ThankyoufororganizingaCommunityFundraisertobenefittheNationalBrainTumorSociety(NBTS).Wearegratefulforyourcommitmenttoourcommunity,andsupportofourmissiontofindacure.Byprovidingthisdocumentpubliclyonourwebsite,weassumeallEventOrganizershavereadandfullyunderstoodthebelowinformation,andtheNationalBrainTumorSocietyisnotliableshouldanEventOrganizernottakethetimetoreadorunderstandtheCommunityFundraisingTerms&Conditions.ByraisingfundsfortheNationalBrainTumorSociety,allEventOrganizersautomaticallyagreetothefollowing:
UseofNationalBrainTumorSocietyBrand
1. Uponrequestandtotheextentpossible,NBTSwillprovidetheCommunityOrganizerwithavailableprintmaterialsandelectroniclogosappropriatetotheevent/initiativeanditsfundraisingactivities.
2. TheNationalBrainTumorSociety'snameorlogomaynotbealteredinanyway,anditsusagerequirespriorknowledgebyanNBTSstaffmember.AnyquestionableCommunityFundraisingmaterialsorcontentcreatedbytheCommunityOrganizer(e.g.promotionalitems,invitations,etc.)usingtheNBTSname,logoorlikenessmaynotbeapprovedforfinalprint,publishing,ordistributiontothegeneralpublicbyanNBTSstaffmember.Logoguidelinesareavailableuponrequest.
3. AllCommunityFundraisingmaterialsandpromotionaltoolsmaynotmakeanyrepresentationwhichwouldindicateNBTSishosting,producingorsponsoringthiseventorinitiative.Alleventorinitiativematerialsshouldmakeclear,wherepossible,thatfundsarebeingraised"onbehalfof",“insupportof”,or“tobenefit”ratherthan"by"theNationalBrianTumorSociety.
4. AllwebsitecontentpertainingtoNBTS,ifapplicable,shouldbesubmittedtoanNBTSstaffmemberforreviewandshouldbeapprovedbyNBTSbeforeanythingisposted.NBTSreservestherighttoremoveanylinktotheCommunityFundraisingwebsiteifitcontainsanycontentdeemedobjectionableorreservestherighttorequestthatwebsitecontentbechangedorremovedifitisdeemedobjectionableand/orincorrect.
UseofNationalBrainTumorSocietyOnlineFundraisingPages
CommunityOrganizersmaycreateaneventorinitiativewebsite,hostedbyNBTS,andallowonlinecreditcarddonationstobemadedirectlytoNBTSthroughtheClassyplatformanditsprocessors.
1. CommunityOrganizersareNOTauthorizedtoenterinofflinedonations.Allofflinedonations,checksoranticipatedfunds,mustbemailedtotheNationalBrainTumorSocietynationaloffice
andenteredontothewebsitebyanofficialNBTSstaffmember.
2. TheCommunityOrganizer’swebsitemustfollowthestructureprovided;contentrepresentingNBTSmaynotbedeletedoraltered.
3. TheCommunityOrganizerisresponsibleforcreatingandmaintainingtheinformationontheeventorinitiative’swebsite.
4. NBTSreservestherighttoremoveobjectionablematerialfromanyCommunityOrganizer’swebsites.
Donations&GiftAcknowledgements
1. TheCommunityOrganizerisresponsibleforallexpenses,andwillmaintainappropriatefinancialcontrolsandrecordsrelatedtofundraising.TheNationalBrainTumorSocietyisnotabletocutfundsbacktoaCommunityOrganizertoassistwiththepaymentofeventexpenses.IfaCommunityOrganizerchoosestohostregistrationonanon-NBTSaffiliatedwebsite,theEventOrganizershouldconsulthis/hertaxadvisorforanytaximplicationsassociatedwithdepositingeventrevenueintopersonaloreventrelatedaccounts.
2. CommunityOrganizershavetheoptiontoaccept,process,andacknowledgetheirdonationsinoneofthefollowingwaysandwillberequiredtoadheretothefollowingtermsandconditionsappropriatetotheselectedoption.
a. Createafundraisingwebsite,hostedbyNBTS,andallowonlinecreditcarddonationstobemadedirectlytoNBTS.Anemailreceiptwillbesenttoalldonorsthroughthisoption.RegistrationsthroughtheNBTSeventwebsitemaynotbetaxdeductible.
b. CommunityOrganizerscancollectdonors’checksmadepayabletoNationalBrainTumorSocietyandsendthemdirectlytotheNBTS,Attn:CommunityEvents,NationalBrainTumorSociety,55ChapelStreet,Suite200,Newton,MA02458;suchdonationswillbeprocessedandacknowledgedbytheNationalBrainTumorSocietyundertheorganization’staxidentificationnumber.CommunityOrganizersmustincludeacompletedCommunityOrganizerDonationFormwithchecksthatindicateswhichCommunityEventorCommunityInitiativethedonationsarefor.
