The above-named Parties hereby mu­tually agree to carry out the ac­tivities described in this Agree­ment in accordance with (1) the terms of this Agreement, including any annexes attached hereto; and,(2) any general agreement between the two Governments regarding eco­nomic or technical cooperation.

4. Contribuciones del Donatario al Proyecto

El Congreso proporcionard para esta actividad por lo menos el equivalente a DOSCIENTOS CINCUENTA MIL DOLARES DE LOS ESTADOS UNIDOS ($250,000) como financiamiento de contrapartida. La contribuci6n de contrapartida financiarA los gastosadministrativos peri6dicos, el apoyo tecnico y las compras del equipo.

El Donatario comunicara tri-mestralmente los fondos contribui-dos al Proyecto de todas las fuen-tes diferentes a A.I.D. Los fon-dos en moneda local contribuidos al Proyecto serAn convertidos a 161ares de los Estados Unidos a la tasa mAs alta que se encuentre disponible en el pais por d6lar de los Estados Unidos y que no sea ilegal, en la fecha en que sea firmado el Convenio. El valor de las contribuciones en especie serA establecido de acuerdo con los principios de costos aplicables a este Convenio.

La3 contribuciones se reporta-ran en moneda local y deberdn in-cluir tanto el periodo del informe como el total acumulado, que com-pare los desembolsos reales en efectivo con las contribuciones presupuestadas. Esta informaci6n deberA ser presentada de acuerdo al formato que aparece en el Cuadro 1. En una carta de ejecuci6n sub-siguiente del Proyecto se propor­cionarA informaci6n detallada sobre estos informes.

4. Grantee Contributions to the Proiect

The Congress will provide the equivalent of at least TWO HUNDRED FIFTY THOUSAND UNITED STATES DOL-LARS ($250,000) as counterpartfunding for this activity. Counterpart resources will finance administrative recurring costs, technical support, and equipment procurements.

The Grantee will report quar­terly funds contributed to the project from all sources other than A.I.D. Funds contributed to the project in local currency will be translated into U.S. Dollars at the highest rate per U.S. Dollar not unlawful that is available to anyone in the recipient country, on the date the Agreement is sign­ed. Value for in-kind contribu­tions will be established in ac­cordance with the cost principles applicable to this Agreement.

Contributions will be reportedboth for the reporting period and on a cumulative basis, in local currency, comparing actual cash disbursements to budgeted contri­bution figures, in the same format as contained in Table 1. Detailed reporting requirements will be provided in a subsequent Project Implementation Letter.

DESCRIPCION DEL PROYECTO

I. Antecedentes del Provecto

La asistencia proporcionada en el pasado por A.I.D. al Congreso de Guatemala ha financiado una se-tie de estudios sobre anAlisis quecubren el sistema de comisiones del Congreso, la biblioteca, la estruc-tura de personal y las relaciones diputado-constituyente. De estos anAlisis surgi6 una imagen mAs clara del funcionamiento del Con-greso y de los muchos problemas queafronta. En base tanto a estos estudios como a plAticas con lide-res del Congreso, es evidente quelo mas importante del trabajo del Congreso radica en el sistema de comisiones; sistema que completa-mente carece de asistencia tdcnica. Este Proyecto estA dirigido a co-laborar con el sistema de comisio-nes para mejorar la calidad y can­tidad de su legislaci6n, que es esencialmente el mandato del Con­greso.

II. DescriDci6n del Provecto

El prop6sito del Proyecto fi-nanciado con este Convenio es for-talecer la capacidad del Congreso para llevar a cabo su mandato constitucional. Esto se lograrA por medio del establecimiento de una Unidad de Asistencia Tdcnica que colaborarA con el sistema de comisiones en su funci6n legisla­tiva.

PROJECT DESCRIPTION

I. Project Backqround

Past A.I.D. assistance to the Guatemalan Congress has financed a series of diagnostic studies, coy­ering the Congress' committee sys­tem, library, staff structure and deputy-constituent relations. From these analyses, a clearer pictureemerged of the Congress' operations and the many problems it faces. Based on these studies as well as discussions with the Congressionalleadership, it is apparent that the heart of the Congress' work lies in the Committee system which completely lacks technical assist­ance. This Project will focus on supporting the committee system to improve the quality and quantity of its legislation, which is in essence the mandate of Congress.

II. Project Descri~tion

The Rurpose of the Project funded under this agreement is to strengthen the Congress' ability to carry out its constitutional mandate. This will be accomplished by establishing a technical assist­ance unit to support the committee system in its legislative function.

