home and operate a pet grooming business out of the home as a form ofHome Occupation.• Staff confirmed that the B-3 zoning allows for single-family residential as well as commercial land uses, while other commercial
zones do not allow both.• Staffread herfindings and recommendations. Discussion followed regarding the surrounding land uses.• Mrs. Mary Ann Hager motioned to send a favorable recommendation to the County Commission for the rezoning request.• Commissioner John Gardner seconded the motion and the vote in favor passed unanimously.

WHEREAS,the Sullivan CountyCommissionin actionsdatingback to 2006thru 2012 soughtto reducestaffing levelsatvariousdepartmentsincluding theSullivan CountyHighwayDepartment,and
WHEREAS,theMissionand Objectivesof the SCHD havebeenredefinedthroughefforts of the SCHDwith agreementof theSullivan CountyCommission,specificallytheadditionof PavementEvaluationandPavementMaintenancetechniquesto theequipmentandcapabilitiesofthe SCHD, and
WHEREAS,additional staffis requiredto fully utilize theaddedcapabilities.
WHEREAS,theCommissionerof Highwayswill add staffonly asallowedwithin the currentbudgetfor
FY ‘17-’ 18 andis not requestingadditionalfunding.

WHEREAS, Sullivan County facesmany challengesand must look at ways to reducethe size ofgovernment;and,
WHEREAS,all electedand appointedofficials and departmentheadshavethe responsibilityto thetaxpayersaswell astheBoardof Commissionersto makean effort to reducetheirbudget.

WHEREAS,theSullivan CountyPublicRecordsCommissionunanimouslyrecommendsthecreationofanarchivesandrecordmanagementfeefor Sullivan County.
BE IT RESOLVEDBY THE BOARD OF COUNTYCOMMISSIONERSOF SULLIVANCOUNTY,TENNESSEETHAT:
SECTION 1. In accordancewith TennesseeCode Annotated §10-7-408(attached), the countylegislative hereby createsan archives and record managementfeeof $3 per record for the followingrecords:
Courts of General Sessions, Circuit, Criminal, Probate, and Chancery, all publicrecordsfiled with the clerksofcourtfor thepurposeofinitiating a legalproceeding.
County Clerk of Court, public records including marriage licenseapplications,beerpermit applications, notary public applications, vehicle titles including replacementtitles, andbusinesslicenseapplications;

WHEREAS,on December20, 2010, Sullivan Countypassedresolution# 2010-11-107which authorizedSullivan County to enterinto an interlocal agreementwith the citiesof Kingsportand Bluff City, whichagreementprovidedfor thecreationofthenot-for-profit corporationSullivan County-BluffCity-KingsportAnimal ControlCenter,Inc. (SBK) [DBA Petworkslto provideanimalcontrolin theunincorporatedareasof Sullivan Countyandin thecorporatelimits of Kingsportand Bluff City andto operateandmaintaintheanimalcontrolfacilities in Kingsportand Blountville; and
WHEREAS,that interlocal agreementwasenteredinto by Sullivan County,Kingsport and Bluff City onJanuary3 1, 2011;and
WHEREAS,thenot-for-profit corporationSullivan County-BluffCity-KingsportAnimal Control Center,Inc. (SBK) [DBA Petworks]wasestablishedpursuantto thefiling of thecharterfor saidcorporationwiththeStateofTennesseeon February8,2011,andsaid corporationhasbeenin operationsincethatdate;and
WHEREAS,it is nowin thebestinterestof SullivanCountyto dissolvesaidinterlocalagreementsuchthatSullivan Countywill hereafterprovideanimal control in theunincorporatedareasof Sullivan Countyandin thecorporatelimits ofBluff City andoperateandmaintaintheanimalcontrolfacility in Blountville, andKingsport and said non-for-profit corporationwill hereafterprovideanimal control within the corporatelimits of Kingsportandoperateandmaintaintheanimalcontrolfacility in Kingsport;and
WHEREAS,pursuantto thetermsoftheTerminationAgreementapprovedherewithSullivan CountyandBluff City irrevocably assign to Kingsport their right to appoint board membersto the not-for-profitcorporation,andboardmemberspreviouslyappointedby Sullivan Countyand Bluff City will resignon orbefore January1, 2018, which togetherwill allow for the continuedexistenceof the not-for-profitcorporationSullivanCounty-BluffCity-KingsportAnimal ControlCenter,Inc. subjectto the sole controlof the city of Kingsport and subjectto whateverchangesto its Charterand By-laws Kingsport hereafterdeemsappropriate;
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners of SullivanCounty, Tennessee,assembledin Regular Session hereby approve the attached TerminationAgreement providing for the dissolution of the interlocal agreement between Sullivan County, BluffCity and Kingsportreferenced above, providing for the resignation of directors appointedto SullivanCounty-BluffCity-Kingsport Animal Control Center,Inc. by Sullivan Countyand Bluff City, andproviding for the continuation of said corporation solely by the City of Kingsport;andtheBoard ofCounty Commissionershereby authorize the Mayor of Sullivan County to approve and executesaidagreementand upon consultation with the County Attorney to make changesto said TerminationAgreementif necessaryto accomplishthesegoals.

