The regular meeting of the CONSTRUCTION TRADES QUALIFYING BOARD – DIVISION "B" was called to order at 10:28 a.m., on TUESDAY, JANUARY 8, 2008, in the 16th Floor Conference Room # 1605 of the Metro-Dade Flagler Building located at 140 West Flagler Street, Miami, Florida 33130-1563.

REYNALDO LEYVA (JOURNEYMAN PLUMBER) Appeared before the Board to request late renewal of his personal certification which expired September 30, 2003. Mr. Leyva’s continuing education record reflects 48 hours pending. A motion was made by Lucio Rivero and seconded by Charles Goins to APPROVE pending submission of his continuing education hours. Mr. Leyva’s request for late renewal of his personal certification was granted. The motion carried unanimously.

MECHANICAL APPEARANCES RICARDO A. DIAZ (EXAM APPLICANT – MASTER REFRIGERATION – UNLTD) Appeared before the Board to appeal the denial of his application for referenced examination. After some discussion and deliberation, the Board DENIED his application for examination for lack of sufficient evidence to prove six(6) years of comprehensive experience in the trade. ARMANDO G. LOPEZ (MECHANICAL MAINTENANCE) Appeared before the Board to request late renewal of his personal certification which expired September 30, 1999. Mr. Lopez’s continuing education record reflects 80 hours pending. A motion was made by Michael Affronte and seconded by Barry Jordan to APPROVE his request for late renewal pending receipt of his continuing education hours. The motion carried unanimously. EDUARDO ROSELL (EXAM APPLICANT – MASTER ROOM A/C) Appeared before the Board to appeal the denial of his application for referenced examination. After some discussion, a motion was made By Michael Affronte and seconded by Lucio Rivero to APPROVE his application for examination. The motion carried unanimously.

MIAMI-DADE COUNTY MINUTES OF MARCH 11, 2008 BUILDING CODE COMPLIANCE OFFICE CONTRACTOR LICENSING and ENFORCEMENT SECTION CONSTRUCTION TRADES QUALIFYING BOARD DIVISION “B” BOARD DISCUSSION (NON-AGENDA) re: BOARD ORDERS The Chairman, Nestor Bustamante, addressed the Board members regarding the Board Orders for January 8, 2008 hearings on Illegally Obtained Licenses. Mr. Bustamante reminded the members of the recommended language to the State, included during the penalty phase after each hearing at that meeting. However, the Chairman, indicated that at the February 12, 2008 hearings that same language was not verbalized case by case nor collectively. Consequently, the Chairman asked whether it was the intent of the Board to include the recommendation language to the State in all Board Orders thereafter or only when stated during penalty phase on a case by case basis. After some discussion and deliberation, wherein the members gave their position on the issue, a motion was made by Charles Goins and seconded by Calvin Samuels that the Board members intended the recommendation language to the state to be standard on all Board Orders for Illegally Obtained Licensed Respondent. The motion carried unanimously.

Mr. Anechina exam application was denied for lack of prerequisite of a journeyman certification. SAMUEL PROFECTA (MASTER ELECTRICIAN and MASTER AIR CONDITIONING-LTD) Appeared before the Board to again discuss qualifying two different companies with his dual certifications. Mr. Profecta was again DENIED the request to qualify two different companies with his dual certifications based on Chapter 10 of the Code of Miami-Dade County. Additionally, Mr. Profecta requested a letter of reciprocity with the required passing score standard for Broward County and West Palm Bach as department records only show passing an examination in 1989 but were unable to provide a score. The Board granted Mr. Profecta’s request and directed staff to provide a reciprocation letter to those counties indicating a passing score of 75%.