El Proyecto apoyarA las si-guientes actividades de la Unidad de Asistencia Tdcnica para el sis-tema de comisiones del Congreso:

(a) La realizaci6n de estudios e investigaciones. La Unidad lle-varA a cabo estudios e investiga-ciones sobre asuntos legislativosclaves de las comisiones que el Congreso considere tienen primacia.Esto serA fundamental para la ela-boraci6n adecuada de legislaci6n importante.

(b) La elaboraci6n, junto con las comisiones seleccionadas, de decretos y de legislaci6n clave. Los expertos legales y especialis-tas tecnicos de la Unidad propor-cionardn servicios vitales para la elaboraci6n de la legislaci6n, queactualmente no se encuentran dis­ponibles.

By the end of the project the technical assistance unit will be fully functional, providing support on demand to the committee systemof the Congress and will be com­pletely financed by the Guatemalan Congress. The quality and quantityof legislation produced will have significantly increased.

The Project will support the following activities of the tech­nical assistance unit for the com­mittee system of Congress:

(a) Carry out research and studies. The unit will carry out research and studies for key leg­islation in priority committees designated by Congress. This will be fundamental to the proper draft­ing of important legislation.

(b) Draft key legislation and decrees with the selected commit­tees. Legal experts and technical specialists from the unit will provide vital services that are currently not available in drafting legislation.

III. Estimaci6n de Costos v Plan Financieki El costo total estimado del

Proyecto con el Congreso Nacional es de CUATROCIENTOS SETENTA Y CINCO NIL DOLARES DE LOS ESTADOS UNIDOS (US$475,000); de esta cantidad, DOSCIENTOS VEINTICINCO NIL DOLARES DE LOS ESTADOS UNIDOS (US$225,000) serAn proporcionados como fondos de Donaci6n de A.I.D. El Gobierno de Guatemala proporcionara, a tra-yes del Congreso Nacional, moneda local por el equivalente a DOS-CIENTOS CINCUENTA NIL DOLARES DE LOS ESTADOS UNIDOS (US$250,000).El Cuadro I adjunto a este Anexo incluye el desglose proyectado de las partidas del presupuesto.Estas asignaciones se describir~n mAs ampliamente en planes de eje-cuci6n posteriores.

IV. Arreglos de Ejecuci6n

Por recomendaci6n del Presi-dente del Congreso y de la Comi-si6n Coordinadora, la Misi6n A.I.D. contratarA a la Asociaci6n de In-vestigaci6n y Estudios Sociales (ASIES) para que proporcione los servicios de conformidad con este Convenio. El Congreso ha hecho una minuciosa investigaci6n paraseleccionar a la instituci6n apro-piada (descrita en el Suplementodel Documento B~sico) y eligi6 a ASIES por las razones mencionadas en la propuesta y en el Suplementodel Documento B~sico. ASIES lle-var& a cabo el Proyecto de acuerdo

III. Cost Estimate and Financial n

The total estimated cost of the Project with the National Con­gress is FOUR HUNDRED SEVENTY FIVE THOUSAND UNITED STATES DOLLARS (US$475,000), of which TWO HUNDRED TWENTY FIVE THOUSAND UNITED STATES DOLLARS (US$225,000) will be pro­vided in A.I.D. Grant funds. The Government of Guatemala, throughthe National Congress, will providethe local currency equivalent of TWO HUNDRED FIFTY THOUSAND UNITED STATES DOLLARS (US$250,000). The projected line item breakdowns for the budget are contained in Table I, attached to this Annex. These budget allocations will be further defined in subsequent implementa­tion plans.

IV. Implementation Arrangements

The USAID Mission will con­tract the Asociaci6n de Investiga­ci6n y Estudios Sociales (ASIES)to carry out all services under this agreement at the recommenda­tion of the President of Congressand the Liaison Committee. The Congress has conducted a thoroughsearch for an appropriate institu­tion (described in PPS) and se­lected ASIES for reasons stated in the proposal and the PPS. ASIES will implement the Project in ac­cordance with the above named ac­tivities and instructions from the Congress. ASIES will implement the

V. Auditorias y Evaluaciones

Tambidn el Proyecto serA evaluado a su fina-lizaci6n. Esta evaluaci6n estA programada para llevarse a cabo seis meses antes de la Fecha de Terminaci6n de la Asistencia al Proyecto. AdemAs, la Donaci6n fi-nanciard las auditorias que sean necesarias. El Donatario propor-cionarA "comprobantes a los que se les puedan practicar auditorias" do los recursos que ha contribuido al Proyecto. El formato, contenido y frecuencia de estos informes serA establecido posteriormente porA.I.D. en correspondencia futura.

V. Evaluations and Audits

The final evalua­tion will be scheduled six months prior to PACD. The Grant will fi­nance any required audits. The Grantee will provide "auditable evidence" of their resource con­tribution to the Project. The form, substance and frequency of these reports will be further described by A.I.D. in future correspondence.
