Statement: The City is required to review all surplus property and identify any parcels that are suitable for affordable housing before putting them up for sale. I don’t understand how this parcel was not identified as suitable for affordable housing. This would be an ideal site for a multi‐family affordable development. The rating criteria that Florida Housing uses in reviewing sites include things such as: • access to public transportation – this is on one bus route and a quarter mile from another • access to food – there are multiple options for food shopping within walking distance of the site and well as multiple eating establishments • access to medical care – there is a hospital within 1.2 miles, doctor’s offices in less than a mile and pharmacies within walking distance • access to shopping – there are multiple shopping options within a half mile of the site • access to major transportation arteries – this is on a major connector Another consideration in selecting a site for an affordable housing development is access to jobs for the tenants. There are a numerous job opportunities within walking distance of this site. While there has been tremendous activity in multi‐family development in the last few years those have been market rate rentals. Affordable rental housing requires local government assistance. Your policies do not require multi‐family development to include affordable units, even when supported by local dollars. As a result there is a tremendous shortage of affordable rental units in Tallahassee. Working with a successful affordable multi‐family developer we have a plan for an affordable housing development of 100 units with a mix of 1, 2 and 3 bedroom units in three story buildings with surface parking. Our development partner has years of experience in the development of multi‐family affordable housing developments and we would be interested in this as a site for our development. We will not be able to compete with private sector bidders in a competitive process and acquire this land at a price that will make the development work financially. Making surplus land owned by local government available for affordable housing is one way to make affordable housing deal work. That is the reason for the requirements in State law. You put over $1.3 million dollars in a 100 unit development for the Tallahassee Housing Authority. That was needed to make the deal work on land that the Housing Authority already owns. How about putting this land, as your local contribution, in a 100 unit affordable development with us? This site is the perfect size for such a development and will include nice open space if the City accepts the site’s storm water in the new holding pond and a large portion of the site is not needed for a storm water facility. The site has all City utility services available which would allow for the maximum use of gas reducing the utility costs for the low income residents. I recommend that you reevaluate this

Statement: HI, I am a nearby resident who just learned that the city is planning to sell this parcel. I have seen wildlife ‐ especially our rare wood storks ‐ using this area for many years. Also, considering it's hydrological connections to our aquifer, I believe that it would be prudent for the city to hold onto this parcel to mitigate the impacts of the very intensive development in the area. I oppose selling this parcel and believe it would be a mistake that we will later regret. I am sorry that the present circumstances of the pandemic prevent me from testifying in person, but hope that you will consider my comments and others in making your decision. Thank you.

Statement: This agenda item warrants delay indefinitely until in‐person public can occur. As a public employee who also has to conduct meetings via internet platforms such as GoToMeeting, we makes sure not to include anything that is highly controversial on the agenda. That is because virtual meetings have inherent limitations to public participation in the process. I understand the need to conduct regular business, but this item if approved will result in significant impact to Tallahassee and residents deserve to speak in‐person on the record at a public meeting. Statement: As I have noted at prior meetings, traffic was, at times, already a problem in this area and has increased significantly due to this development. The City’s Inclusionary Housing Ordinance grants a 25% increase in allowable density. This amendment will only add to an already existing problem with traffic. If more affordable housing is your true objective, there are means of attainment which do not entail increased housing density and traffic: reduce the sales price of residential units and the profit for the developers. Do I believe more affordable housing is a primary objective of this developer? No, I do not. I do believe, however, it is exploited by the developer to gain support for more dense development (and ultimately added financial gain). This developer relies on tactics long used by developers to win over support for otherwise controversial developments, including becoming friends with and/or ingratiating local, often elected, officials, key decision makers in the permitting process. This includes members of the City Commission, County Commission, and Planning Commission. During the current City Commission’s initial meetings, some citizens expressed optimism that the Commission would be entering a new phase with several fresh faces. I, on the other hand, was not optimistic about change. Three out of five of you (a majority) had already been involved in the process for some time: one had already been serving on the City Commission and had been on the Blue Print Citizen Committee, another one had long served on the County Commission, and another one had served on the Planning Commission. All three of you had already partaken in key decisions involving controversial projects of this developer. All three of you had shown support for this developer despite strong opposition expressed by concerned constituents and/or area residents. Based on what I have observed in commission meetings and/or have read in public records or local media reports, there is reason to suspect that personal ties have influenced your decision‐making. At the very least, there is an appearance of a conflict of interest for some (a majority) of you due to pre‐existing relationships with this developer and/or associates of the developer. One of you has, on occasion, noted “indigenous rights” of those already in areas prior to development. You specifically mentioned “indigenous rights” of residents of French Town as well as those along Springhill Road when proposed developments in and around those sites were under consideration. Yet, when those rights were brought up on behalf of neighborhoods already impacted and/or potentially impacted by this developer (Woodhaven by Sandco Mining, and Centerville Road by Canopy), you totally ignored the “indigenous rights” of these neighborhoods. I was surprised someone so outspoken about ‘indigenous rights’ in French Town and along Springhill Road could be so neglectful of those same rights in these other cases until I became aware of th

