With declining household incomes, families are struggling to pay their bills. This proposal would serve eligible households, earning up to 120% of the area median income ($120,000 for a family of four) with a verifiable loss of income directly related to the COVID-19 pandemic. Households may receive financial assistance up to $1,000 per household per month, for up to three months. Mile High United Way will verify client eligibility and process payments directly to the vendor(s) on behalf of the Thornton resident. Funds will be distributed on a first come, first served basis until available funding is expended.

Food Drive Update• Staff Initiated Food Drive began on Friday, April 24, 2020.

SYNOPSIS: During their consideration of the short-term rental (STR) ordinance at the Public Hearing on June 9, 2020, Council directed staff to explore options for allowing existing investment-type STRs to continue. The current ordinance, which was approved on first reading, allows property owners to operate only their primary residence as a STR. This residency requirement prohibits a person from operating a STR in a home where they do not live for at least 50 percent of the year. RECOMMENDATION: Staff recommends Alternative No. 1, take no further action regarding investment-type STRs, and consider the current STR ordinance on second reading. Council previously discussed investment-type STRs and, at that time concluded that these were not appropriate for the City due to numerous neighborhood experiences and concerns about noise, maintenance, and other issues. Staff has been unable to find or create a functional and defendable method of grandfathering or granting variances to investment-type STRs under the structure of the currently proposed ordinance. Those STR operators who cannot meet the requirements of the new primary residence-based licensing program could choose to rent their properties to long-term tenants. BUDGET/STAFF IMPLICATIONS: Expanding the types of STRs allowed to operate in the City may require additional staff resources and will lead to additional costs for monitoring and compliance services by a private company. However, some of those costs may be offset by the licensing fee and collected lodger’s taxes. None of the STRs currently operating in the City have a business license, and none have been submitting lodger’s taxes for their ongoing rentals. ALTERNATIVES: 1. Take no further action regarding investment-type STRs, and consider the current STR ordinance

on second reading. 2. Direct staff to draft another ordinance for Council’s future consideration that would define and allow

investment-type STRs as a new land use with potentially different operating and zoning criteria. Meanwhile, consider the current STR ordinance on second reading.

3. Direct staff to amend the current ordinance to add allowances for investment-type STRs with potentially different operating and zoning criteria, and postpone Council’s consideration of the current STR ordinance on second reading.

BACKGROUND (ANALYSIS/NEXT STEPS/HISTORY): (includes previous City Council action) Based on Council’s direction at the June 9, 2020 meeting, staff has explored a variety of concepts for allowing the currently operating investment-type STRs to continue, including those outlined below. In summary, no feasible option has been identified due to legal constraints.

• Authorization via a variance process. City Code (Code) Section 18-34(c) includes very specific criteria that must be met before a variance can be approved. Generally, the variance must be related to specific conditions at the property and be in keeping with the intent of the Development Code. Variances cannot be granted solely due to a self-imposed, personal, or financial hardship. Further, there must be unique physical circumstances, such as narrowness or shallowness of a lot, which are particular to that property such that the property cannot be reasonably developed or used in compliance with the Code. Current STRs are operating in violation of the Code. Those operators who cannot meet the requirements of the new licensing program could choose to rent their properties to long-term tenants. Therefore, these situations would not qualify for a variance.

• Consideration as a legal, nonconforming use.

The City Code defines a nonconforming use as “a use that does not conform to the use regulations of this chapter, but was lawfully established under the regulations in force at the beginning of operations and has been in regular use since that time.” If investment STRs were currently allowed and the City was imposing additional regulations, then those STRs could be considered a legal nonconforming use and could be allowed to continue operating. In the current situation, the opposite is true. STRs are not currently permitted in the City, so they don’t qualify for legal nonconforming use consideration moving forward.

An online search for other regulatory approaches was unhelpful. However, staff identified several municipalities that recently have repealed or significantly restricted options for investment STRs due to ongoing neighborhood problems related to noise, property maintenance, and a variety of other issues. Given these factors, staff has been unable to identify a viable way to amend the current ordinance to allow only currently operating investment STRs to continue. However, if Council desires to allow all investment STRs, regardless of whether they are currently operating, then the following options could be considered:

• Continue with Council’s consideration of the current STR ordinance on second reading, and direct staff to prepare an additional ordinance specifically for investment-type STRs for Council’s future consideration. The current ordinance considers the operation of a STR to be accessory to the use of a home as a primary residence for at least 50 percent of the year. Using a home as an investment STR changes the context of the rental to be more like a hotel or similar facility, as there is little to no connection to the use of the home as a residence. Staff has not fully researched all of the necessary requirements for investment rentals, as Council was not interested in this approach. Zoning and other operational requirements need to be evaluated, and there may be Fire and/or Building Code and accessibility requirements. Both Fort Collins and Golden have two types of STRs, with primary residency and zoning restrictions as significant differentiating factors. Another possibility is combining investment-type STRs with the already-existing bed and

breakfast land use, although updates to those regulations would also be required. The research and drafting process will likely require at least several weeks to accomplish.

