MARING RADIO COMMUNICATIONS ASSOCIATION OF THE PHILIPPINES INC. vs. REYES
Petitioners are self-described enterpreneurs. They provide ship to ship and shore to shore public marine coastal radio stations. In July, DTC unveiled their own system (SOLAS) to ensure the safety of lives at sea. It was set to provide the same services free of charge. Atty. Cabigao for Marin Radio sent a letter to Sec. Reyes expressing that the entry of the government into their line of business would spell financial ruin for them. Reply: MARCAPIs main business is of public correspondence
Petitioners allege that Sec. Reyes had been guilty of grave abuse. Petitioners hold that the Government cannot compete in public correspondence given Sec 20: The state encourages private enterprise. Solicitor General: Government cannot abandon its ministerial functions of rendering public service. Therefore petition has no merit. Sec 6: All economic agents shall contribute to the common good. Objective of government is to sustain increase in the amount of goods for the benefit of the people. Sec 20 merely mandates the recognizing the role of the private sector in the shaping of our nation, but does not constitute absolute foregoing for citizenry.
RULING: DTC is not guilty of uncompensated taking by providing free public correspondence.