MARIO CARVAJAL (MASTER FIRE ALARM, MASTER TV ANTENNA, MASTER LOW VOLTAGE) Appeared before the Board to discuss difficulty with obtaining a reciprocation letter for the State of Florida Electrical Contractors Licensing Board regarding his Miami-Dade County Master Fire alarm license. Mr. Carvajal stated he needs the letter to register with the State Licensing Board. However, Mr. Carvajal stated staff was concern that they did not find any record to reflect that he had taken an examination for the Master Fire Alarm license. Mr. Carvajal informed that he had received his license 38 years ago and there was no examination at that time. After some consideration, a motion was made by Art Fernandez for staff to issue requested letter for the State indicating licensee held license for 38 years and at that time no examination was required. The motion was seconded by Lucio Rivero and carried unanimously. ROBERT HERNANDEZ (JOURNEYMAN ELECTRICIAN) Appeared before the Board to request late renewal of his journeyman electrician certification which expired September 30, 1999. Mr. Hernandez’s certification is pending 80 hours of continuing education. After consideration, a motion was made, seconded and carried unanimously to APPROVE his request for late renewal with the proviso complies with the continuing education requirement.

Sponsor renewal and one course renewal Electrical Code Refresher Course (16 hours) D014-001 BOARD DISCUSSION – SCOPE OF WORK Staff (specifically Toby Cline, Code Compliance Investigator) has asked for the Board’s interpretation of the Master Plumber’s scope of work as to whether it includes the installation of catch basins and exfiltration systems. Mr. Cline was not available. Jose Lezcano, Supervisor Contractor Licensing and Investigations, informed the Board that it is clear that the State of Florida Statute allows a plumber to do referenced systems. Mr. Lezcano stated, however, that the Miami-Dade County Code is not clear and as a result the Coral Gables Building Official has interpreted Chapter 10 of the Miami-Dade County Code that a plumber is unable to perform this type of work. After much discussion and deliberation, a motion was by Todd Stiff to interpret our local code definition of a Master Plumber to allow the installation of catch basins and exfiltration systems as referenced by the “installation of storm and sanitary sewer lines…” in the existing definition. The motion was seconded by Charles Goins and carried unanimously.

Attorney Yehuda Bruck requested to address the Board regarding his client RAFAEL

PEREZ/PRT COOL SERVICE INC. Respondent appeared for a hearing before the Board on January 8, 2008. Mr. Bruck has submitted a motion to mitigate sanctions and correct Board Order. Attorney Sunya Sean appeared on behalf of Mr. Bruck. Ms. Sean refreshed the Board members recollection and stated Respondent changed his plea to Guilty and gave an explanation but yet was fined $5,000.00. Ms. Sean commented it appeared due to penalties imposed that the Board felt Respondent continues working and stated Respondent has a Qualifying Agent. Additionally, she stated that the Order failed to include a reduction in fine of $1,500.00 if return the license. Ms. Sean was informed that the $1,500.00 is not a reduction but a waiver of said fine if license is returned. However, Ms. Sean was informed that condition is not automatic and was not given at this hearing. Yehuda Bruck appeared during this discussion. The Assistant County Attorney Ben Simon informed the attorneys that the fine imposed was done relative to the past and not what Respondent is doing now. Mr. Bruck asked that the Board allow his client to speak with Jose Lezcano, Lead Investigator, about his business practices and come back to the Board with some kind of recommendation. The Chairman, Nestor Bustamante, advised Mr. Bruck to order the hearing transcript and then return with his concern regarding why the Board imposed the penalties that they did and went beyond their guidelines. Mr. Bruck indicated he would order the hearing transcript as advised.

• Examination Reviews The Board members expressed their disappointment with the examination review material presented by Gainsville Independent Testing Service (“GITS”). Some Building Code Compliance staff agreed. After some discussion on the specifics of what was wrong with some of the examination questions, a request was made to have the representative of GITS, Jay Bowermiester, appear at the upcoming Full Board meeting of July 24, 2008.

From: GAINSVILLE INDEPENDENT TESTING SERVICE (“GITS”)

As is our custom and practice GITS will soon be holding a series of upcoming workshops to develop test items, review existing test items, and discuss reciprocity issues around the state. These meetings will be held in diverse locations to allow as many as possible, that are interested, to attend. Below is the schedule of events we are currently planning. If interested in attending please let us know so that we can assure proper seating for each meeting date.

Item Development workshops consist of one day periods where new or updated references along with any older edition of the reference are used to write new items for use on examinations. These meetings also focus on the actual examination blueprint including number of items on the test, time length of the test, and approved reference list for each test.

