Protecting ConstructionWorkers in Confined Spaces:

The special dangers of confined spaces.A confined space is a space whose configuration and/orcontents may present special dangers not found in normalwork areas. Confined spaces may be poorly ventilated and,as a result, contain insufficient oxygen or hazardous levels oftoxic gases. Working in a tight space can prevent a worker fromkeeping a safe distance from mechanical and electrical hazardsin the space. Fumes from a flammable liquid that is used in apoorly ventilated area can reach explosive levels. Such hazardsendanger both the workers in the confined space and otherswho become exposed to the hazards when they attempt torescue injured workers. In a number of cases, rescue workershave themselves died or been injured because they did nothave the training and equipment necessary to conduct therescue safely.

Confined Spaces and Permit SpacesThe distinction between confined spaces and permit spaces is crucial to understanding what the standard requires. Briefly, apermit space is a confined space containing a serious hazard or hazards. Employers must evaluate all confined spaces todetermine whether they are permit spaces but must take steps to protect workers only if a space is classified as a permit space.What is a “confined space?”A confined space is a space that:(1) Is large enough and so arranged that an employee canbodily enter it;(2) Has limited or restricted means for entry and exit; and(3) Is not designed for continuous employee occupancy.A space has a limited or restricted means of exit if a person could not readily escape from the space in an emergency. Anyof the following factors indicate that a work space has a limited or restricted means of exit:

■ The need to use a ladder or movable stairs, or stairs that arenarrow or twisted;

■ A door that is difficult to open or a doorway that is too smallto exit while walking upright;

■ Obstructions such as pipes, conduits, ducts, or materials that aworker would need to crawl over or under or squeeze around;

■ The need to travel a long distance to a point of safety.A space is not designed for continuous employee occupancy if it is not designed with features such as ventilation, lighting,and sufficient room to work and move about that are needed if people are to occupy it continuously.

Duties of Employers under the Confined Spaces StandardCategory ofEmployer Employer ResponsibilitiesAll Employers • Identify all confined spaces in which their workers maywork and determine whether any are permit spaces. Ifits workers are supposed to enter permit spaces, theemployer is an “entry employer.”• Employers who are not “entry employers” must makesure their workers stay out of any permit spacespresent on the site, unless the workers are authorizedfor entry.Entry Employers • Protect workers against permit space hazards bycomplying with the standard.• Inform controlling contractor of the program followedand hazards encountered in permit spaces.ControllingContractors• Share information it has about permit space hazardswith entry employers and other employers whoseactivities may create hazards in the permit space.• Coordinate entry operations when there is more thanone entry employer.• Coordinate operations when permit space entry occursduring other activities at the site that might create ahazard in the space.Host Employers • Share information it has about permit space hazardswith the controlling contractor.

Worker Training (Section 1207)Before any worker works in a permit space, the entry employermust train authorized entrants, attendants, entry supervisors,and other employees with duties under the standard (such aspersons who test and monitor the atmosphere in a permit space)to understand the hazards in the permit space and the methodsused to protect against those hazards. If a worker is not authorizedto perform entry rescues, the training must include the dangers ofattempting such rescues. All training must be provided at no costto workers. After the training, the employer must ensure that theworkers have the understanding, knowledge and skills necessaryto safely perform their assigned duties.

FLOWCHART At a construction site, a host employer (the owner of the site) is added to the mix of parties in communication. Prior to entry operations, the host employer must provide information to the controlling contractor on the location and potential hazards of any known confined spaces, as well as any precautions implemented for employee safety. The controlling contractor must then share that information with each entity entering the space or that could potentially introduce a hazard into the space. Each entry employer (subcontractor) should then inform the controlling contractor of the permit space program it plans to follow and any hazards likely to be confronted. The controlling contractor is then responsible for coordinating the activities of entry employers when multiple entities are either in the same space or their activities might conflict and introduce a hazard. After entry operations, the controlling contractor must debrief each entity that entered the permit space regarding the program followed and any hazards encountered. The controlling contractor must then provide the information gathered to the host employer.

The required training must be provided: ■ In both a language and vocabulary that the worker can

understand; ■ Before the worker is first assigned duties under this standard

and before there is a change in the worker’s assigned duties; ■ Whenever there is a change in permit space entry operations

that presents a new hazard about which the worker has notpreviously been trained;

■ Whenever the worker’s actions show inadequacies in theworker’s knowledge or use of entry procedures.As discussed below in chapter 11, rescue personnel must alsobe trained to perform their duties.The employer must keep a record showing that the requiredworker training has been completed. The record must containthe worker’s name, the trainer’s signature or initials and the datesof the training. The employer must make the record available forinspection by workers and their authorized representatives.

