Excelsior Correspondent NOWSHERA, Feb 6: General Officer Commanding in Chief Northern Command Lt Gen D S Hooda paid tributes to martyrs of Nowshera battle to mark Nowshera Day. Nowshera Day, is the tall testi- mony of supreme sacrifice and passionate love of Indian Army and the locals of the area for their motherland. In 1947-48, Indian troops and locals fought together to defend Nowshera and threw out Pakistani Tribal raiders from the area. Prominent battles include battle for defence of Nowshera and Qila Darhal and recapture of Jhangar. Ever since then the bonding and bonhomie grew stronger between Indian Army and civilians. Nowshera Day is special as it is the celebration of those strong rela- tions. A number of connect and care and educate and empower events were organised as built up to the grand finale in last month. On February 6, 2016, the series of these events culminated into a grand and solemn memorial serv- ice to commemorate 68th Nowshera Day. The events were graced by Lt Gen DS Hooda, Army Commander, Northern Comm-and and Rashmi Hooda, Regional President AWWA Northern Command along with large number of Military and civil dignitaries. The Army Commander laid wreath at Naik Jadhunath Singh memorial followed by visit to Bal Ashram where Army Commander, Northern Comm-and and Rashmi Hooda interacted with children. The visit to Bal Ashram was followed by a colorful impres- sive variety entertainment program presented by enthusiastic students. The Army Commander, AWWA president felicitated Veer Naris and families of defenders of Qila Darhal and meritorious students. The grand event was witnessed by a large number of locals. Army Commander recalled the valiant contributions of martyrs and locals who played important role in defending Nowshera. He called upon everyone to actively participate in nation building. Excelsior Correspondent JAMMU, Feb 6: A number of permanent employees in Jammu University, recruited after January 1, 2010, under New Pension Scheme, have not yet been provided their Permanent Retirement Account Number (PRAN) even as the university has been deducting share of their contribution from the monthly salary. Laxity on the part of JU authorities is now turning into harassment to the aggrieved employees, who have been offi- cially ‘warned’ that they would be deprived of income tax rebate on the deducted amount of their salary, which the Jammu University claims to have deposited in banks. A formal communiqué in this regard was issued by the Accounts Section of JU this week to the employees without PRAN even as they have submitted the application forms twice with the university Establishment Wing for the purpose. The official warning has trig- gered a strong resentment among the affected staff, mostly non- gazetted and class IV employees, who are suffering because of no fault of theirs but the university authorities. According to the official sources, the employees under New Pension Scheme could not get their PRAN because of some technical reasons and lack of coordination between JU and the Kashmir based concerned agency, which did not perform its job as per the requirement. Later, this agency claimed that the application forms had got washed away in 2014 floods and there- after the employees were recently asked to submit application forms afresh. Even as Jammu University claims that share of the staff was regularly being deposited in the bank for transferring the same to respective employee’s PRAN as and when it is allotted, the recent communiqué of the Accounts Section has triggered the contro- versy and exposed the lack of coordination among different sec- tions of the university. Instead of seeking a clarifica- tion from the Establishment Wing on delay in getting the PRAN of left over employees, the Accounts Section directly wrote to the concerned employees warning no tax rebate on their deduction, sources explained. Laxity on the part of con- cerned official can be gauged from the fact that deducted share an employee, who joined the JU services two years back and was already having a PRAN while working previously with another organization, was also not deposited in his Retirement Account Number despite a forma, request for the same by him. When contacted, JU Registrar, Prof Keshav Sharma said that majority of the employ- ees have been provided with PRAN and the process was on to ensure that the left over can also get the same as early as possible. Pertinent to mention that the New Pension Scheme was imple- mented in Jammu and Kashmir from January 1, 2010 for all the employees recruited. since that date. The NPS is on the pattern of Central Government, which too has done away with the pension and set up a statutory body for the employees to avail themselves of pensionary benefits on their own. It is almost similar on the pattern of Contributory Provident Fund (CPF), which is binding on Public Sector Undertakings, lim- ited companies and organizations employing more than 10 people. Under the NPS, an employee contributes 10 per cent from his salary. An equal amount is con- tributed by the Government and deposited in the employee’s account with the Pension Fund Development and Regulatory Authority (PFDRA). The pen- sioner