The52ndamendmenttotheConstitutionaddedtheTenthSchedule whichlaiddowntheprocessbywhichlegislatorsmaybedisqualifiedongroundsofdefection.Amemberofparliamentorstatelegislaturewasdeemedtohavedefectedifheeithervoluntarilyresignedfromhispartyordisobeyedthedirectivesofthepartyleadershiponavote.Thatis,theymaynotvoteonanyissueincontraventiontotheparty’swhip. Independentmembers

wouldbedisqualifiediftheyjoinedapoliticalparty.

Earlier,10thschedulewasrelatedtoassociationofSikkimwithIndia.Once,Sikkimbecamefullfledgedstate,thisschedulewasrepealedviathe 36th

amendmentact.

PresidentialElection,2017– Righttovoteornottovote– Clarification

CertaindoubtshaveariseninthemindsofsomeoftheelectorsatthecurrentPresidentialElection,2017totheeffectwhetheramemberofapoliticalparty

votingindefiance ofthepolitical party’s decision wouldattractthedisqualificationonthegroundofdefectionundertheTenthScheduletothe

ConstitutionofIndiaorthepoliticalpartytakingsuchdecisionwouldbeliabletoanypenaltyforaskingtheirmemberstovoteinaparticularmannerornot

tovoteatall.

“TheCommissionwouldliketoclarifyinthiscontextthatthevotingatelectiontotheOfficeofPresidentofIndiaisnotcompulsory,likethevotingatelectionstotheHouseofthePeopleandStateLegislatureswherealso

thereisnocompulsiontovote.

The‘electoralright’ofavoterisdefinedinsection171A(b)oftheIndianPenalcodeto‘meantherightofapersontostand,ornottostandas,orto

withdrawfrombeing,acandidateor tovoteorrefrainfromvotingatelection’.

Thus,everyelectoratthePresidentialelectionhasthefreedomofmakingachoicetovoteforanyofthecandidatesornottovoteattheelection,asper

hisfreewillandchoice.

Thiswillequallyapplytothepoliticalpartiesandtheyarefreetocanvasorseekvotesofelectorsforanycandidateorrequestingorappealingtothem

torefrainfromvoting.

However,thepoliticalpartiescannotissueanydirectionorwhiptotheirmemberstovoteinaparticularmannerornottovoteattheelectionleavingthemwithnochoice,asthatwouldtantamounttotheoffenceofundue

influencewithinthemeaningofsection171CoftheIPC.

TheCommissionmayalsoliketofurtherclarifythatvotingatelectiontotheofficeofPresidentisdifferentfromvotingbyamemberofParliamentorState

LegislatureinsidetheHouse

andthat,asheldbytheHon’bleSupremeCourtinKuldip Nayar v Union of India

theprovisionsofTenthScheduletotheConstitutionwouldbeattractedinthecaseoftheelectiontotheRajya SabhaifamemberofaStateLegislative

Assemblyvotesforacandidateindefiancetheparty’sdirections,wherethevotesarenowgivenbythesystemofopenvoting.The Hon’ble Supreme Court held that an elector would not attract the penal provisions of the Tenth Schedule for having so voted at the Rajya Sabha election.Attentionmaybeinvitedtothe

followingobservationsoftheHon’bleSupremeCourtinthatcase:-

In India, OpenBallotSystem usesforelectionofUpperHouse(Rajya Sabha)members.Here,PoliticalPartiesnominatemembers

forcontestingmembershipinRajya Sabha.

Duringelectionofthesemembers(MPs),MLAsadvisedtovoteinfavour ofparty-man,butfewMLAsdefytheirpartylineandresorttoconsciencevote.Thiscrossvotingmightbemotivatedbysome

leverage.

TheelectiontotheOfficeofthepresidentisalsoheldbyanelectoralcollegewhichconsistsofelectedmembersofbothHouseofParliamentandelectedmembersoftheStateLegislativeAssemblies(Article54oftheConstitution).

TheelectorsofthiselectoralcollegevoteatthePresidentialelectionasmemberorthesaidelectoralcollegeandthevotingatsuchelectionisoutside

adjustingforrefunds,thenetgrowthinCITcollectionsis 22.4% whilethatinPITis 8.5%. Refundsamountingto Rs.55,520crore havebeenissuedduringApriltoJune,2017,whichis 5.2% lower

thantherefundsissuedduringcorrespondingperiodofF.Y.2016-17.

Anamountof Rs.58,783crore hasbeenreceivedas AdvanceTax upto30thJune,2017reflectingagrowthof 11.9% overtheAdvanceTaxpaymentsofthecorrespondingperiodoflastyear.The

growthinCorporateAdvance Taxisat 8.1% andthatin Personal AdvanceTaxisat 40.3%.

TheproposedNationalHealthProtectionScheme(NHPS)envisagesinclusionofpreventivecare,robustITplatform,stronggrievance

redressalmechanisminadditiontoexpandingbothpopulationandbenefitcoverageandprovidinganadditionalcoveragetoseniorcitizens,

ShriNadda alsostatedthattoaddressthegrowingburdenofNon-CommunicableDiseases(NCDs)onaccountofprematuremortalityand

morbidity,Indiahaslaunchedauniversalpopulation-basedfreescreening,controlandmanagementprogrammeforfivecommonNCDsthatisenvisagedtotranslateintooneofthelargestpopulationbasedscreeningandmanagementprogrammesintheworldinnextfew

years.

AspartoftheNationalHealthMission,theMinistryofHealthandFamilyWelfarelaunchedpopulationbasedprevention,screeningandcontrolprogramme forfivecommonnon-communicablediseases,

namely

Hypertension,Diabetes,andCancersoforalcavity,breastandcervix.OnFebruary4thcoincidingwithWorldCancerDay

CardiovascularDiseases(CVDs)suchasheartattacksstroke,Diabetes,

ChronicRespiratoryDiseases(ChronicObstructivePulmonaryDiseasesandAsthma)

andCancerinteraliaaccountforover60%ofallmortalityinIndia.

Ofthese,nearly55%areprematuremortality.Thisimposesafinancialandsocialcostonfamiliesandthecountry. AccordingtotheWorldEconomicForum,Indiastandstolose$4.58trillion(Rs 311.94trillion

between2012and2030duetonon-communicablediseases.