Overview of the StandardThis chapter contains an overview of the Confined Spacesstandard’s requirements and identifies the chapters of this guidewhere more detailed information on specific topics can be found.Employers must take the following steps to protect workersagainst confined space hazards.

■ Have a competent person identify all confined spaces inwhich its employees may work.A competent person is “one who is capable of identifyingexisting and predictable hazards in the surroundings or workingconditions which are unsanitary, hazardous, or dangerousto employees, and who has the authority to take promptcorrective measures to eliminate them.” The competentperson need not be an employee of any particular employer.The various contractors on a site may use a single individualto perform the duties required of a competent person.

■ If confined spaces are present, the employer must have thecompetent person determine whether the confined spacesare “permit spaces.”A permit space has one or more of the followingcharacteristics:(1) contains or has the potential to contain a hazardousatmosphere;(2) contains a material that has the potential for engulfingan entrant;(3) has an internal configuration such that an entrant couldbe trapped or asphyxiated by inwardly converging wallsor by a floor which slopes downward and tapers to asmaller cross section; or(4) contains any other recognized serious safety orhealth hazard.

Example of a Permit-RequiredConfined Space ProgramWorkplace. Sewer entry.Potential hazards. The employees could be exposed to thefollowing:Engulfment.Presence of toxic gases. Equal to or more than 10 ppmhydrogen sulfide measured as an 8-hour time-weightedaverage, and equal to or more than 35 ppm carbon monoxidemeasured as an 8-hour time-weighted average. If the presenceof other toxic contaminants is suspected, specific monitoringprograms will be developed.Presence of explosive/flammable gases. Equal to or greaterthan 10% of the lower flammable limit (LFL).Oxygen deficiency. A concentration of oxygen in theatmosphere equal to or less than 19.5% by volume.

Entry Without Permit/AttendantCertification. Confined spaces may be entered without theneed for a written permit or an attendant provided that thespace can be maintained in a safe condition for entry bymechanical ventilation alone, as provided in §1926.1203(e).All spaces must be considered permit-required confinedspaces until the pre-entry procedures demonstrateotherwise. Any employee required or permitted to pre-checkor enter an enclosed/confined space must have successfullycompleted, at a minimum, the training as required by thefollowing sections of these procedures. A written copyof operating and rescue procedures as required by theseprocedures must be at the work site for the duration ofthe job. The Confined Space Pre-Entry Check List mustbe completed by the LEAD WORKER before entry into aconfined space.

Entry Permit RequiredConfined Space Entry Permit. All spaces must beconsidered permit-required confined spaces until the preentryprocedures demonstrate otherwise. Any employeerequired or permitted to pre-check or enter a permit-requiredconfined space must have successfully completed, at aminimum, the training as required by the following sectionsof these procedures. A written copy of operating and rescueprocedures as required by these procedures must be at thework site for the duration of the job. The Confined Space EntryPermit must be completed before approval can be given toenter a permit-required confined space. This permit verifiescompletion of the items listed below. This permit must bekept at the job site for the duration of the job. If circumstancescause an interruption in the work or a change in the alarmconditions for which entry was approved, a new ConfinedSpace Entry Permit must be completed.

Confined spaces rule could protect nearly 800 construction workers a year Source: United States Department of Labor May 1,2015from serious injuries and reduce life-threatening hazardsConstruction protections now match those in manufacturing and general industry

WASHINGTON – The Occupational Safety and Health Administration today issued a final rule* to increase protections for construction workers in confined spaces.

Manholes, crawl spaces, tanks and other confined spaces are not intended for continuous occupancy. They are also difficult to exit in an emergency. People working in confined spaces face life-threatening hazards including toxic substances, electrocutions, explosions and asphyxiation.

Last year, two workers were asphyxiated while repairing leaks in a manhole, the second when he went down to save the first – which is not uncommon in cases of asphyxiation in confined spaces.

“In the construction industry, entering confined spaces is often necessary, but fatalities like these don’t have to happen,” said Secretary of Labor Thomas E. Perez. “This new rule will significantly improve the safety of construction workers who enter confined spaces. In fact, we estimate that it will prevent about 780 serious injuries every year.”

The rule will provide construction workers with protections similar to those manufacturing and general industry workers have had for more than two decades, with some differences tailored to the construction industry. These include requirements to ensure that multiple employers share vital safety information and to continuously monitor hazards – a safety option made possible by technological advances after the manufacturing and general industry standards were created.

“This rule will save lives of construction workers,” said Assistant Secretary of Labor for Occupational Safety and Health Dr. David Michaels. “Unlike most general industry worksites, construction sites are continually evolving, with the number and characteristics of confined spaces changing as work progresses. This rule emphasizes training, continuous worksite evaluation and communication requirements to further protect workers’ safety and health.”
