WHEREAS, TennesseeCodeAnnotated§10-7-408permits countiesto enactan archivesandrecordmanagementfee to fund countyarchives,and
WHEREAS,the Sullivan CountyDepartmentof Archivesand Tourismis in needoffunding forrecordsspace,andpersonnelfor managing,scanning,andaccessingits archivalrecords,and
WHEREAS, the Sullivan County Public RecordsCommissionunanimouslyrecommendsthecreationofan archivesandrecordmanagementfee for Sullivan County.
NOW THEREFORE BE IT RESOLVED By The Board Of County Commissioners OfSullivan, Tennessee That:
SECTION 1. In accordancewith TennesseeCode Annotated § 10-7-408, which authorizescounties to establishan archivesand record managementfee, the county legislative herebycreatesan archivesand recordmanagementfee in accordancewith the following schedule:
A) CourtsofGeneralSessions,Circuit, Criminal,Probate,and Chancery:A fee of $5.00 for all public recordsfiled with the clerks of court for thepurposeof initiating alegal proceeding.

10-7-408. Appropriation of funds Filing fees.
(a) The county legislative body of any county which creates a county records commission has the
power to appropriate such funds as may be required for the carrying out of the purposes of this
chapter including, but not limited to, the purchase or leasing of equipment, the equipping of an office
and the payment of the expenses thereof, the furnishing of secretaries and clerical help and the
employment of expert advice and assistance.
(b) In any county, if the county legislative body creates a county records commission, then the
county legislative body is authorized to:
(1) Appropriate such funds as may be required for carrying out of the purposes of this chapter,
including, but not limited to, the purchase or leasing of equipment, the equipping of an office and the
payment of the expenses of the office, the furnishing of secretaries and clerical help, and the
employment of expert advice and assistance; and
(2) Establish and collect, through all entities creating public records, as defined in § 10-7-403, an
archives and record management fee not to exceed five dollars ($5.00) per document filed. Funds
collected through this fee must be designated exclusively for duplicating, storing, and maintaining any
records required by law to be permanently kept.

WHEREAS, TCA 68-120-101 requiresthe state or local jurisdiction to adopt and enforce buildingconstructionsafetystandardsfor one-familyand two-family constructionas publishedby the InternationalCodeCouncil andto keepwithin seven(7) yearsofthedateof the latestedition publication;and
WHEREAS,pursuantto TCA 5-1-121,Sullivan County previouslyestablishedmonetarypenaltiesof notto exceed$500 for eachviolation ofits zoning andbuilding codeordinances;
NOW THEREFORE BE IT RESOLVED by the Board of County Commissionersof SullivanCounty, Tennessee,assembledin Regular Session, that International Residential Code, 2012edition, Chapters 1-10 & 44 including Appendix H, J (International Residential Code SectionR102.5,2012 edition), as published by the International Code Council, as hereinafter revised, beand is hereby adopted as the Residential Code of Sullivan County, Tennessee, [hereinafter“ResidentialCode of Sullivan County”] to be applicable in the unincorporated areas of SullivanCounty, regulating and governing the construction, alteration, movement, enlargement,replacement,repair, location, removal and demolition of detachedone and two family dwellingsand multiple single family dwellings (townhouses)not more than three stories in height withseparatemeansof egress;and

CountyEmergencyMedical Service.

9. Lesseeagreesnot to makeany alterations,additions,improvementsor changesto
thepremises,interior or exterior,or to theequipmentandfixturesprovidedby Lessoror to install

Agreementterm to save harmlessand indemni~’Lessorfrom and aganstany and all loss,
liability, claim orexpensedue to injury and/ordeathto personor propertythatmay be incurred
by Lesseeor anythird party by andreasonof any negligentorwillful act or omissionby Lessee
arising from or in any way growingout of theuse,misuse4orabuseby Lesseeof the premises

as may he due to or causedby the acts or omissionsof Lessee, Lessorshall carry appropriate
public liability insurance and property damage insurance, special form, insuring all

11. Nothing in this agreementis intended or should be construedas creating a
partnershiprelationship between the Lessor and Lesseeor as making Lessor and agent,
representativeor employeeof Lesseeor as making Lesseean agent,representativeor employee
of Lessor.
12. In the eventof any breachor default of any of the termsandconditionsof this
LeaseAgreement,the defaultingparty agreesto pay the reasonableattorneyfeesincurredby the
non-defaultingparty in the enforcementof this LeaseAgreement.

WHEREAS,the Sullivan County Boardof Educationand the County Commissiondesiresto completeaFacility Condition Assessmentand Facility MasterPlanning Processin order to developa long-rangefacility plan for Sullivan CountyDepartmentofEducation;and
WI-IEREAS, thepurposeof thestudy will extendbeyonda facilities conditionsstudy that was completedin 2008 (PEFAstudy) at the requestof theCountyCommission;and
WI-JEREAS, the Facilities Master Planning processincludes comprehensiveplans for communityinvolvementthrougha steeringcommitteeand communitymeetings;and
WHEREAS, the Kingsport City Schools and Kingsport Board of Mayor and Alderman arc alsoconductinga similar assessment;and
