONFIDENTIAL by the government of the United States and protected as CONFIDENTIAL in accordance with United States laws and regulations
c The protection of classified information from disclosure to unauthorized persons will be in accordance with existing UAE and U s procedures supplemented if necessary to meet the needs of a particular program project or plan as may be agreed by the two governments

ARTICLE V
This agreement shall apply to all exchanges of classified military information between all agencies and authorized officials of the government of the United States middot and the government of the United Arab Emirates However this agreement shall not apply to classified information for which separate security agreements and arrangements already have been concluded Details regarding channels of communication and the application of the foregoing principles shall be the subject of such technica 1 arrangements ( including an i ndus tr ia 1 security arrangement) as may be necessary between appropriate agencies of the respective governments
ARTICLE VI
Each government wii1 permit security experts of the other government to make periodic visits to its territory at mutually agreed-to-times to discuss with its security authorities its procedures and facilities for the protection of classified military information furnished by the other government Each government will assist such experts in determining whether such information provided by the other government is being adequately protected At least twelve months shall elapse between these general security survey visits
ARTICLE VI I
The recipient government will investigate all cases in which it is known or there are grounds for suspecting that classified military information from the originating government has been lost or disclosed to unauthorized persons The recipient government shall also promptly and fully inform the originating government of the details of such occurrences and shall provide it with the final results of the investigation and corrective action taken to preclude recurrences
ARTICLE VII I
A In the event that either government or its contractors awards a contract involving classified military information for performance within the territory of the other government then the government of the country in which performance under the contract is taking place will assume responsibility for administering security measures within its own territory for the protection of such classified information in accordance with its own standards and requirements and the requirements of Article IV

B lrior to the release to a contractor or prospective contr~ctor of any classified military information received from the other government the recipient government will
( l) r~nsure that such contractor or prospective contractor and his facility have the capability to protect the classified information adequately
(2) Grant to the facility the appropriate security clearance to this effect
(3) Grant the appropriate security clearance for all personnel whose duties require access to the information
(4) Ensure that all persons having access to the classified information are inf or med of their res pons ibi 1 it ies to protect the information in accordance with applicable laws
(5) carry out periodic security inspections of cleared facilities to ensure that classified mi 1 it a r y info r mat ion is protected as required herein
(6) Assure that access to the classified mi 1 i tary information is limited to those persons who have an official need-to-know
c A request for authorization to visit a facility when access to classified military information is involved will be submitted to the appropriate department or agency of the government of the country where the facility is located This request will be made by an agency designated for this purpose by the other government and will include a statement of the level of security clearance and the official status of the visitor as well as the reason for the visit If mutually agreed to an authorization va 1 id for recurring visits over extended periods may be arranged The government to which the request is submitted will be responsible for advising the contractor of the proposed visit and for authorizing the visit to be made
ARTICLE IX
Costs incurred in conducting security investigations or inspections required hereunder will not be subject to reimbursement

c A request for authorization to visit a facility when access to classified military information is involved will be submitted to the appropriate department or agency of the government of the country where the facility is located This request will be made by an agency designated for this purpose by the other government and will include a statement of the level of security clearance and the official status of the visitor as well as the reason for the visit If mutually agreed to an authorization va 1 id for recurring visits over extended periods may be arranged The government to which the request is submitted will be responsible for advising the contractor of the proposed visit and for authorizing the visit to be made

