14 I, Charles Cox, hereby declare as follows:15 1. I am over the age of 18 years, make this Declaration based on personal knowledge, and16 am competent to testify to the facts contained herein.17 2. On or about December 7,2009, our daughter disappeared from the horne she shared with18 her husband Joshua Powell and her two sons in West Valley City, Utah.19 3. Susan was reported missing on December 7, 2009, when she failed to show up to work20 and our grandsons were not dropped off at daycare.21 4. On December 7, 2009, local police went to the family horne to check on the family's22 whereabouts and no one was horne.23

1 5. Joshua and our two grandsons were not heard from until they showed up at the house at

2 approximately 5:00 p.m. on December 7, 2009. Joshua told police that he left the family horne3 just after midnight to take our grandsons camping in subfreezing conditions. He told police that

4 when he left Susan was sleeping and when he returned she was gone. The following day I spoke5 with him and he informed me that Susan was getting ready for bed when he left.6 6. To date, Susan's whereabouts are unknown and police have labeled her disappearance as

7 highly suspicious. Joshua is the only named person of interest in the investigation to find Susan8 and has been extremely uncooperative with law enforcement in helping find her.

9 7. Eleven days after Susan's disappearance Joshua moved to Puyallup, Washington, where10 he currently resides in the horne of his father, Steven PowelL.11 8. In 2010, Joshua and his family created a website called SusanPowell.org. The website

12 seeks to address the Powell family's belief that Susan ran off with another man, Steven Koecher.13 Around the same time that Susan disappeared, Utah resident, Steven Koecher, also disappeared.14 Although investigators in Susan's and Mr. Koecher's disappearance have found absolutely no15 link between the two, the Powell family has held steadfast to this belief.16 9. In an attempt to give credit to their outlandish belief that Susan ran off with another man,

17 the Powell family has begun publishing and distributing Susan's personal journal entries. While18 neither I nor my wife have ever read the journal entries, out of respect for our daughter's privacy,19 I know that Susan began writing journal entries at the age of 8 and continued writing until she20 was approximately 20 years old. Journal entries have been published on SusanPowell.org and21 distributed to numerous media outlets.22 10. The journal entries are of a very private nature and detail very personal family matters.23 One journal entry has been published on SusanPowell.org that details a quarrel between our

1 daughter and my wife. The journal entry was written by a friend of Susan's, Brittainy Cornett.2 Ms. Cornett never consented to the release of the entry and it was written in the journal with the3 knowledge it would be kept private. Another journal entry that was distributed to various media4 outlets details an episode where our daughter consumed a number of over the counter headache

5 medication and had to be taken to the hospital as a precaution. While there are a number of6 journal entries and I have only seen the ones that have been released by the Powell family, I can

7 only assume that all of them detail very personal family matters and are private.8 a. Attached as Exhibit A is a true and correct copy of an excerpt from9 SusanPowell.org10 b. Attached as Exhibit B are true and correct copies of news articles discussing11 journal entries and their distribution by the Powell family12 11. The publication and distribution of these journals has caused my wife and I severe13 emotional distress and anguish. It is horrible enough that we have had to endure the14 disappearance of our daughter, but now her husband and his family are releasing private15 information about our family. They have no right to release this information and it invades my16 privacy, my wife's privacy, and most importantly, my daughter's privacy. Our daughter has17 never consented to the release of this information and my wife and I have never consented to the18 release of this information.19 12. My wife and I have made repeated requests to Joshua and his family to not publish the20 journals or distribute them. We have also made repeated requests that the journals be given to us21 as they are not Joshua's property and we know our daughter would not consent to his use of

the22 journals.23

I can't even begin to explain the pain, anger and frustration my wife and I feel not3 knowing the whereabouts of our daughter and having to watch her husband and family behave in4 such a maner. Every day my wife and I sit on pins and needles not knowing if the Powell5 family is going to release more journal entries and disclose more private information about my

6 daughter and our family. The acts of Joshua and his family are outrageous and I beg this Cour

7 to recognize our rights, the rights of our daughter, and the rights of our family as we continue to

8 await word on the fate of our daughter.

Brittainyalso wrote that she could empathize with Susan. Having been a victim ofemotional abuse herself. Because of the Powells' increasing understanding of Susan as theycontinue to read Susan's childhood journals, the Powells believe that even now.this ongoing abuse is destroying this loving mother and wife. wherever she maybe.Chuck and Judy Cox's abuse of Susan and her children. inflcted both in themedia and privately. must be stopped. During a recent interview with NBC's "Today" show, Steve Powell said he has 2,000 pages ofjournals his daughter-in-law allegedly kept before she went missing. Her husband, Joshua Powell, told police hehad been camping with their two children, ages 2 and 4, and had last seen his wife aroundmidnight.Suspicious of Joshua Powell's story, investigators named him a "person of interest" in his wife'sdisappearance. Several search warrants were served, including one to draw biological samplesfrom him. Police also impounded the family van.No one has been charged in Powells disappearance, and police say the case remains an activeinvestigation. The renewed interest into Susan CoxPowell's disappearance comes as both families have publicly traded accusations over her fate.Chuck Cox, Susan's father, and Steve Powell, Josh's father, argued loudly in front of reportersand television cameras in Puyallup, Wash., on Saturday. Cox said that the information already released by the Powells comes from when his daughterwas a teenager.In one passage, the television station reports, Josh Powell claims that Susan had written shehad "taken 10 Ibuprofen" but then later stated she "wasn't trying to kill herself."Steve Powell, according to the TV station, said this information shows "that Susan led a double-life from the time she was 13,14, or possibly even 12."Cox said he believes Susan was about 13 at the time of the incident, which his family recallsinvolving about six pills of the over-the-counter headache medication. Cox said his daughterwas taken to an emergency room as a precaution, but was released. A health policy in place atthe time required a social worker visit after such an incident, he said."They concluded that she was not suicidal," he said. "In Steve's mind, that proves that shewas."In the journal entry about the incident, Susan wrote that she was repeatedly being asked if shehad been trying to commit suicide. "No!!!" the journal entry states.The AP could not independently verify the validity of the documents and Chuck Cox didn'timmediately return an email Monday evening.West Valley City police Sgt.