Statement: Greetings This agenda item recommends the following changes to the Canopy inclusionary unit agreement. All of these are reasonable modifications and will provide clarity around some issues that have surfaced in the process of building and selling these units. I support you making these changes. ‐ increase number of inclusionary units (to 67) reflecting revisions to PUD, ‐ reflect relocation of certain inclusionary units, ‐ provide for payment of realtor fees from sales price (to be paid by developer), ‐ provide for payment of 3% of buyer's closing costs (to be paid by developer), ‐ provide for annual adjustments to sales price controls, ‐ increase pool of eligible buyers (households up to 100% of area median income), ‐ restart clock for City to purchase unsold inclusionary units, and ‐ eliminate posting of bond There is, however, one major changes to the agreement that is not included in this list and not mentioned in the agenda item at all. I believe it represents the largest policy change represented by this modification and it seems strange that it was not included in the narrative of the agenda item. During the presentation of the original agreement, the proposed term for the units to remain affordable would be 10 years (the minimum required by your policy). We suggested at that time that the term should be perpetuity. The primary goal of inclusionary zoning is to provide for economic diversity in the new development. We all know that Tallahassee is a very economically segregated city. Inclusionary zoning is one tool to address this issue. If you create affordable units those units need to remain affordable in order to continue to have economic diversity. Removing the affordable restrictions and allowing the units to revert to being market rate housing only exacerbates the economic segregation. During that Commission meeting, the developer agreed to increase the restriction period to 15 years. While that only kicks the can down the road a few more years it was better that the ten years proposed by City staff. This agreement now proposes to reduce the restriction period to seven years, which is below the minimum called for in the Inclusionary Zoning Policy. The general argument for reducing the restrictions is that it makes the units easier to sale. These are quality houses in an attractive development. For the target market, families with household income at or below the average in the community, they are getting a home at a price they cannot otherwise afford. These homes are a stepping stone to a full market rate house. With the limit on the sales price and the thousands of dollars in closing costs and additional down payment assistance this is a very attractive package. The other issues addressed in this new agreement – marketing efforts, commissions to realtors, etc. will assist on the sales side. Statement: Mayor and Commissioners, on behalf of United Partners for Human Services and our member agencies ‐ thank you so much for your support of the $1M in Blueprint funding for nonprofits (Local Emergency Assistance for Nonprofits ‐ LEAN grant) in the wake of the COVID‐19 pandemic. Because participation in this program has been slower than anticipated and has yet to meet program capacity, we have been working with our sector partners (COCA and INIE) alongside OEV to better understand the barriers that have prevented nonprofit agencies from applying. The biggest area to note is that many nonprofits have not yet experienced a 25% decrease in revenue, however losses of this amount are anticipated through FY2020 (just not yet realized). Additionally, nonprofits have generally seen an increase in COVID‐specific expenses but this was not originally considered as part of the criteria. With this knowledge, OEV made some modifications to the criteria on May 5th and we would respectfully request consideration at the May 21st IA/Blueprint Meeting to maintain the funding for nonprofits and extend the deadline through June 1st to ensure all eligible nonprofits have the ability to apply. We have been and will continue to make phone calls to our member agencies regarding this funding opportunity, as well as, provide technical assistance as needed. This additional time will help us and our partners ensure local nonprofits gain access to this critical funding in such an uncertain and unknown time. We appreciate your consideration and your continued leadership during this trying time for our community.

