SUBSCRIPTION INFORMATION

Subscription Notice for Draft Agenda Items

In compliance with Public Utilities Code Section 311.5, parties who wish to subscribe to receive draft agenda items may do so by writing to the Public Utilities Commission; Attention: Poly Arca, Room 1003, 505 Van Ness Avenue, San Francisco, CA 94102, or by calling (415) 703-1798. The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. You may also order a partial agenda package (energy agenda items only or telecommunication agenda items only) at the cost of $500 per year. The package you receive via mail will include only those agenda items available at the time of the agenda distribution date, which is usually 10 to 12 days prior to the Commission meeting. If agenda items (including revisions) are not ready on the distribution date, they will be made available at no charge in the lobby outside the Commission Auditorium at 9:00 a.m. on the morning of the Commission meeting, but not earlier.In addition, the Commission will make draft agenda items available for viewing and photocopying (at 20 cents per page) at the Commission’s Central Files Office (Room 2002), 505 Van Ness Avenue, San Francisco, and in the Los Angeles, San Diego, and Sacramento field offices. Draft Resolution Confirming Staff’s Authority to Suspend the Effectiveness of Advice Letter Filings of Tariff Changes

A draft resolution (M-4801) by the Executive Division confirming staff’s authority to suspend the effectiveness of advice letter filings of tariff changes will be on the February 8, 2001 Commission meeting agenda. This draft resolution also ratifies staff’s suspension of advice letters prior to its effective date. The Commission may vote on this resolution at that time, or it may postpone a vote until later. Also present were Maryam Ebke, advisor to Cmmr. Wood; Jason Zeller, ORA Counsel; James Weil, representing the Aglet Consumer Alliance; Christopher Warner, Counsel for Pacific Gas & Electric Company (“PG&E”); Bruce Foster, Vice-President, and Mike Hoover of Regulatory Affairs, Southern California Edison Company (“SCE”); William Powers of Congress of California Seniors; Howard Owens of the Consumer Federation of California; Lupe De La Cruz of the American Association of Retired Persons; Mike Aquirre representing a class-action group of California ratepayers; William Adams, representing himself; John Gamba representing Greenlining; Jose Hernandez of the Latino Issues Forum; Ron Liebert, Counsel for the California Farm Bureau Federation; Valentina Gavalya-Sandoval, Milbank Tweed Hadley & McClay; Nancy Ryan from Environmental Defense; Sara Myers, Counsel for the Center of Energy Efficiency and Renewable Technologies; James Boothe, LeBouef, Lamb Green & MacRae; and Monica Schwebs, Counsel, and Jennifer Tachera of the California Energy Commission. ORA commented that neither SCE nor PG&E have proposed aggressive cost cutting measures in light of the power acquisition debt they are facing. ORA also commented how irresponsible it was for SCE to request to be relieved of its obligation to serve if it did not receive the rate increase it was seeking. ORA also noted that simply lowering the authorized rate of return for PG&E and SCE would significantly reduce their cash requirements.

Summary: LATE FILED. AUGMENTATION REQUIRED. On January 3, 2001, Chris Warner, attorney for Pacific Gas and Electric Company (PG&E), participated in an all-party meeting with Cmmr. Wood in San Francisco. Also present, among other participants, was Maryam Ebke, advisor to Cmmr. Wood. Warner stated that in late October and early November, PG&E raised approximately $2.7 billion of cash through bank and capital markets borrowings and is looking for some assurance from the Commission to enable lenders to continue loaning money to PG&E. Warner noted that the problems with the proposed decision (PD) are: first, there is no certainty about recovery of costs going forward because the PD does not lift the rate freeze and would only provide PG&E with approximately $70 million per month of additional revenues and second, crediting the generation memorandum account would prolong the rate freeze and prevent PG&E from collecting those costs.
