WHAT IS COPYRIGHT LAW?

• Copyright is a form of protection provided for original works of authorship. This can include literary musical, graphic and audiovisual creations. Copyright basically means the right to copy.

• Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed or made into a derivative work without the permission of the copyright owner.

Strength – The website is very well know and provides programmes, music videos, music ect. Therefore it is clear as to what the copy right law is.

Weakness- This copy right law shown on the website may apply in the U.S another countries which means it may not be the same in the U.K. This can be irrelevant.

WHAT IS COPYRIGHT LAW? When you own the copyright

of a piece of work, it means literally that you have the “right to make copies” of that work. By extension you also have the right to license that work to others who want to use it. It is a form of intellectual property law that protects an original piece of work from being pirated and used without permission of its creator.

Strengths- This has been repeated in many other sources therefore I have established what copy right is.The positive thing with this website is it is very simply defined therefore it’s understandable.

Weaknesses- This does not particularly apply to music videos.

producers, take copyright infringement very seriously.

In the UK, many of them are working with Internet Service Providers and the government to clamp down on this practice and have already taken action against a number of file-sharers.

labels.Makes it clear what can be done to stop it. Aimed at the UKWeaknesses-Does not give exams of record labels. We are unaware of ‘very seriously’ means. How serious is it really? There are no specific facts that can be backed up.

WHAT IS COPYRIGHT LAW?

Copyright laws protect those who work in the creative industries, allowing them to be rewarded fairly and to continue to create music, film and TV programmes. They also apply to downloading, sharing and streaming just as in the world of physical CDs and DVDs. If you make music, film or TV content available to others on a file-sharing network, download from an illegal site, or sell copies without the permission of those who own the copyright, and then you are breaking the law and could face serious penalties.

Strength- Copy right laws protect those who work in creative industries.Copyright law applies to a number of things including music videos. This attempts to stop people from downing, sharing or streaming illegally.People could face seriously penalties if found copyrighting.

Weakness-Although the laws in place it still happens.

WHAT IS COPYRIGHT LAW?

How do I know if a particular piece of music is protected by copyright?

‘All recordings of music are protected by copyright from the moment of their creation. The duration of the rights granted to the different persons involved in the creation of the music are for a period of at least 50 years (and up

Strengths- All music is protected from the minute it’s created.

Weakness- Unclear as say I make music for fun and someone copy rights it but I’m not protected by a record label, are they still copy righting?Copy right rights can end after a number of years?

to 120 years in some countries) from the making of the recording. Authors and music publishers typically retain copyright for 70 years after the death of the author. You may find a copyright or other notice indicating that the music and the recording are protected’

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?Apparently if the video you are creating is not shown outside your own classroom and is as part of a class project, you may use the music if your teacher approves.

Strength- My video will only be played in my class and be on YouTube for a short period of time whilst it is being marked. I have sent an email to the artist whose song I wished to use as she is a small scale artist.Weakness- Some people don’t reply

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?

Copyright holders are generally concerned about two things with regard to use of their music: if it generates profits and if it creates a suitable image.

Strength- In my video I don’t think I created an unsuitable image. It included appropriate footage and wouldn’t make the artist look bad in any way.I can’t profit from my video.Weakness- What I may think is suitable for the video may not be in the artist eyes.

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?Find out who owns the copyright to the music you are interested in using. Only the copyright holder may grant permission to use their music in a project.

Strengths- Must email them or get in touch to ask. This source is clear and understandable.Weakness- This is obvious and too brief

13/06/12 http://filmlondon.org.uk/filming_in_london/planning_your_shoot/

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?

Strength- Very specific that you must ask for permission from to owners of locations or people in charge.

Page 4: Code of practise 2

permissions_and_boroughs

It is important that wherever you plan to film you get permission or notify the appropriate authority. You will also need to make sure you have Public Liability Insurance. It is good practice to inform local police for ALL exterior location filming, and it may be a legal requirement to do so. Other aspects of your script or shoot may also mean you need to get in touch with the police.

Weakness- If you don’t ask will they know? Surely you’d be tempted too.

There were many numbers therefore it was easy to find someone to call however, it was not clear which number was best suited for me.

13/06/12 http://kino-eye.com/docs/dvb/DVB-release-forms-v2.pdf

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?

You must create a release form for the cast in order for them to take part in your music video. This must included their name, when they will be working, what their role will require and any other additional information.

This is straight forward but you must have a plan to let them know about.

HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF YOUR PRODUCTION?This is an example of how someone else has gained permission for a song and location.

Some more info on how to gain permission for locations and songs. The links to places are out there so it’s not impossible to get permission however you do nee to research to find the right people to call.