TERMINATION AGREEMENT
This TerminationAgreementis enteredinto this _____ day of ______________, 2017, by andamongSULLIVAN COUNTY, TENNESSEE,hereinafterreferredto as Sullivan County, the CITY OFBLUFF CITY, TENNESSEE,hereinafterreferredto as Bluff City, and the CITY OF KINGSPORT,TENNESSEE,hereinafterreferredto asKingsport.
WITNESSETI-I:
WHEREAS,thepartiesenteredinto an InterlocalAgreementon January31, 2011, for thepurposeof creatinga not-for-profit Corporationto operate exclusivelyfor charitable and educationalpurposeswithin themeaningof section501 (c)(3) of the InternalRevenueCodeof 1986,or correspondingsectionof any thture tax code, by providing animal control and operationof one or moreanimal shelterswithinSullivan County, Bluff City, and Kingsport and to preventcruelty to animals,togetherwith the generalpowersset forth underT.C.A. § 48-53-102.
WHEREAS,saidnot-for-profitCorporationwascreated,with corporatecharterfiled with the Stateof Tennesseeon February 8, 2011, and currently exists and operatesas Sullivan County-Bluff City-KingsportAnimal ControlCenter,Inc. (hereinreferredto asCorporation).
WHEREAS,thepartiesnow agreethatthejoint operationofanimal controlandanimalsheltersascurrently done pursuantto the Interlocal Agreementshould be modified so that the shelterand animalcontrolin theunincorporatedareaoftheCountyandBluff City shouldbeoperatedby Sullivan County,andthe shelterandanimal control in Kingsport shouldbe operatedby Kingsportwhich canbeaccomplishedthroughthe Corporation;and
WHEREAS,the parties remain very interestedin a mutual long-term solutionto animal control,which could includea singleshelterfor all ofSullivan County; and
WHEREAS, this Agreementsets out the general terms of the termination of the InterlocalAgreement.
NOW THEREFORE,in considerationof thepremisesandmutual covenantscontainedherein,theparties agree as follows:
1. The Interlocal Agreemententeredinto by the partieson January31, 2011, asreferencedabove,is herebyterminatedeffectivemidnight,December31, 2017,subjectto theprovisionscontainedinthisAgreement.
2. Thepartiesagreethat the Corporationcreatedpursuantto the Interlocal Agreementshallcontinuein existence.
3. Sullivan County and Bluff City irrevocablyassignto Kingsportthe right to appoint boardmembersthey are entitle to appoint to the Corporationeffective on the terminationof the InterlocalAgreement,or earlier if so agreedby the parities, and the threeboardmembersappointedby SullivanCounty will resignfrom the boardeffectiveon or before January1, 2018, and the one board memberappointedby Bluff City will resignfrom theboardeffectiveonorbeforeJanuary1,2018.This is intended
to enableKingsportto makeappointmentsto theCorporation’sboardto enabletheCorporationto continuein existenceandto amendits charter,bylawsandname,asneeded,dueto theterminationoftheInterlocalAgreement.
4. TheSullivan Countyemployeescurrentlyassignedto workwith theCorporationwill returnto Sullivan County on January 1, 2018, and the two vehicles provided by Sullivan County for theiremployees’usewill return to SullivanCountyat thesametime.
5. All property donatedto or given to the Corporationby Sullivan County, Bluff City,Kingsport,or anyotherpersonorentity for usefor the operationof animalcontrol andtheanimal shelterin Kingsport shall remain the sole property of theCorporation.
6. BeginningJanuary1, 2018, SullivanCountyshall takeoveroperationoftheanimal shelterin Blountville andanimalcontrolin theunincorporatedpart oftheCountyand in Bluff City, andKingsportand theCorporationshallbe relievedfrom further responsibilityto operatethat shelterorprovide animalcontrol servicein theunincorporatedpartof theCountyor in Bluff City. As ofJanuary1, 2018,the leaseagreementbetweenSullivan County and the Corporation,originally enteredto on July 26, 2011, shallterminateandend.
7. BeginningJanuary 1, 2018, Kingsport shall takeover operationof the animal shelterandanimalcontrol in Kingsport,whichmay assignthecontinuedoperationoftheanimalshelteranimalcontrolin Kingsport to the Corporation,and Sullivan County and Bluff City shall be relieved from furtherresponsibilityto operatetheshelterorprovideanimalcontrolservicein Kingsport.
8. Beginningon January1, 2018, theanimal control officers shall operatein their respectivejurisdiction, or asotherwiseprovidedby law, or in accordancewith an InterlocalAgreementthat maybeenteredinto hereafterby theparties.
9. Theparties agree that it is the intent of the parties thatontheeffectivedateoftheterminationthatthe Corporationcontinueto existto operateexclusivelyfor charitableandeducationalpurposeswithinthe meaning of section 501 (c)(3) of the InternalRevenueCodeof 1986, or correspondingsectionofanyfuture tax code,by providinganimal controlandoperationof one or moreanimal shelters,andto preventcruelty to animals, together with the general powers set forth under T.C.A. § 48-53-102,andthepartieswillreasonablyassisttheCorporationin maintainingits tax exemptstatuswith theInternal RevenueService,providedno partiesshall be requiredto expendany fundsin ftilfilling this provision.
10. The Corporationexecutesthis Agreementfor the purposeof recognizingits benefitsanddutiesherein,and consentsandagreesto all actionstakenandto be takenasdescribedherein.