• Postpone Council’s consideration of the current STR ordinance on second reading. Direct staff

to amend the current ordinance to allow investment-type STRs in Thornton along with the primary residence locations already included. This option will require the same research considerations mentioned above, but instead of a new, separate ordinance, the current ordinance would be revised. The time for adjustments could further delay the implementation of a STR license program for primary residences.

SYNOPSIS:

The South Thornton Urban Renewal Authority Non-Residential Property Maintenance Code (PMC), Sections 10-236 through 10-281 of City Code, provides appeal procedures and requirements and the scope of the Building Code Advisory Board’s (BCAB) in hearing appeals. Staff proposes to amend, clarify, and streamline these provisions to provide a clearer and more efficient appeal process. Staff also proposes to amend the PMC’s provisions on violations and penalties, which are modeled on those of the International Property Maintenance Code (IPMC), to provide clarity and consistency with the provisions and terminology of City Code, and to conform other model language that is derived from the IPMC to be more suited to City Code. Proposed amendments include the following:

Eliminating the right to apply to the appropriate court for a writ of certiorari to correct errors oflaw.

Providing that an appeal of a notice of violations must be based on a claim that, and BCAB mayreview only whether, an asserted violation does not violate the plain terms of a code requirement.

Clarifying that BCAB may not review whether a correction order provides a reasonable time tocomplete repairs.

Clarifying that relevant evidence may not include any information relating to an appellant’sfinancial ability or wherewithal to correct violations.

Clarifying that only certain persons with financial, contractual, or similar interests in the subjectproperty have the right to be heard during an appeal hearing.

Repealing the right to request a postponement of a hearing if all five members of BCAB are notpresent to hear the appeal, and providing that a hearing may be postponed only for good causeshown.

Repealing superfluous provisions concerning BCAB membership, as these provisions arealready provided in the City Code.

BACKGROUND (ANALYSIS/NEXT STEPS/HISTORY): (includes previous City Council action) In 2016, the City adopted the PMC. The PMC is largely comprised of model language from the IPMC, which is developed by the International Code Council. Appeals filed pursuant to the PMC are heard by BCAB. Thus far, BCAB has conducted one appeal hearing pursuant to the PMC. The hearing was held on April 30, 2020 and concerned an appeal of a notice of violations. During the course of this appeal, staff found there are provisions in the PMC in need of clarification or streamlining. While BCAB affirmed all the code violations alleged in the notice of violations, it ordered staff and the appellant meet to agree on a reasonable timeframe for violations to be corrected, finding 15 days was not reasonable. Staff has attempted to meet with the appellant, but has been unsuccessful. As a result, many of the affirmed violations still exist, after the property owner was first contacted about the violations in November 2019, the notice of violations was issued on February 20, 2020, and the appeal hearing was held at the end of April. During the course of the review of the City Code, several issues that could streamline the process were identified. Additionally, a few issues of City Code clean-up were identified.

(a) Liability. The building official, member of the building code advisory board or employee charged with the enforcement of this building code, while acting in the course and scope of their duties required by this building code or other pertinent law or ordinance, shall not thereby be rendered liable personally and are hereby relieved from personal liability for any damage accruing to persons or property as a result of any act or by reason of an act or omission in the discharge of official duties. Any suit instituted against an officer or employee because of an act performed by that officer or employee in the lawful discharge of duties and under the provisions of this building code shall be defended by a legal representative of the jurisdiction City until the final termination of the proceedings.

2. Subsections 10-241(c) through (e) of the Thornton City Code are hereby

amended, by the addition of the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-241. – Violations and penalties; Remedies.

(c) Prosecution of violation Remedies. Any person failing to comply with a notice of violation or order served in accordance with Section 10-242 shall be deemed guilty of a misdemeanor or civil infraction as determined by the local municipality, and the violation shall be deemed a strict liability offense. In addition to the penalties set forth in subsection (d) of this section, if the a notice of violation or order served in accordance with Section 10-242 is not complied with, the code official City shall institute the appropriate proceeding at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the order or direction made pursuant thereto. Any action taken by the authority having jurisdiction City on such premises shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate.

(d) Violation and penalties. Any person, who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, shall be prosecuted within the limited by provided by state or local laws. Any person failing to comply with a notice of violation or order served in accordance with Section 10-242 shall, upon conviction, be deemed guilty of a misdemeanor or civil infraction as determined by the local municipality punished as provided in Section 1-8(a). The violation shall be deemed a strict liability offense. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

(e) Abatement of violation. The imposition of the penalties herein prescribed shall not preclude the legal officer of the jurisdiction the City from instituting appropriate action to restrain, correct or abate a violation, or to prevent illegal occupancy of a building, structure or premises, or to stop an illegal act, conduct, business or utilization of the building, structure or premises.