c. DonorsmaymailchecksdirectlytoNationalBrainTumorSociety,Attn:CommunityEvents,55ChapelStreet,Suite200,Newton,MA02458.DonorsmustrecordtheCommunityEventorCommunityInitiative’snameonthecheckmemolineandincludeacompletedindividualdonordonationform.
d. IfaCommunityOrganizerreceivescashoracheckmadeouttothempersonally,theCommunityOrganizermaydepositthechecksorcash;however,theCommunityOrganizermustthensendacheckmadeouttotheNationalBrainTumorSocietyforthe
depositedamountormakeanonlinedonationtohis/hereventpageforthedepositedamount.IftheCommunityOrganizersubmitsdonationsthisway,onlytheCommunityOrganizerwillreceiveanacknowledgementfromtheNationalBrainTumorSociety.TheCommunityOrganizerisresponsibleforfollowingIRSguidelinesfortaxdeductibledonations.Pleaseconsultyourtaxadvisorforanytaximplicationsassociatedwithdepositingfundsassociatedwiththeevent.
3. ItisencouragedthatalldonationsbesenttoNBTSwithin30businessdaysoftheeventand/or
collectionactivitytoensurepromptprocessingandacknowledgements.DonationsmadepayabledirectlytotheNationalBrainTumorSocietywillbeacknowledgedbyNBTSaccordingtothefollowing:1)onlinedonationswillbeacknowledgedbyemail;2)allofflinedonationswillbeacknowledgedinwritingviamailprovidedthedonorprovidesavalidstreetaddress.*Pleasenote,donoracknowledgementmaytakeupto4weeks.
EventExpenses&Vendors
1. TheCommunityOrganizerisresponsibleforhiringandmanagingallvendors.
2. TheCommunityOrganizerisresponsibleforallbookkeeping,accountsreceivableandaccountspayablefortheevent.
3. NBTSdoesnotprovideupfrontcapitalorpaymentofexpensesbeforeorafteranevent.NBTScannotpayCommunityOrganizersbackforexpenses.
CompliancewithLaw
TheCommunityOrganizeragreestocomplywithallfederal,stateandlocallaws,regulations,ordinancesandrulesrelatingthepromotion,organizationandconductoftheCommunityEventorCommunityinitiative.TheEventOrganizeragreestoadheretoanylocalandfederallawsregardinggaming,rafflesorauctionsofanykind.TheCommunityOrganizeragreeshe/sheshallberesponsibleforobtainingallpermits,licenses,insuranceandpermissionsfromstateandlocalauthoritiesnecessaryforpromoting,organizingandconductingtheeventorinitiative.TheCommunityOrganizeragreesitshallbeexclusivelyliableforanyinjuriesorlossessustainedbythird-partiesinconnectionwiththeCommunityEventorInitiative.
GeneralLiability&Indemnification
1. TheCommunityOrganizerisresponsibleforsecuringandadheringtoallguidelinesassociatedwithrequiredpermitting,licensing,andinsurancerequiredbytheappropriatelocal,state,andfederalgoverningbodies.
2. NBTSwillnotbeheldliableforanyinjuries,accidents,oremergencyconditionsthatmayoccurbefore,duringoraftertheevent/initiativeortheplanningofsuchevent.
3. NBTSisnotresponsibleforanyfinanciallossordamagedgoodsassociatedwiththeplanningandexecutionoftheevent.
4. NBTSisnotresponsibleforthesuccessoftheevent/initiative,northeactivitiesconductedbytheCommunityOrganizer.
5. NBTSisnotresponsibleforandcannotprovideinsurancefortheevent/fundraiser.
6. TheCommunityOrganizeragreestoindemnifyandholdharmlessNBTSagainstlossorthreatenedlossorexpensebyreasonoftheliabilityorpotentialliabilityoftheNBTSfororarisingoutofanyclaimsfordamages.
7. NBTSmaywithdrawitssupportandaffiliationwiththeeventatanytimeifdeemednecessaryforanyreason.
Photo&VideoConsent
Byhostinganevent/initiativeinsupportofortobenefittheNationalBrainTumorSociety,theEventOrganizeragreestoconsenttoandauthorizetheuseandreproductionofanyandallphotographs,audioandvideorecording,oranyotherrecordswhicharetakenofhim/herortheirevent/initiative,event/initiativeparticipants,ortheirCommunityEventthatarepostedonsocialmediaorarespecificallytakenbytheNationalBrainTumorSociety,oranyoneauthorizedbytheNationalBrainTumorSociety,withoutanycompensationtothem.
FinalAgreement
Bythisdocumentbeingpublicrecordtothecommunity,allNationalBrainTumorSocietyCommunityOrganizersautomaticallyagreetoallsectionsoftheCommunityFundraisingTermsandConditions.TheCommunityOrganizerisalsoagreeingtoexecutehis/herCommunityEventorInitiativetothebestofhis/herabilityandagreetonotholdtheNationalBrainTumorSocietyliableforanyissuesthatmayariseduringtheplanningorexecutionoftheeventorinitiative.