AND THE UNITED ARAB EMIRATES
ARTICLE I
All classified military information communicated directly or indirectly between the government of the United States of America and the government of the United Arab Emirates including that subsequently released to contractors and provided herein shall be protected in accordance with the following principles
A The recipient government will not release the information to a third-country government person or firm without the prior approval of the releasing government
B The recipient government will afford the information a degree of protection equivalent to that afforded it by the releasing government consistent with the requirements in Article IV
c The recipient government will not use the information for other than the purpose for which it was given and
D The recipient government will respect private rights such as patents copyrights or trade secrets which are involved in the information
ARTICLE II
Classified military information material or equipment shall be transferred only on a government-to-government basis and only to persons who have an appropriate security clearance and an official need-to-know
ARTICLE I II
For the purpose of this agreement the term classified military information is that official military information material or equipment which in the interest of the national security of the releasing government and in accordarice with applicable national laws and regulations has been designated as classified by the appropriate security authority and which requires protection against any unauthorized disclosure These
me a s ur1~s apply to any classified military information in what ever [orm be it written oral or visual Material or egu i pment may be any document product or substance on or in which information may be recorded or embodied or from which information may be derived regardless of its physical character or makeup including but not limited to documents writing hardware software machinery apparatus devices models photographs recordings reproductions notes sketches plans prototypes designs configurations maps and letters
ARTICLE IV
Military information classified by one government and furnished to the other government will be assigned a security classification by the appropriate security authorities of the receiving government which will assure a degree of protection equivalent to that required by the releasing government in the following manner
A Information classified by the government of the United States as TOP SECRET or SECRET will be marked TOP SECRET ( d-- I J s ) in Arabic by the government of the United Arab Emirates and protected as TOP SECRET in accordance with laws and regulations of the government of the United Arab Emirates Information classified by the government of the United States as CONFIDENTIAL will be marked SECRET ( s ) in Arabic by the government of the United Arao Emirates and protected as SECRET in accordance with the laws and regulations of the government of the United Arab Emirates
B Information classified by the government of the United Arab Emirates as TOP SECRET ( 4-I 11 - ) wi 11 be marked SECRET in English by the government of the United States and protected as SECRET in accordance with United States laws and regulations Such information may be marked TOP SECRET in English by the government of the United States and protected accordingly when officially requested by the government of the United Arab Emirates Information classified by the government of the United Arab Emirates as SECRET ( ~ s ) will be marked in English as SECRET by the government of the United States and protected as SECRET in accordance with United States laws and regulations Information classified by the government of the United Arab Emirates as CONFIDENTIAL ( I ) will be marked in English as CONFIDENTIAL by the government of the United States and protected as CONFIDENTIAL in accordance with United States laws and regulations
c The protection of classified information from disclosure to unauthorized persons will be in accordance with existing UAE and U s procedures supplemented if necessary to meet the needs of a particular program project or plan as may be agreed by the two governments

ARTICLE V
This agreement shall apply to all exchanges of classified military information between all agencies and authorized officials of the government of the United States middot and the government of the United Arab Emirates However this agreement shall not apply to classified information for which separate security agreements and arrangements already have been concluded Details regarding channels of communication and the application of the foregoing principles shall be the subject of such technica 1 arrangements ( including an i ndus tr ia 1 security arrangement) as may be necessary between appropriate agencies of the respective governments
ARTICLE VI
Each government wii1 permit security experts of the other government to make periodic visits to its territory at mutually agreed-to-times to discuss with its security authorities its procedures and facilities for the protection of classified military information furnished by the other government Each government will assist such experts in determining whether such information provided by the other government is being adequately protected At least twelve months shall elapse between these general security survey visits
ARTICLE VI I
The recipient government will investigate all cases in which it is known or there are grounds for suspecting that classified military information from the originating government has been lost or disclosed to unauthorized persons The recipient government shall also promptly and fully inform the originating government of the details of such occurrences and shall provide it with the final results of the investigation and corrective action taken to preclude recurrences
ARTICLE VII I
A In the event that either government or its contractors awards a contract involving classified military information for performance within the territory of the other government then the government of the country in which performance under the contract is taking place will assume responsibility for administering security measures within its own territory for the protection of such classified information in accordance with its own standards and requirements and the requirements of Article IV

B lrior to the release to a contractor or prospective contr~ctor of any classified military information received from the other government the recipient government will
( l) r~nsure that such contractor or prospective contractor and his facility have the capability to protect the classified information adequately
(2) Grant to the facility the appropriate security clearance to this effect
(3) Grant the appropriate security clearance for all personnel whose duties require access to the information
(4) Ensure that all persons having access to the classified information are inf or med of their res pons ibi 1 it ies to protect the information in accordance with applicable laws
(5) carry out periodic security inspections of cleared facilities to ensure that classified mi 1 it a r y info r mat ion is protected as required herein
(6) Assure that access to the classified mi 1 i tary information is limited to those persons who have an official need-to-know

GENERAL SECURITY OF MILITARY INFORMATION AGREEMENT (GSOMIA)