3. Subsection 10-242(a) of the Thornton City Code is hereby amended, by the addition of the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-242. - Notices and orders.

(a) Notice to person responsible. Whenever the code official determines that there has been a violation of this code or has grounds to believe that a violation has occurred, notice shall be given in the manner prescribed in Sections 10-242(b) and 10-242(c) to the person responsible for the violation as specified in this code. Notices for condemnation procedures shall also comply with Section 10-243(c) 10-243(e).

4. Subsections 10-244(e) and (f) of the Thornton City Code are amended, by the addition of the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-244. - Emergency Measures.

(e) Costs of emergency repairs. Costs incurred in the performance of emergency work shall be paid by the jurisdiction. The legal counsel of the jurisdiction City shall institute appropriate action against the owner of the premises where the unsafe structure is or was located for the recovery of such costs.

(f) Hearing. Any person ordered to take emergency measures shall comply with such order forthwith. Any affected person shall thereafter, upon petition directed to the appeals Building Code Advisory Board, be afforded a hearing as described in this code.

5. Section 10-246 of the Thornton City Code is hereby amended, by the addition of

the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-246. - Means of appeal. (a) Application for appeal; failure to appeal. Any person directly affected by a decision of the code official or a notice or order issued under this code shall have the right to appeal to the Building Code Advisory Board of appeals, provided that a written application for appeal is filed within 20 15 days after the day the decision, notice or order was served. An application for appeal shall be based on a claim that the true intent plain terms of this code or the rules legally adopted thereunder have been incorrectly interpreted or applied, the provisions of this code do not fully apply, or the requirements of this code are adequately satisfied by other means. An application for appeal of a notice of violations shall be based only on a claim that an alleged violation does not violate the plain terms of any applicable code requirement. The application shall be accompanied by the fee

required under Section 10-34(e). The failure to appeal in accordance with this subsection shall constitute a waiver of the right to a hearing.

(b) Membership of board. The building code advisory board shall consist of a minimum of five members who are qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of the jurisdiction. The code official shall be an ex-officio member but shall have no vote on any matter before the board. The board shall be appointed by the chief appointing authority, and shall serve staggered and overlapping terms. Burden of proof. The appellant shall have the burden of proof by a preponderance of the evidence to establish the necessary facts or legal basis in support of a claim to warrant favorable action by the board.

(1) Alternate members. The chief appointing authority shall appoint a minimum of two alternate members who shall be called by the board chairman to hear appeals during the absence or disqualification of a member. Alternate members shall possess the qualifications required for board membership.

(2) Chairman. The board shall annually select one of its members to serve as chairman.

(3) Disqualification of member. A member shall not hear an appeal in which that member has a personal, professional or financial interest.

(4) Secretary. The code official shall designate a qualified person to serve as secretary to the board. The secretary shall file a detailed record of all proceedings in the office of the chief administrative officer.

(5) Compensation of members. Compensation of members shall be determined by law. (c) Notice of meeting. The board shall meet upon notice from the chairman, within 20 days of the filing of an appeal, or at stated periodic meetings. Not less than 10 days before the hearing, notice of the hearing shall be published and posted in accordance with Section 2-1(a)(1) and (2) and shall be mailed to the appellant. (d) Open hearing. All hearings before the board shall be open to the public. Only the appellant, the appellant's representative, the code official and any lessee, lessor, lienholder or other person whose financial, contractual or similar interests in the property are affected shall be given an opportunity to be heard. A quorum shall consist of a minimum of three members of the building code advisory board membership.

(1) Procedure. The board shall adopt and make available to the public through the

secretary procedures under which a hearing will be conducted. The procedures shall conduct a hearing in an informal manner. It shall not require compliance be required to comply with strict rules of evidence, but shall mandate that only relevant information be received. Relevant evidence shall not include any information related to an appellant’s financial ability or wherewithal to make the repairs and improvements required to bring the building or structure into compliance with the provisions of this code. The appellant and building official

may give opening and closing statements, submit position statements, proffer evidence, examine, cross-examine and redirect examine witnesses, impeach a witness’ credibility and rebut evidence.

(e) Postponed hearing; failure to appear. When the full board is not present to hear an

appeal, either the appellant or the appellant's representative shall have the right to request a postponement of the hearing. The board may postpone a hearing at the request of the appellant only for good cause shown. Failure of the appellant to appear at a scheduled hearing shall constitute a waiver of the right to a hearing.

(f) Board decision. The board shall modify or reverse the decision of the code official only by a concurring vote of a majority of the total number of appointed board members. In hearing an appeal of a notice of violations, the board may decide only whether an alleged violation does not violate the plain terms of any applicable code requirement. The board does not have any authority to decide whether a correction order provides a reasonable time to make the repairs and improvements required to bring the building or structure into compliance with the provisions of this code.