TheJobsIncentiveProgram (JIP) was established in 2003by theIndustrialDevelopmentBoardofSullivanCounty. The program was createdto assistlocal small businessesin thecreationofnewjobs.Only businessesthat weretoo small (orcreatingtoo fewjobs) to qualify for stategrantsor loanswereeligible. TheuPwasestablishedasa loanprogramwith loansbasedon thenumberof newjobsto becreated.Loansto thebusinesseswereforgivenafteroneyear, if employment goalsweremet. (Loansof$500 for eachnewjob createdwere grantedto businessesup to atotal of$12,500(25 Jobs).Typical loansrangedfrom $5,000to $7,500.)
The original funding for theprogramwasappropriatedby theCountyutilizing moniesfrom landsalesintheTn-CountyIndustrialParkand lease payments to the 1DB madeby Sullivan Countycompanieswhichhadreceivedfavorabletax incentivesfor locatingin thecounty. TheJIP fund started with a balance$127,301.
Since2003 theJIP programhasassisted17 companiesand contributedto thecreationofmorethan 1,170newjobs in theCounty. This representsacostof $109.24for eachnewjob created. Someofthecompaniesassistedinclude:DPI (DiversifiedPowerInternational),DHL Industries,Goessling,USA,Clean& Safe,andEastTennesseeDistillery. Cold StarInternationalwasaidedfollowing thelossoftheirbuilding dueto a fire. TheJIP programalsofundedincentivesthat ledto theattractionofSprint (Agero,Inc.).
TheJIP’sexisting fund balance is $24,186.Severalbusinessesarecurrentlyrequestingloans. IfapprovedtheJIP loanfundscouldsoonbe depleted.TheIndustrialDevelopmentBoardis requestingtheCountyCommissioncontinuetheprogramwith an appropriationof $50,000. Suchfinds, asin thepast,couldbe appropriatedfrom theCounty’sAccount#58120-700Subfiind021 (This subfiind wasestablishedin1993, with monies from the sale ofCounty-owned Tn-County Industrial Park properties. The Subffind wascreatedfor thepurpose of finding future economicdevelopmentprojectswithin theCountyto includelocalmatch requirements for state economic development grants and for programs like JIP.