AND
THE UNITED ARAB EMIRATES

AGREEMENT ON GENERAL SECURITY OF MILITARY INFORMATION AGREEMENT (GSOMIA)
BETWEEN THE UNITED STATES OF AMERICA
AND THE UNITED ARAB EMIRATES
ARTICLE I
All classified military information communicated directly or indirectly between the government of the United States of America and the government of the United Arab Emirates including that subsequently released to contractors and provided herein shall be protected in accordance with the following principles
A The recipient government will not release the information to a third-country government person or firm without the prior approval of the releasing government
B The recipient government will afford the information a degree of protection equivalent to that afforded it by the releasing government consistent with the requirements in Article IV
c The recipient government will not use the information for other than the purpose for which it was given and
D The recipient government will respect private rights such as patents copyrights or trade secrets which are involved in the information
ARTICLE II
Classified military information material or equipment shall be transferred only on a government-to-government basis and only to persons who have an appropriate security clearance and an official need-to-know
ARTICLE I II
For the purpose of this agreement the term classified military information is that official military information material or equipment which in the interest of the national security of the releasing government and in accordarice with applicable national laws and regulations has been designated as classified by the appropriate security authority and which requires protection against any unauthorized disclosure These
me a s ur1~s apply to any classified military information in what ever [orm be it written oral or visual Material or egu i pment may be any document product or substance on or in which information may be recorded or embodied or from which information may be derived regardless of its physical character or makeup including but not limited to documents writing hardware software machinery apparatus devices models photographs recordings reproductions notes sketches plans prototypes designs configurations maps and letters
ARTICLE IV
Military information classified by one government and furnished to the other government will be assigned a security classification by the appropriate security authorities of the receiving government which will assure a degree of protection equivalent to that required by the releasing government in the following manner
A Information classified by the government of the United States as TOP SECRET or SECRET will be marked TOP SECRET ( d-- I J s ) in Arabic by the government of the United Arab Emirates and protected as TOP SECRET in accordance with laws and regulations of the government of the United Arab Emirates Information classified by the government of the United States as CONFIDENTIAL will be marked SECRET ( s ) in Arabic by the government of the United Arao Emirates and protected as SECRET in accordance with the laws and regulations of the government of the United Arab Emirates
B Information classified by the government of the United Arab Emirates as TOP SECRET ( 4-I 11 - ) wi 11 be marked SECRET in English by the government of the United States and protected as SECRET in accordance with United States laws and regulations Such information may be marked TOP SECRET in English by the government of the United States and protected accordingly when officially requested by the government of the United Arab Emirates Information classified by the government of the United Arab Emirates as SECRET ( ~ s ) will be marked in English as SECRET by the government of the United States and protected as SECRET in accordance with United States laws and regulations Information classified by the government of the United Arab Emirates as CONFIDENTIAL ( I ) will be marked in English as CONFIDENTIAL by the government of the United States and protected as CONFIDENTIAL in accordance with United States laws and regulations
c The protection of classified information from disclosure to unauthorized persons will be in accordance with existing UAE and U s procedures supplemented if necessary to meet the needs of a particular program project or plan as may be agreed by the two governments

ARTICLE V
This agreement shall apply to all exchanges of classified military information between all agencies and authorized officials of the government of the United States middot and the government of the United Arab Emirates However this agreement shall not apply to classified information for which separate security agreements and arrangements already have been concluded Details regarding channels of communication and the application of the foregoing principles shall be the subject of such technica 1 arrangements ( including an i ndus tr ia 1 security arrangement) as may be necessary between appropriate agencies of the respective governments
ARTICLE VI
Each government wii1 permit security experts of the other government to make periodic visits to its territory at mutually agreed-to-times to discuss with its security authorities its procedures and facilities for the protection of classified military information furnished by the other government Each government will assist such experts in determining whether such information provided by the other government is being adequately protected At least twelve months shall elapse between these general security survey visits
ARTICLE VI I
The recipient government will investigate all cases in which it is known or there are grounds for suspecting that classified military information from the originating government has been lost or disclosed to unauthorized persons The recipient government shall also promptly and fully inform the originating government of the details of such occurrences and shall provide it with the final results of the investigation and corrective action taken to preclude recurrences
ARTICLE VII I
A In the event that either government or its contractors awards a contract involving classified military information for performance within the territory of the other government then the government of the country in which performance under the contract is taking place will assume responsibility for administering security measures within its own territory for the protection of such classified information in accordance with its own standards and requirements and the requirements of Article IV

