Our integrated team works across legal disciplines - with property, planning,
environmental, tax, corporate and commercial, and banking lawyers assisting our projects
and construction specialists to advise on all aspects of transactions, projects and disputes.
Our transactional practice
Working across the Clyde & Co worldwide network of offices, we handle the full range of
multi-national construction and engineering projects in both the public and private sectors
for a broad cross-section of the industry. Projects range in value from £10m to £1bn but
our client focused and cost-conscious approach to resourcing means that all our projects
are handled economically and efficiently.
Our work spans all procurement methods (whether PFI/PPP, DB(F)O, BOT, EPC turnkey,
design and build, or traditional employer-led design) and has covered over 60 countries
worldwide. We are extremely familiar with all of the main standard forms of contract
(including FIDIC, ICE, NEC and JCT) and we prepare and advise on all forms of bespoke
agreements.
Examples of our recent experience include:
• Advising a number of major international contractors in the energy sector on their
EPC contracts for various power projects in the UK, Trinidad, Brazil and Germany;
• Contractual advice and assistance in relation to the construction of the OL3 nuclear
power plant in Finland;
• Advising Songas Limited in Tanzania on expanding its production facilities by the
addition of two new gas processing trains;
• Drafting and advising on a large road and rail infrastructure project in Sierra Leone,
including the construction of a power station;
• Advising the Dubai Municipality on its multi-billion dollar development of the Dubai
metro traversing the city of Dubai and linking up with its airport;
• Drafting and negotiating a bespoke EPC contract for a $2 billion upgrade of an oil
refinery in Colombia;
• Drafting a suite of contracts for a public-private sector developer in connection with
a multi-billion dollar master planned development in the Emirate of Abu Dhabi;
• Representing the UAE based contractor on the development incorporating
Gazprom’s new corporate headquarters in St Petersburg. This is a US$ 2 billion
development and the largest commercial development in Russia;
• Reviewing and amending a suite of construction contracts for an airport expansion
project valued at US$ 4.2 billion and a greenfield airport development for a
governmental department in the UAE;
• M25 London Orbital PPP – advised the capital works contractor to one of the short
listed consortia on their bid for the design, build, finance and operation of the M25
widening project. Capital value £1.25bn; and
• London Underground PPP – acted for the supply chain joint ventures established
by Metronet for the SSL and BCV (Bakerloo, Victoria and Central lines) networks.
Capital value £30bn.

Our disputes practice
In construction and engineering disputes few can match our capabilities. We are
commonly engaged by clients to assist them from the earliest stages in finding negotiated
settlements that enable them to avoid long and costly proceedings. We have extensive
experience in adjudication, arbitration, mediation, conciliation and litigation and work
closely with our clients and their other advisers to achieve an early and clear
understanding of their key issues and needs.
Our international arbitration practice has an outstanding global reputation. At any one time,
the Clyde & Co team deals with several hundred arbitrations all over the world with values
running into billions of dollars. We are proud of our international reputation as specialists
who apply imaginative and strategic thinking. We have considerable experience in relation
to the following:
• Delay and disruption / extensions of time claims;
• Final account disputes;
• Defect claims ;
• Negligence claims;
• Misrepresentation actions;
• Release of retention disputes;
• Payment of performance bonds; and
• Subsidence claims, waste, drainage and any other environmental issues.
Our objective is to put our clients in a position of strength from the outset by adopting the
most effective method of dispute resolution available to them.
Our world-leading insurance practice means that we also have deep insight into insurance
issues relating to the construction industry. We have drafted the professional indemnity
policies for household insurance names and are well equipped to know industry
preferences.
Examples of our recent experience include:
• Advising an Italian contractor in relation to a series of Dispute Adjudication Board
(DAB) and ICC Arbitration proceedings regarding claims for extension of time, delay
and disruption, and termination costs on a motorway by-pass project;
• Representing a UAE main contractor in the first construction case issued in the
Dubai International Financial Centre (DIFC) Courts;
• Representing a European joint venture in ICC arbitration proceedings relating to a
Caribbean port project;
• Representing a Chinese main contractor in relation to disputes arising from the
design and construction of an iconic tower in Doha (disputes to be referred to
arbitration pursuant to the ICC rules);
• Assistance in relation to issues arising out of contracts for the design and supply of
facilities for the processing and storage of spent nuclear fuel in Lithuania and
Ukraine;
• Representing a leading Japanese construction company in defence of UNCITRAL
arbitration proceedings brought in connection with a US$ 900m Abu Dhabi water
transmission scheme; and
• Acting for main contractor on the Burj Khalifa (the world’s tallest building) in
connection with disputes arising from design and installation of the curtain wall and
cladding;