can draw the pension any- where from designated post offices and banks. Excelsior Correspondent JAMMU, Feb 6: High Court has held that out of turn promotion by the Government servants par- ticularly in the belt force cannot be sought as a matter of right and a proper mechanism evolved in this regard has to be followed strictly. These observations were made by Justice Janak Rak Kotwal while dismissing a petition filed by one Parvinder Kumar Sharma, who was seeking out of turn pro- motion on the analogy of those who were given this benefit for exceptional performance on the anti-militancy front. The ground of the petitioner was that he too was part of the Special Task Force which had fought with the militants in Doda district in the year 2011. His griev- ance was that while 10 respon- dents were given out of turn pro- motion by the Police Headquarters the remaining members including the petitioner were given only cash award. Advocate Virender Bhat appearing for the petitioner sub- mitted that petitioner has been arbitrarily ignored for out of turn promotion in as much as his role and performance in the operation, which was no less than the respon- dents. He further submitted that the petitioner has been illegally discriminated and his fundamental right of equality enshrined under Articles 14 and 16 of the Constitution of India has been vio- lated. However, Additional Advocate General, Wasim Sadiq Nargal submitted that petitioner has no cause of action because out of turn promotion is granted on the basis of outstanding performance on anti militancy front, which is a factor to be determined by the offi- cers of the Police Department and the administration and cannot be agitated or disputed by invoking writ jurisdiction of the court. He also relied upon the judgment delivered in Tilak Raj Thakur and Others Versus State of J&K and Others. After hearing both the sides, Justice Janak Raj Kotwal observed, “whether performance of a police man on anti-militancy front was exceptional or not is a question of fact which can be determined only by the competent officers of the department and nor- mally should not be put to judicial review unless a strong case of non compliance with prescribed proce- dure or discrimination is made out”. “No ground, much less a suffi- cient ground, for re-examining the evaluation done by the competent officers in exercise of power of judicial review of this court is made out in this case”, Justice Kotwal said while dismissing the writ petition. The Advisor was addressing officers of Rural Development Department during a review-cum- interactive meeting held here today. Secretary Rural Development Department, Khurshid Ahmed Shah, Director Rural Development Jammu, M. L. Raina, CEO IWMP, Bashir Ahmed Khan, Director Panchayati Raj, R. K. Bhat, Member Secretary MGNREGA, K. K. Sidha, Joint Director Planning, ACDs, XEns, DPOs, POs, IWMP and other senior offi- cers of Jammu division were pres- ent in the meeting. Mr. Ganai asked the officers to ensure that the schemes are implemented in a transparent manner and in accordance with the set guidelines. He said that there should be no deviation from the procedures to be adopted and the local representatives of the areas should also be consulted during implementation of these schemes. The Advisor also stressed on putting in place an online griev- ance redressal system at block, district and state level for conven- ience of the people. He said that an effective mechanism should also be devised for quick and timely disposal of the problems (griev- ances) being faced by the people of the state especially those living in rural and far-flung areas. Mr. Ganai asked Secretary RDD to expedite the release of funds so that the pace of works gets accelerated and new projects are also taken up. He said that the requisite process for ensuring the release of pending funds from the Centre should also be initiated. While directing the ACDs of Kathua, Samba, Kishtwar, Doda, Udhampur, Poonch, Rajouri and Ramban to undertake regular tours of the far-flung areas in their respective districts, Mr. Ganai said that this would help them in getting first hand information about implementation status of various schemes and also help them receive requisite feedback from the people of the area. The Advisor also asked the officers to speed up the imple- mentation of various RDD schemes like MGNREGA, IAY and IWMP, maintaining that they have been instrumental in chang- ing the rural landscape of the state by way of asset creation, provid- ing employment avenues and also giving the much needed housing facilities to the needy people. Mr Gania said that the imple- mentation of the Swachh Bharat Abhiyan should also be expedited as the scheme has tremendous potential of providing clean and pollution free environs in the rural areas. The scheme is being per- sonally monitored by the Prime Minister and the mission should be monitored so that envisaged goals are achieved at the earliest, he added. Director General of Police (DGP), K Rajendra Kumar con- vened a meeting at Police Headquarters (PHQ) here today to mourn the demise of Mrs Watali. The meeting was attended by senior police officers including the officers at PHQ.