B lrior to the release to a contractor or prospective contr~ctor of any classified military information received from the other government the recipient government will
( l) r~nsure that such contractor or prospective contractor and his facility have the capability to protect the classified information adequately
(2) Grant to the facility the appropriate security clearance to this effect
(3) Grant the appropriate security clearance for all personnel whose duties require access to the information
(4) Ensure that all persons having access to the classified information are inf or med of their res pons ibi 1 it ies to protect the information in accordance with applicable laws
(5) carry out periodic security inspections of cleared facilities to ensure that classified mi 1 it a r y info r mat ion is protected as required herein
(6) Assure that access to the classified mi 1 i tary information is limited to those persons who have an official need-to-know
c A request for authorization to visit a facility when access to classified military information is involved will be submitted to the appropriate department or agency of the government of the country where the facility is located This request will be made by an agency designated for this purpose by the other government and will include a statement of the level of security clearance and the official status of the visitor as well as the reason for the visit If mutually agreed to an authorization va 1 id for recurring visits over extended periods may be arranged The government to which the request is submitted will be responsible for advising the contractor of the proposed visit and for authorizing the visit to be made
ARTICLE IX
Costs incurred in conducting security investigations or inspections required hereunder will not be subject to reimbursement

For the purpose of this agreement the term classified military information is that official military information material or equipment which in the interest of the national security of the releasing government and in accordarice with applicable national laws and regulations has been designated as classified by the appropriate security authority and which requires protection against any unauthorized disclosure These
me a s ur1~s apply to any classified military information in what ever [orm be it written oral or visual Material or egu i pment may be any document product or substance on or in which information may be recorded or embodied or from which information may be derived regardless of its physical character or makeup including but not limited to documents writing hardware software machinery apparatus devices models photographs recordings reproductions notes sketches plans prototypes designs configurations maps and letters
ARTICLE IV
Military information classified by one government and furnished to the other government will be assigned a security classification by the appropriate security authorities of the receiving government which will assure a degree of protection equivalent to that required by the releasing government in the following manner
A Information classified by the government of the United States as TOP SECRET or SECRET will be marked TOP SECRET ( d-- I J s ) in Arabic by the government of the United Arab Emirates and protected as TOP SECRET in accordance with laws and regulations of the government of the United Arab Emirates Information classified by the government of the United States as CONFIDENTIAL will be marked SECRET ( s ) in Arabic by the government of the United Arao Emirates and protected as SECRET in accordance with the laws and regulations of the government of the United Arab Emirates
B Information classified by the government of the United Arab Emirates as TOP SECRET ( 4-I 11 - ) wi 11 be marked SECRET in English by the government of the United States and protected as SECRET in accordance with United States laws and regulations Such information may be marked TOP SECRET in English by the government of the United States and protected accordingly when officially requested by the government of the United Arab Emirates Information classified by the government of the United Arab Emirates as SECRET ( ~ s ) will be marked in English as SECRET by the government of the United States and protected as SECRET in accordance with United States laws and regulations Information classified by the government of the United Arab Emirates as CONFIDENTIAL ( I ) will be marked in English as CONFIDENTIAL by the government of the United States and protected as CONFIDENTIAL in accordance with United States laws and regulations
c The protection of classified information from disclosure to unauthorized persons will be in accordance with existing UAE and U s procedures supplemented if necessary to meet the needs of a particular program project or plan as may be agreed by the two governments

ARTICLE V
This agreement shall apply to all exchanges of classified military information between all agencies and authorized officials of the government of the United States middot and the government of the United Arab Emirates However this agreement shall not apply to classified information for which separate security agreements and arrangements already have been concluded Details regarding channels of communication and the application of the foregoing principles shall be the subject of such technica 1 arrangements ( including an i ndus tr ia 1 security arrangement) as may be necessary between appropriate agencies of the respective governments
ARTICLE VI
Each government wii1 permit security experts of the other government to make periodic visits to its territory at mutually agreed-to-times to discuss with its security authorities its procedures and facilities for the protection of classified military information furnished by the other government Each government will assist such experts in determining whether such information provided by the other government is being adequately protected At least twelve months shall elapse between these general security survey visits
ARTICLE VI I
The recipient government will investigate all cases in which it is known or there are grounds for suspecting that classified military information from the originating government has been lost or disclosed to unauthorized persons The recipient government shall also promptly and fully inform the originating government of the details of such occurrences and shall provide it with the final results of the investigation and corrective action taken to preclude recurrences
ARTICLE VII I
A In the event that either government or its contractors awards a contract involving classified military information for performance within the territory of the other government then the government of the country in which performance under the contract is taking place will assume responsibility for administering security measures within its own territory for the protection of such classified information in accordance with its own standards and requirements and the requirements of Article IV