The design resulting from this work would be usedin gaining the approvalfor work on CSXT ROW and to solicit participation in correction costs by CSX Transportation(CSXT).
WHEREAS, this County Commission in an action in August 2017 (ResolutionNumber2017-08-56)authorizedthe first step in landslidecorrectionthrougha PreliminaryEngineeringAgreementwith STy,Inc, and
WHEREAS, the next step in the correctionprocesswill require submissionof detailed designs andspecificationsto CSXT,and
WHEREAS,theSullivan CountyPurchasingDepartmentis solicitingproposalsfor this designwork fromlocal engineeringfirms dueon November21, 2017,and
WHEREAS,theCounty HighwayFundhasbeengrownby over$2.4 million since2014througheffective
managementoftheHighwayDepartmentaccountsandcurrentlystandsat approximately$5.4 million, and
WHEREAS,theestimatedcostofthedesignis lessthan$50,000.
NOWTHEREFOREBE IT RESOLVEDthat the Sullivan County Commissionerof Highways ishereby authorizedto selectan engineering firm assolicited by the Sullivan County PurchasingDepartment and executean agreementfor said designs. The costof the designis not in the currentHighway Department budget but will be funded out ofthe Highway Fund Balance.

RESOLUTIONFORTENNESSEEMUNICIPALITIES TO RESTORELOCAL CONTROL
Whereasnumerousstudieshavefoundthat tobaccosmokeis amajor contributorto indoorair pollution,andthat breathingsecondhandsmoke is acauseofdiseasein healthynonsmokers,includingheartdisease,stroke,respiratorydisease,andlung cancer;and
Whereas the National CancerInstitutedeterminedin 1999 that secondhandsmokeis responsiblefor theearlydeathsof 53,000Americans annually; and
Whereas the Public Health Service’sNational Toxicology Programhas listed secondhandsmokeas aknowncarcinogen;and
Whereasthe 2006U.S. SurgeonGeneral’sreport, “The Health ConsequencesofInvoluntaryExposuretoTobaccoSmoke,”concludedthat there is 1) no risk-free level of exposureto secondhandsmoke; 2)ventilationandother air cleaningtechnologiescannotcompletelycontrol for exposureof nonsmokerstosecondhandsmoke;3) smoke-freeworkplacepoliciesare theonly effectivewayto eliminatesecondhandsmokeexposurein theworkplace,and4) evidencefrom peer-reviewedstudiesshowsthat smoke-freepoliciesand laws do nothaveanadverseeconomicimpacton thehospitalityindustry; and
Whereas the World HealthOrganizationdeterminedthat scientific evidencehasfirmly establishedthatthereis no safe level of exposureto second-handtobaccosmoke,a pollutantthat causesseriousillness inadults and children, and that there is indisputable evidencethat implementing 100% smoke-freeenvironmentsis theonly effectivewayto protect thepopulationfrom the harmful effects of exposure tosecondhandsmoke;and
Whereas secondhand smoke is particularly hazardousto individuals with cardiovasculardisease,individuals with impairedrespiratoryfunction, including asthmaticsand thosewith obstructive airwaydisease,andelderly people;and
Whereas childrenexposedto secondhandsmokehavean increasedrisk of asthma,respiratoryinfections,suddeninfantdeathsyndrome,physicalandcognitivedevelopmentalabnormalities,andcancer;and
Whereas data consistentlydemonstratesthat secondhandsmokeexposureincreasesthe risk of coronaryheartdiseaseandheart attacks andthat smoke-freelawsreduceheartattacks;and
Whereasthepeoplein local communitiesshouldhavetheright to protectthemselvesagainsttheharmfuleffectsof secondhandsmoke;and
Whereas local governmentshavetheright and responsibilityto adoptlawsthatprotectthehealthand safetyof theircitizens;and
Whereas more than 4,579local governmentsthroughoutthecountryhavesuccessfullypassedsmoke-freeair lawsto protectpeopleagainsttheharmfuleffectsofsecondhandsmoke;and
Whereas the tobacco industry, in an effort to negatesuch local legislation, haslong hadas its chieflegislativestrategythepreemptionof local authorityto regulatetobacco;and
Whereas preemptive statelawshaveadevastatingeffect on tobaccocontrol effortsandon thepublic healthofthestates’residentsandworkers;and
Whereas the vast majority of states do not preempt local smoke-free air legislation; and
Whereasmultiple stateshavesuccessfullyoverturnedpreemptionand restoredlocal controlto enactandenforcesmoke-freeair laws; and
Whereasprotectingpeoplefrom theharmfuleffectsof secondhandsmokeis bestaccomplishedby localcommunitiesworkingdirectlywith thepeoplemostaffectedby smoke-freeair laws; and
WhereastheTennesseeGeneralAssemblyshould not deprive local governmentsofthe authority to protectpeoplefrom theharmfuleffectsofsecondhandsmoke;
Now, therefore, be it resolved that the Sullivan County Board of Commissionersurgesthe TennesseeGeneralAssemblyto repealanypreemptionof local smoke-freeair and other tobacco-relatedlaws, andrestoretheright of local governmentsto enactandenforcesmoke-freeair andothertobacco-relatedlaws.
And be it furtherresolvedthat theSullivan County Boardof Commissionersstronglyencouragesotherlocal governmental entitiesin Tennesseeto adoptsimilar resolutions.