DESCRIBE THE PARTS OF THE CODE RELEVANT TO MUSIC VIDEO PRODUCTION?

Not more than half the amount of people found it offensive so is it enough to change this? And what about the people that don’t

Page 5: Code of practise 2

even care?

he top five concerns measured as a percentage of all teens questioned were: sexually explicit content, offensive language, violence, nakedness/naked body parts, news and animals being killed or mistreated.’

There are five areas which may cause offence. You need to satisfy them all in order to not make your video in breach of ofcom.

13/06/12 Offensive language: masking offensive language is one way in which broadcasters may edit post-watershed material to make it suitable for broadcast pre-watershed

Masking offensive language before the watershed could work but then don’t the children have access to computers and the videos with the offensive language?

13/06/12 Violence: broadcasters editing post-watershed drama material including violent scenes for pre-watershed transmission should ensure that such scenes are appropriately limited.

Violence needs to be kept to a bare minimum so scenes are appropriate before the watershed.

13/06/12 Ofcom acknowledges the importance attached to freedom of expression in the broadcasting environment. Music videos are an artistic and creative medium, which can and do sometimes contain challenging content which some may find offensive. However, while music videos must have room for innovation and creativity, Ofcom has statutory duties with regard to all programmes, including music videos (whatever the genre), to:

• ensure that under-eighteens

Music videos can be creative but also must be suitable for under 18’s. This may ruin things and ideas that the director or producer had to begin with losing them money if they have to change it.

Page 6: Code of practise 2

are protected; and

• enforce generally accepted standards so as to provide adequate protection for members of the public from the inclusion of offensive and/or harmful material.

13/06/12 http://www.independentproducerhandbook.co.uk/181/4a-protecting-under-18s-and-harm-and-offence/scheduling-and-the-watershed.html

The main way in which fewer than 18s may be protected from potentially harmful and offensive material is through the appropriate scheduling of programming.

Scheduling of programmes/videos may not make a difference as children will stay awake if they want to but a positive for this is that ofcom have done what they can however its then up to the parents.

13/06/12 http://www.independentproducerhandbook.co.uk/181/4a-protecting-under-18s-and-harm-and-offence/scheduling-and-the-watershed.html

Some content may be considered so potentially harmful and offensive (e.g. material that "...might seriously impair the physical, mental or moral development of people under 18") that it should never be broadcast on television

This can include: scenes condoning sexual violence, very explicit sado-masochistic practices.

Strength is it gives you that to consider but at the sae time you could create something you subjectively believe isn’t offensive but someone else may find it offensive.

13/06/12 http://www.independentproducerhandbook.co.uk/200/4b-crime/key-points.html

Videos must not contain material that is likely to encourage or incite crime, or lead to disorder.Videos should not contain detailed descriptions of criminal techniques that could enable the commission of the crime, unless there is editorial justification.

Avoid encouraging criminal activity

thunder-rolls Nashville Network and Country Music Television to ban its airing.

13/06/12 http://www.guardian.co.uk/media/tvandradioblog/2011/sep/30/ofcom-moves-to-enforce-watershed

The video for the song I Like the Way She Do It contained the lyrics: "It never enough she like it rough. We keep it going and we switch positions, listen". Another video for the song If I Can't contained the words "pussies","nigger","motherfucker" and "fuck".

I need to make sure that my song does not include explicit lyrics and words which may cause offence.

Insurance14/06/12 http://

www.moneysupermarket.com/insurance/

Many insurance companies for different things including van, bike, breakdown, pet, landlord, business, income and caravan insurance.

This demonstrates how many types of insurance there are however it is not relevant to music video insurance.

14/06/12 http://www.productioninsurance.com/short.htm

Eligible production types There is insurance for different areas of a music video therefore you have to distinguish between which ones are useful for you.Weakness of this is you may not get a certain type of insurance however you may require it when an accident occurs.

It covers income loss or specified additional expenses that result from a delay in the completion of a construction project when the delay is caused by covered property damage.

If you forget something you have money aside to use so you won’t be stuck. If it’s not used then that’s plus point.

It covers the costs of any additional expenses you might incur on a house purchase if you are unable to complete on the agreed date. Covers such things as extra moving / storage costs, addition interest / penalties for failing to complete on the contracted date.

Additional expenses are covered no matter how sudden and unexpected.

A life insurance policy for people who purchase mutual fund shares as part of a periodic payment plan. In the event of the participant's death before completion of the contract, plan completion insurance pays an amount sufficient to complete the remaining payments.

This is irrelevant to me however it just justifies what insurance was