Item review workshops include using the original reference the item was written from and the newest version to verify that the item has remained valid. If it has nothing is changed except the notation to the newest reference page/paragraph/section/subsection. If a significant number of items from the original are no longer referenced then replacement items are developed from the newest edition and the date of the publication is updated on the Examination Information Sheet. Historically a sufficient number of questions lost would be any amount that could cause a candidate to fail the examination, which is unique for each test and each reference book, with in reason. As we will also be transitioning from the 2004 to the 2007 FBC code update checks of items will be occurring at all review workshops.

Attendees will be provided with Onsite Snacks and Lunch – Dade County License Holders can receive CE credits of up to 16 hours total with 8 hours earned per full day of attendance. (Course numbers D010-001, D010-002)

Qualified Attendees: These are private meeting where proprietary and copyrighted materials are displayed and discussed and GITS, LLC reserves the right to limit the number and the actual attendees, but if the potential attendees meet these requirements they will be welcomed and allowed to participate. (There are some limitations of when attendees may be restricted due to the portion of the materials being reviewed and the individuals’ aspect in the industry creating a conflict. In these cases the individual will be welcome to attend the portion for which no conflict exists. GITS employees will decide the appropriate time for the attendance of each individual depending upon their interaction and position in the industry.)

BOARD DISCUSSION A request was submitted to Staff questioning why Chapter 10 Section 10-2(X) of the Code of Miami-Dade County - Journeyman 3-1 Rule is no longer enforceable. Michael Goolsby, Chief, Code Compliance Office, explained to the Board that there was a lawsuit in favor of not enforcing State contractors to follow the Journeyman 3-1 rule. Therefore, it was administratively decided that if the rule could not be enforced on the State level then Miami-Dade County could not enforce this rule on their contractors. Members of the Board asked for the individual whom requested the information to come forward to discuss this issue; however, there was no one present to discuss this issue before the Board. Therefore the Board did not have a specific request to act on. No action was taken by the Board. Marlon Moffet, Assistant County Attorney, Miami-Dade County, presented to the Board a Settlement Agreement reached between himself and Attorney Kerr under Chapter 10 of the Code of Miami-Dade County Section 10-15-1. After some discussion with the Board, it was determined that a few details needed to be discussed before the agreement was reached.

The Settlement Agreement was stated as follows: The Respondent would pay $10,000.00 dollars within 30 days to Miami-Dade County. The Respondent would pay $40,000.00 dollars by November 7, 2009 to Miami-Dade County. The Respondent would pay $25,000.00 dollars by November 7, 2011 to Miami-Dade County. The Respondent must pay administrative costs in the amount of $836.00 dollars by November 7, 2011. The full payment totals $75,836.00 dollars paid in full by November 7, 2011. If the Respondent requires additional time to pay he must appear before the Board to request an extension. An affidavit must be submitted within 90 days stating that the license has been destroyed. The 158 permits that are pending must be sent certified-mail and all pending certified-mail documentation must be submitted to the Building Code Compliance Office within 90 days. Once all stipulations of the agreement are met the Respondent may apply to take the examination. Failure to comply with this settlement will result in a penalty of $1,000,000.00 dollars being enforced by Miami-Dade County. A motion was made by Todd Stiff to accept the Settlement Agreement. Mr. Charles Goins requested additional information on the Journeyman 3-1 rule, which was discussed in his absence at the October 7th meeting. Mr. Michael Goolsby, Chief, Code Compliance Division, explained to the Board that the Journeyman 3-1 rule, in the Code of Miami-Dade County Chapter 10-2 X, explains that for every three trainees on the construction or installation job site there should be one Journeyman present. It was further explained that at the State level, this rule has not been enforced, therefore it was administratively decided that it could not be enforced at the County level. The Board discussed the possibility of enforcing the rule, however, after further discussion, it was determined that this Board does not have the authority to enforce the rule. Mr. Bustamante presented a copy of the stipulation of settlement for Staff to provide copies to each Board member. Further discussion may take place at next meeting after each member has time to review the settlement. There being no further business, the Board adjourned at 11:00 A.M.