WHEREAS,the Sullivan County HighwayCommissionerdesiresto purchasethesesix (6) dumptruckson an annualleasepaymentasthe HighwayDepartmentdoesnot havesufficient capital fundsin any oneyearto purchasethesetrucks.
NOW, THEREFORE,lIE IT RESOLVED, that the Board of County Commissioners of SullivanCounty, Tennessee, assembled in regular session, hereby approves an annual lease/purchaseobligating $90,000.00per year for six (6) years and a payment amount of $10,002.00in thefinal yearof this agreement for a total of $550,002.00. Interest on this agreementis at a rate of 4.26 percentwith the first payment being made from the 2017-2018 budget.

RESOLUTION TO AUTHORIZE THE SULLIVAN COUNTYPURCHASINGAGENT TOSOLICIT REQUEST FOR QUALIFICATIONS FOR CONSULTING SERVICES FOR ACORRECTIONALMASTERPLANFORSULLIVAN COUNTY
WHEREAS,theCountyhasupdatedits facilities severaltimesoverthe last30 yearsto no avail, and;
WHEREAS,the issueof havingto continuouslyincreasethe spaceavailablefor incarcerationofinmates
is not uniqueto Sullivan County, consideringthat mostadjoiningcountieshaverecentlyexperiencedthe
problemor arecurrently experiencingtheproblem;and,
WHEREAS,theJail Committeehasheldnumerousmeetingsand gatheredmuchinformationrelevantto
theproblemand have decided that it is clearthereareno simplesolutionsbut theproblemremains,and;
WHEREAS,consideringtheneedto moveforwardat resolvingtheproblem,the Committeehasdecided
to seeka qualifiedfirm to developa MasterPlanto impactandbettermanagetheCorrectional/Detention
challengesbeforeSullivan County.
NOW THEREFORE BE IT RESOLVED THAT, this body is directing the Purchasing Agent in
consultation with theCounty Mayor, Sheriff and theChairman of theJail Committeeto solicit firms
with qualifications/resourcesfor the developmentof a plan to provide expert direction to this body
in resolvingthe issuesbefore them, including but not limited to the following:
a. Kick off Project missionstatementwith kick-off meeting,setup committees;refine schedules,
verify datafrom previousassessments.
b. Study and update inmate profile.
c. Examine and develop recommendations for expansionof alternatives/optionsfor pre-trial and
sentencedoffendersand other changesto help control thebed needsfor the incarcerated.
d. Determine bed needsby inmate categorywith and without proposed changesto alternatives
for pre-trial and sentenced offenders and other justice system changes.
e. Comprehensivelyevaluatetheexistingbuilding andsiteand developa facility assessmentand
report existing conditions.
f. Develop master plan options for existing building renovations and expansion.
g Develop proposed space program. (optional)
h. Developconceptual floor plan with masterplan phases.(optional)
BE IT RESOLVEDthe contract shall be limited to an initial appropriation of $100,000for the 2017-
2018 fiscal year and shall be completed in phases as listed and reported to this body periodically as
progressand time permits. Account Codesto be assignedby Director of Accounts and Budgets.
BE IT FURTHER RESOLVED that the Purchasing Agent is hereby authorized to enter a contract
with chosenfirm to provide said professional servicesto Sullivan County.

Sulilvan County has appointed Mrs Cindy Stewart as the counflADA Coorinator, whose primary duties pertain to the supeMsion of maintenance of aU county-owned buildings. She along withthe Planning Director will be working closely with coutty officials and depserit heads ii the assessment and inventory of allcounty-owned public buildln~.In addition, the catty has contracted with a local adifteclural flmt experienced in this process,to perform the accessibility check-list of S public buildings owned and operated by the cojity using the ADA Check-List tool asyou have provided. During this time period, the Board of Education will be performing the same process to ensure that allschools and facilities have been assessed.
Once the salt-assessment has been completed, the countys ADACoordinator along with the architectural consul~ngflint and support stall wil review the inal repn of the tecilides, buildings rid pat and sep04 back to the County Commissionof their findings. The Sell-Evaluation assessment shodd be completed by July of 2018 wIth the ADA Transition Plan completedshortly thereafter.