(1) Records and copies. The decision of the board shall be recorded. Copies shall be furnished to the appellant and to the code official.

(2) Administration. The code official shall take immediate action in accordance with the decision of the board.

(g) Court review. Any person, whether or not a previous party of the appeal, shall have the right to apply to the appropriate court for a writ of certiorari to correct errors of law. Application for review shall be made in the manner and time required by law following the filing of the decision in the office of the code official. (h) (g) Stays of enforcement. Appeals of notice and orders (other than imminent danger

notices) shall stay the enforcement of the notice and order until the appeal is heard by the appeals board.

6. Subsection 10-247(d) is hereby amended, by the addition of the words double-

underlined and the deletion of the words stricken, to read as follows: Sec. 10-247. - Stop work order. (d) Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be penalized as provided in Section 10-423(b) 10-241(d) of the City Code.

7. Subsection 10-251(d) of the Thornton City Code is hereby amended, by the addition of the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-251. - Exterior property areas. (d) Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of eight inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Landscaping shall be maintained in accordance with the approved landscaping plan. If there is no approved plan, landscaping shall be maintained in accordance with Section 18-556. Upon failure of the owner or agent having charge of a property to cut and destroy weeds or take action to adequately maintain landscaping after service of a notice of violation, they shall be subject to prosecution in accordance with Section 10-241(c) and as prescribed by the authority having jurisdiction the civil remedies and penalties provided in Section 10-241(c) and (d), respectively. Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the costs of such removal shall be paid by the owner or agent responsible for the property. Assessment of costs shall be in accordance with Section 38-453 of the City Code.

8. Subsection 10-275(a) of the Thornton City Code is hereby amended, by the addition of the words double-underlined and the deletion of the words stricken, to read as follows:

Sec. 10-275. - Elevators, escalators, and dumbwaiters. (a) General. Elevators, dumbwaiters and escalators shall be maintained in compliance with ASME A17.1. The most current certificate of inspection shall be on display at all times within the elevator or attached to the escalator or dumbwaiter, be available for public inspection in the office of the building operator or be posted in a publicly conspicuous location approved by the code official. The inspection and tests shall be performed at not less than the periodic intervals listed in ASME A17.1, Appendix N, except where otherwise specified by the authority having jurisdiction the City.

9. If any portion of this ordinance is held to be unconstitutional or invalid for any

reason, such decision shall not affect the constitutionality or validity of the remaining portions of this ordinance. City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared unconstitutional or invalid.

10. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.

11. The repeal or amendment of any provision of the Code by this ordinance shall

not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions.

12. This ordinance shall take effect upon final passage.

is set for July 31. Due to COVID-19 the timeline is tentative. • Staff will provide tours and curbside meals beginning August 3 at the new AAC. Programming within

the building will begin when safe. • All programming and services will be moved to new AAC from the current facility. These include use

of fitness center, meal program, health services, fitness classes, and drop-in activities. • Transportation for older adults to the current AAC has been provided for the last 30 years and will

continue to be provided to the new AAC. This service is part of the A-Lift program and is a door to door, five days per week, service for adults who no longer drive.

• The existing AAC will be repurposed for use by the Community Connections Division and the nine staff members will move into this building in late July 2020. Programs in this facility will include assistance with resources and weekly programming provided by non-profits that support our residents’ needs. Classes may include, General Education Development (GED), English as Second Language (ESL), and budgeting. Special events, such as resource fairs, will also take place.

• The Community Center will undergo a reinvention process, as shared at the 2020 Strategic Planning Conference (SPC), including public input with a focus on improved recreation opportunities for the entire community and Americans with Disabilities Act (ADA) upgrades.

• A meeting is planned with Cultivando to assist in reaching to a wider community during the outreach efforts.

RECOMMENDATION: For informational purposes only. BUDGET: The City has engaged the services of a recruitment firm who specializes in recruiting for the position of Police Chief and who has had local success in hiring candidates for other jurisdictions in the Denver Metro area. The estimated total cost of the recruitment is approximately $32,000, plus travel expenses. ALTERNATIVES: For informational purposes only. BACKGROUND (ANALYSIS/NEXT STEPS/HISTORY): (includes previous City Council action) Upon receiving notice of the existing Police Chief’s retirement, Human Resources, at the direction of the City Manager, engaged the services of Public Sector Search & Consulting to assist in completing a recruitment for the position. A marketing brochure was created and the City began accepting applications on April 1, 2020. In total there have been approximately 40 applications received for the position, including a diverse pool of applicants and backgrounds. The recruitment is currently proceeding to narrow the pool of applicants, which includes additional screening tools, interviews, and various town halls. City employees, including police employees, senior leadership, and the community will be involved.