Statement: Last month at the first public hearing on this agreement, Commissioner Richardson (whose ties with the developer I spoke of earlier) motioned immediately for acceptance of the agreement despite the fact a second public hearing was scheduled. Decisions are supposed to be reached after all public hearings have been held and all concerns of citizens have been taken into account. I question whether the Commissioner intended to consider any public input or expressions of concern. As noted earlier, the Commissioner seems to ignore public concerns expressed about this developer. But Commissioner Richardson is not the only one of you who has shown support for this developer despite strong public opposition. Last August, I read in the Tallahassee Democrat that one of you had in October 2018, while running for City Commission, received 19 maximum campaign donations totaling $4750 from companies all at the same address as Ghazvini‐Asbury, LTD, the developer of Canopy. This was the same one of you who had served on the Planning Commission prior to the City Commission. You served on the Planning Commission with a key player, Tim Edmond, in the development of Canopy. Mr. Edmond has been heavily involved with the development for some time. In 2010 and 2011, he lobbied the City Commission for approval of the development. While on the Planning Commission, Mr. Edmond also served as a member of the Canopy Community Development District. It is no secret that members of governmental committees (like Planning Commissions) often court favors from one another. Developers have long been known to seek appointments on committees which will address and make key decisions involving their developments. Even if the developers recuse themselves when voting on those particular items, they often court favorable votes from fellow committee members. I attended Planning Commission meetings when you were a member and items related to this developer were addressed. Despite several serious concerns and strong opposition expressed by the public about anticipated impacts of proposed developments, never once did you question a proposed development. On every occasion, you supported this developer’s request. Another individual who was quite involved with Canopy and the development of Welaunee Plantation is Debbie Lightsey, who was on this City Commission for 20‐plus years during which several special measures were taken on behalf of the Plantation owners, whom she knew before her term on the Commission. Ms. Lightsey has long‐standing ties, as well, with these developers. Not surprisingly, at your first City Commission meeting, you (the former Planning Commissioner) mentioned Ms. Lightsey as one of your key environmental advisors (she was the first name you mentioned). I was not at all surprised, and what I have observed since then from you on this Commission further confirms my beliefs about your lack of an environmental ethic (much like Ms. Lightsey and the developers).

Statement: As noted in the last agenda item, Tim Edmond was appointed to the Planning Commission despite having major ties to Canopy development and the developers. Several related items were presented to the Planning Commission during his term. But on his application, he specifically noted that he did not foresee any conflicts of interest. Yet he had to recuse himself from several votes due to conflicts of interest. These conflicts could have readily been anticipated before he submitted his application. Had he noted the conflicts, I was told that he would, in all likelihood, not have been appointed. But he chose not to disclose those conflicts until some time later when they were brought forth by a member of the public. Soon after this, he did step down from the Commission. But after revising his application and listing potential conflicts of interest (Sandco Mining and Premier Builders, both of which are owned by Canopy’s developer), Mr. Edmond was reappointed to the Planning Commission. I specifically addressed these conflicts of interest with one of you, the same one of you who had originally nominated Mr. Edmond to his first term on the Planning Commission and then voted for his reappointment (after I had pointed out to you his failure to include the conflicts in his original application). Earlier this year in the Tallahassee Democrat, I read an article entitled “The Man Behind The Curtain”, referring to Drew Jones with VancoreJones Communications. I learned about long‐standing ties between you and Mr. Jones, another key party involved with Canopy development. I read that the firm’s clients include Ghazvini‐backed businesses as well as CNL and Hopping Green & Sams, both of which have been heavily involved in the Canopy development. “Jones has helped longtime clients the Ghazvini family and Premier Homes navigate approvals for its Canopy development.” Despite several violations and restrictions for further development being implemented, I read that Mr. Jones has been able to help in getting permits and “ in getting things moving along.” As noted earlier, there is definitely at the very least an appearance of conflicts in interest for some (three out of five of you, a majority) on issues related to Canopy development and/or the developers and their associates. I do wish that I could have presented my case face‐to‐face directly with you as well as the developer. This has been a very frustrating experience the past twelve years as I have closely followed the development of Welaunee Plantation. As someone who cared deeply about the land and is very concerned about the impacts of the development on the surrounding area, I am asking that each of you consider the well‐being of all impacted parties and not just the interests of the developers and their associates.