B lrior to the release to a contractor or prospective contr~ctor of any classified military information received from the other government the recipient government will
( l) r~nsure that such contractor or prospective contractor and his facility have the capability to protect the classified information adequately
(2) Grant to the facility the appropriate security clearance to this effect
(3) Grant the appropriate security clearance for all personnel whose duties require access to the information
(4) Ensure that all persons having access to the classified information are inf or med of their res pons ibi 1 it ies to protect the information in accordance with applicable laws
(5) carry out periodic security inspections of cleared facilities to ensure that classified mi 1 it a r y info r mat ion is protected as required herein
(6) Assure that access to the classified mi 1 i tary information is limited to those persons who have an official need-to-know
c A request for authorization to visit a facility when access to classified military information is involved will be submitted to the appropriate department or agency of the government of the country where the facility is located This request will be made by an agency designated for this purpose by the other government and will include a statement of the level of security clearance and the official status of the visitor as well as the reason for the visit If mutually agreed to an authorization va 1 id for recurring visits over extended periods may be arranged The government to which the request is submitted will be responsible for advising the contractor of the proposed visit and for authorizing the visit to be made
ARTICLE IX
Costs incurred in conducting security investigations or inspections required hereunder will not be subject to reimbursement

ARTICLE V
This agreement shall apply to all exchanges of classified military information between all agencies and authorized officials of the government of the United States middot and the government of the United Arab Emirates However this agreement shall not apply to classified information for which separate security agreements and arrangements already have been concluded Details regarding channels of communication and the application of the foregoing principles shall be the subject of such technica 1 arrangements ( including an i ndus tr ia 1 security arrangement) as may be necessary between appropriate agencies of the respective governments
ARTICLE VI
Each government wii1 permit security experts of the other government to make periodic visits to its territory at mutually agreed-to-times to discuss with its security authorities its procedures and facilities for the protection of classified military information furnished by the other government Each government will assist such experts in determining whether such information provided by the other government is being adequately protected At least twelve months shall elapse between these general security survey visits
ARTICLE VI I
The recipient government will investigate all cases in which it is known or there are grounds for suspecting that classified military information from the originating government has been lost or disclosed to unauthorized persons The recipient government shall also promptly and fully inform the originating government of the details of such occurrences and shall provide it with the final results of the investigation and corrective action taken to preclude recurrences
ARTICLE VII I
A In the event that either government or its contractors awards a contract involving classified military information for performance within the territory of the other government then the government of the country in which performance under the contract is taking place will assume responsibility for administering security measures within its own territory for the protection of such classified information in accordance with its own standards and requirements and the requirements of Article IV

B lrior to the release to a contractor or prospective contr~ctor of any classified military information received from the other government the recipient government will
( l) r~nsure that such contractor or prospective contractor and his facility have the capability to protect the classified information adequately
(2) Grant to the facility the appropriate security clearance to this effect
(3) Grant the appropriate security clearance for all personnel whose duties require access to the information
(4) Ensure that all persons having access to the classified information are inf or med of their res pons ibi 1 it ies to protect the information in accordance with applicable laws
(5) carry out periodic security inspections of cleared facilities to ensure that classified mi 1 it a r y info r mat ion is protected as required herein
(6) Assure that access to the classified mi 1 i tary information is limited to those persons who have an official need-to-know
c A request for authorization to visit a facility when access to classified military information is involved will be submitted to the appropriate department or agency of the government of the country where the facility is located This request will be made by an agency designated for this purpose by the other government and will include a statement of the level of security clearance and the official status of the visitor as well as the reason for the visit If mutually agreed to an authorization va 1 id for recurring visits over extended periods may be arranged The government to which the request is submitted will be responsible for advising the contractor of the proposed visit and for authorizing the visit to be made
ARTICLE IX
Costs incurred in conducting security investigations or inspections required hereunder will not be subject to reimbursement
